INFORMATION TO PROSPECTIVE QUOTERS
This is a combined Synopsis/Solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Firm, fixed-price quotes are requested under Request for Quotation (RFQ) Solicitation number 140L5221Q0005. This document incorporates provisions and clauses which are in effect through Federal Acquisition Regulations 2021-05. This solicitation is set-aside for small business under North American Industry Classification System (NAICS) code 238220. The Small Business Annual Receipts for the preceding three (3) fiscal years does not exceed $16.5 Million.
Site Visit: No Site Visit will be held
Due Date: Wednesday, April 07, 2021 at 1:00PM Mountain Daylight Time. Quotes will be accepted via Email at nbertels@blm.gov . Offerors must be registered and active in the System for Award Management (SAM) database found at https://www.sam.gov.

DESCRIPTION/SPECIFICATIONS/WORK STATEMENT
Summary of Work:
Contractor shall furnish all necessary labor, equipment, supplies, and materials, to complete the annual inspections for 13 backflow preventer tests, 5 five-year fire sprinkler inspections, 4 annual fire sprinkler and backflow inspection with anti-freeze loop,1 annual fire sprinkler and backflow inspection, and the replacement of the anti-freeze solution for one system.
Site Locations:
Work will be completed on the following locations;
Shoshone Field Office: 400 W F Street, Shoshone, ID 83352-5284 Burley Fire Office: 3630 Overland Road, Burley, ID 83318 Burley Gun Club Well House: 800 W Milner Rd, Burley, ID 83318 Twin Falls Airbase: 492 Airport Loop, Twin Falls, ID 83301 Carey Guard Station: 20550 N Main Street, Carey, ID 83320 Kimama Guard Station: 1500 N 600 W., Paul, ID 83347 Rogerson Guard Station: 2295 E 1500 N, Rogerson, ID 83302 Lud Drexler Well House: 98 Salmon Dam Rd., Rogerson, ID 83302
A drawing with the location of each site will be included (See attachment labeled Work Locations).
Requirements:
Contractor provided Technicians shall be certified to test back flow prevention devices in the state of Idaho. Contractor shall be licensed in state of Idaho to test and inspect fire sprinkler systems as per the NFPA 25. Anti-freeze solution shall be UL Listed for fire service.
Estimated Period of Performance: 05/03/2021 to 06/03/2021
Performance Time:
Work must be completed within 15 calendar days. Contractor will be required to start work within three days after being notified by the Contracting Officer Representative.
Contractor Furnished Materials:
All personnel, labor, tools, and other equipment needed to complete the work as specified. Contractor shall furnish an estimated 90 gallons of antifreeze that is UL Listed for fire service.
Government Furnished Materials: None
Site Access:
All locations are secured government facilities. Contractor shall coordinate with the COR/PI for access to all sites.

• Backflow preventer testing will take place at the following locations: Shoshone Field Office (4 backflow preventers), Carey Guard Station (1 backflow preventer), Twin Falls Airbase (2 backflow preventers), Rogerson Guard Station (1 backflow preventer), Kimama Guard Station (2 backflow preventers), Burley Fire Office (1 backflow preventer), Burley Gun Club Well House (1 backflow preventer), and Lud Drexler Well House (1 backflow preventer).

• The annual fire sprinkler system inspection with anti-freeze Loop will take place at the following locations: Carey Guard Station, Twin Falls Airbase, Burley Fire Office, and Rogerson Guard Station
• Contractor must be licensed in the state of Idaho to test and inspect fire sprinkler systems as per the NFPA 25.
• Contractor must be certified in the state of Idaho to test backflows.
• Contractor will send inspection report with findings and cost to the Contracting Officer
Representative within one week of inspection.
• Contractor will tag devices and fill required forms per inspection.

• Replacing 90 gallons of anti-freeze solution will take place at the following location:
Twin Falls Airbase.
• Anti-freeze shall be replaced with a UL Rated for fire service anti-freeze or approved equal by Contracting Officer Representative.
• Contractor must be licensed in the state of Idaho to test and inspect fire sprinkler systems as per the NFPA 25.
Item 0001E – 5 Year- Internal Inspection of Fire Sprinkler Systems Total Estimated Units: 5
• 5-year internal inspections of fire sprinkler systems will take place at the following locations: Burley Fire Office, Twin Falls Airbase, Carey Guard Station, Kimama Guard Station, and Rogerson Guard Station.
• Inspection of the fire sprinkler system must include checking for stoppage, corrosion, or foreign material, known as a 5-year inspection.
• Contractor must be licensed in the state of Idaho to test and inspect fire sprinkler systems as per the NFPA 25.
• Contractor will send inspection report with finds and cost to the Contracting Officer Representative within one week of inspection.
• Contractor will tag devices and fill required forms per inspection.

