PWS 1.0 Background on the Government’s Requirement
The Dixie Fire of 2021 became the single largest wildfire in California state history. The wildfire burned a total of 963,309 acres and destroyed 1,329 structures, including several communities, across the counties of Butte, Plumas, Lassen, Shasta, and Tehama. A 40-acre BLM managed parcel near the Chester Airport in Chester, California (Plumas County) was impacted by the wildfire, which burned approximately 27 acres and left little remaining vegetation on site. On the remaining 6 acres approximately of unburned timbered land, the stand density is high leading to competition-induced stress and tree mortality, as well as hazardous fuel loading on this parcel adjacent to private residences and within the Wildland Urban Interface (WUI). The goal of this project is to reduce hazardous fuel continuity adjacent to the wildland urban interface, as well as reduce stand densities adjacent to homes to improve tree vigor.
PWS 2.0 General Scope of Work
The general scope of work to be performed includes forest management activities and hazardous fuel reduction related work.
Services required include:
• Commercially thin a ponderosa and Jeffrey pine stand to a target residual basal area of between 60 and 80 square feet per acre on six (6) acres.
• Mastication of standing dead trees and downed dead woody debris on 27 acres. Note, the area designated for mastication is currently designated as a fuelwood collection area to remove accumulated fuels on the forest floor. Remaining dead standing trees and material left on site shall be masticated.
Place of Performance:
Project Location Legal: T28N R7E, NW ¼ of the NW ¼ of Section 17
Directions: From Highway 36/Main Street in Chester, California, Plumas County, go east on Chester Airport Road for approximately 1 mile until you reach unit boundary. Additionally, project area can be accessed by heading south for approximately 1.5 miles on 1st Ave from Highway 36/Main Street in Chester until you reach unit boundary.
Unit Designation: Georeferenced PDF maps will be provided after contract is awarded that include unit boundaries and important features (archeological sites, exclusion areas, etc.)
Period of Performance: The period of performance shall be for two (2) years beginning on October 1st, 2026 (or date of award) and concluding on September 30th, 2028. The Period of Performance reads as follows:
October 1st, 2026 (or date of award) and concluding on September 30th, 2028
PWS Page 3
PWS 3.0 Overall Objective(s)
The objective of this work is to remove live trees using mechanical equipment and remove from the site for utilization on six (6) acres, as well as masticate standing dead and downed woody debris on 27 acres as identified in the project area. The goal would be to reduce standing live tree density to between 60 and 80 square feet of basal area/ acre to improve forest health, as well as address hazardous fuel related concerns adjacent to the WUI.
PWS 4.0 Specific Tasks
Task 1: Item/Service Activity #0001 Commercial thinning through Designation by Prescription (6 acres): The target residual basal area is to be between 60 and 80 square feet per acre within the identified area. The largest, healthiest, and best formed trees shall be selected as leave trees. Characteristics used in the selection of leave trees include the following:
• Has no apparent damage to the main bole
• Is not chlorotic (has good color)
• Demonstrates good vigor and is disease free
• Has at least 35-40% live crown
• Crown class is dominant or codominant.
• Vigorous annual terminal growth
All trees designated for removal will be harvested using traditional ground-based systems and removed from site. Trees designated for removal will be removed between 11 and 25 inches in diameter measured at breast height (DBH). Trees that fall below 11 inches and above 25 inches shall be protected from damage as much as possible during harvesting operations. All stumps must be 12 inches or less in height, measured from the uphill side.
Task 2: Item/Service Activity #0002 Biomass removal (6 acres): All limbs, tops, and other materials generated during harvesting operations shall be chipped as biomass and removed from the project site. Remaining material that cannot be utilized for biomass will be piled in or near the designated landing area to be burned at a later time (burning not incorporated in this contract). Additionally, debris generated from harvesting within the unit shall be lopped-and-scattered to a height of less than 18 inches.
Piling specifications:
• Pile(s) will be compact, free of interior open spaces, and free of dirt and/or other non-combustibles
• Pile(s) will be constructed in an open area and a minimum of 20 feet away from any leave tree, fence line, roadway, and unit boundary.
• Pile(s) dimensions: Half-sphere shaped, maximum 20 feet wide by 6 feet tall
Task 3: Item/Service Activity #0003 Mastication of standing dead and downed woody debris (27 acres). Standing dead and downed woody debris up to 12 inches DBH will be masticated. Residual slash or chip bed depth should be less than four (4) inches deep. Mastication will also include treatment of dead and downed woody material present prior to treatment. All woody debris that is not in contact with the ground (e.g., suspended/propped up by limbs) should be masticated up to the woody material diameter that the equipment allows. Additionally, protect residual trees and regeneration where possible during operations.
PWS Page 4
Mitigation Measures, Restrictions, and Special Provisions:
The Contractor shall comply with the following requirements common to all tasks unless otherwise authorized in writing.
