The proposed project is located in San Miguel County at an average elevation of 7,800 feet. The vegetation is Pinon/Juniper and Mixed Mountain Shrub. To achieve the objectives, the project work is vegetation treatment by mastication of 2 units for a total of 67 acres. An additional 10 acres of Ponderosa Pine within Unit 42D will need ladder fuels masticated underneath the dripline of overstory Ponderosa trees.

The average slope is 10% Crown cover is greater than 60%.

The Contractor will be responsible for removal of all vegetation that have less than 16” DBH along a 100’ wide swath following the interior edge of the fire control lines of Units 42D and 42C. All vegetation larger than 16” DBH within the 100’ wide swath will be limbed to six feet above ground level. All standing dead or down logs/trees will be removed from the 100’ swath on the interior edge of the fire control lines either by mastication or by relocation. The contractor will grind/mulch all vegetation less than 16” DBH with contractor furnished equipment (e.g., Hydro-Ax, Fecon Bull Hog or similar) Mechanical Thinning of Control Lines: Remove all vegetation <16” DBH, limb all remaining vegetation larger than 16” DBH to six feet above ground level.

• Slash will be masticated and dispersed (to a depth of less than 6 inches)

• Stump heights should be 6 inches or less on the uphill side.

• Retain mature juniper and pinyon trees > 16” DBH - Flattened or rounded top, deeply furrowed bark (juniper), thick, plate-like bark

(pinyon), twisted trunks/branches, dead branches and spike tops, large lower limbs, large trunk diameter relative to tree height.

• Leave trees larger that 16” DBH will be limbed six feet above ground level.

• Standing dead/down logs and trees within the 100’ swath will be removed either by mastication or by being re-located by contractor furnished equipment.

Drip-lining of Ponderosa Pine: Remove all vegetation <16” DBH, and limb all remaining vegetation larger than 16” DBH to six feet above ground level underneath the driplines of Ponderosa trees plus ten feet.

• Remove all vegetation underneath the dripline of overstory Ponderosa tree plus ten feet around the dripline.

• Stump heights should be 6 inches or less on the uphill hide.

• Retain all Ponderosa trees regardless of DBH

• Ponderosa trees larger than 16” DBH will be limbed six feet above ground level.

Review of Contract Quote Items The following Quote items are listed in descending order of priority:

1. Mechanically Thin Unit: 42D – 40 Acres * Cost per acre.

2. Mechanically Thin Unit 42C – 27 Acres: * Cost per acre.

3. Mechanically Thin Ponderosa Drip-lining – 10 Acres * Cost per acre.

SPECIAL CONSIDERATIONS TO OPERATION i.e.----Operations will cease during times where rutting or excessive soil disturbance is being observed-rutting greater than 3 inches. The government Contracting Officer’s Representative will inform awardee if the work is acceptable to the government.

Machine Operation:

• Prohibit mechanical operation on wet soils exceeding ruts 3 inches depth for 10 feet or more.

• Vehicle traffic and equipment operation will be restricted during wet periods to prevent rutting in excess of one inch on gravel roads and 2 inches on native surface roads. Vehicle traffic and equipment operation may also be restricted during dry periods if native surface roads become powdered.

• Equipment will not travel on slopes greater than 40%.

Additional treatment specifications: The following areas shall be free from treatment slash created by this project:

• Roadways and road edges; slash and tree trunks will not be left within 100 feet of any road or fire control line edge.

• Perennial streams for a distance of 15 feet.

• Cut and fill slopes, Ditches, rolling dips, water bars, culverts and other water management structures for a distance of 15 feet.

• Improvements such as roads, established trails, telephone, power line, stock driveways, fences, established land corners, etc.

The COR and/or PI will do periodic inspections which may include compliance monitoring plots to ensure consistency with contract specifications.

Location: ---GROUND TRANSPORTATION ROUTE Access to the Work: Access to the project site is via County and BLM roads. The primary road, County Road K8 is a county road that is a dirt/gravel road that is maintained seasonally by the county but remains open year-round. Once to the County Road “K8” vehicles may require 4-wheel drive if the road is wet or muddy. Other roads within the unit are unmarked BLM roads that may require 4-wheel drive to access other portions of the treatment area.

From Dove Creek go North on Highway 141 11.6 miles and then take a right on County Road K8. Follow County Road K8 East 4.2 miles to reach the Northernmost end of Unit 42D. Access to the rest of the project area will be with an unmarked BLM road that follows the Western boundary of Unit 42D.