(d) Comptroller General Examination of Record. 3. 52.204-25 Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment (Aug 2020)
(a) Definitions. As used in this clause— Backhaul means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet). Covered foreign country means The People’s Republic of China. Covered telecommunications equipment or services means–
(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);

(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);
(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or (4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.
Critical technology means–
(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;
(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled-
(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or
(ii) For reasons relating to regional stability or surreptitious listening;
(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);
(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);
(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or
(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).
Interconnection arrangements means arrangements governing the physical connection of two or more networks to allow the use of another's network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources.
Reasonable inquiry means an inquiry designed to uncover any information in the entity's possession about the identity of the producer or provider of covered telecommunications equipment or services used by the entity that excludes the need to include an internal or third-party audit.
Roaming means cellular communications services (e.g., voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high.
Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.
(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.
The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub.
L.115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract, or extending or renewing a contract, with an entity that uses any equipment, system, or service that uses covered

This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.
(c) Exceptions. This clause does not prohibit contractors from providing—
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(d) Reporting requirement. (1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.
(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause
(i) Within one business day from the date of such identification or notification: the contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.
(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause: any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services, and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.
(e) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (e) and excluding paragraph (b)(2), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial items.
4. 52.252-6 Authorized Deviations in Clauses (Nov 2020)
(a) The use in this solicitation or contract of any Federal Acquisition Regulation (48 CFR Chapter 1) clause with an authorized deviation is indicated by the addition of "(DEVIATION)" after the date of the clause.

CONTRACT ADMINISTRATION DATA
1. Authorities and Delegations (Sep 2011)
(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award.
The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor.
Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum.
The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

Payment requests must be submitted electronically through the U.S. Department of the Treasury's Internet Payment Platform System (IPP).

SPECIAL CONTRACT REQUIREMENTS
1. 52.211-10 Commencement, Prosecution, and Completion of Work (Apr 1984)
The Contractor shall be required to (a) commence work under this contract within 3 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 06/03/2021. *The time stated for completion shall include final cleanup of the premises.
2. Simultaneous Performance
If a Contractor receives award of more than one contract, simultaneous performance will be required. All work must be completed within the timeframe allowed for each contract.
3. BLM - Variation in Quantity (Services) (Deviation)

The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 120 percent or below 80 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgment of the Contracting Officer, is justified.
4. Work Hours
The performance period established for this contract is based upon all work being conducted during regular working hours between 7:30am and 5:30pm, Monday through Friday, excluding government holidays. If the Contractor desires to carry on work outside regular hours, including Saturdays, Sundays, and government holidays, a request must be submitted to the Contracting Officer in sufficient time to allow satisfactory arrangements to be made by the Government for access to the work site and inspection.
In addition to any holidays declared by Executive Orders, the following Federal Legal Holidays are observed:
New Year’s Day Martin Luther King Jr. Day President’s Day Memorial Day Independence Day Labor Day Columbus Day Veterans Day Thanksgiving Day Christmas Day
5. Communications
“Time” for communications received after 3:00 pm, after 12:00 pm locally on Fridays, or after 12:00 pm locally prior to a holiday will not start until the next business day. All times are local Mountain time.

6. Health and Safety
The nature of the work to be performed under this contract may involve inherently hazardous situations. Further requirements are specified in the Statement of Work.
7. Publicity
(a) The Contractor agrees that there shall be no release of any information to the news media regarding the removal or remedial activities being conducted under this contract.
(b) All information shall be released to the news media by BLM or other Federal Agencies utilizing this contract.
8. Subcontracts
If the Contractor desires to subcontract any work under the contract and subject to the limitations of “FAR 52.219-14 Limitations on Subcontracting”, it shall obtain the Bureau of Land Management Contracting Officer's written consent.
The request to subcontract shall contain the following information:
1. Name of Sub-Contractor
2. Description and amount of supplies or services to be subcontracted. The Contractor shall insert in any subcontracts all applicable clauses contained in the contract.
9. Responsibility for Government Property
The Contractor assumes full responsibility for and shall compensate the Government for any and all loss or damages of whatsoever kind and nature to any and all Government property, including any equipment, supplies accessories or part furnished, while in his custody and care for storage, repairs or service to be performed under the terms of this contract, resulting in whole or in part from the negligent act or omissions of Contractor, any sub- Contractor or any employee agent or representative of Contractor or sub-Contractor.
10. Restoration of Resources
1. CLEANUP - The Contractor is responsible for cleaning up all camp and worksites before leaving the area. Final payment may be withheld until the Contractor has complied with this requirement.
2. ACCESS ROADS - Public or private access roads damaged by the Contractor shall be restored, at his expense, to the same condition they were in at the commencement of work.
11. Environmental Impact
All waste materials generated by any work under the contract performed on a Government installation shall at all times be handled, transported, stored, and disposed of by the contractor and by his subcontractors in accordance with all applicable Federal, state, and local laws, ordinances, regulations, court orders, and other types of rulings having the effect of the law, including, but not limited to…
