1 INTRODUCTION

1.A Background

1.A.1 The Bureau of Land Management (BLM) is required, under Section 106 of the National Historic Preservation Act of 1966 (as amended) (NHPA) to take into account the effects of its actions on historic properties through a process of identification, evaluation, assessment of effects, and, if needed, mitigation.

Prior to any ground-disturbing activity, the BLM conducts a Class III (intensive) cultural resource inventory per requirements provided in BLM’s 8110 Manual for the purpose of identifying and evaluating cultural resources which may be affected by the proposed action. BLM cultural resource specialists can then use these evaluations, in combination with information gained through consultation with affected Tribes, the Colorado State Historic Preservation Officer (SHPO), and other consulting parties to determine whether mitigation treatments are required for any site.

1.A.2 Class III (intensive) cultural resource inventory is guided by the consultation process outlined in the State Protocol Agreement (Protocol) with the Colorado SHPO dated October 29, 2014. Inventory standards and guidelines are specified in the most current BLM Colorado Handbook of Guidelines and Procedures for Inventory, Evaluation, and Mitigation of Cultural Resources and associated Digital Data Specifications Guide, Colorado SHPO standards, District and field office standards and procedures (for BLM-LSFO adhere to the 2021 Procedures and Reporting Standards for Cultural Resource Consultants Conducting Projects Under a CRUP Permit for the Colorado Northwest District and Upper Colorado River District, Bureau of Land Management) and other supplemental guidance.

1.A.3 A cultural resource overview of the project area is being provided below with the intent of assisting prospective offerors with more specific inventory information about areas adjacent to the project area. It is frequently the case that a similar site density with similar site types can be expected in the project area if it is a similar landscape, however, this is not always true. Prospective bidders should not assume that this overview is anything more than an informed projection of what could possibly be present in the project area.

1.B Objectives

1.B.1 A Class III (intensive) field inventory of approximately 1,930 BLM acres of public land in Moffat, Rio Blanco, and Garfield Counties, Colorado is requested. The cultural resource inventory is required prior to

Solicitation No. 140L3725Q0061 Page 3 of 58 mechanical (mastication) vegetation reductions, cut and piling, and prescribed burning to locate, evaluate and adequately protect all sites from the effects of the undertaking. All newly-identified sites and isolated finds located will be recorded and mapped. Previously recorded sites will be re-located, evaluated, and re-recorded if their original recording is over 10 years old; for those identified within 10 years of the current inventory, complete OAHP Cultural Re-Visitation Forms addressing impacts or changes to the site, if any exist.

Potentially eligible sites will be tested to determine site depth potential, integrity, and eligibility wherever possible. This will be done to reduce the number of “Needs Data” evaluations. If encountered, all cadastral survey monuments will be recorded with a GPS receiver and recorded as isolated finds.

Several small cultural resource inventories have been conducted within the current Area of Potential Effects (APE). The overlapping areas are negligible; therefore, the entire inventory area will be surveyed at the Class III level. From these previous inventories, three cultural resources were identified within the current APEs.

These include a prehistoric open lithic site (5MF.6466), a prehistoric isolated find (5RB.9422), and County Road (5RB.9030). Site 5MF.6466 was previously evaluated as Needs Data and will need to be fully re-recorded and assessed for NRHP eligibility. No further work is required for the isolated find unless more cultural materials are found that upgrades the resource to a site. Prehistoric site density is expected to be low to moderate throughout the inventory areas.

Archival research suggests low to moderate densities of historic resources may be present within the current inventory area. County Road 87 (5RB.9030) cuts through the Angora APE. The road was recorded in 2023 and officially determined as not eligible; therefore, the site will not require field documentation. Only named historic routes and features plotted on historic USGS map and GLO plats within the APE will require documentation using BLM’s Linear Management Data and Segment forms.

