STATEMENT OF WORK

INTRODUCTION:

The U.S. Geological Survey (USGS), Western Ecological Research Center is in need of a boat charter in the spring of 2026 and in the fall of 2026. The research involves the long-term monitoring of the near shore ecosystem in the waters around San Nicolas Island, California (SNI). The work consists of a six-day boat charter in support of USGS research at SNI to be scheduled between April - June 2026 and another identical boat charter between September to November 2026. Exact scheduling of the trips will be worked out between the vessel operator and chief scientist.

WORK REQUIREMENTS:

The trip will depart early morning on the first day of the charter or the evening before, from the vessel’s port so that arrival will be 0800 at San Nicolas Island. Several long-term monitoring sites will be visited where USGS scientists will conduct survey work using scuba equipment. The scientists will also be using air or battery powered drills to install marking hardware on the sea floor at depths of approximately 50’. Navigation to GPS coordinates for the sites is required. Setting anchor in close proximity to the GPS coordinates is required. A scuba compressor is required to be on board the vessel, with scuba tanks filled as needed. Departure from SNI area is scheduled for afternoon of the sixth day, to return to the vessel’s port but may occur earlier if work is completed.

CHARTER VESSEL MUST MEET THE FOLLOWING REQUIREMENTS:

1. The vessel shall be fully licensed by the U.S. Coast Guard as required by law and shall have passed all appropriate U.S Coast Guard requirements for safety and seaworthiness.

2. The vessel shall be equipped with radar, depth sounder, EPIRB, VHF radios, safety equipment, first aid kit, oxygen kit, current nautical charts, and GPS navigation.

3. Any mechanical breakdowns in excess of 24 hours that cause rescheduling of the USGS operational schedule shall require the contractor to deduct operational costs (daily contract rate) for that period of time from their final invoice.

4. The vessel must be capable of operating up to 90 miles offshore.

5. The vessel must provide adequate berthing quarters for 10 biologists.

6. Berthing area(s) shall be separate from the galley, wheelhouse, and deck areas.

7. Three meals per day shall be provided for the biologists. The intended work will require some flexibility in meal times and provision of snack food throughout the day. Breakfast and lunch may be either hot or cold meals, but dinner must be a hot meal. Meals must be well balanced, nutritious, palatable and varied. If special dietary needs (e.g., lactose free, low-sodium, vegetarian, diabetic, etc.) are required, USGS will notify the contractor at least 7 days prior to scheduled departure of the nature and number of special dietary requirements.

8. The vessel must be capable of providing occasional hot showers for each science crew member.

9. The vessel shall carry enough fuel, potable water, and food sufficient for up to 6 days at sea without a port call.

10. The vessel must have an air compressor in good working order appropriate for filling scuba cylinders with air.

Membrane produced Nitrox preferred but not required.

11. The vessel must provide 12 cylinders, 100 cubic foot cylinders preferred but not required. If the vessel’s compressor cannot accommodate filling cylinders within the surface interval between dives, more cylinders will be required.

12. Staffing, including a Captain, possessing a U.S. Coast Guard License appropriate to the size of Vessel.

13. Appropriate staffing to provide a “bubble-watcher” during dive operations that is equipped to respond to a diver emergency.

14. A piloted chase boat that can be deployed quickly to respond to a diver in distress.

VESSEL OPERATIONAL SPECIFICATIONS TO BE PROVIDED TO USGS:

Information shall be provided with quote:

1. Name and detailed description of the vessel to be used under this contract.

2. Name, proof of U.S Coast Guard license, and description of experience of the captain.

3. Safety documentation supporting successful completion of Vessel Safety Exam conducted by the U.S. Coast Guard.

PLACE OF PERFORMANCE

The Pacific Ocean off the southern California Coast between the mainland and San Nicolas Island, CA.

PERIOD OF PERFORMANCE:

A six-day period that will take place during April-June 2026, scheduled by the chief scientist and an option for another six-day period, boat charter in fall 2026 with the same work requirements and specifications.

GOVERNMENT FURNISHED PROPERTY:

Proof of insurance shall be provided after contract award before the period of performance:

Contract vessel shall have marine and general public liability insurance with limits of liability for:

1. Bodily Injury of not less than $100,000 for each person and $500,000 for each occurrence.

2. Property damage of not less than $100,000 for each incident and $500,000 in aggregate.

BACKGROUND:

The Department of the Interior has been monitoring several permanent subtidal sites around SNI since 1980.