Environmental Considerations: The majority of the targeted area is relatively flat to moderately sloping mesa top adjacent to the Dolores River Canyon. Most rocky areas are associated with drainages and knobs. Slopes greater than 30% are short in nature and excluded from treatments.

Work Limits: Moving should be limited to dry conditions to reduce damage to any roads, or the contractor will need to smooth roads with equipment at the end of the project returning it to the prior condition. Work should not continue in wet conditions where more than 3 inch ruts will be produced by equipment operation.

SCHEDULING: This is a single schedule contract.

In the event of extreme weather or environmental conditions, the Contracting Officer will determine the best course of action based on comments from the Contractor and PI/COR.

CONTRACTOR FURNISHED ITEMS:

The contractor will provide necessary equipment with an operator. The equipment will be equipped with a machine mounted, thinning and shredding machine [a mower/mulcher]. Either a vertical-shaft or horizontal-shaft may be used in this contract area.

• Transportation for equipment and operator to and from the site.

• All fuels, lubricants, parts for repairs, and repairs to the machine.

GOVERNMENT FURNISHED PROPERTY:

The BLM will GPS the outer perimeter of the parcel areas to be treated using an electronic map/shape file, which will be available to the contractor.

Any area within the project area to be avoided by the contractor will be identified on a map/shapefile and discussed during the pre-work meeting.

From this point it will be the contractor’s responsibility to avoid these areas.

The BLM will provide maps and descriptions of the area and will go with the operator around the boundary of the area. The government will map the area treated by the Contractor after the treatment using a Global Positioning System (GPS), based on horizontal plane measurement, not “slope” acreage.

Acreage is determined with computer software and is two-dimensional. It will be the responsibility of the quoter to quote accordingly.

Only areas shown on the Project Map will be treated. The project areas are identified with GPS units. It will be the contractor’s responsibility to provide a GPS capable of loading project areas from a computer. The project boundaries will not be marked, and it will be the responsibility of the contractor to know how to use and read a GPS to find project boundaries and to stay within them while implementing the treatment.

Government staff will identify unit boundaries for the work executed under the contract through GPS shapefiles.

The government will provide representatives to act as liaisons between the contractor and the BLM Contracting Officer to implement the project and to ensure that the resource objectives of the project are met.

The BLM will provide treatment measurement: The determination of the acreage of completed work will be made by using the Global Positioning System (GPS). Area measurements required under this Contract will be measured on a horizontal plane. Mechanical treatment of trees and brush will be measured and paid for by the number of acres treated to the nearest whole acre. Work performed according to the specifications will be considered acceptable for payment purposes.

The BLM will provide re-measurement of the acreage under this Contract upon the written request of the Contractor. The request for re-measurement must be made in writing within 10 calendar days after completion of the work. If re-measurement indicates a difference of not more than 5 percent from the original measurement, the Contractor shall pay the actual cost of the re-measurement. Payments will be based on the second measurement where the difference between measurements is more than 5 percent. Where the difference is less than 5 percent the results of the first measurement will be used.

The PI and/or COR will conduct periodic on-site inspections. The Contractor is encouraged to observe inspections while they are being made and have a supervisor on site to confer with the PI and/or COR. If an onsite visit has not occurred during the period, the contractor is required to report status of work each week, or when any special situations or problems are encountered. These reports may be made by telephone to the Project Lead.

TRANSPORTATION OF EQUIPMENT, DELIVERY, STORAGE, AND HANDLING:

The contractor will provide transportation for all equipment; operators, fuel, and water to and from the site. The Contractor shall be responsible for providing the necessary material handling equipment to on-load and off-load all materials and the appropriate security when equipment or property is left on site.

LUBRICATING AND SERVICING OF EQUIPMENT:

The Contractor shall be responsible for all service to all equipment including support vehicles. The Contractor shall keep all the equipment in proper functioning condition to ensure objectives of the project are met.

REPAIRS TO EQUIPMENT:

The Contractor shall be responsible for repair of all equipment including the support vehicles. The Contractor shall keep all the equipment in proper functioning condition to ensure objectives of the project are met. The Contractor shall be equipped to make necessary field repairs to equipment.

Use of welding equipment may be limited by fire restrictions. It is the Contractors responsibility to keep current on any restrictions.