The project areas are spread out across three counties. The Angora survey area is in Rio Blanco County and is roughly 13 miles northeast of Rangely, Colorado, and 1.4 miles north of Highway 64. The Blue Mountain survey area is in Moffat County and is roughly 24 miles north-northwest of Rangely, Colorado. The Cathedral N. Aspen survey area is in Rio Blanco and Garfield Counties. The northernmost unit is roughly 37 miles west of Meeker, Colorado, whereas the southernmost survey area is roughly 40 miles southwest of Meeker, Colorado and 40 miles northwest of Rifle, Colorado. These units include pinyon, juniper, and sagebrush environments. The units can range from flat with some slopes and rolling terrain to rocky outcrops with steep slopes. Most of the area is accessible by 4WD vehicle and/or ATV/UTV. County roads access the area but can become impassable when wet.

1.B.2 The general activities involved in this effort include planning, fieldwork, analysis, report preparation, and artifact curation. Secondary objectives include the compiling of inventory data, technical editing and desk top publishing of documents, updating records, and providing GIS and GPS data to BLM field offices.

1.B.3 Objectives include providing information on the distribution and character of cultural resources in the project areas to better assess their significance and preservation requirements as well as determining the effects of the proposed undertaking on historic properties.

1.B.4 To protect site information from unauthorized disclosure, all site location and content information must be kept in strictest confidence. The contractor shall make the information available only to the Contracting Officer’s Technical Representative (COR)/ Project Inspector (PI) and must take whatever internal measures are necessary to ensure that confidential material is protected. All site specific records, photographs, and maps generated in the course of this contract, including original field maps and notes, will be considered BLM property and will be turned over to the COR/PI upon completion of the project. The contractor’s Contract Manager will be responsible for ensuring that all excess site specific documents, maps, site forms, Solicitation No. 140L3725Q0061 Page 4 of 58 etc., (i.e., those not submitted as deliverables, internal review drafts, etc.) are properly disposed of upon completion of the project. All BLM Permits for Archaeological Investigations (PAI) stipulations will be followed.

1.B.5 To allow BLM to meet a schedule for projects requiring cultural resource inventory, inventories and deliverables must be completed by the dates specified in the Award and SOW in order for project implementation to occur as scheduled.

1.C To accomplish these objectives

1.C.1 The Contractor must hold or be able to obtain a PAI issued from the Colorado State Office BLM to be permitted to work on BLM lands managed by LSFO and field work must be immediately supervised by personnel under that permit qualified to work in the project area. All PIA permit stipulations will be followed.

1.C.2 A pre-work meeting will be scheduled after award of the contract. The Contractor will be required to mobilize no more than two (2) weeks from the date of the pre-work meeting or as otherwise agreed upon.

1.C.3 The Contractor shall furnish all labor, supervision, transportation, services, facilities, materials, and supplies necessary for the performance of all aspects of the tasks described herein.

1.C.4 No contract modifications will be provided for unanticipated site density or logistical complexity not considered by the contractor in their bid.

2 PLACE OF PERFORMANCE

2.A The work is located on BLM-administered lands in Colorado, within the Northwest District, White River Field Office, as described in 1.B Objectives.

2.B The BLM reserves the right to pursue other means, outside of this contract, to accomplish the work described under this contract. These means include, but are not limited to: assistance agreements, interagency agreements, data sharing agreements, Challenge-Cost-Share projects, volunteer agreements, in-house work, or other contracts.

3 TASKS

3.A Task 1: Conduct Class III Cultural Resource Inventory

3.A.1 Pre-field Literature and Records Review

3.A.1.a The Contractor must review all existing sources of information on the cultural resources of the Area of Potential Effect (APE) including from the Colorado SHPO and BLM White River Field Office. The areas indicated on the attached maps are the APE where direct effects from the proposed undertaking will occur.

The BLM will define the area of the inventory accurately and clearly. The records and literature review will include a minimum 1-mile radius around the direct APE. The search will determine if there are previously recorded cultural resources in the APE and will document the nature and extent of previous cultural resource inventory and research in the general area. An important outcome of this review is to develop a historic context to discuss the results of the contractor’s survey report.

