Combined Synopsis/Solicitation This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

Solicitation no. 140L4323Q0220 has been issued as a Request For Quotation for a firm fixed price commercial items services contract for Pre-Commercial Thinning/Juniper Cutting/Machine Piling Services, located within the vicinity of the Burns district area of responsibility at one lump sum price.

The scope of work includes “refer to Statement of Work attached.” The performance period is from September 1, 2023, through June 30, 2025. The delivery location and place of acceptance is 28910 U:S-20, Hines, OR. 97738, F.O.B. Destination. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2023-04 effective June 2nd, 2023.

The provision at 52.212-1, Instructions to Offerors - Commercial, applies to this acquisition. The provision at 52.212-2, Evaluation - Commercial Items, applies to this acquisition. The following factors shall be used to evaluate offers: Price and past performance as reviewed in CPARS and are equal in importance when combined, to price. Offerors are advised to submit a completed copy of the provision at 52.212-3, Offeror Representations and Certifications - Commercial Items, with its offer. The clause at 52.212-4, Contract Terms and Conditions

- Commercial Items, applies to this acquisition. The clause at 52.212-5 Contract Terms and Conditions Required to Implement Statutes Or Executive Orders - Commercial Items applies to this acquisition. This requirement is set-aside for SMALL BUSINESS. The NAICS code is 115310 and the small business size standard is $11.5 M. The basis of award is the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award will be made to the responsible respondent pursuant to FAR subpart 9.1. STATEMENT OF WORK

PRECOMMERCIAL THINNING/JUNIPER CUTTING AND MACHINE PILING

1.0 GENERAL

1.1 Description of Work

Project consists of providing more growing space for selected trees and other vegetation by cutting competing trees and machine piling the slash. The units are located generally within ponderosa pine woodland and mountain big sagebrush communities with inclusions of juniper woodlands, mountain mahogany stands, and remnant aspen groves. The cutting is a mix of precommercial thinning and juniper cutting.

Units are in the southeastern portion of the Silvies Valley area just East of Hwy 395. They are approximately 24 air miles north-northeast of Burns, Oregon.

1.3 Boundaries of Project Areas

All Units are marked with orange flagging and orange paint. The paint faces into the project area.

Painted and flagged boundary trees will not be cut/piled under this contract. All units were surveyed using the Global Positioning System and acreages computed on a horizontal basis.

1.4 Access

All Calamity Camp Units can be reached by taking Hwy. 395 North out of Burns, Oregon to the junction of Forest Service Road #2840 (approximately 27.5 miles). All units can be reached either by the 2840 road or spurs off it.

Units 2, 10, 11, 12, and 13 can be accessed by driving east on the 2840 road, from the junction of Hwy. 395, for approximately 3.6 miles. Turn South onto the Camp Creek Road and proceed 0.8 -

2.0 miles to access all units.

Unit 15 can be accessed by driving east on the 2840 road, from the junction of Hwy. 395, for approximately 3.2 miles (unit will be on both sides of road).

Units 16, 18, and 19 can be accessed by driving east on the 2840 road, from the junction of Hwy.

395, for approximately 4.0 miles then turn south onto One Pine Road. Proceed for approximately

0.5 miles and unit 18 will be on your east. For access to Units 16 and 19 turn right on unnamed two-track and proceed approximately 0.25 miles and unit 19 will be on your right and unit 16 will be on your left.

Access to the project areas is by improved seasonal roads, wet/snowy road conditions may hinder or temporarily prevent access.

Additional Bureau of Land Management (BLM) travel maps are available for purchase at the Burns District Office in Hines, Oregon, and are highly recommended for navigation. Also PDF maps that can be downloaded to mapping applications, such as Avenza, may be made available.

Use of All-Terrain Vehicles (ATVs): Use of ATVs will be allowed to access remote portions of project areas if needed. If an ATV is used, it shall be of such design that it will travel over rough, uneven terrain and not create wheel ruts and channels.

