GFP consists of Government-Furnished Facilities, Government-Furnished Equipment, Government-Furnished Supplies and Materials, and Government-Furnished Services that are made available by the Government for the Contractor’s use in the performance of contract requirements. The Contractor shall become accountable for GFP when the Government transfers it to the Contractor. The Contractor shall not use GFP or services for any other purpose than execution of services under this contract.

Work areas that are Government-Furnished are subject to inspection at any time. The Company and Contractor shall cooperate with officials making periodic Government inspections.

Government-Furnished Facilities (GFF): The Government will provide or make available to the Contractor appropriate workspace at the facilities where work is required for performance of the contract. The Contractor shall keep all work areas clean and in neat and professional order at all times.

Upon completion of the contract, the facilities used by the Contractor shall be in the same condition as when the Contractor began work, except for reasonable wear. The initial condition of these facilities shall be established during an initial joint inventory of GFF.

The Contractor shall not alter the space except with written permission from the CO. Any such alterations or improvements become the property of the Government; however, the CO may require the Contractor to remove or dismantle such alterations or improvements and restore the facilities to their original condition upon expiration or termination of the contract. This dismantling and restoration shall be performed at the Contractor’s expense.

The Government will provide Contractor access to local facilities or space not assigned to the Contractor, such as break areas and areas where equipment is located.

Government-Furnished Equipment (GFE): The Government will provide all equipment for the performance of work required by this contract except as identified as Contractor furnished equipment. Such equipment includes office space, furniture, telephones, computer equipment, scanners, fax machines, and printers.

The Government will provide all necessary support, and maintenance and repair of GFE except where designated as the responsibility of the Contractor. The Contractor shall coordinate through the COTR for all equipment maintenance and repairs of GFE.

TITLE: Administrative & Technical Support Services Page 10

All equipment offered for the Contractor’s use under this Contract will be provided in “as is” condition. If equipment is not in working order, or cannot be used in its current condition, the Contractor shall notify the COTR. The Government, at its option, will repair or replace all such equipment items. If any Government furnished equipment becomes unneeded or breaks down, the Contractor shall notify the COTR. The Government will replace GFE that has reached the end of its useful life if it is still needed for successful completion of work required under this contract.

The Contractor shall replace, at no expense to the Government, GFE that is damaged beyond economical repair due to Contractor misuse or negligence, as determined by the COTR. The title for Contractor replaced equipment shall be vested in the Government. The Contractor shall not remove GFE from any GFF location without prior written approval from the CO.

At the completion of the contract, the Contractor shall return all GFE equal in type, kind, quality, and quantity of items as originally furnished by the Government and accepted by the Contractor, excluding those items of equipment turned over to the Government for disposal during the course of performing the contract. The Contractor shall also return all equipment for which title was vested in the Government. Such property shall be in the same condition as when originally furnished, with the exception of normal wear and tear.

For all items requiring repair or replacement due to negligence of the Contractor, the Government will determine equivalent monetary value required to repair or replace facilities, equipment, and /or materials necessary to reestablish the same levels of inventory. The Contractor shall reimburse the Government at current Government estimated replacement value or estimated amount to cover the cost of repair as determined by the CO. This amount will be withheld from the Contractor’s next recurring monthly invoice.

Government-Furnished Supplies and Materials: The Government will provide materials and supplies, including general office supplies, on hand at the start of the contract and on an ongoing basis throughout the contract used to accomplish work or services required under this contract.

Regulations, guidance and procedures are typically available via electronic systems available to personnel under this award. If necessary, the Government will provide paper copies of any additional material needed for performance.

Government-Furnished Services: The Government will furnish the following services for purposes of the contract: telephone services, utilities, facility maintenance, custodial services, and fire protection. These services shall not be used for any other purpose outside the scope of this contract. The Contractor shall coordinate with the appropriate office for the provision of these services as necessary.

The Contractor shall have access to designated telephones, for the purpose of conducting business under this contract. Non-business long-distance calls shall be placed as either collect calls or credit card calls.

Collect calls may not be received by any Contractor employee.