Currently USGS regularly monitors four sites and opportunistically samples the “legacy site” (See map).

The sites are in depths of about 35–50 feet a quarter mile or more from shore. They are being sampled with the permission and cooperation of the US Navy.

Sites are located by dropping a buoy on GPS coordinates and diving in the vicinity to locate marker bolts. After locating the site, divers run meter tapes from fixed points to count benthic kelp and invertebrates, count bottom and mid-water fish, measure cover of sessile invertebrates and macroalgae, and measure samples of sea urchins. Some replacement of marker bolts by means of small power drills and marine epoxy may occur if time and conditions permit.

It usually takes all day to sample each of the four regular sites (four to five dives plus surface intervals) and half that to do the legacy site.

Electronic Invoicing and Payment Requirements - Internet Payment Platform (IPP) (February 2021) Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of St. Louis (FRBSTL) within 3 - 5 business days of the contract award date. If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

GS0231 Technical Liaison - Technical Clarification (December 2024)

a) The performance required herein shall be subject to the technical clarification of the Technical Liaison (TL) as identified below. As used herein, "technical clarification" is defined as communication to help the contractor fully understand the requirements.

(b) The Technical Liaison is not delegated any Contracting Officer’s Representative responsibilities.

(c) The Technical Liaison may not modify the requirements in any way. All modifications must be authorized by the Contracting Officer.

(d) The contractor shall immediately notify the Contracting Officer, in writing, if they believe the Technical Liaison is directing work outside the requirements of this contract. The contractor may not be reimbursed for any work outside the requirements of this contract.

GS1131 Unilateral Deobligation of Unexpended Funds (May 2013) The contractor shall submit all invoices under the award no later than 90 calendar days after the period of performance has expired, unless a request for extension has been submitted to the Contracting Officer. After 120 days has passed since the expiration of the performance period, the government reserves the right to issue a unilateral modification deobligating any unexpended funds, and to initiate closeout procedures.

GS1338 Notice to the Government of Delays (July 2001) In the event the contractor encounters difficulty in meeting performance requirements, or when it anticipates difficulty in complying with the contract delivery schedule or date, or whenever the contractor has knowledge that any actual or potential situation is delaying or threatens to delay the timely performance of this contract, the contractor shall immediately notify the contracting officer and the COR (if one has been designated), in writing, giving pertinent details. This data shall be informational only in character. Notice under this provision shall not be construed as a waiver by the Government of any delivery schedule or date or of any rights or remedies provided by law or under this contract.

GS1364 Nonpersonal Services and Supervision of Contractor’s Employees (September 2017) This contract is a “nonpersonal services contract” as defined in FAR 37.101. It is therefore, understood and agreed that the contractor and/or the contractor’s employees:

Shall perform the services specified herein as independent contractors, not as employees of the government;

Shall request clarification in writing from the Contracting Officer if the Contractor finds it necessary with respect to the scope of services to be performed or the manner in which the services are to be performed hereunder.

Shall be responsible for their own management and administration of the work required and bear sole responsibility for complying with any and all technical, schedule, or financial requirements or constraints attendant to the performance of this contract;

Shall be free from supervision, direction or control by any government employee with respect to the manner or method of performance of the services specified; but shall comply with such general direction of the Contracting Officer (or the duly authorized representative) pursuant to the government’s right and obligation to inspect, accept or reject the work as is necessary to ensure accomplishment of the contract objectives.

Shall not be at any time during the contract period employees of the U.S. Government.

The contractor's employees and subcontractors must make clear, in dealings with the public, federal employees, or other contractors that they are not federal employees. To minimize possible confusion, contractors and subcontractors are not permitted to wear clothing or other items (apart from official identity credential) bearing the name, logo, or seal of the U.S.

Geological Survey while performing work under this contract.

DIAR 1428.301 Liability Insurance – Department of the Interior (JUL 1996)

a) The Contractor shall procure and maintain during the term of this contract and any extension thereof liability insurance in form satisfactory to the Contracting Officer by an insurance company which is acceptable to the Contracting Officer. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

FAR 52.217-9 Option to Extend the Term of the Contract (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 10 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.