1.5 Pre-Work Conference:

At the mandatory prework conference, and as required throughout the contract, the Contractor shall provide a work schedule outlining proposed work accomplishment rates which must be acceptable to the Government.

1.6 Permit

State law requires a permit to operate power driven machinery. Permits must be obtained from the State Forestry Office in Salem or at local offices prior to the operation of power-driven machinery. This requirement applies to chain saws. Permits will be made available at the time of the pre-work meeting.

1.7 Noxious Weeds

In order to prevent the spread of noxious weeds, all equipment and vehicles including ATV/UTVs will be cleaned off prior to entry onto Government land. Removal of all dirt, grease, and plant parts that carry noxious weed seeds or vegetative parts is required and may be accomplished with a pressure hose. In addition, Contractor's equipment shall be cleaned prior to all subsequent moves if operations have been in an area known to have noxious weeds. The COR

BLM BURNS DISTRICT Page 6 of 63 may request to inspect all equipment to be used on the project area prior to being moved into the project area.

2.0 DEFINITIONS

Brush - Vegetation consisting of shrub species with single or multi-stems origination at or near ground level not normally reaching 20 feet in height. Examples include mountain mahogany, chokecherry, and serviceberry.

Competitive trees - All juniper seedlings, saplings, and trees and other live coniferous trees, not selected as leave trees; or stumps with live limbs.

Conifer - An evergreen or cone bearing tree such as ponderosa pine, Douglas-fir, Western larch, grand fir, white fir, and juniper.

Damaged leave tree - A leave tree damaged through felling of other trees or brush or contact with cutting tools.

DBH - Diameter of the tree at breast height, measured at a point 4½ feet above ground level from the uphill side of the tree.

Duff - A layer of needle cast and fine woody material on the forest floor, usually in various depths and stages of decomposition.

Hardwood - A broad-leaved tree which usually has a single well-defined trunk and attains a height of greater than 20 feet. Includes, but not limited to, species such as aspen, cottonwood, and willow. Sprouting hardwood species may be in the form of multi-stemmed clumps.

Leave trees

a. (Trees not cut) All conifer trees except juniper, greater than 12 inches DBH. All hardwood trees.

b. Any tree having survey/monument signs or survey marks on it.

c. Any Tree having boundary paint or flagging on it.

d. All trees along fence lines that have fence wire attached to them.

e. Trees with cultural significance or obvious wildlife occupation, i.e., cavities or raptor nests.

f. NOTE: All leave trees are not marked. It is the Contractor's responsibility to identify them.

Lodged trees - Cut trees leaning into, supported by or covering a leave tree.

Lop - Trim by cutting off branches, twigs or stems.

Old growth juniper - Any juniper trees possessing most of these characteristics: a rounded top, large dead limbs, deeply furrowed bark, deeply dissected trunk, large lower limbs, and yellow lichen on branches.

Shrub - Vegetation consisting of shrub species with single or multi-stems origination at or near ground level not normally reaching 20 feet in height. Examples include, but are not limited to, mountain mahogany, chokecherry, and serviceberry.

Slash - Any downed woody material within the project area. Slash includes cull logs, uprooted stumps, wood chunks, broken tops, limbs, branches, rotten wood, dead or damaged mountain mahogany, damaged brush, damaged or destroyed young trees, felled snags, and surplus trees.

3.0 CONTRACTOR-FURNISHED ITEMS

3.1 Property and Services

The Contractor shall provide all transportation, supervision, labor, tools, materials, and equipment required to satisfactorily complete the contract.

3.2 Crew Requirements

3.2.1 The Contractor must maintain an adequate workforce at all times to ensure timely completion of the work.

3.2.2 No more than three crews will be permitted to work simultaneously unless authorized.

3.2.3 State safety regulations require that crewmembers shall not work alone and access to emergency transportation shall be provided by the Contractor at all times.