As needed, the Government will provide network access, such as e-mail, Intranet, Internet, and access to local area network applications (e.g., Microsoft Office products, SharePoint, FBMS, etc.) for the Contractor.

Utilization of Government information systems and internal mail distribution systems will be provided to the extent that contract performance requires their use. Systems must not be used for Contractor or individual employee purposes. Contractor personnel may use available initial emergency medical services and concessions located in Government facilities.

TITLE: Administrative & Technical Support Services Page 11

Government-Furnished Vehicle: The Government will make a Government-owned vehicle (GOV) available for use by the Contractor to visit project locations, attend meetings, or complete other tasks associated with the work to be completed under the Performance Work Statement of this contract. Under no circumstances is the Contractor to domicile a GOV or use the GOV to commute to and from the Government-furnished facility.

Authorization to use GOVs does not authorize the Contractor to be reimbursed by the Government for mileage when a non-GOV is used for tasks performed under this contract

Contract employees operating fleet vehicles, heavy equipment and all-terrain vehicles will have a valid driver’s license and will obtain the equivalent training and certification to that which is required of Government employees. Prior to using a GOV, the Contractor shall be certified as satisfactorily completing a defensive driving course acceptable to the Government. The certification will be kept current as long as the Contractor uses GOVs under the terms of this contract. This agreement incorporates the authorization to operate Government vehicles, heavy equipment or all-terrain vehicles and that liability and tort-related actions are also included.

The Contractor agrees to follow any established Government procedures for using a GOV, including, but not limited to reserving the vehicle, checking it out, conducting pre-trip inspections, reporting accidents, and completing mileage reports.

The Contractor will establish and enforce suitable penalties for their employees who willfully use or authorize the use of such vehicles for other than official purposes. The Contractor assumes any cost or expense incident to use not related to the performance of this contract, without right of reimbursement from the Government for such cost or expense. The Contractor shall replace, at no expense to the Government, a GOV that is damaged beyond economical repair due to Contractor misuse or negligence, as determined by the COTR. The title for Contractor replaced equipment shall be vested in the Government. A copy of the current Certificate of Liability Insurance must be submitted to the Government.

III. CONTRACTOR FURNISHED ITEMS

General: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform services as defined in this Performance Work Statement (PWS) except for those items specified as Government Furnished under Section II.

On site management of contractor personnel is not required.

Security Clearance: The Contractor is responsible to provide and maintain personnel which can meet the security clearance requirements of the BLM. The BLM mission includes a fiscal responsibility element. Due to this mission element the Agency clearance may necessitate providing supporting documentation regarding personal finances. All personnel must be able to meet the security requirements of the Agency. Contractor personnel performing work under this contract will be required to submit all necessary and requested documentation to complete the Agency’s security background checks and thereafter continue to meet the requirements necessary to maintain the appropriate security clearance. The Government pays for the costs of the background check, and it is expected that contractor personnel will be expeditious and complete in their submission of any/all requested documentation to support the clearance. BLM is a funds handling Agency and there is emphasis placed on the financial background of all employees and contractors. If a person submitted for clearance fails to submit any requested documentation within ten (10) work days of requested, their background check may be cancelled and the prime contract will be responsible to both: reimburse the Government for all changes associated with the cancelled background check and within ten (10) business days submit a new candidate for consideration.

Access to the BLM facilities and the BLM computer system is strictly limited to authorized personnel. The Contractor employee must not allow access to BLM facilities or the computer system by unauthorized persons.

The Contractor is responsible for safeguarding information of a confidential or sensitive nature. Failure to safeguard any classified/privileged information which may involve the Company or the Contractor, or to which they may have access, may subject the Company and/or the Contractor to criminal liability under Title 18, section 793 and 7908 of the United States Code. Provisions of the Privacy Act apply to all records and reports maintained by the Contractor. All programs and materials developed at Government expense during the course of this contract are the property of the Government. Contractor shall be required to obtain and maintain security badges and adhere to the installation security requirements.