3.A.1.b Cultural resource data, including site records and project reports for public land actions are available from the Colorado SHPO, Office of Archaeology and Historic Preservation Office (OAHP) in Denver. The OAHP site files are in the COMPASS database and survey records for much of the State have been computerized and are available. The backlog of survey and site records in COMPASS also requires that the cultural resource project and site files and GIS data located in BLM White River Field Office are reviewed.

3.A.1.c Failure to conduct a pre-field literature and records review may result in the rejection of the associated report and/or suspension or revocation of the Contractor’s PAI. Review of all existing information held in the BLM Field Office(s) will be conducted at the field office.

3.B.1 Cultural Resource Inventory

3.B.1.a The contractor must follow the inventory standards and guidelines specified in the most current versions of the following documents:

3.B1.b Shapefiles that define the survey area boundaries will be provided to the successful offeror by the COR. The Contractor must locate the boundaries of the defined inventory area prior to commencement of the survey. Use GPS units, corner markers, benchmarks, 7.5 minute topographic maps, aerial photographs (where available), roadways and other landscape features, if needed, to ensure ground control and confidence in the inventory area and in the location of cultural resources.

3.B.1.c A 100% pedestrian survey at transect intervals not exceeding 15-20 meters for block survey areas and 10-15 meters for linear survey areas will be conducted to identify and record all cultural resources.

Actual ground examination should result in the identification and recording of all cultural resources observable on the surface and in exposed subsurface profiles.

3.B.1.d Each field crew must be supervised in the field by a qualified crew chief listed on the PAI. Crew

3.B.1.e The Contractor must notify the COR/PI by telephone and with written confirmation immediately upon the discovery of human remains, funerary objects, sacred objects, or objects of cultural patrimony (as defined in 43 CFR 10.2) and must immediately stop any activities connected with such discovery.

3.B.1.f The provenience of all surface diagnostic artifacts, artifact concentrations, tools and features must be shown on the site map. The BLM generally adheres to a no collection policy. Collection is only recommended if in the opinion of the field office Archaeologist, the artifact(s) are unique and vulnerable to unauthorized collection or destruction, diagnostic (time-sensitive), and cannot be readily identified in the field. Under Section II(f) of the Northwest District Standards and Procedures, contractors are expected to plot obsidian materials on instrument/sketch maps and collect a representative sample of obsidian debitage or tools located during survey for sourcing by the contractor. Obsidian artifacts are not to be curated; once sourcing analysis is complete the contractor will mail the artifacts back to the BLM (specifically to the Archaeologist) along with the coordinates so they can be returned to the cultural resource. The contractor may return the artifacts themselves, but only if fieldwork is ongoing. It is not expected for the contractor to mobilize after fieldwork has been completed to return obsidian artifacts; this action can be done by the BLM.

Additionally, if ceramic artifacts are encountered in the field, the field office archaeologist should be contacted to discuss collection options. A catalog sheet, drawings of the artifact(s), and location of the collected artifacts (e.g. name and contact information of museum) will be included in the body of the report and attached to the appropriate site form(s). The location of collected artifacts shall be accurately plotted on site sketch maps.

Cultural resource materials removed from BLM-administered land, along with copies of the associated records, are curated as property of the United States in a university, museum, or other approved scientific or educational institution in the State of Colorado. Collected artifacts must be curated according to the standards of the facility designated as the curatorial repository. No paleontological resources may be collected under a cultural resource permit.

3.B.1.g Within two weeks of the completion of field work, the Contractor must provide the COR/PI corrected GIS shapefiles of the area surveyed and of all cultural resources identified and recorded during the inventory along with the Progress Report (task 3.D.2). The Contractor will provide the COR/PI with a list or table of UTM coordinates for all cultural resource sites identified and recorded during the inventory and recommendations of eligibility, when required. All shapefiles will be in NAD 83 UTM Zone 12N for submission through a secure electronic transfer (no email) or FTP site transfer to the PI.

