This is a Request for Quote (RFQ) for commercial services prepared in accordance with FAR 12 and utilizing the procedures of FAR 13. Quotes are being requested for law enforcement vehicle upfitting services. This solicitation incorporates provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2024-04. Solicitation number 140L5724Q0081 is issued as a request for quotation (RFQ). Firm fixed-price offers are requested. This RFQ is unrestricted under the North American Industry Classification (NAICS) Code 811111- General Automotive Repair with a size standard size of $9M.
Successful vendor must be registered with System for Award Management (SAM) found at https://www.sam.gov/portal/public/SAM/ to be considered eligible for award. The System for Award Management (SAM) is the Official U.S. Government system that consolidated the capabilities of CCR/FedReg, ORCA, EPLS, and more. There is NO fee to register for this site.

Submission Instructions & Notices
1. Quoters shall submit signed and dated SF1449 with submitted quotes.
2. The quote shall contain:
a. A detailed breakout of all equipment/materials and associated costs.
b. A detailed breakout of all labor and associated labor rates for installation.
3. Vendors must be located in the State of Utah and within a 50-mile radius of the West Desert District Office 491 North John Glenn Road, Salt City, UT.
4. This Solicitation will result in a Firm Fixed Priced award. Award is anticipated on or around September 09, 2024. Award will include appropriate wage determinations based on awardee’s place of business.
Evaluation and Award Basis
The following factors shall be used to evaluate quotes:
1) Technical Specification: Products meet the specifications of the Statement of Work.
2) Price
Award will be made to the vendor whose quotation conforms to the specifications and is considered to represent the best value to the Government based on the Lowest Price Technically Acceptable methodology.

1.0 Background
This statement of work (SOW) will outline the contract requirements for the purchase and installation of specialized law enforcement equipment to be installed in two (2) 2024 Chevy Special Services Package Tahoe vehicles. The vehicle will become the primary law enforcement patrol vehicle used by Salt Lake Field Office Law Enforcement Ranger.
Due to the rough terrain the trucks are operated in, special attention should be placed on tightening items to the specified torque values and/or using Loctite, Nyloc nuts, or lock washers where appropriate to prevent loosening of equipment.
The SOW requirements are based on the following policy documents:
a. 446 DM Chapter 12
b. BLM Handbook 9260 Chapters 17 and 18
c. BLM Handbook 9260-1 Chapter XII
2.0 Scope
The scope of this requirement includes the outfitting of two (2) new 2024 Chevy Special Services Package Tahoe vehicles labeled Vehicle 1 and Vehicle 2. The Government will drop off and pick up the vehicle from the Contractor’s place of business, which shall be within a 50-mile radius of West Desert District Office 491 North John Glenn Road, Salt City, UT. The vehicle shall be upfitted with the new and supplied equipment, properly installed and in accordance with the SOW.
3.0 Work Requirements
The work requirements of this SOW are listed below in 3.1 Furnish & Installation. Unforeseen deviations after the beginning of the contract must be directed to the Government immediately. Any equipment and/or labor changes to this SOW MUST be approved by the Government prior to initiating any work.
3.1 Purchase and Installation:
The following items shall be removed or purchased as indicated and installed by the contract recipient prior to the delivery of the vehicle. Installation should follow industry standards.
The attached table describes the items that shall be provided and installed by the contractor and equipment furnished by the Government that is required to be installed.
3.2 The Government furnished equipment is currently installed in existing law enforcement vehicles and is operational (one vehicle is a Chevy Tahoe, the other is a Ford F150 Crew Cab). The vendor is required to remove the equipment and install in the new 2024 Chevy Tahoe’s. The existing vehicles will be delivered to the vendor one at a time and allowed a maximum of 14 calendar days for each vehicle.
3.3 Following delivery of new vehicles, the vendor shall remove all aftermarket equipment, exterior vehicle striping and agency identification from the two existing law enforcement vehicles. The two vehicles must be restored back to factory operation and functionality, before returning the vehicles to the Government.
4.0 Place of Performance
The Government will drop off the vehicle at the Contractor’s place of business located at <to be completed at time of award>. All work must be conducted on-site at the Contractor’s place of business.
Deviation from the installation location (e.g. a third-party shop), must be cleared by the Government prior to any movement of the vehicles. Under no circumstances shall the vehicles be moved from the vendor installation address to an alternate place of business without the Government’s express written approval.
5.0 Delivery - Origin
Installation shall be completed on or before December 3, 2024, upon completion, the Contractor shall notify the Government so the Government can plan to pick up the vehicle. The Government will conduct inspection and acceptance at the Contractor’s place of business in accordance with Section 6.0, paragraph
(a) below. If accepted, the finished vehicles will be retrieved (i.e. driven away by BLM) and Risk of Loss will pass to the Government in accordance with Section 6.0, paragraph (j) below and as modified herein.
Shipment of the vehicles to a Government location is not required.
6.0 Inspection/Acceptance
Pursuant to FAR 52.212-4 Contract Terms and Conditions—Commercial Products and Commercial Services (Nov 2023):
(a) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government will exercise its post-acceptance rights-
(1) Within a reasonable time after the defect was discovered or should have been discovered;
and
(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.
(j) Risk of loss. Unless the contract specifically provides otherwise, risk of loss or damage to the supplies provided under this contract shall remain with the Contractor until and shall pass to the Government upon delivery of vehicles to the Government.
(1) Delivery of the supplies to a carrier, if transportation is f.o.b. origin; or
(2) Delivery of the supplies to the Government at the destination specified in the contract, if transportation is f.o.b. destination.

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

(d) Comptroller General Examination of Record. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS-COMMERCIAL PRODUCTS AND
COMMERCIAL SERVICES (MAY 2024)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
(a) Definitions. As used in this provision—
Covered telecommunications equipment or services has the meaning provided in the clause 52.204- 25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
Economically disadvantaged women-owned small business (EDWOSB) concern means a small http://www.acquisition.gov/far http://www.acquisition.gov/diar https://www.sam.gov/ https://www.acquisition.gov/far/part-52#FAR_52_204_25 business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR
127.300. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
Forced or indentured child labor means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
Immediate owner means an entity, other than the offeror, that has direct control of the offeror.
Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
Inverted domestic corporation, means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except—
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.
Reasonable inquiry has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174).
Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
