SECTION C – STATEMENT OF WORK

I. Marbled Murrelet Surveys

1.0 GENERAL

1.1 Description of Work, Objectives, and Methods - A pre-work meeting will occur as agreed with the Contracting Officer's Representative (COR) to review expectations, communications, deliverables, safety, site access, inspections and schedules

1.1.1 The Contractor shall conduct surveys to locate Marbled Murrelet (Brachyramphus marmoratus) from survey stations (either resetting established stations or setting up new stations) and conduct intensive surveys to locate Marbled Murrelet in survey areas on Bureau of Land Management (BLM) in western Oregon to include the Coos Bay, Medford, Northwest Oregon, and Roseburg Districts. The objective is to document the occurrence or probable absence of Marbled Murrelet in forest stands by conducting intensive surveys in accordance with the current Pacific Seabird Group (PSG) Protocol “Methods for surveying Marbled Murrelet in forests: A revised protocol for land management and research”, 7 January 2003, available at http://www.pacificseabirdgroup.org/publications/PSG_TechPub2_MAMU_ISP.pdf (hereafter PSG protocol). The BLM’s occupied site delineation direction differs from the PSG direction and may require continued surveys in portions of a survey site after an occupying detection. The COR may request additional surveys to clarify earlier detections.

1.1.2 All station set-up, survey visits, and employee training/testing shall be done in strict accordance with the PSG protocol. All personnel to include crew leaders and Marbled Murrelet surveyors shall provide written proof that they meet the training and qualifications required in the PSG protocol in order to perform work under this contract. Certificates of training completion/pass will be provided to COR.

1.1.3 The Universal Transverse Mercator (UTM) coordinates for each survey station will be determined using Global Positioning System (GPS) and the NAD83 datum. Per the PSG protocol, data, observed behaviors, and nesting activities shall be collected, recorded, and reported on all audio and visual Marbled Murrelet detections.

1.1.4 All survey visits will be conducted between May 1 and August 5, per the PSG protocol. The COR may approve an extension of the survey season at sites where murrelet presence has been documented. Hours outside normal office hours shall be required, including hours before sunrise. Conditions (i.e., Marbled Murrelet presence or poor environmental conditions, as described in the definitions), defined in the PSG protocol, may trigger the need for additional surveys beyond the number anticipated at the initiation of the survey season. Additional surveys (equivalent to approximately 10% above the minimum surveys anticipated at the initiation of the survey season) will be included in the task orders to accommodate for potential additional required surveys, such as from adverse environmental conditions or increased survey load after a Marbled Murrelet detection. Station set-up can occur when the TO period of performance starts and is not confined to the survey season. However, station set-up will not occur until after the pre-season meeting between COR and contractor.

1.1.5 Station set up will entail locating new stations in a survey area, or re-visiting stations established during previous surveys. Stations shall meet the standards in the approved protocol, independently and throughout the entire survey area. Each station shall be set, or re-set, once annually.

http://www.pacificseabirdgroup.org/publications/PSG_TechPub2_MAMU_ISP.pdf

COOS BAY, LAKEVIEW, MEDFORD, NORTHWEST OREGON & ROSEBURG DISTRCITS Page 12 of 135

1.1.6 Data on station set-up, survey visits, and original field data and original forms (may be electronic) shall be collected and submitted once a week or as agreed with the COR at the pre-work meeting. A summary report shall be submitted annually.

If requested, all data shall be entered into the BLM’s Marbled Murrelet database, an Access based database, unless an alternate database system is approved by the COR.

1.1.7 Marbled Murrelet detections shall be submitted the same day via email or phone including a map showing the detection(s) as per the PSG protocol. Data forms with detections must be submitted within 48 hours.

1.1.8 For work completed within the Sudden Oak Death (SOD) quarantine area, the Contractor shall supply fresh water, bleach and spray bottles containing a 10% bleach solution with water for treatment of boot soles and equipment throughout the course of the contract. A fresh bleach solution shall be prepared daily. The solution shall be applied to boots and equipment each time the contractor leaves a unit and returns to the road. The vehicle must be washed, including the underside, whenever it leaves the quarantine area.