3.B.1.h After the receipt of GIS shapefiles of the surveyed area and all cultural resources, the BLM will have two weeks to perform quality control field inspections, if warranted. Should the field inspections result in the discovery of inventory or site recording deficiencies, the contractor must address these deficiencies at no cost to the government. This includes, but is not limited to, additional field mobilizations.

3.B.1.i After the BLM conducts or waives the fieldwork inspection, the BLM will request the OAHP document number and Smithsonian numbers. The contractor is not to request these numbers.

3.B.1.j Flagging eligible sites is not required. After the draft report has been accepted, a GIS shapefile should be included with the final deliverables that contains “Avoidance Areas” unless directed otherwise.

The avoidance areas will include all eligible sites documented within the inventory area with a 30 m buffer applied.

3.B.1.k Note: Task 3.A.1 & 3.B.1 must be completed within six weeks of the pre-work meeting or otherwise agreed upon date.

3.C Task 2: Recordation and Evaluation of Cultural Resources

3.C.1 The Contractor must record each cultural resource identified, including any previously recorded site, following the Colorado BLM Digital Data Specifications Guide and the use of Colorado state site forms.

Reevaluations will be performed on all sites in the inventory area that have not been reevaluated in the last 10 years. Sites that have been recorded during the last 10 years will not need to be reevaluated unless reportable changes have occurred to the site. New management data and component forms will be filled out on previously recorded sites that have the older site form versions.

3.C.2 Sites partially within the inventory area will be fully recorded. [Note: Portions of extensive sites may be excluded from this requirement on a case-by-case basis in consultation with the appropriate BLM archaeologist.] Linear sites shall be recorded within project boundaries, on BLM linear site forms. Following BLM NW District policy, the entire linear site must be recovered and evaluated for eligibility if the recording is the first recording of the linear site.

3.C.3 To refine National Register eligibility recommendations, evaluative testing units (minor probing, troweling, or shovel testing) will be conducted at all sites where the Contractor is unable to determine site eligibility based on surface evidence. This evaluative testing during field recording should be used to determine the potential for subsurface cultural deposits and the site boundary, as needed. In no case should such evaluative testing exceed three (3) square meters of site surface. Test plots should also be shown on the site map. If subsurface cultural deposits are encountered during testing, photographs with a scale should be included with the site’s documentation. The level of testing should not be conducted in a manner that requires the retrieval of artifacts or impacts or destroys information that contributes to the site’s eligibility. Criteria used to determine potentially eligible properties must be substantive, objective, and stated in the report.

3.C.4 Furnish a complete Colorado SHPO site and IF form for each cultural resource identified and revisited during inventory. The Colorado SHPO requires that prehistoric and historic sites be recorded on the Colorado Inventory Form and Management Data Form. In addition to this form, a Prehistoric Archaeological Component Form must also be completed for sites with a prehistoric component and a Historical Archaeological Component Form must be completed for sites with a historic component. The Rock Art Component Form is required for rock art sites. The Contractor must contact the Colorado SHPO to obtain the latest update of any form used prior to submitting any report. The Contractor shall use the latest updates of the form available at the time of report preparation.

If other types of sites are encountered during the survey, those sites will be recorded on standardized forms available from BLM, Colorado. Linear sites must be recorded on the BLM Linear Site Forms. If wickiups, culturally modified trees, and historic well pads are encountered, such sites are to be recorded on site forms specific to these types of sites. 3.C.5 There must be sufficient description on the forms for the COR/PI to derive an accurate eligibility assessment. The site description must include number and types of objects present, site dimensions, types of features, topographic location, etc. If any significant disturbances or impacts have occurred, these must be described and photographed. Each form must be legible and must include a formal site map and a USGS 7.5', 1:24,000 scale GIS produced topographic map showing the exact location of the site. Site boundaries must be depicted as accurately on both the site and topographic maps. The topographic map must be clearly labeled with the map name, site number, map scale, north arrow and land status. Site maps must include spatial relationships of features and artifacts to each other and other pertinent non-cultural data or topography (i.e., roads, trees, drainages, etc.). If tools or diagnostic artifacts are present, scaled artifact sketches or photographs must accompany the site form. Diagnostic artifacts, including obsidian, should also

3.D Task 3: Reporting and Deliverables

3.D.1 Upon completion of inventory, a progress report followed by a draft report, then a final report must be submitted to the COR/PI. At a minimum, the reports must follow the Colorado SHPO report guidelines.