3.2.4 The Contractor shall obtain written authorization from the Resource Area Office prior to camping on land administered by the BLM.

3.3 Supervisor Requirements

Persons designated by the Contractor as supervisors must actually perform in that capacity. The supervisor shall ensure the contract work is performed properly. The supervisor must, therefore, effectively direct the crew by (1) making periodic inspections of the crew's work, (2) advising them as to deficient work, and (3) providing instructions for correcting such deficiencies. This person shall be capable of speaking and reading English well enough to ensure good communications with the PI. Any group of people without such an individual will not be considered a crew. Should the supervisor fail to adequately perform these duties, the Government has the right to request substitution.

The Contractor shall designate one English-speaking supervisor for each crew. Any changes in supervisory designations must be submitted in writing to the CO at least 24 hours prior to the changes taking effect.

4.0 GOVERNMENT-FURNISHED PROPERTY

There is no government furnished property.

5.0 SPECIFIC TASKS

5.1 Trees Reserved from Cutting (Leave Trees)

5.1.1 All conifers over 12” DBH with the exception of juniper. All juniper shall be cut unless protected under 5.1.3 or other clauses in this contract.

5.1.2 Live mountain mahogany, serviceberry, bitter cherry, elderberry, aspen, and chokecherry shall not be cut, but some damage and/or removal will be allowed in order to pile cut trees and slash.

5.1.3 All dead and live juniper that are providing cavity-nesting habitat, raptor nest, or showing old growth characteristics (defined in 2.0) shall not be cut.

5.1.4 Leave all trees to which a fence is attached.

5.1.5 Contractor shall protect from injury or damage all bearing trees, corner posts and monuments within or adjacent to the project area(s).

5.1.6 All trees with boundary paint or ribbon for this contract shall not be cut.

5.2 Selection of Cut Trees or Trees to be Cut/Felled

5.2.1 All juniper trees unless protected by other clauses of this contract mentioned above.

5.2.2 All other conifers under 12” shall be cut unless specified by other clauses of the contract.

5.2.3 All cut trees shall be completely severed from the stump(s). No live limbs will be left on the stump of cut trees. Stump height shall not exceed 6 inches measured on the uphill side.

5.2.4 Cut trees lodged in leave trees shall be dislodged or removed.

5.2.5 Trees that have been felled across secondary roads shall be removed from the road the same day.

5.2.6 Cut trees falling across property lines between BLM and adjacent landowners, as shown on the project maps, shall be moved completely into the project area that same day.

5.2.7 All fences shall be kept free of cut trees concurrently with thinning. Any damage to fences resulting from this project shall be repaired by the Contractor, at the Contractor's expense, on the same day that damage occurred.

5.3 General - Machine Gathering/Piling

The following specifications are designed to accomplish the reduction of fire hazard in the designated area by machine piling of the slash created by cutting activities (all units) as well as preexisting slash (Units 2, 16, & 19).

For Item 10: Only the slash created by cutting activities will be piled. All preexisting slash will be left as is, unless it hinders the ability to pile the slash created by cutting.

For Item 20: All slash created by cutting as well as pre-existing slash on the landscape will be piled.

Machine piling shall be done concurrent with cutting. All operator generated slash shall be piled within 30 days of being cut and/or prior to being shut down due to high fire danger.

5.3.1 Definition of Slash

Any downed woody material within the project area. Slash includes uprooted stumps, chunks, broken tops, limbs, branches, rotten wood, dead or damaged mountain mahogany, dead aspen, damaged brush, damaged or destroyed young trees, and felled trees.

5.3.2 Equipment –Machine Gathering/Piling Both Items 10 & 20

Machine gathering/piling shall be accomplished with machinery capable of suspending one end of the load and as needed, yarding slash to a suitable site for piling. It is expected that the type of equipment shall be a Caterpillar E140 excavator or equivalent or smaller.

5.3.3 Location and Construction of Piles

Pile locations will be selected by the Contractor and must be within the unit boundaries.