General Operations
1. The contract may be terminated by the Authorized Officer upon determination that the operations of the contractor are or may cause significant environmental damage. It may also be terminated if non-compliance is found of laws and regulations intended to protect the environment or natural resources, as well as any inconsistencies with appropriate land use plans. Upon such determination, the Authorized Officer has the discretion to order an immediate suspension of the operations under this contract.
Logging
1. Before beginning operations on the Contract Area for the first time or after a shutdown of ten (10) or more days, the Contractor shall notify the COR in writing of the day they plan to begin operations. The Contractor shall also notify the COR in writing, email acceptable, if they intend to cease operations for any period of ten (10) or more days.
2. Prior to the commencement of operations, the Contractor shall obtain from the COR written approval of a basic Operation Plan commensurate with the terms and conditions of the contract which shall include how the work will be performed and protection of existing improvements. A pre-work conference between the Contractor’s authorized representative and the COR must be held at a location and time designated by the COR.
All logging shall be done in accordance with the plan developed by this provision.
3. During logging operations, the Contractor shall keep roads where they pass through the
Contract Area clear of trees, rock, dirt, and other debris so far as is practicable. The roads shall not be blocked by such operations for more than thirty
4. (30) minutes unless otherwise approved by the COR.
5. All trees designated for cutting may be manually or mechanically felled using a feller-processor or feller-buncher with the approval of the COR and in accordance with the following specifications:
6. Mechanized felling and skidding operations shall generally be limited to slopes of fifty

Operations may resume at the discovery site upon receipt of written instructions and authorization by the
COR.
4. The Contractor shall immediately discontinue specified construction or timber harvesting operations upon written notice from the Contracting Officer that:
a. Threatened or endangered plants or animals protected under the Endangered Species
Act of 1973, as amended, may be affected by the operation, and a determination is made that consultation or re-initiation of consultation is required concerning the species prior to continuing operation, or;
b. Federal proposed, federal candidate, Bureau sensitive or State listed species protected under BLM Manual 6840 - Special Status Species Management - have been identified, and a determination is made that continued operations would affect the species or its habitat, or;
c. When, in order to comply with a court order, which enjoins operations on the sale or otherwise requires the Bureau of Land Management to suspend operations, or;
d. When, in order to comply with a court order, the Contracting Officer determines it may be necessary to modify or terminate the contract, or;
e. Species have been discovered which were identified for protection in accordance with management direction established in the Record of Decision (ROD) and Resource Management Plan (RMP), and the Contracting Officer determines that continued operations would affect the species or its habitat, or;
f. When, in order to protect species which were identified for protection in accordance with management direction established in the ROD and RMP, the Contracting Officer determines it may be necessary to modify or terminate the contract.
5. The Contracting Officer may determine that it is necessary to modify the contract or terminate the cutting and removal rights under the contract in order to comply with the Endangered Species Act, prevent incidental take of California spotted owls in accordance with the ROD and RMP, protect species that have been discovered which were identified for protection in accordance with management direction established in the ROD and
PWS Page 7
RMP, or comply with a court order. Following the issuance of a written notice that cutting and removal rights will be terminated, the Contractor will be permitted to remove timber cut under the contract, if allowed by the Endangered Species Act.
6. In the event the contract is modified or cutting, and removal rights are terminated under this subsection, the Contractor agrees that the liability of the United States shall be limited to the actual costs incurred by the Contractor which have not been amortized by timber removed from the Contract Area. This calculation of liability shall utilize actual Contractor costs and Government estimates of timber volumes. At the COR's request, the Contractor agrees to provide documentation of the actual costs incurred in the performance of the contract. In addition, the Contractor shall be released from the obligation to pay the contract price for any timber which is not authorized to be removed from the Contract Area.
7. The Contractor specifically and expressly waives any right to claim damages, other than those described in the preceding paragraphs, based on an alleged breach of any duty to the Contractor, whether express or implied, regarding the manner in which the Government defended the litigation which resulted in the court order affecting the operation of the contract. This waiver also extends to any claims based on effects on the operation of the contract that arise from litigation against another agency. Furthermore, the Contractor specifically acknowledges and agrees that a court ruling that the Government violated the Administrative Procedures Act cannot be interpreted to mean that the Government had not acted reasonably in regard to its duties to the Contractor under this contract.
Fire Prevention and Control If the Contracting Officer Representative (COR) allows the Contractor to continue work during periods of declared fire danger or season, the Contractor shall comply with all applicable state laws relating to fire prevention and with all special conditions of work as directed by the COR.
1. Primarily for purposes of fire prevention and control, the Contractor shall, prior to the operation of power-driven equipment in construction or logging operations under this contract during the closed fire season or periods of fire danger, prepare a fire prevention and control plan to the satisfaction of the COR.
2. The COR may stop all or part of the logging operations of the Contractor during especially hazardous fire weather. This stoppage may be made prior to the time that the State of California and/or the U.S. Forest Service might require stoppage of logging operations.
3. During periods of fire danger, smoking shall be permitted only in such portions of the landing as are free of flammable material.