1.1.9 For surveys where Port Orford Cedar (POC) is present or could be present, the Contractor must wash their vehicle including the underside, whenever it leaves infested Phytophthora lateralis (PL) areas prior to entering uninfested POC watersheds. This would only be required during the wet season (generally prior to June 15). The infested and uninfested POC watersheds will be identified during prework.

1.1.10 Selected BLM Special Status Species on the list furnished by the BLM and observed during the course of this work (trail and station set-up and surveys) will be recorded and submitted (in the provided form) once a week. Exception: any northern spotted owl detections shall be reported on the same day they occurred.

The COR will review this requirement with the contractor in the pre-work conference.

1.2 General Location and Description of Survey Areas

1.2.1 A map of survey areas will be furnished with each task order. Final maps will be provided at the pre-work meeting. Station general area is accessible by vehicle and most require access on foot to reach final station locations. Much of the terrain is steep, covered with dense vegetation, and may be difficult to walk through.

1.2.2 Survey area boundaries will not be physically identified on the ground. Most boundaries will require interpretation of physical features on aerial photos and topographic maps and/or the use of a GPS device.

1.2.3 The COR may substitute survey stations as planning objectives change and will notify the contractor of any changes within 14 days, or as agreed with the contractor. Any changes that are outside of the original objectives of the task order will be incorporated into the task order by use of a modification. Only the Contracting Officer can modify the task order.

1.3 Access – Survey areas are generally accessible by roads passable with a 4-wheel drive vehicle (2-wheel drive in some cases). Survey sites and stations typically require access by foot, cross-country hiking.

Survey areas are, on average, 1 to 2.5 hours from Coos Bay (Coos Bay District). Survey areas are, on average, 1 hour from Roseburg, OR (Roseburg District) and Grants Pass, OR (Medford District). Survey areas are, on average, 1.5 hours from each of the following towns within field offices for the Northwest Oregon District: Tillamook (Tillamook Field Office), Salem (Mary’s Peak Field Office), Eugene- Springfield (Siuslaw Field Office).

1.3.1 The BLM does not guarantee nearby road access to all survey areas. Roads closed due to natural occurrences may not be reopened or maintained solely for the purposes of providing access for the Contractor. Some roads may be accessible only by foot due to vegetation or road closure. Average walking

COOS BAY, LAKEVIEW, MEDFORD, NORTHWEST OREGON & ROSEBURG DISTRCITS Page 13 of 135 time from nearest road to the survey station is approximately 15-30 minutes. Average slope is 30-50 percent although a few areas may be 60 -70 percent. Walk-ins that would trigger a surcharge (i.e., over 0.5 mile) must be pre-approved by the COR.

1.3.2 Private Lands – Due to mixed land ownership, travel through private lands is typically needed to access BLM lands. As a result, access may be restricted through private lands and may include locked and unlocked gates, access agreements, and notification requirements. Private landowners may require any or all of the following: notification prior to crossing their lands, a gate key deposit, and/or an access agreement. It is the responsibility of the Contractor to gain and maintain access through private lands by following the terms of agreement, by following all public laws, and by maintaining a good working relationship with landowners.

1.3.3 Gates - Some areas and roads may be behind locked gates. Locked gates shall remain locked at all times other than when the Contractor is passing through them. Access is granted only to complete tasks within the scope of the task order. BLM keys, for access to gates locked with a BLM lock, will be signed out by the Contractor. All keys shall be returned to the COR in a usable condition before final payment is made.

The Contractor will be charged actual costs for replacement of lost keys or keys returned in unusable condition.

1.3.4 It is the responsibility of the Contractor to determine local conditions affecting access to each area. Snow and adverse weather can affect access. The access should be verified before the survey takes place to ensure access, timing of surveys, and remaining on schedule.

1.3.5 Traveling on forest roads requires an awareness of potential hazards that may change during the survey season. It is the responsibility of the Contractor to determine local conditions affecting access to each survey site. Adverse weather, logging operations, and hauling traffic are likely to affect access during the course of the survey season.