Contractor Personnel Security and Suitability Requirements: Performance of this contract requires contractor personnel to have a Federal government- issued Personal Identity Verification (PIV) credential before being allowed unsupervised access to a Department of the Interior (DOI) facility and/or information system. The Contracting Officer's Technical Representative (COTR) will be the requesting official and will make arrangements through a DOI Access Card Sponsor for personal identity verification and DOI Access Card issuance.

At least two weeks before start of contract performance, the Contractor must identify all contractor and subcontractor personnel who will require [physical and/or logical] access for performance of work under this contract. Physical Access means routine, unescorted or unmonitored access to non-public areas of a Federally-controlled facility. Logical Access means routine, unsupervised access to a Level 3 or 4

Federally-controlled information system. The Contractor must make their personnel available at the place and time specified by the COTR or DOI Access Card Sponsor in order to initiate screening and background investigations. The following forms and inquiries, or their equivalent, will be used to initiate the credentialing process:

• OPM Standard Form 85 or 85P

• OF 306

• National Criminal History Check (NCHC) (local procedures may require fingerprinting to be done at a police station; in this case, any charges are to be borne by the contractor)

• Release to Obtain Credit Information

• PIV card application (web-based)

Before starting work under this contract, a National Criminal History Check (NCHC) will be initiated to verify the identity of the individual applying for clearance and to determine the individual's suitability for the position.

If the NCHC adjudication is favorable, a DOl Access Card will be issued for that individual. If the adjudication is unfavorable, the credentials will not be issued, and the contractor must make other arrangements for performance of the work. In the event of a disagreement between the Contractor and the Government concerning the suitability of an individual to perform work under this contract, DOl shall have the right of final determination.

Contractor employees must give, and authorize others to give, full, frank, and truthful answers to relevant and material questions needed to reach a suitability determination. Refusal or failure to furnish or authorize provision of information may constitute grounds for denial or revocation of credentials.

Government personnel may contact the contractor personnel being screened or investigated in person, by telephone or in writing, and the Contractor must ensure they are available for such contact.

TITLE: Administrative & Technical Support Services Page 14

Alternatively, if an individual has already been credentialed by another agency through OPM, and that credential has not yet expired, further investigation may not be necessary. In that case, the contractor must provide the COTR/COTR with documentation that supports the individual's credentialed status.

Contractor employees who have been successfully adjudicated will be issued DOI Access Cards, which must be activated at a USAccess Credentialing Center. Those Contractor employees not located within a reasonable travel time of a USAccess Credentialing Center will be screened and issued alternate credentials, such as temporary access badges.

During performance of the contract, the Contractor must keep the COTR apprised of changes in personnel to ensure that performance is not delayed by compliance with credentialing processes. Cards that have been lost, damaged, or stolen must be reported to the COTR and Issuing Office within 24 hours. If reissuance of expired credentials is needed, it must be coordinated through the COTR.

At the end of contract performance, or when a contractor employee is no longer working under this contract, the Contractor must ensure that all identification cards are returned to the COTR.

This requirement must be incorporated into any subcontracts that require subcontractor personnel to have routine unsupervised access to a Federally-controlled facility for more than 180 calendar days or any unsupervised access to a Federally controlled Level 3 or 4 information system.

During performance of the contract, the Contractor will keep the COTR apprised of changes in personnel to ensure that performance is not delayed by compliance with credentialing processes. Cards that have been lost, damaged, or stolen must be reported to the COTR and Issuing Office within 24 hours. Replacement will be at the contractor’s expense. If reissuance of expired credentials is needed, it will be coordinated through the COTR. At the end of contract performance, or when a contractor employee is no longer working under this contract, the Contractor will ensure that all identification cards are returned to the COTR.

Physical Security and Access Control: The Contractor shall be responsible for safeguarding all Government equipment, information and property provided for Contractor use. At the close of each work period, Government facilities, equipment, and materials shall be secured in accordance with local regulations and/or procedures that may be in effect during the prescribed period of performance. No Government files or media will be removed from the Idaho State Office without prior coordination and approval of the Contracting Officer.

The Contractor shall establish and implement methods of making sure that in the event that services are provided in a Government facility that requires controlled access that all keys/key cards or ingress/egress access codes issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons.

