An index such as the Chicago Mecantile Exchange softwood lumber futures contract or a state or regional index/publication commonly used for timber sale appraisals shall be identified and documented before contract solicitation to establish a basis for triggering a reappraisal. A baseline will be established upon award of the contract from the most current price of the selected index.
(Note the source of the prices used for the appraisal does not have to be the same source used for the baseline. In some cases, appraisals are obtained by calling mills for a current pond value. It may not be feasible to directly monitor mill prices to determine precise and objective market fluctuations.) Product price shall be adjusted by obtaining the current price from the appraisal data source and calculating the difference between that and the price used for the original appraisal. The difference will be applied to the contract through a modification and a new baseline will be established from the current price at that time.
In some cases the Schedule B price will be a value less than the value of the adjustment and will require a modification to add a service bid item to account for the market impact. At no time will the product value be less than $0.01. In instances where product removal has already begun and a proportion of the volume from Schedule B has been transported off the project, the COR shall determine what proportion has been removed. The reappraised price will not be applied to the volume that has already been transported. Any further failure to agree on the pricing will be handled under the clause entitled “Disputes.”