Distance between machine piles measured from pile edge to pile edge will be at least 50 feet where that is possible.

Piles shall be located so that burning will not cause damage to standing green trees or to physical improvements such as cattleguards or fences. Unless otherwise approved, this will be construed to mean the near edge of piles will be at least 16 feet or not less than twice the height of a pile from the crown of any live tree or physical improvement, whichever is the greater distance.

If conditions make it impractical to locate piles so that damage to the leave trees cannot be completely avoided, a space shall be cleared, and all material placed on the pile in the cleared area. Select a low priority tree to sacrifice where spacing allows no room for a pile. All natural openings shall be used before clearing a pile site.

Machine piles shall contain a minimum of soil. No dirt other than that adhering to bark or in root wads will be acceptable in the pile.

Machine piles shall not be less than 16 feet in diameter nor less than 8 feet in height. Machine piles shall not exceed 22 feet in diameter or 12 feet in height. The piles shall be constructed by laying stems, cut boles, and other slash so as to be parallel with each other as much as is practicable. All other specifications regarding machine piles shall still apply.

All logs shall be placed in piles perpendicular to the slope so they will not roll downhill during burning.

Pine logs or pieces 20 inches or larger at the large end shall be left in place and not piled whenever possible and practicable.

All slash within 20 feet of the edge of the pile shall be piled.

All material placed in the pile shall be contained within the general contour of the pile.

5.3.4 The majority of duff within 4 feet of ponderosa pine trees over 26 inches DBH will be scraped down to mineral soil on all sides and will be spread away from any leave tree to a depth of less than 12 inches. Care shall be taken to not dislodge the bark on the tree nor to dig into the soil and disturb the root system. It is anticipated this work will be conducted with an excavator. If this work cannot be accomplished with an excavator, hand tools shall be used. A dozer or skidder will not be approved for this work.

5.3.5 Damage

Trees knocked over or uprooted shall be cut leaving a stump no higher than 6 inches above the ground and shall be treated as any other slash in the unit.

Piling shall be accomplished with the least possible disturbance to the residual stand, ground cover, and soil. If, the Contractor is causing too much damage, the Contractor shall be required to alter his operation to prevent the occurrence of such damage. The amount of acceptable damage to the resources varies from timber type to soil type and slope.

5.3.6 Damage to Improvements

Equipment shall not be operated on road surfaces, cutbanks or fill slopes. Any damage to fences shall be immediately repaired. Also, damage to waterbars, ditches, and other improvements shall be promptly repaired before leaving the area. These repairs will be at the expense of the Contractor.

5.4 Utilization of Woody Biomass

a. The Contractor may remove and utilize woody biomass if:

(1) Project work is progressing as scheduled; and

(2) Removal is completed before contract expiration.

b. To execute this option, the Contractor must submit a written request to the Government.

There is an estimated quantity of 500 green tons of woody biomass in the project area.

c. Following receipt of the written request, and if appropriate, the Government and the

Contractor will negotiate and execute a separate timber/vegetative sales contract.

Payment under the timber/vegetative sale contract must be at a price equal to or greater than the appraised value of the woody biomass. The Contractor must make any appropriate payment specified in the related timber/vegetative sales contract before removal may be authorized.

d. If required by law, regulation or Bureau policy, the Government will prepare a timber/vegetative sales notice and/or prospectus, including volume estimates, appraised value and any appropriate special provisions.

e. The Contractor must treat any woody biomass not removed in accordance with the specifications in the service contract.

f. The sales contract and service contract are severable; default or termination under either contract does not remove the Contractor from payment or performance obligations under the other contract.

g. Definitions:

Timber/vegetative sales contract and/or notice means the agency-specific authorized contract instrument for the sale, barter, exchange, billing, or other compensation for the payment, removal, and/or transportation of woody biomass material.

Woody biomass means the trees and woody plants, including limbs, tops, needles, leaves, and other woody parts, grown in a forest, woodland, or rangeland environment, that are the by-products of management, restoration and/or hazardous fuel reduction treatment.