NOTE: All references to keys include key cards and/or access codes. No keys issued to the Contractor by the Government shall be duplicated. The Contractor shall develop procedures covering key control that shall be included in the Quality Control Plan.

Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The Contractor shall immediately report any occurrences of lost or duplicate keys/key cards to the Contracting Officer.

In the event keys, other than master keys, are lost or duplicated, the Contractor shall, upon direction of the Contracting Officer, re-key or replace the affected lock or locks; however, the Government, at its option, may replace the affected lock or locks or perform re-keying. When the replacement of locks or re-keying is performed by the Government, the total cost of re-keying or the replacement of the lock or locks shall be deducted from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due the Contractor.

TITLE: Administrative & Technical Support Services Page 15

The Contractor shall prohibit the use of Government issued keys/key cards by any persons other than the Contractor’s employees. The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the Contracting Officer.

The Contractor shall establish and implement methods of ensuring that all lock combinations are not revealed to unauthorized persons. The Contractor shall ensure that lock combinations are changed when personnel having access to the combinations no longer have a need to know such combinations.

VII. QUALITY CONTROL

Quality Assurance: The Contractor shall achieve an acceptable performance rating in accomplishing the tasks and services listed herein. The performance rating will be based on the results of an inspection process that the Government will administer using the Quality Assurance Surveillance Plan (QASP). The Government will inspect services under this contract to assess the Contractor’s overall performance. The results of the inspections will determine overall satisfaction with various services provided, focusing primarily on the timeliness and quality of these services. When an observance indicates defective performance, the COTR will notify the CO and the Contractor and document the observation in accordance with the QASP.

Performance Evaluation: The Contractor shall participate in conference calls and/or meetings with the COTR and the CO to review contract performance. Discussions shall include review of contract performance, issues, suggestions for changes in the business process, etc. In the event performance problems exist, the parties will discuss the problems in an effort to achieve a mutual resolution.

The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. Thereafter, the CO, COTR, and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. If called, at these meetings, the CO will apprise the Contractor of how the Government views the Contractor's performance and the Contractor will apprise the Government of any problems being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government. There is no separate price line for these meetings.

Suggested Action: When the Contractor has been informed of defective services, the Contractor must rework the task or service if rework is possible. The COTR will evaluate the defective service and the impact thereof. Based upon criticality, the COTR may decide to strictly document the defects on a Contractor Discrepancy Report (CDR) and not allow further expenditure of resources for rework.

In the event of rework, the time of Contractor notification will serve as the beginning of the rework period. If, at the completion of the rework, the task or service is still unacceptable, then another CDR will be submitted. The Contractor’s Program Manager will again be required to sign and date a CDR to be submitted to the CO.

VIII. SAFETY REQUIREMENTS

All contractor personnel shall comply with all applicable Federal, State, and local laws while engaged in the performance of this contract to include safety policies and regulations established by the BLM. All hard copy publications are available via the referenced websites below. Supplements or amendments to listed publications may be issued during the life of the contract. The BLM Defensive Driving Course will be provided, if use of a government owned vehicle is authorized.

TITLE: Administrative & Technical Support Services Page 16

Occupational Safety and Health: The Contractor shall comply with all provisions of the William-Steiger Occupational Safety and Health Act of 1970, all applicable safety and health regulations that have been promulgated by the Secretary of Labor under the Williams-Steiger Occupational Safety and Health Act of 1970, to include 29 Code of Federal Regulation (CFR) Part 1910 (Occupational Safety and Health Standards), and all applicable safety and health codes and standards of the state and local jurisdictions where the work is to be performed. The Contractor shall ensure safety in the assigned work areas and shall identify safety hazards to the COTR. Before any work is performed, the Contractor shall advise persons performing the work of any hazards involved. The contractor must be able to safely bend, lift and carry items that weigh up to approximately 60 pounds of weight on an ongoing basis.

Prohibited Activity: Smoking is prohibited in all areas inside the facility. Smoking is allowed outside the facility in designated smoking areas.

Energy Conservation: The Contractor shall participate in Government utility conservation and resource recycling programs.