3.D.2 A progress report must be supplied to the COR/PI within two weeks of completion of fieldwork. The report shall be typewritten in a brief, narrative or table format. The report shall include the Contract Number and project name including county at the top of the first page. It will include: (1) a description of each site and IF including site type, temporal or cultural affiliation, and the NRHP eligibility recommendation; (2) a copy of a 7.5’ topographic map showing the project survey boundary and site and IF locations; and (3) corrected shapefiles containing resource boundaries (see Task 3.B.1.g). The BLM will have two weeks to conduct fieldwork inspections and either approve the task as complete or request that deficiencies noted during the inspection are corrected.

3.D.3 A digital copy of a draft final report meeting the most current BLM-Colorado Northwest District’s “Procedures and Reporting Standards for Cultural Resource Consultants” and copies of the site and IF forms and corrected shapefiles of the surveyed areas, cultural resource sites, and IFs shall be submitted for review by the COR/PI within six weeks of completion of fieldwork. The draft shapefiles may be subject to minor editing based on the COR/PI review. The draft report shall be copy edited and completed with all photographs, maps, figures, tables, charts, and graphs necessary to adequately describe the findings. The COR/PI shall have six weeks to review the draft report and return comments or corrections which must be addressed in the final report.

3.D.3.a The draft final report and all required survey information and site and IF forms will meet the guidelines established by the Secretary of Interior’s Standards and Guidelines for Archaeology and Historic Preservation, the most current BLM Colorado Handbook of Guidelines and Procedures for Inventory, Evaluation, and Mitigation of Cultural Resources and associated Digital Data Specifications Guide, Colorado SHPO standards, District and field office standards and procedures and other supplemental guidance.

3.D.3.b The draft final report will include evaluations of all sites, recommendations on National Register eligibility, and a discussion of site impacts. The evaluations should be made in the context of previous investigations and findings in the general area, and research questions for the region. All sites brought forward as “Need Data” will include a detailed discussion of how field testing was conducted and why field testing was inconclusive and specific recommendations for additional evaluative testing to determine eligibility. The recommendations for site management must take into account the current site condition based on disturbances observed while conducting the field work.

The contractor will submit digital copies of the draft report and site and isolated find forms through a secure electronic transfer or FTP site. The site and isolated find forms shall be saved as individual documents in PDF format.

3.D.3.c All sites must have at a minimum of two photographs showing the general site location with a horizon. Reevaluations of sites should also include the above photo specifications. Site overview photographs should also include coordinates from where the photograph was taken.

3.D.3.d Any artifacts collected during the survey will be fully described in the report.

3.D.4 The final report containing all changes and corrections identified from the draft report review shall be submitted within three weeks of receiving the BLM draft report comments. The Contractor shall submit one bound copy of the final report and one set of stapled final site and isolated find forms. Unless the contractor is using secure electronic file transfer or FTP, a thumb drive shall be submitted containing the following:

1. Final Report in PDF format.

2. Individual site and isolated find forms in PDF format.

3. Shapefiles of survey areas, sites, isolated finds, and if applicable, a shapefile of “avoidance areas.”

A request, in writing, for an extension due to unforeseen circumstances may be granted, but the request must be submitted to the COR/PI three (3) working days before the due date of the final report, and it must clearly state why the extension is needed.

3.D.4.a The shapefiles must be polygonal (no points or lines) of both the actual area inventoried, and the site and IF boundaries. All shapefiles will be in NAD 83 for submission on a thumb drive or placed into a FTP site for access by BLM.

