SECTION C. - DESCRIPTION/SPECIFICATIONS/WORK STATEMENT
Baseline raptor surveys within Organ Mountains for OMDPNM Resource Management Plan
1. GENERAL
a. Objectives
The Bureau of Land Management Las Cruces District Office is in the process of developing a Resource Management Plan for the Organ Mountains Desert Peaks (OMDP) National Monument. The Monument has experienced a significant increase in visitation since establishment in 2014. Within OMDP, raptors may be more susceptible to increasing levels of recreation and management actions. Documenting baseline data for nesting raptors will provide the basis from which managers can assess potential impacts from uses. The goal of this project is to obtain presence-absence information and map nesting sites for raptors across the most frequently visited subunits of OMDP, focusing on the northern Organ Mountains (from Highway 70 south to Bishop cap). Additional subunits of OMDP can be inventoried for baseline data pending funding availability. The target species for the habitat and region include: Golden Eagle (Aquila chrysaetos), Red-tailed Hawk (Buteo jamaicensis), Prairie Falcon (Falco mexicanus), and Peregrine Falcon (Falco peregrinus). These species are known to nest in cliff habitats in southern New Mexico
b. Project Dates A project initiation meeting will be held January 2, 2023. Field surveys for year 1 will continue throughout the nesting season up to July 31, 2023. Progress reports are to be provided monthly, with a draft end of year report due on or before December 15, 2023.
Field surveys for year 2 will begin in January 2024 and continue through the nesting season up to July 31, 2024. Progress reports are to be provided monthly. A report synthesizing findings across the two years of surveys is due on or before December 13, 2024.
c. Project Locations and Descriptions*** The proposed project is to take place across 10 recreational climbing and hiking areas in the northern Organ Mountains from highway 70 south to Bishop cap. Areas of focus include Sugarloaf, Organ Needle, Indian Hollow, Pine Tree Trail, The Needles, Rabbit Ears, Baylor Peak, Soledad Canyon, Peña Blanca, and Bishop Cap. More survey locations may be added pending funding availability.
Sugarloaf: 32.3464° N, 106.5439° W Organ Needle: 32.3451° N, 106.5614° W Indian Hollow: 32.3720° N, 106.5427° W Pine Tree Trail: 32.3700° N, 106.5601°W The Needles: 32.3548° N, 106.5725° W
Rabbit Ears: 32.3670° N, 106.5781° W Baylor Peak: 32.3930° N, 106.577° W Soledad Canyon: 32.306° N, 106.589° W Peña Blanca: 32.2223° N, 106.6038° W Bishop Cap: 32.1904° N, 106.6042° W

*additional maps and associated shapefiles can be provided upon request
2. RESPONSIBILITY OF SURVEYOR
a. Conduct surveys (2 per month) within the 10 areas described above. If sites have no raptor activity by mid-nesting season, they may be dropped from repeat surveys so efforts can focus on occupied sites.
b. Habitat assessments will be completed at each siting location.
c. Conduct qualitative assessment of recreation levels and types at each siting location.
d. Conduct breeding pair monitoring if detected.
e. Monitor territorial and/or breeding pairs of raptors to assess their habitat use, habitat characteristics, prey availability, prey use, breeding behavior, and productivity, as appropriate (at least 1 visit per week and up to 2 visits per week during critical stages of nesting to document breeding success). Continue monitoring of young birds until fully independent of parents (approximately 30 days after leaving the nest).
f. UTM locations (NAD 1983) of all raptor sightings and nest locations will be collected.
g. Provide survey and monitoring updates at the end of each month via email to BLM-
LCDO.
h. Provide the BLM Las Cruces District with a draft report summarizing raptor surveys and monitoring at the end of year 1 (on or before December 15, 2023), and a final project report at the end of year 2 (on or before December 13, 2024). The survey report will be compiled in a word document (doc), including maps, sighting/nest location (as appropriate) coordinate summary, habitat assessment summary for raptor sighting locations, and summary observations from each survey date.
i. All spatial information collected and included within the summary report must meet the following specifications:
-Projection - NAD83/UTM/Units Meters.
-Vertical Datum – GSC North American 1983.
-Format – ESRI file (geodatabase)

The Government must exercise its postacceptance rights (1) within a reasonable time after the defect was discovered or should have been discovered; and (2) before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.

(e) Definitions. The clause at FAR 52.202-1, Definitions, is incorporated herein by reference.

7109, which is applicable to the period in which the amount becomes due, as provided in (i)(6)(v) of this clause, and then at the rate applicable for each six-month period as fixed by the Secretary until the amount is paid.
(ii) The Government may issue a demand for payment to the Contractor upon finding a debt is due under the contract.
(iii) Final decisions. The Contracting Officer will issue a final decision as required by 33.211 if-
(A) The Contracting Officer and the Contractor are unable to reach agreement on the existence or amount of a debt within 30 days;