SPECIFIC TASKS:

Protection: The Contractor is required to protect section corners, bench marks, and other markers and stakes from damage or removal. In case of destruction or removal by the Contractor, they will be replaced by the Government and the actual cost for replacement will be deducted from payments due the Contractor. The Contractor is also required to avoid all areas flagged and identified by the COR as areas to be protected due to resource concerns.

The Contractor shall immediately upon entering the project area, begin work, locate control points, section corners, and take such action to prevent their destruction.

Noxious Weeds: Vehicles and heavy equipment are one of the primary agents for the spread of noxious weed seed to public lands. In efforts to mitigate the spread of weed seed to BLM lands the following actions are required for contractors prior to transport to a BLM project area. The Contractor will be responsible for power-washing or comparable cleaning, to ensure that noxious weed seeds are removed from any and all equipment and vehicles used on the project prior to entering the project area. BLM will require a pre-implementation inspection to ensure compliance which would be arranged to occur before the equipment enters BLM lands, most likely in Dove Creek, CO or Egnar, CO when the contractor is planning transport to the project area. The Contractor is responsible for any additional transport or expenses associated with non-compliance.

Support vehicles (pickups, fuel/service vehicles, transports, dump trucks, etc.)

• Pressure wash radiator to flush seeds.

• Pressure wash undercarriage to remove accumulations of mud and soil that may contain seeds.

Heavy Equipment (dozers, road graders, excavators, backhoes, loaders, etc.)

• Pressure wash radiator(s) to flush seeds.

On-site disposal of Hazardous Materials or Waste including hydrocarbons is not authorized. The Contractor will be responsible to prevent introduction of hazardous materials into the environment during the implementation of the proposed action. Any on-site disposal or release of two gallons or more in the form of spilled fuel, hydraulic fluid, or oil used by the machinery and the resulting contaminated soil will subject the contractor to at least the cost of reclamation and the appropriate disposal of contaminated soil. Fueling and maintenance activities should not take place in or adjacent to any drainage (perennial or ephemeral.)

• All product containers, cans, and debris should be removed from the site and disposed of properly.

• Incidental leaks from fittings, gaskets, or ruptured hoses will not subject the contractor to remedial requirements (if less than 2 gallons).

• Fueling equipment and maintenance/repair locations, and equipment will be inspected and approved prior to contract startup by the owner/operator and the Government’s PI/COR. Inspections will include checking for evidence of oil/fuel leaks at all piping, oil/fuel lines, hydraulic lines and seals, fuel tanks and other potential sources of leaks. All evidence of leaks will be investigated and immediately repaired prior to equipment operation on the job and continual leaks will be noted on inspection reports and corrected through required maintenance.

• All non-manual fueling equipment will have an automatic shut-off switch installed to avoid fuel releases.

• Fuel tanks greater than 200 gallons may only be used within a spill containment pit. The spill containment pit shall be constructed at a site designated by the PI/COR, with an impermeable liner capable of containing a released volume of one and one-half times the tank volume.

The Contractor will report all hazardous substance spills immediately to the BLM PI or COR

Fire Prevention and Fire Safety Provisions: The government may require the contractor to curtail or cease operations should wildland fire danger approach critical levels. The contractor will be given 24 hour notice in the form of a suspend work order issued by the Contracting Officer.

Ignition of a wild land fire that threatens the project area may require the Contractor to proceed with an emergency evacuation of the project area.

A 10 lb. ABC fire extinguisher and shovel or equivalent tool will be available on the operating equipment for fire prevention and control.

If extreme fire and fuels condition thresholds are exceeded there may be a stop-work order to reduce the opportunity for unintentional ignitions by mechanized operations. These thresholds include “Red Flag Warnings” and/or a “Fire Weather Watch” issued by either the Durango Interagency Dispatch Center or Moab Interagency Dispatch Center. Stop-work orders may also be issued by either the BLM Project Inspector (PI) or Contracting Officers Representative (COR) if in their judgment extreme fire and fuels conditions are present.

MASTICATION OPERATIONS:

General: Mastication shall be performed within the project area as marked by the Government and instructed by the COR or PI. Insufficient shredding/mulching may require areas to be treated more than once to meet objectives.

• Remaining stumps shall not exceed 6 inches in height.

• Vegetation shall be reduced to a mulch material with a minimum of 80% of the woody material being less than 1" in diameter and 6" long.

The mulch shall be scattered evenly across the soil surface and not remain in piles greater than 6" deep.