3.D.4.b Site Confidentiality: To protect site information from unauthorized disclosure, all site location and content information must be kept in strictest confidence. The Contractor shall make the information available only to the COR/PI and must take whatever internal measures are necessary to ensure that confidential material is protected. All site specific records, photographs, and maps generated in the course of this contract, including original field maps and notes, will be considered BLM property and will be turned over to the COR/PI upon completion of the project. The Contractor will be responsible for ensuring that all excess site specific documents, maps, site forms, etc., (i.e., those not submitted as deliverables, internal review drafts, etc.) are properly disposed of upon completion of the project.

3.D.4.c All collected artifacts will be curated at the repository identified in the PAI within the stipulated time frame.

3.D.4.c The BLM retains ownership of, and all rights to, all artifacts collected, records, data, maps, drawings, photographs, samples, artifacts, GIS products, automated data bases, or other products. These items cannot be used by the Contractor without written permission from the BLM.

4 COORDINATION

4.A The Contractor must be highly flexible and able to adapt to rapidly changing circumstances. Close coordination with the CO and COR/PI will be necessary to meet BLM deadlines. If problems arise, they first shall be discussed with the COR/PI. The Contractor must be able to quickly "gear-up" to execute assigned tasks within short time frames.

4.B The Contractor shall be responsible for obtaining and coordinating access across private lands for the purpose of conducting work under this contract; contact information will be provided by BLM. The Contractor shall advise the COR/PI within one (1) working day of any access restriction which would significantly delay progress.

4.C Any contacts/communications with the news media or other public concerning work performed under this contract shall first be cleared through the COR/PI.

4.D Any problems which may delay the Contractor’s work schedule must be reported immediately to the COR/PI.

4.E The Contractors project director and all field supervisors must have a valid BLM Colorado Permits for Archaeological Investigations (PAI) and have submitted a Fieldwork Authorization request prior to the initiation of fieldwork. A Fieldwork Authorization Request must be submitted to the White River Field Office at 220 East Market St, Meeker, CO, 81641.

4.F During the course of the project, reasonable precautions will be taken to avoid the disclosure of site locations to all but authorized personnel. In addition, field personnel will be required to keep all motorized vehicles on existing roads and trails. Field personnel will contact the COR at least one week prior to initiating fieldwork.

5 PROGRAM MANAGEMENT AND CONTROL REQUIREMENTS

5.A Work performed under this contract shall be monitored according to contract specifications, provisions, and the Contractor's Technical Quote. The Technical Quote Package to this RFQ shall thoroughly discuss cost and schedule control as well as quality control.

5.B Cost and Schedule Control: Adherence to costs and schedules contained in the award shall be closely monitored. The Contractor’s response shall specify individuals who shall be responsible for monitoring costs and schedules. Each type of task included in Section 3 above, shall be structured as a series of steps, each with identifiable goals and end points. Progress shall be evaluated periodically and shall be included in the progress/letter report, if required. A detailed plan for the early identification and resolution of problems (i.e., scheduling delays due to inclement weather, etc.) shall be prepared and followed. Potential problem areas shall be identified in consultation with the technical and administrative staffs before work begins. All records of actual time and costs charged to this contract shall be made available for inspection upon request by the BLM.

5.C. Quality Control: Control over the technical quality of all work and deliverables shall be closely monitored by the Contractor to assure required BLM and other professional standards are met. Within the Technical Proposal to this RFP, explicit procedures shall be provided that assure periodic quality checks on field/laboratory methods and products (site records, artifact attribute sheets, final reports, etc.) associated with individual orders. A discussion of actual procedures which shall be followed to monitor progress and assure quality control shall also be included within the Technical Proposal. These procedures could include periodic meetings with staff, field or laboratory inspections, independent checks of analytic procedures, etc.

At any time when after the PI conducts the quality control during fieldwork inspections and finds additional sites that have been missed, the contractor will remobilize at their own cost to correct the missing information.

The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.