6.0 REMEASUREMENT OF UNITS

The Contractor may, at any time during the course of the contract, request remeasurement of any unit he feels that the acreage stated in the contract is incorrect. If remeasurement indicates that a variance of 5 percent or less exists, the Contractor will pay for the actual cost of the remeasurement. Under this condition, payment for the unit will be made on the acreage stated in the contract. If remeasurement indicates the actual variance is greater than 5 percent, payment for the unit will be based on the remeasured acreage. Acreages are measured on the horizontal plane.

7.0 PRESERVATION OF HISTORICAL AND ARCHAEOLOGICAL RESOURCES

If, in connection with operations under this contract, the Contractor, subcontractors, or the employees of any of them, discovers, encounters or becomes aware of any objects or sites of cultural value on the project area, such as historical or prehistorical ruins, graves or grave markers, fossils, or artifacts, the Contractor shall immediately suspend all operations in the vicinity of the cultural value and shall notify the CO in writing of the findings. No objects of cultural resource value may be removed. Operations may resume at the discovery site upon receipt of written instructions. Actions taken under this paragraph shall be subject to the Suspension of Work clause.

8.0 SUBCONTRACTS

If the Contractor desires to subcontract any work under the contract, it shall obtain the CO's written consent. The request to subcontract shall contain the following information:

a. Name of subcontractor

b. Description and amount of supplies or services to be subcontracted. The Contractor shall insert in any subcontracts all applicable clauses contained in the contract.

9.0 RESTORATION OF RESOURCES

Cleanup - The Contractor is responsible for cleaning up all camp and worksites before leaving the area. Final payment may be withheld until the Contractor has complied with this requirement.

Access Roads - Public or private access roads damaged by the Contractor shall be restored, at his expense, to the same condition they were in at the commencement of work.

INSPECTION AND ACCEPTANCE

1.0 INSPECTION

The Government will inspect thinning and piling to determine compliance with performance standards. Inspections may include observations of operations, quality control procedures, and examination of individual cut and leave trees and piles on sample inspection plots. Cutting and piling will be inspected simultaneously. The Contractor is encouraged to observe inspections and will receive inspection results upon request.

2.0 Inspection of Juniper and Other Conifer Cutting

If a visual inspection reveals any uncut juniper or other conifer trees not protected under other clauses of the contract, the unit will be reworked until all excess juniper and other conifer trees have been eliminated.

3.0 Inspection of Precommercial Thinning

Government inspections will be made by a series of 1/20 acre (26.3-foot radius) plots located at random intervals across each work unit. Flagged markers will be used to locate the plot centers and identify them by consecutive number. Flags will also indicate the date of inspection and inspector's initials. The number of plots will be one plot per 5 acres.

3.1 Each inspection plot will be evaluated for compliance with all contract specifications as follows:

a. Each inspection plot will be divided into four quadrants based on cardinal directions:

Each quadrant will be evaluated for compliance with all contract specifications.

Quadrants meeting all contract specifications will receive 3 points. One point will be deducted from a quadrant for each contract violation found within the quadrant.

Quadrants found to have three or more contract violations will receive 0 (zero) points. A maximum of 12 points is possible for each plot.

b. Factors evaluated in each quadrant shall include:

(1) Cut leave trees.

(2) Excess trees not cut.

(3) Presence of unpiled slash.

(4) Slash piles not constructed in accordance with the specifications.

(5) Slash piles not covered in accordance with the specifications.

(6) Improperly located/spaced slash piles.

(7) Duff around big trees not disturbed as per the specifications.

3.2 Work Quality Percentage (WQP)

The WQP is derived from inspection plot data. The WQP is determined by dividing the total number of points earned by the total number of points possible. This rate multiplied by 100 provides the work quality percentage.