1.3.5 Station set-up, re-sets, or surveys may be done any day of the week following methods outlined in the latest version of the PSG protocol (http://www.pacificseabirdgroup.org/publications/PSG_TechPub2_MAMU_ISP.pdf).

2.0 DEFINITIONS

The definitions contained in the PSG Protocol dated 6 January 2003 at:

http://www.pacificseabirdgroup.org/publications/PSG_TechPub2_MAMU_ISP.pdf are incorporated by reference herein, and shall apply to the terms in this contract, whether such terms are capitalized or not. Certain terms from the PSG protocol are further defined below. If there is any conflict between a defined term in the PSG protocol and the definitions section below, the defined term in the definitions section below shall have precedence.

2.1. Additional Surveys - An additional survey visit required because of a non-protocol survey (definition below), to determine occupancy in a stand, or as needed to clarify site status.

2.2. Audio-visual Survey –The process of determining Marbled Murrelet presence, probable absence, or occupancy of a site by visiting it on the ground and observing for murrelets.

2.3. Bureau Sensitive Species – Agency designated sensitive and special status species which, if heard or observed, will be recorded on Wildlife Observation Forms.

Examples are heavy fog, moderate to heavy rain, moderate to high winds, nearby logging equipment activity, loud https://www.esrl.noaa.gov/gmd/grad/solcalc/

COOS BAY, LAKEVIEW, MEDFORD, NORTHWEST OREGON & ROSEBURG DISTRCITS Page 15 of 135 creek noise or vehicles. An accumulation (continuous or discontinuous) of twelve minutes or more of poor environmental conditions creates a non-protocol survey and the station will require an additional survey. Additional descriptions of poor environmental conditions can be found in the PSG survey protocol.

2.18. Potential Habitat - Is defined as 1) mature (with or without an old growth component) or an old-growth coniferous forest; or 2) younger coniferous forest that have trees with platforms; or 3) small patches of residual trees with one or more platforms.

2.19. Presence – An area of potential habitat where there has been a minimum of one visual or auditory Marbled Murrelet detection that does not include occupying behavior (definition above). In addition, for the purpose of this contract, presence shall include visual or auditory detection over areas considered non-habitat (e.g., roads, young forest stands, etc.)

2.20. Protocol Site - A survey site that meets the number of survey visits, time of year, distribution of visits, and time of day constraints as outlined in the PSG protocol. This consists of a minimum of 5 protocol surveys (definition below) for the season, and 9 protocol surveys if Marbled Murrelet presence occurs. A protocol site may require fewer than 5 visits if occupancy is determined sooner.

2.21. Protocol Survey - A survey that meets the daily time and environmental constraints per the PSG protocol and was conducted with fewer than 12 minutes (cumulative) of poor environmental conditions.

2.22. PSG - Pacific Seabird Group (http://www.pacificseabirdgroup.org).

2.23. PSG Protocol - “Methods of Surveying for Marbled Murrelet in Forests: A Revised Protocol for Land Management and Research” as published by the Pacific Seabird Group, 6 January 2003. Located on the internet at: http://www.pacificseabirdgroup.org/publications/PSG_TechPub2_MAMU_ISP.pdf

2.24. Special Status Species - Agency special status species (Threatened and Endangered, Bureau Sensitive, and other species of concern (e.g., Golden Eagle, Northern Goshawk, Great Gray Owl) as provided by the agency which, if heard or observed, will be recorded on Wildlife Observation Forms.

2.25. Suitable Habitat – See Potential Habitat

2.26. Survey or Survey visit - A single visit to a station for the purposes of determining Marbled Murrelet occupancy, presence, or absence within the stand that meets the requirements of the PSG protocol.

2.27. Survey Area - The entire area that is under observation - a group of trees that forms contiguous potential habitat with no gaps wider than 100 meters (330 feet). Large survey areas (greater than 150 acres [60 hectares]) are broken down into smaller Survey Sites.

2.28. Survey Season – May 1 through August 5, unless extended by the COR for monitoring sites or sites with late season detections.

2.29. Survey Site – The unit by which survey visits are designed and carried out, and the unit to which the requisite number of visits (5 minimum unless occupancy is established sooner) applies.

