1. BLM uses Verizon for the majority of its wireless services. Some BLM personnel in CO, ID, UT, WY and other rural areas use Union Wireless due to the call quality in those locations.

There is no formal contract in place. Billing is handled by other means. The purpose of this task order is to formalize an order with a contractor for wireless services within the scope of this document.

This does not mean we are specifically looking for a Union Wireless solution. We want a solution with the best call quality relative to price in and around specific rural areas. All wireless providers are welcome to submit their solutions for testing and evaluation.

BLM is currently transitioning from Maas360 to InTune for our mobile device management application. The transition must be completed by August 1, 2023.

2. BLM CURRENT STATE

a. Here is a breakdown of BLM’s Union Wireless services from last year. The primary usage areas are those listed above.

b. Other Information

i. We’re currently using US domestic coverage with extremely limited international.

ii. None of our current Union Wireless devices are DEP. All new devices need to be DEP. All devices not currently enrolled will need to be replaced with compliant devices. BLM does not want a trade-in scheme. New devices will be ordered.

3. BLM REQUIREMENTS

a. Period of Performance

The POP of this task order is a one-year base and four one-year options.

b. Devices

Initially, BLM requires these devices (however this number may change prior to award). Although the actual number of lines and equipment may vary from year to year, we do not anticipate large changes in the number of lines or equipment.

There could be small changes (such as a few employees leaving or being hired every year). This is the same for the quantity of equipment, voice plans, and data plans.

g. Transition Plan

i. The contractor shall submit a preliminary transition plan describing the key activities, milestones, roles and responsibilities of BLM and the contractor in meeting the delivery schedule for this task order. No later than thirty days after award, the contractor shall submit a final transition plan.

ii. All existing numbers shall be ported to new service plans where possible.

If the contractor does not offer equivalent devices as SED, a cost shall be proposed for this transition in the quotation so that BLM can properly evaluate the total anticipated cost of the transition. In addition, any switching costs should be identified in the transition plan.

h. Customer Support

Service Provider shall provide a phone number for basic tier 1 support for end users on a 24/7 basis. In addition, a Tier 2 level help desk to help desk support will be available for more complex issues to assist internal help desk functions inside BLM. Points of Contact. Service provider shall provide point(s) of contact for communication and resolution of invoice, billing and reporting issues.

i. Ordering

BLM will provide an updated list of ordering officials within BLM. Service Provider shall provide an ordering portal.

j. Training.

Free of charge training required under this order must include Ordering Official training for use of ordering portal. Provider shall also describe in their quotation any other training offered under this Order.

4. FUNDING

The values on each CLIN are not-to-exceed amounts. In no event shall the contractor invoice for amounts greater than those on individual CLINs. The contractor must notify the government when 80% of the value of any CLIN has been invoiced and provide a projection as to when that CLIN will be exhausted at current usage rates. The purpose is to avoid any Anti-Deficiency Act violation.

When any option period is exercised, the exact funded value will be determined at that time and will also be a NTE amount. All CLIN values are estimates of required lines and equipment. Additional lines may or may not be ordered. Due to the nature of wireless service contracts (adding and subtracting lines and equipment), modifications adjusting funding (such as adding or subtracting additional funding) are routinely anticipated.

5. TERMS AND CONDITIONS

a. Mobile Devices

i. Contractors shall provide devices to enable services, hereafter called “service enabling devices” or SEDS. Unless otherwise requested or agreed upon within this RFQ, Contractors will utilize current version devices or devices that are no more than one generation behind the most current version as SEDs. All SEDs shall be new except where this task order specifically states otherwise.

a. At a minimum, the Contractor’s offerings of SEDs shall include the following

b. A choice of two smartphones (2 iOS,) no more than one generation behind most current version

c. A choice of two tablets (iOS) no more than one generation behind most current version

d. At least two Wireless broadband SED (e.g., AirCards, mobile Wi-Fi hotspots, or MiFi)

b. Service Plans

i. The Contractor shall offer service plans to government agencies that provide their own Government Furnished Equipment (GFE) devices that are compatible with the Contractor's network technology.

ii. Voice plans include voice calling and text messaging.

iii. Data service plans added to voice service plans are defined as data add-on service plans. Data may include emails, Internet access, video, Multimedia Messaging Service (MMS), and other data.

iv. Data only service plans shall include emails, Internet access, video, MMS, and other data transport not combined with voice service plans.

