SALIENT CHARACTERISTICS FOR BRAND NAME OR EQUAL TO MICROMILL 2

The USGS, G3 Science Center in Lakewood, CO, supporting GEMMA, operates a New Wave Research computer guided micro-sampling instrument located in the sample prep lab, Room 2453, Building 95, Denver Federal Center. This current instrument and its computer were purchased in 1999 and are used to drill out sample powders from precise locations (micron-scale) of rocks, minerals, ore deposits, and fossils for stable and radiogenic isotope analyses. This instrument is over 25 years old and unfortunately loses the use of its camera for hours at a time, rendering the instrument useless during these frequent down periods. It is only a matter of time before the camera fails permanently. New Wave Research has since gone out of business and the instrument cannot be serviced. To support the research goals of many USGS scientists across multiple science centers, and visiting scientists from around the world, we are seeking to purchase a MicroMill2 from Elemental Scientific Lasers. This purchase would bring the sampling instrument, computer, and software a much needed 25-year update.

Several G3 projects involving over a dozen of our staff have a stake in seeing this vital research component replaced. The MicroMill2 will fill the needs of a broad range of USGS scientists and visitors, as it has done for the last 25 years, by obtaining powders for stable and radiogenic isotope studies. Two example projects include, “Applying New MRP Ore System Research to Enhance Mineral Assessments of Sedimentary Basins: Cutting-edge Research to Real-world Application,” which involve nine G3 researchers. And a second project, “Global Syn-Sed-Min Targeting” (CMMI) involves the collaborative efforts with international partners in the Geological Survey of Canada and Geoscience Australia. The work on both projects also supports several graduate and postdoc students in the US, Europe, Canada, and Australia. Replacement of the MicroMill2 is fundamental to sustaining this important research which supports a multitude of end users.

Specifications

1. ESL’s proprietary ActiveView2 application software (USGS SWAM approved), which includes ESL’s workflow concept, enabling users to import images from other sources directly into live experiments, to utilize the unique layer management feature for image overlay and alignment and to continuously place new scans during active drilling runs.

2. Submicron sample motion control with 50mm total range in X, Y and Z. Stage travel is optionally expandable to 100mm in X and Y.

3. A 5MP, USB3 high resolution camera with a 10mm full field of view, optical resolution down to

5.5 microns and digital zoom down to 0.3mm field of view. The camera, coupled with ActiveView2 enables seamless digital mosaic mapping of samples.

4. An included HEPA filtered enclosure for minimal environmental contamination of the drilled sample.

5. LED sample lighting, both flood and transmitted.

6. Software-controlled rotating cross polarizer.

7. Variable drill speed from 0-50,000 rpm (software controlled).

8. Angled drilling from 0-22.5°.

9. Variable bit shank diameter of 1/8” or 3/32”.

(a) Definitions. As used in this clause—

Program participation means membership or participation in, or access or admission to: training, mentoring, or leadership development programs; educational opportunities; clubs; associations; or similar opportunities that are sponsored or established by the contractor or subcontractor.

Racially discriminatory diversity, equity, and inclusion (DEI) activities means disparate treatment based on race or ethnicity in the recruitment, employment (e.g., hiring, promotions), contracting (e.g., vendor agreements), program participation, or allocation or deployment of an entity's resources.

(b) In connection with the performance of work under this contract, the Contractor agrees as follows:

(1) The Contractor will not engage in any racially discriminatory DEI activities;

(2) The Contractor will furnish all information and reports, including providing access to books, records, and accounts, as required by the Contracting Officer, for purposes of ascertaining compliance with this clause;

(3) In the event of the Contractor's or a subcontractor's noncompliance with this clause, this contract may be canceled, terminated, or suspended in whole or in part, and the Contractor or subcontractor may be declared ineligible for further Government contracts;

(4) The Contractor will report any subcontractor's known or reasonably knowable conduct that may violate this clause to the Contracting Officer and take any appropriate remedial actions directed by the Contracting Officer; and

(5) The Contractor will inform the Contracting Officer if a subcontractor sues the Contractor and the suit puts at issue, in any way, the validity of this clause.

(6) The Contractor recognizes that compliance with the requirements of this clause are material to the Government's payment decisions for purposes of 31 U.S.C. 3729(b)(4).

(c) The Contractor must include the substance of this clause, including this paragraph (c), in subcontracts at any tier, including those for commercial products and commercial services, except those where the place of delivery or performance is outside the United States.

(d) Comptroller General Examination of Record. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

The performance required herein shall be subject to the technical direction of the Technical Liaison (TL) as identified below. As used herein, "technical direction" is defined as direction to the contractor that fills in details, suggests possible lines of approach, or otherwise supplements the scope of the work set forth herein and shall not constitute a new assignment, and does not supersede or modify any article or clause of this contract.

(b) The Technical Liaison is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government. Only a warranted Contracting Officer is authorized to obligate funds on this or any other contract action.

(c) The contractor shall immediately notify the Contracting Officer in writing if the Technical Liaison has taken an action (or fails to take action) or issues direction (written or oral) that the contractor considers to exceed the above limitations.

GS1131 Unilateral De-obligation of Unexpended Funds. (MAY 2013)

The contractor shall submit all invoices under the award no later than 90 calendar days after the period of performance has expired, unless a request for extension has been submitted to the Contracting Officer.

After 120 days has passed since the expiration of the performance period, the government reserves the right to issue a unilateral modification deobligating any unexpended funds, and to initiate closeout procedures.

GS1338 Notice to the Government of Delays. (JUL 2001)

In the event the contractor encounters difficulty in meeting performance requirements, or when it anticipates difficulty in complying with the contract delivery schedule or date, or whenever the contractor has knowledge that any actual or potential situation is delaying or threatens to delay the timely performance of this contract, the contractor shall immediately notify the contracting officer and the COR (if one has been designated), in writing, giving pertinent details. This data shall be informational only in character. Notice under this provision shall not be construed as a waiver by the Government of any delivery schedule or date or of any rights or remedies provided by law or under this contract.

DOI Electronic Invoicing and Payment Requirements – Invoice Processing Platform (IPP) (APR 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP). "Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is:

https://www.ipp.gov. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

A copy of the Contractor's internally generated invoice payroll statement shall be submitted with each invoice and must receive prior approval from the COR/TL and CO. Final invoice must also include a Release of Claims Form DI-137.

The Contractor must use the IPP website to register, access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131. If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.