Worker –

(1)

(i) Means any person engaged in performing work on, or in connection with, a contract covered by Executive Order 14026, and–

(A) Whose wages under such contract are governed by the Fair Labor Standards Act (29 U.S.C. chapter 8), the Service Contract Labor Standards statute (41 U.S.C. chapter 67), or the Wage Rate Requirements (Construction) statute (40 U.S.C. chapter 31, subchapter IV);

(B) Other than individuals employed in a bona fide executive, administrative, or professional capacity, as those terms are defined in 29 CFR part 541; and

(C) Regardless of the contractual relationship alleged to exist between the individual and the employer.

(ii) Includes workers performing on, or in connection with, the contract whose wages are calculated pursuant to special certificates issued under 29 U.S.C. 214(c).

(iii) Also includes any person working on, or in connection with, the contract and individually registered in a bona fide apprenticeship or training program registered with the Department of Labor’s Employment and Training Administration, Office of Apprenticeship, or with a State Apprenticeship Agency recognized by the Office of Apprenticeship.

(2)

(i) A worker performs on a contract if the worker directly performs the specific services called for by the contract; and

(ii) A worker performs in connection with a contract if the worker's work activities are necessary to the performance of a contract but are not the specific services called for by the contract.

(b) Executive Order Minimum wage rate.

(1) The Contractor shall pay to workers, while performing in the United States, and performing on, or in connection with, this contract, a minimum hourly wage rate of $15.00 per hour beginning January 30, 2022.

(2) The Contractor shall adjust the minimum wage paid, if necessary, beginning January 1, 2023, and annually thereafter, to meet the applicable annual E.O. minimum wage. The Administrator of the Department of Labor’s Wage and Hour Division (the Administrator) will publish annual determinations in the Federal Register no later than 90 days before the effective date of the new E.O. minimum wage rate. The Administrator will also publish the applicable E.O. minimum wage on https://www.sam.gov (or any successor website), and a general notice on all wage determinations issued under the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute, that will provide information on the E.O. minimum wage and how to obtain annual updates. The applicable published E.O. minimum wage is incorporated by reference into this contract.

(3)

(i) The Contractor may request a price adjustment only after the effective date of the new annual E.O.

minimum wage determination. Prices will be adjusted only for increased labor costs (including subcontractor labor costs) as a result of an increase in the annual E.O. minimum wage, and for associated labor costs (including those for subcontractors). Associated labor costs shall include increases or decreases that result from changes in social security and unemployment taxes and workers’ compensation insurance, but will not otherwise include any amount for general and administrative costs, overhead, or profit.

(ii) Subcontractors may be entitled to adjustments due to the new minimum wage, pursuant to paragraph (b)(2). Contractors shall consider any subcontractor requests for such price adjustment.

(iii) The Contracting Officer will not adjust the contract price under this clause for any costs other than those identified in paragraph (b)(3)(i) of this clause, and will not provide duplicate price adjustments with any price adjustment under clauses implementing the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute.

(4) The Contractor warrants that the prices in this contract do not include allowance for any contingency to cover increased costs for which adjustment is provided under this clause.

(5) A pay period under this clause may not be longer than semi-monthly, but may be shorter to comply with any applicable law or other requirement under this contract establishing a shorter pay period. Workers shall be paid no later than one pay period following the end of the regular pay period in which such wages were earned or accrued.

(6) The Contractor shall pay, unconditionally to each worker, all wages due free and clear without subsequent rebate or kickback. The Contractor may make deductions that reduce a worker’s wages below the E.O.

minimum wage rate only if done in accordance with 29 CFR 23.230, Deductions.

(7) The Contractor shall not discharge any part of its minimum wage obligation under this clause by furnishing fringe benefits or, with respect to workers whose wages are governed by the Service Contract Labor Standards statute, the cash equivalent thereof.

(8) Nothing in this clause shall excuse the Contractor from compliance with any applicable Federal or State prevailing wage law or any applicable law or municipal ordinance or any applicable contract establishing a minimum wage higher than the E.O. 14026 minimum wage. However, wage increases under such other laws or municipal ordinances are not subject to price adjustment under this subpart.

https://www.sam.gov/

(10) The Contractor shall follow the policies and procedures in 29 CFR 23.240(b) and 23.280 for treatment of workers engaged in an occupation in which they customarily and regularly receive more than $30 a month in tips.

