STATEMENT OF WORK (SOW)

BLM KING RANGE PROJECT OFFICE

VAULT TOILET PUMPING / KING RANGE NATIONAL CONSERVATION AREA’S 4

CAMPGROUNDS

Pumping of ten (10) vault toilets located at the King Range national conservation area’s 4 campgrounds.

The Bureau of Land Management (BLM) has ten (10) vault toilets located at the King Range national conservation area’s 4 campgrounds, which require raw sewage to be pumped out.

All ten (10) vault toilets are located inside the boundaries of the King Range national conservation area’s 4 campgrounds.

The King Range national conservation area is located within Whitehorn, CA.

The contractor shall provide all labor, supplies, supervision, tools, equipment, and transportation necessary to provide pumping of vault toilets in accordance with the specifications listed below.

Requirements for delivery are as follows and the successful contractor will be required to comply. Those wishing to provide a quote will be required to provide their certifications for services.

1. Service must be completed within ten (10) days of BLM calling for service.

2. Vaults must be pumped dry, with no sewage remaining in the vault.

3. Vaults often contain trash such as beverage containers, plastic bags, etc. Removal of these items is a requirement of the contract. Contractor shall be responsible for the removal, transport and proper disposal of trash and refuse found within the vault.

4. Upon completion of vault excavation contractor will clean up any spill or contamination of the vault toilet walls (inside and outside), ceilings, floors, and any spillage on the surrounding soil or vault lid area.

5. Sewage removed from vaults must be disposed of in a licensed or permitted sewage disposal facility. Proof of proper disposal may be required. Documentation of proper disposal shall be maintained in the contractor’s records for a minimal of three (3) years.

6. BLM will request a minimum of 4 (calls) to the vaults to be scheduled for pumping at any, during the Period of Performance.

7. Vendor will pump up to 2,500 gallons per trip.

8. BLM must have the opportunity to witness all services.

9. BLM will establish a firm fixed price purchase order for one (1) base year with four (4) option years.

10. Vault toilets are located at different sites throughout the King Range national conservation area’s 4 campgrounds.

Mattole Campground (2 vault toilets):

Location: North end of King Range NCA at the beach. U.S. Highway 101 at Garberville, South Fork/Honeydew, or Ferndale exits. Follow signs toward Petrolia, turn on Lighthouse Road toward ocean.

Tolkan Campground (2 vault toilets):

Location: U.S. Highway 101 to Redway, west 22 miles on Briceland/Shelter Cove Road, then 3.5 miles north on King Peak Road.

Nadelos Campground (2 vault toilets):

Location: U.S. 101 to Redway, west 22 miles on Briceland/Shelter Cove Road, south 1.5 miles on Chemise Mountain Road.

Wailaki Campground (4 vault toilets):

(d) Comptroller General Examination of Record. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements - Internet Payment Platform (IPP) APRIL 2011 Beginning May 1, 2011, payment requests for all new awards must be submitted electronically through the U. S. Department of the Treasury's Internet Payment Platform System (IPP).

Payment terms for existing contracts and orders awarded prior to May 1 remain the same. The Contractor must use IPP for contracts and orders awarded May 1 and later, and must use the non-IPP invoicing process for those contracts and orders awarded prior to May 1.

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in FAR 32.905(b), "Payment documentation and process" and the applicable Prompt Payment clause included in this contract. 1452.201-70 Authorities and Delegations (Sept 2011)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

PROVISIONS:

52.204-7 System for Award Management.

System for Award Management (Oct 2018)

(a) Definitions. As used in this provision—

"Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.

Registered in the System for Award Management (SAM) means that–

(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14) into SAM

(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in SAM;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record "Active".

Unique entity identifier means a number or other identifier used to identify a specific commercial, nonprofit, or Government entity. See www.sam.gov for the designated entity for establishing unique entity identifiers.

(b) (1) An Offeror is required to be registered in SAM when submitting an offer or quotation, and shall continue to be registered until time of award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation "Unique Entity Identifier" followed by the unique entity identifier that identifies the Offeror's name and address exactly as stated in the offer. (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Evaluation will be based on low price technically acceptable services in accordance with the Statement of Work (SOW) and all specifications. In the quote you provide make sure it includes technically how you plan to complete the job. Past Performance will be considered when evaluation of your quote. The Government reserves the right to award without discussions. Therefore, each initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if determined necessary by the Contracting Officer.

TECHNICAL FACTORS:

1. Factor (1) Past performance:

a. Provide a minimum of 3 recent client references (from within the past 5 years)

b. Provide the client’s name, as well as address and telephone number for a point of contact who can provide information regarding the Vendor’s performance.

c. The offeror shall briefly describe, summarize or provide an overview of 3 projects successfully completed within the last five years. Provide contact information on these projects. Statements by past clients may be used in the evaluation of the vendor's technical quote under any and all applicable evaluation criteria. Any information obtained by the Government from references outside the vendor's quote may be used in a similar manner.

2. Factor (2) Performance Work Statement

3. Factor (3) Cost:

a. The award determination shall be based on the Lowest Priced Technically Acceptable.

52.212-3 Offeror Representations and Certifications-Commercial Items. (JAN 2021)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v)) of this provision.

(a) Definitions. As used in this provision-

Covered telecommunications equipment or services has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

Forced or indentured child labor means all work or service-

Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate-

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that-

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by-

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

Subsidiary means an entity in which more than 50 percent of the entity is owned-

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term "successor" does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

Veteran-owned small business concern means a small business concern-

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans;