2.30. Survey Station - The location where the observer stands when conducting a survey visit. Stations ideally include a gap in the canopy and have a view of potential nesting platforms. Stations should target gaps in http://www.pacificseabirdgroup.org/publications/PSG_TechPub2_MAMU_ISP.pdf

COOS BAY, LAKEVIEW, MEDFORD, NORTHWEST OREGON & ROSEBURG DISTRCITS Page 16 of 135 the canopy and sightlines of suitable nesting habitat. In optimal conditions, a single survey station covers 15 acres (6 hectares) of habitat but is typically far less. Descriptions for station set-up and layout are included in the PSG protocol.

2.31. Walk-in - The BLM does not guarantee vehicle accessible roads to all survey stations. Surveyors may be required to access calling stations by walking on closed or decommissioned roads and cross country.

Walk-ins will include hiking on natural terrain, which may include maneuvering through tripping hazards, harmful plants and rough landscape. Examples: loose rocks, down wood, thorned bushes, poison oak, steep slopes, etc. The line item for walk-ins provides a method of compensation for survey stations that require walk-ins over 0.5 mile for marbled murrelets.

For marbled murrelets, a walk-in begins at 0.5 mile. The walk-in fee may apply for each 0.5 mile after the first 0.5 mile. Each separate walk-in over 0.5 mile will be paid a separate walk-in charge. Walk-ins are calculated as one-way distance (e.g. a station 1-mile from the vehicle would be calculated as a 0.5-mile walk-in distance). Walk-ins will be assigned by the BLM at beginning of the survey season. Stations temporarily blocked by other extenuating circumstances will not be paid for walk-in surcharges unless agreed upon by the COR while areas are being cleared (tree blocking access, rocks, etc.). Walk-in charges need to be agreed upon by government before walk-in occurs.

5.0 SPECIFIC TASKS

5.1 Work Sequence

5.1.1 The Contractor shall get approval for the sequence of work from the COR prior to the beginning of work, at the pre-work meeting and then throughout the season. Certain survey areas or portions of survey areas may be designated by the COR as higher priority. However all work will be required to be completed to protocol.

5.1.2 A minimum of 25 percent of survey stations, by survey area, shall be set-up and approved by the COR by May 1 (if a task order is in place for this work.) The rest of the stations must be submitted at least 2 weeks prior to scheduled survey, allowing time for the COR to approve (with changes as the COR may require) prior to survey date.

5.1.4 During the survey season, the Contractor shall notify the COR of all visual or auditory Marbled Murrelet detections on the day which they occurred, through email, or a phone call if email is unavailable.

COOS BAY, LAKEVIEW, MEDFORD, NORTHWEST OREGON & ROSEBURG DISTRCITS Page 20 of 135

5.1.5 The Contractor may elect to substitute survey stations as planning objectives change. However, the Contractor shall get approval from the COR prior to making any substitutions at least 24 hours in advance.

5.2 Survey Schedule - The proposed survey schedule shall be approved by the COR (see 5.2 B- Survey Schedule) and the Contractor shall perform the following:

A. Before the start of the survey season, the contractor shall provide the COR with a survey schedule for all survey sites for at least the first two weeks of the survey season. The survey schedule shall comply with the PSG protocol for daily timing and spacing requirements.

B. On a weekly basis, the Contractor shall provide the daily log, completed digital data forms (including forms from non-protocol surveys), digital recordings of field sessions in a format approved by the COR, and the GPS data collected by the surveyors (i.e., station set-up and survey visit data).

The Contractor shall provide electronic copies of all data forms for surveys completed the previous week on a day agreed upon with the COR weekly. Data shall be submitted in a format provided by the COR at the pre-work meeting.

C. On a day of the week pre-determined at the pre-work meeting prior to each week’s survey work, Contractor shall give the COR a schedule of the Marbled Murrelet surveys planned for the upcoming week and a summary of what was actually surveyed in the past week. Changes to the survey schedule shall be reported to the COR a minimum of 24 hours before the change is to occur.