c. No Additional Charge Items

i. Third-party direct billing, where the wireless service provider is billing for charges not covered by this task order, is not allowed.

d. Warranty and Replacement

i. Device replacements may not be made with refurbished hardware.

e. Device Refresh

i. The Contractor shall offer refresh SEDs after no more than 18 months of activation. An Ordering Entity may refresh SEDs upon request, with the device options and obligations of a new activation. For SEDs activated less than 18 months, the Contractor shall publish its method for determining the refresh price. At any time, when a device model is no longer supported with OEM OS updates, those devices will be decommissioned and replaced with technically supported devices by the Contractor as part of the standard refresh service.

f. Business Portal

i. At no additional charge, the Contractor shall provide account access to their carrier portal to obtain account level information.

g. Billing

i. Billing shall be prorated daily for the billing period and include both activated units and emergency units. The contractor must invoice the government monthly.

h. Agency Billing Summary Report

i. The Contractor shall provide an electronic billing summary by account to the Agency office of the CIO and the Agency acquisition office each calendar month. Additionally, the Contractor shall provide the above to the Mobile Services Category Team Portal (https://tscportal.fas.gsa.gov/#/login) each calendar month (15th).

Vendors providing Account Billing Summary Report (ABSR) reporting for Wireless Carrier Services will be required to submit reporting in accordance with the following data elements:

i. Billing Fraud or Excessive Usage

The Contractor shall electronically notify impacted agencies by the next business day if potential fraud or excessive usage is identified.

j. Device Recycling and Disposal

Due to the sustainability initiatives within the Government, Contractors shall administer a device recycling and disposal process and identify if it meets the security specifications below. This includes whether the Contractor will accept devices from other Contractors or carriers. The Contractor shall propose the method that they will use to determine the amount that they will pay and how they will communicate the payment amount for used devices (if available). A device recycling and disposal process shall include a process, in accordance with NIST SP80024 Guidelines on Cell Phone and PDA Security §3.1.1 and §4.1.4 and NIST SP800-88 Guidelines for Media Sanitization, for completely erasing the memory of a device by completely overwriting it or expunging all data to keep the contents from being recovered and analyzed. A device recycling and disposal process must demonstrate that all facilities engaged in device dismantling and recycling have been certified by an accredited, independent third-party auditor that they meet specific standards to safely recycle and manage electronics. The two standards recognized in this procurement are the Responsible Recycling (R2) Practices and the e-Stewards Standard.

If a device recycling and disposal process is provided, the Contractor shall maintain an auditable record of each item’s final disposition status and deliver monthly disposition reports to each ordering Entity that enables each organization to meet the personal property management reporting requirements of Title 40 of United States Code and the Federal Management Regulation (41 CFR chapter 102). The disposition report should include the following:

i. IMEI/ ESN

ii. Model Number

iii. Asset Tag Number

iv. Service Status

v. Wipe Date

vi. Disposition Status (reused, recycled)

vii. Location (not applicable if device is destroyed)

k. Network Problem Reporting

In the event of a major outage, the Contractor shall notify the Agency when it occurs and keep the Agency advised regarding the status of the outage through its resolution.

l. System Security Requirements

If the Contractor becomes aware of any unauthorized access to an agency’s Confidential Information or a security breach that compromises or reasonably could compromise an agency’s Confidential Information (an “incident”), the Contractor shall take appropriate immediate actions to contain the incident, in accordance with applicable law, and notify the impacted Agency as soon as reasonably possible. The Contractor shall provide the Agency with information regarding any incident as may be reasonably requested by the Agency and that is in the Contractor’s possession, custody, or control at the time a request is received. Upon request of Agency, the Contractor will reasonably cooperate with the Agency to investigate the nature and scope of any incident and to take appropriate actions to investigate and otherwise respond to the incident or associated risks. (As used in this Section, “compromise” means that the information has been exposed to any unauthorized access, inadvertent disclosure, known misuse, or known loss, alteration or destruction of Confidential Information other than as required to provide the services.)

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

52.217-8 Option to Extend Services NOV 1999

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor one month prior to task order expiration.

The prices for the services, lines, data, equipment, and any other charges to be extended under this clause are those in effect for year five of the task order and their prices have been evaluated at the time of award.

52.217-9 Option to Extend the Term of the Contract MAR 2000

(a) The Government may extend the term of this contract by written notice to the Contractor at least 30 days prior to the end of the current period of performance; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 66 months (this includes 52.217-8).

- Invoice Processing Platform (IPP).

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts.
