This is a combined Synopsis/Solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Firm, fixed-price quotes are requested under Request for Quotation (RFQ) Solicitation number 140L2625Q0019. This document incorporates provisions and clauses which are in effect through Federal Acquisition Regulations 2024-05 This solicitation is set-aside for small business under North American Industry Classification System (NAICS) code 562119. The Small Business Annual Receipts for the preceding three (3) fiscal years does not exceed $47 Million.

DESCRIPTION/SPECIFICATIONS/WORK STATEMENT

Scope of Contract Furnish labor, equipment, supplies, and materials, to water and pump vault toilets, holding/septic tanks and traps in in the Bureau of Land Management Boise District as described in these Contract Documents.

SECTION 01010

SUMMARY OF WORK

PART l: GENERAL

1.1 SUMMARY

A. Description of Work: Contractor shall furnish, on a call when needed basis, vault toilet and holding/septic tank pumping services which includes all equipment, supervision, transportation, labor, operating supplies, and incidentals necessary to pump, wash down, cleanup, disinfect, and dispose of all waste products removed from vaults, in accordance with the following contract specifications and in accordance with State and Federal regulations.

B. Frequency and Dates of Work: The frequency and exact dates when services will be required cannot be pre-determined.

C. Scheduling of Work: The COR shall notify the Contractor of the required servicing. This initial notification shall be by phone. Within twenty-four (24) hours of the initial notification, the Contractor shall confirm by phone the date and time of the scheduled servicing. The Contractor shall complete the pumping services within five (5) calendar days after the initial notification. Response time for emergency servicing shall be by mutual agreement between both parties.

D. Definitions:

1. Sewage: liquid, semi-liquid, and solid waste matter contained in vault.

2. Debris: all other refuse found in vault, to include but not limited to items such as cans, bottles, rocks, sticks and logs, animals or animal parts, clothing, plastic bags and containers, metal products, pinecones, food products, cardboard and paper products, whole rolls of toilet paper, tools, diapers and sanitary napkins, and other miscellaneous trash.

3. Waste Material: sewage and debris.

1.2 QUALITY ASSURANCE

A. Quality Assurance: The work shall be inspected as stated in 2.2. Deficient work shall be corrected as stated in 2.3

1.3 SITE CONDITIONS

A. Access to Work Sites: Roads to and in work locations may be unpaved B. Hours of Work: Work shall be scheduled so that it is accomplished between the hours of 8:00 A.M. and 5:00 P.M.; emergency pumping may occur outside of these hours.

D. A set of keys will be provided. The keys should unlock BLM owned gates or cleanout hatches that may be encountered on a site. All keys are government property and shall be returned to the government.

C. Security/Safety: Cleanouts from which servicing shall be performed are covered with a hatch. The cleanout hatch is locked shut in for visitor safety. The Contractor shall be responsible for unlocking the hatch to gain access to the cleanout and replacing the lock immediately after servicing is complete. At no time, shall the Contractor leave an uncovered cleanout hatch unattended.

PART 2: EXECUTION

2.1 MEETINGS

A. Pre-Work Meeting Shall be held after the award of the contract but prior to the start of any work. The Contractor will be notified in advance of the meeting time, date, and place. The purpose will be to review required work, invoicing, and other administrative provisions of the Contract.

2.2 INSPECTIONS

A. Method: The work will be inspected randomly by the COR on or after the scheduled date and time of pumping services.

2.3 DEFICIENT WORK

A. Remedy: If work is found to be deficient, the Contractor shall be notified by the COR immediately and will have forty-eight (48) hours in which to correct the work. The Contractor shall notify the COR immediately after work is corrected.

B. Penalty: Deficient work not corrected by the Contractor in the prescribed time shall result in non-payment of bid item.

2.4 EQUIPMENT

A. Contractor shall use a septic pumper truck with a four (4) inch minimum suction hose.

B. Suction hose shall accommodate a maximum distance from road to vault cleanout of forty (40) feet.

C. All equipment shall be in conformance with Federal, State, and local regulations.

2.5 PUMPING SERVICE

A. Contractor shall remove waste material from vault through the cleanout.

B. Before pumping service begins, Contractor shall fill the vault with sufficient water to facilitate removal of all waste materials. (water will not be provided by the government) C. Contractor shall expect debris to be mixed in with sewage and shall be prepared to remove debris either manually or by pumping.

D. Interior vault walls shall be washed by a hose with sufficient pressure to remove clinging waste material. Hose washing shall occur through the cleanout.

E. No waste material shall remain in the vault after pumping services are complete.

F. Clean and disinfect all contaminated areas outside the vault resulting from the pumping services. Wash all waste material that was spilled during the pumping process. Clean the cleanout hatch and close, being sure to lock the closed when done.

G. If any pumping services occurred inside the restroom the entire restroom shall be cleaned and disinfected, including the toilet seat and riser, walls, door and handles, floor, ceiling, and replacement of toilet tissue if necessary.

2.6 DISPOSAL OF SEWAGE AND DEBRIS

A. The Contractor shall be responsible for waste material disposal and all fees associated with disposal. The Contractor shall conform to all Federal, State, and local laws and ordinances regarding disposal of waste material.

B. The Contractor shall prevent spillage and haul waste material in watertight containers. Contractor's handling of waste material shall conform to all applicable health regulations.

PART 3: MEASUREMENT AND PAYMENT

3.1 METHOD OF MEASUREMENT

A. Units: Each is the measurement unit.

B. Each: One unit (each) shall be one pumping service as described for each vault at the work site.

3.2 PAYMENT

A. Payments: Prices and payment will be full compensation for the work described in this section. Payment will be as shown in the Bid Schedule.

B. Invoicing: Invoices shall be submitted as work is completed and all requests for payment shall be made through the government’s Invoice Processing Platform at IPP.gov

(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);

(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);

(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or (4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.

Critical technology means–

(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;

(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled-

(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or

(ii) For reasons relating to regional stability or surreptitious listening;

(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);

(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);

(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or

(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).

Interconnection arrangements means arrangements governing the physical connection of two or more networks to allow the use of another's network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources.

Reasonable inquiry means an inquiry designed to uncover any information in the entity's possession about the identity of the producer or provider of covered telecommunications equipment or services used by the entity that excludes the need to include an internal or third-party audit.

Roaming means cellular communications services (e.g., voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high.

Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from

TITLE: BOISE DISTRICT VAULT PUMPING Page 16 procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.

The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub.

L.115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract, or extending or renewing a contract, with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.

(c) Exceptions. This clause does not prohibit contractors from providing—

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(d) Reporting requirement. (1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil.

For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.

(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause

(i) Within one business day from the date of such identification or notification: the contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.

(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause: any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services, and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.

(e) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (e) and excluding paragraph (b)(2), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial products or commercial services.

CONTRACT ADMINISTRATION DATA

1. Authorities and Delegations (Sep 2011)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award.

The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor.

Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