D. Station Information Forms and a map of the station with its trail shall be emailed, uploaded to the file transfer system, or personally delivered to the BLM at least one week prior to that station being surveyed (e.g., form for stations to be surveyed on a Monday shall be delivered to the BLM by close of business the prior Monday). This will allow BLM personnel adequate time to inspect the station and provide the Contractor adequate time to move the station if the station did not pass inspection.

E. If new survey stations are necessary, then Station Information Forms will be completed (see Section C.5.6) and a map of the station with its trail shall be e- mailed to BLM at least 7 days prior to that station being surveyed (e.g., form for stations to be surveyed on a Monday will be received by close of business the prior Monday). This will allow BLM personnel adequate time to inspect the station and contract personnel adequate time to move the station should the station not pass inspection.

5.3 Survey Protocol

A. Survey sites and stations shall be set-up and surveyed for Marbled Murrelet in strict compliance with techniques detailed in the PSG Protocol. The Government may choose to set up and reset some or all the survey stations used during the survey season.

B. Each Survey Site shall be surveyed according to the PSG protocol, which requires a minimum of 5 surveys per year. If Marbled Murrelet are detected at a site, surveys will increase to 9 for the survey season. In the case of an occupying detection, the COR will notify the Contractor about sites or portions of sites that no longer require surveys. The COR may request additional surveys to clarify earlier detections.

5.4 Station Set-Up and Station Reset

COOS BAY, LAKEVIEW, MEDFORD, NORTHWEST OREGON & ROSEBURG DISTRCITS Page 21 of 135

A. Prior to initiating surveys at a survey site, some or all of the survey stations may need to be set-up as new stations or be reset (previously used survey stations). Any newly established stations will utilize station numbering system provided by the COR to prevent duplicate station numbers.

B. The entire survey area shall be "covered" as defined in the current protocol. Survey station placement should optimize the survey quality of the survey site by providing adequate coverage of the site and utilizing available gaps and sight lines of suitable habitat. Government provided maps will include previous survey station locations (if any) that shall be checked in the field by the contractor to ensure topography or vegetation does not interfere with full visual and audio coverage of all potential habitats. Maps provided may include tentative survey station locations and shall be checked in the field, by the Contractor, to assess habitat quality and ensure topography or vegetation that do not interfere with full visual and audio coverage of all potential habitats. The highest quality habitat within each site shall have the highest priority for station set-

up. Detailed descriptions of station placement are included in the PSG protocol. COR will approve final station set-up to ensure the site is covered adequately and may require a station be moved to achieve quality site coverage. Depending on road density, stations will often need to be placed some distance from roads to provide adequate habitat coverage.

C. To help in observing occupied behaviors, any newly established stations shall be set within the stand unless otherwise approved by the COR. Stations shall be in drainages, rather than on ridge-tops whenever possible. This may require surveying stations during dry periods to reduce the interference from stream noise. Stations shall contribute to the complete coverage of a survey site and will be spaced accordingly.

D. The Contractor shall be required to set-up these stations in areas with good visibility of the sky (i.e., canopy openings) (preferably < 50% canopy cover), available nesting platforms (when possible), and away from high noise sources, as outlined in the PSG Protocol.

E. Trails shall be cleared with a machete (or an appropriate hand tool) and well flagged by the contractor using a color approved by the COR to ensure that project inspectors and surveyors can safely and easily find stations in the dark. This may require 3 to 4 feet of flagging placed at intervals as little as 5 feet apart, especially in areas of heavy brush. Flagging shall be placed on live trees or branches above the reach of browsing animals (deer, elk, and cows) whenever available. Two to three inches of silver or white reflective tape shall be placed in addition to the flagging to facilitate nocturnal travel. Reflective tape is not required on every flagged tree, but at an interval that allows the surveyor to see the next taped flag from the current location. This is generally every 3 to 4 flags, more often with the trail turns and in dense vegetation. Some trails and stations may be pre-flagged by the Government or by a previous contractor and those trails and stations shall be taken over by the Contractor under this contract.

Trails to all stations shall be well flagged with flagging in a color/pattern identified by the District, hung in combination with reflective tape (reflective tape may be attached to flagging or to adjacent trees).

F. Flagging at Survey Stations

All survey stations shall be flagged as prescribed by the COR at the pre-work meeting.