(i) Workers are covered regardless of the contractual relationship alleged to exist between the contractor or subcontractor and the worker;

(ii) Workers with disabilities whose wages are calculated pursuant to special certificates issued under 29 U.S.C. 214(c) are covered; and

(iii) Workers who are registered in a bona fide apprenticeship program or training program registered with the Department of Labor’s Employment and Training Administration, Office of Apprenticeship, or with a State Apprenticeship Agency recognized by the Office of Apprenticeship, are covered.

(2) This clause does not apply to–

(i) Contracts or subcontracts to which the States of Texas, Louisiana, or Mississippi, including their agencies, are a party;

(ii) Fair Labor Standards Act (FLSA)-covered individuals performing in connection with contracts covered by the E.O., i.e. those individuals who perform duties necessary to the performance of the contract, but who are not directly engaged in performing the specific work called for by the contract, and who spend less than 20 percent of their hours worked in a particular workweek performing in connection with such contracts;

(iii) Individuals exempted from the minimum wage requirements of the FLSA under 29 U.S.C. 213(a) and 214(a) and (b), unless otherwise covered by the Service Contract Labor Standards statute, or the Wage Rate Requirements (Construction) statute. These individuals include but are not limited to-

With respect to workers covered by the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute, the Contractor may meet this requirement by posting, in a prominent and accessible place at the worksite, the applicable wage determination under those statutes.

With respect to workers whose wages are governed by the FLSA, the Contractor shall post notice, utilizing the poster provided by the Administrator, which can be obtained at www.dol.gov/agencies/whd/government-contracts, in a prominent and accessible place at the worksite. Contractors that customarily post notices to workers electronically may http://www.dol.gov/agencies/whd/government-contracts post the notice electronically provided the electronic posting is displayed prominently on any Web site that is maintained by the contractor, whether external or internal, and customarily used for notices to workers about terms and conditions of employment.

(e) Payroll Records.

(1) The Contractor shall make and maintain records, for three years after completion of the work, containing the following information for each worker:

(i) Name, address, and social security number;

(ii) The worker’s occupation(s) or classification(s);

(iii) The rate or rates of wages paid;

(iv) The number of daily and weekly hours worked by each worker;

(v) Any deductions made; and

(vi) Total wages paid.

(2) The Contractor shall make records pursuant to paragraph (e)(1) of this clause available for inspection and transcription by authorized representatives of the Administrator. The Contractor shall also make such records available upon request of the Contracting Officer.

(3) The Contractor shall make a copy of the contract available, as applicable, for inspection or transcription by authorized representatives of the Administrator.

(4) Failure to comply with this paragraph (e) shall be a violation of 29 CFR 23.260 and this contract. Upon direction of the Administrator or upon the Contracting Officer's own action, payment shall be withheld until such time as the noncompliance is corrected.

(5) Nothing in this clause limits or otherwise modifies the Contractor’s payroll and recordkeeping obligations, if any, under the Service Contract Labor Standards statute, the Wage Rate Requirements (Construction) statute, the Fair Labor Standards Act, or any other applicable law.

(f) Access. The Contractor shall permit authorized representatives of the Administrator to conduct investigations, including interviewing workers at the worksite during normal working hours.

(g) Withholding. The Contracting Officer, upon his or her own action or upon written request of the Administrator, will withhold funds or cause funds to be withheld, from the Contractor under this or any other Federal contract with the same Contractor, sufficient to pay workers the full amount of wages required by this clause.

(h) Disputes. Department of Labor has set forth in 29 CFR 23.510, Disputes concerning contractor compliance, the procedures for resolving disputes concerning a contractor’s compliance with Department of Labor regulations at 29 CFR part 23. Such disputes shall be resolved in accordance with those procedures and not the Disputes clause of this contract. These disputes include disputes between the Contractor (or any of its subcontractors) and the contracting agency, the Department of Labor, or the workers or their representatives.

(i) Antiretaliation. The Contractor shall not discharge or in any other manner discriminate against any worker because such worker has filed any complaint or instituted or caused to be instituted any proceeding under or related to compliance with the E.O. or this clause, or has testified or is about to testify in any such proceeding.

(j) Subcontractor compliance. The Contractor is responsible for subcontractor compliance with the requirements of this clause and may be held liable for unpaid wages due subcontractor workers.

(k) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (k) in all subcontracts, regardless of dollar value, that are subject to the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute, and are to be performed in whole or in part in the United States.