Example: Number of plots inspected: 25

Number of points possible (12 x 25): 300 Total points earned: 274

WQP: (274/300) x 100 = 91%

3.3 Acceptable Quality Level (AQL)

A minimum AQL of 90 percent WQP is required.

4.0 Rework

When inspection of the unit for precommercial thinning or juniper cut reveals a WQP below the minimum AQL of 90 percent, rework will be required. When instructed, the Contractor shall rework the unit for reinspection. If the unit again fails to meet the minimum AQL of 90 percent, the CO has the option of accepting the unit at the AQL calculated from inspection plots or of ordering the Contractor to rework the unit again. If the CO elects to accept the unit at the AQL percentage calculated after rework, the Contractor will be paid based on the results of the reinspection.

5.0 Reinspection

Reinspection’s after rework will be made in the same manner as the first inspection but on different plot lines. The Contractor shall be charged for the cost of two or more reinspection’s if the quality percentage remains below 90 percent.

6.0 Payment

Payment will be made for completed acres inspected and accepted by the Government.

Payment for units achieving a WQP of 90 to 94 percent before rework, units achieving a WQP of 90 to 100 percent after rework, and units accepted by the CO which do not meet the minimum of 90 percent will be paid at a rate determined by multiplying the actual inspection percentage by the bid price.

An adjustment will be added to the WQP for those units’ achieving 95 percent or better before rework. If the actual quality percentage equals or exceeds 95 percent before rework, full payment (100 percent) will be made.

F.1.0 PERIOD OF PERFORMANCE

The contract shall commence from date of award for a period up to 27 Months, September 1, 2023, through November 30, 2025.

F.2.0 PROGRESS PLAN

At the prework conference, the Contractor shall provide to the COR a written "work progress plan" that details its proposed work force and schedule to provide for orderly completion of the work within the contract performance time. This work schedule must be acceptable to the Government. At a minimum, the schedule must reflect a work progress rate equal to the available amount of contract performance time.

CONTRACT ADMINISTRATION DATA

CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM (JULY 2010)

(a) FAR 42.1502 directs all Federal agencies to collect past performance information on contracts. The Department of the Interior (DOI) has implemented the Contractor Performance Assessment Reporting System (CPARS) to comply with this regulation. One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR42.15.

(b) The past performance evaluation process is a totally paperless process using CPARS. CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.

(c) We request that you furnish the Contracting Officer with the name, position title, phone number, and email address for each person designated to have access to your firm's past performance evaluation(s) for the contract no later than 30 days after award. Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official. The report information must be protected as source selection sensitive information not releasable to the public.

(d) When your Contractor Representative(s) (Past Performance Points of Contact) are registered in CPARS, they will receive an automatically-generated email with detailed login instructions. Further details, systems requirements, and training information for CPARS is available at https://www.cpars.gov/. The CPARS User Manual, registration for On Line Training for Contractor Representatives, and a practice application may be found at this site.

(e) Within 60 days after the end of a performance period, the Contracting Officer will complete an interim or final past performance evaluation, and the report will be accessible at https://www.cpars.gov/. Contractor Representatives may then provide comments in response to the evaluation, or return the evaluation without comment. Comments are limited to the space provided in Block 22. Your comments should focus on objective facts in the Assessing Official's narrative and should provide your views on the causes and ramifications of the assessed performance. In addition to the ratings and supporting narratives, blocks 1 - 17 should be reviewed for accuracy, as these include key fields that will be used by the Government to identify your firm in future source selection actions. If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating ''No comment" in Block 22, and then signing and dating Block 23 of the form. Without a statement in Block 22, you will be unable to sign and submit the evaluation back to the Government. If you do not sign and submit the CPAR within 30 days, it will automatically be returned to the Government and will be annotated: "The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment." Your response is due within 30 calendar days after receipt of the CPAR.

(f) The following guidelines apply concerning your use of the past performance evaluation:

(1) Protect the evaluation as "source selection information." After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the Contracting Officer for instructions.

(2) Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.

(3) Prohibit the use of or reference to evaluation data for advertising, promotional material, preaward surveys, responsibility determinations, production readiness reviews, or other similar purposes.

(g) If you wish to discuss a past performance evaluation, you should request a meeting in writing to the Contracting Officer no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 30- day review period.

(h) A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized.

ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS – INVOICE PROCESSING PLATFORM (IPP)

(APR 2013)

Payment requests must be submitted electronically through the U.S. Department of the Treasury’s Invoice Processing Platform System (IPP).

“Payment request” means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions – Commercial Products and Commercial Services included in commercial products and commercial services contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice

1. Invoice billed according to contract line items and rates.

2. If partial payment is billed and the invoice states a lump sum, the invoice shall include an itemized breakdown and narrative progress summary of the work performed during this invoice period.

3. If final payment is billed, the last invoice shall state “FINAL”.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contract (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3 – 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

SPECIAL CONTRACT REQUIREMENTS

1.0 ACCESS

In the event of a site/facility closure, the Contractor shall not perform or make deliveries to the site/facility until it is reopened by the Government, unless otherwise instructed by the Contracting Officer or their designated representative.

2.0 WORK HOURS

Unless otherwise specified in Section C, Specifications, work hours under this contract shall be limited to the time between one-half hour before sunrise to one-half hour after sunset each day. No work will be done on Saturday, Sunday, or Federal holidays unless authorized by the COR.

3.0 ENVIRONMENTAL INTERRUPTION OF WORK

3.1 Environmental - The Contracting Officer, by issuance of a suspend work order, may direct the Contractor to shut down any work that may be subject to damage due to weather conditions, fire danger, or because it is impracticable to work during the winter season. The Contractor will be given a resume work order which will document the date the work suspension ends. An allowance has been included in the contract time for all environmental delays. The count of contract time will therefore continue during all periods of suspension due to normal weather conditions, including fire danger. The Contractor will not be entitled to additional contract time for any suspensions except to the extent that they are due to unusually severe weather conditions. The Contractor will not be entitled to additional monetary compensation for such suspensions regardless of duration.

3.2 Endangered Species - The Government may direct the Contractor to discontinue all operations in the event that listed or proposed threatened or endangered plants or animals protected under the Endangered Species Act of 1973, as amended, or Federal candidate (Category 1 and 2), sensitive or state listed species, identified under BLM Manual 6840, are discovered to be present in or adjacent to the project area.

4.0 PRESERVATION OF HISTORICAL AND ARCHEOLOGICAL DATA

4.1 Public Law 93-291, May 24, 1974, provides for the preservation of scientific, prehistorical, and archeological data (including relics and specimens) which might otherwise be lost due to alteration of the terrain as a result of any Federal construction project.

4.2 The Contractor agrees that should any contractor employee, in the performance of this contract, discover evidence of possible scientific, prehistorical, historical, or archeological data the contractor will notify the Contracting Officer immediately in writing giving the location and nature of the findings.

4.3 Where appropriate by reason of discovery, the Contracting Officer may order delays in the time of performance and/or changes in the work. If such delays and/or changes are ordered, the time of performance and contract price shall be adjusted in accordance with the applicable clauses in the Contract Clauses Section of this contract.

4.4 The Contractor agrees to insert this requirement in all subcontracts which involve the performance of work on the terrain of the site.

5.0 ENVIRONMENTAL IMPACT

All waste materials generated by any work under the contract performed on a Government installation shall at all times be handled, transported, stored, and disposed of by the contractor and by his subcontractors in accordance with all applicable Federal, state, and local laws, ordinances, regulations, court orders, and other types of rulings having the effect of the law, including, but not limited to Executive Order 12088, 13 October 1978, Federal Compliance with Pollution Control Standards; the Federal Water Pollution Control Act, as amended (33 U.S.C. 1251 ET SEQ); the Clean Air Act as amended (42 U.S.C.
