I. GENERAL INFORMATION
A. Introduction: The purpose of this Statement of Work (SOW) is to acquire appropriately sized bighead carp (Hypophthalmichthys nobilis) for upcoming studies in outdoor ponds. Carp must be grown to a minimum of 18” and in good condition free from pathogens before pickup or delivery to
UMESC.
B. Background: The USGS Upper Midwest Environmental Sciences Center (UMESC) conducts research on invasive carp control techniques. Research requires the use of live invasive carps for experimental procedures. The purpose of this SOW is to acquire appropriately sized invasive carps for upcoming studies in outdoor ponds.
C. Definitions: NA D. SCOPE: The Upper Midwest Environmental Sciences Center (UMESC) and various collaborators are working to develop methods to control invasive carps. To complete critical research UMESC and various cooperators have a need for high quality test specimens. The ability to obtain high-quality, disease-free fish test specimens has been extremely limited due to various federal and state restrictions regarding possession and transportation of these animals. The UMESC, a Department of Interior / US Geological Survey facility, has the ability to obtain state and federal permits to possess and transport invasive carp for research needs. The UMESC will assure that all cooperators involve are properly permitted and have the authority to possess and transfer invasive carp.
II. WORK REQUIREMENTS
A. Technical Requirements:
• Fish shall be available no later than April 2024.
• UMESC shall be notified not less than 7 days in advance of pond harvest.
• UMESC and/or authorized collaborators shall have access to the fish immediately after harvest and disease certifications completed.
• Fish shall be tested for the presence of viral pathogens that cause:
o Viral hemorrhage Septicemia (VHS) o spring viremia of carp (SVC) o infectious pancreatic necrosis (IPN)
• Fish species shall not be co-mingled.
• Disease testing shall be conducted according to AFS blue book (American Fisheries Society, Fish
Health Section Blue Book, 2010 edition, suggested procedures for the detection and identification of certain finfish and shellfish pathogens) standards by a laboratory experienced and authorized to issue fish health certificates.
• Each fish lot must test negative for the listed viruses to be accepted for payment (except as noted below).
• Fish shall be raised by the producer in the following length increments and numbers: 18+” total length.
• The producer must notify UMESC at least 2 weeks prior to fish attaining the desired size range to allow UMESC to schedule receipt and transfer from the producer location to UMESC or cooperator destination. UMESC/USGS will be responsible to transfer the fish from the production site to the UMESC Invasive Species Complex or cooperating facility.
• Fish shall be in visually good health with no external lesions, sores, necrotic gills, fin erosion, fungus or clinical signs of external parasites (Ichthyophthirius multifilis [ich] spots, flashing behavior, etc) prior to acceptance by UMESC on the date of transfer.

• The producer is responsible for compliance with all applicable laws and regulations to dispose or use any remaining fish produced.
• The producer is responsible for obtaining all necessary permits and compliance with all applicable laws and regulations to produce the animals for on-site pickup.
B. Deliverables
• A copy of a one-time independent laboratory fish health report shall be provided to UMESC prior to acceptance of the fish.
• 65 bighead carp 18+” shall be supplied
III. SUPPORTING INFORMATION

(a) Definitions. As used in this clause—
Covered application means the social networking service TikTok or any successor application or service developed or provided by ByteDance Limited or an entity owned by ByteDance Limited.
Information technology, as defined in 40 U.S.C. 11101(6)—
(1) Means any equipment or interconnected system or subsystem of equipment, used in the automatic acquisition, storage, analysis, evaluation, manipulation, management, movement, control, display, switching, interchange, transmission, or reception of data or information by the executive agency, if the equipment is used by http://www.acquisition.gov/

the executive agency directly or is used by a contractor under a contract with the executive agency that requires the use—
(i) Of that equipment; or
(ii) Of that equipment to a significant extent in the performance of a service or the furnishing of a product;
(2) Includes computers, ancillary equipment (including imaging peripherals, input, output, and storage devices necessary for security and surveillance), peripheral equipment designed to be controlled by the central processing unit of a computer, software, firmware and similar procedures, services (including support services), and related resources;
but
(3) Does not include any equipment acquired by a Federal contractor incidental to a Federal contract.
(b) Prohibition. Section 102 of Division R of the Consolidated Appropriations Act, 2023 (Pub. L. 117-328), the No TikTok on Government Devices Act, and its implementing guidance under Office of Management and Budget (OMB) Memorandum M-23-13, dated February 27, 2023, “No TikTok on Government Devices” Implementation Guidance, collectively prohibit the presence or use of a covered application on executive agency information technology, including certain equipment used by Federal contractors. The Contractor is prohibited from having or using a covered application on any information technology owned or managed by the Government, or on any information technology used or provided by the Contractor under this contract, including equipment provided by the Contractor’s employees; however, this prohibition does not apply if the Contracting Officer provides written notification to the Contractor that an exception has been granted in accordance with OMB Memorandum M-23-13.
(c) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (c), in all subcontracts, including subcontracts for the acquisition of commercial products or commercial services.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract.
If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.000S-5079 Technical Liaison - Technical Direction (Oct 1997)
(a) The performance required herein shall be subject to the technical direction of the Technical Liaison (TL) as identified below. As used herein, "technical direction" is defined as direction to the contractor that fills in details, suggests possible lines of approach, or otherwise supplements the scope of the work set forth herein and shall not constitute a new assignment, and does not supersede or modify any article or clause of this contract.
(b) The Technical Liaison is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government. Only a warranted
Contracting Officer is authorized to obligate funds on this or any other contract action.
(c) The contractor shall immediately notify the Contracting Officer in writing if the Technical
Liaison has taken an action (or fails to take action) or issues direction (written or oral) that the contractor considers to exceed the above limitations.
(d) The Technical Liaison assigned for this contract is: Will be provided at time of award.
(e) Only the Contracting Officer may designate a different Technical Liaison.

DOI ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS - INVOICE PROCESSING
PLATFORM (IPP) (APR 2013)
Payment requests must be submitted electronically through the U.S. Department of the Treasury's Internet Payment Platform System (IPP). "Payment requests" means any request for contract financing payment or invoicing payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions- Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:
The vendor shall upon invoicing through the internet payment platform, attach a copy of their regular vendor invoice by utilizing the attachments feature on the lower right-hand corner of the invoicing screen to substantiate requests for payment. The vendor invoice shall be readable in Microsoft Excel, Adobe Acrobat (.pdf) or Microsoft Word.
FAR 32.905(b) outlines a Proper Invoice to include:
1. Name & address of the Contractor.
2. Invoice date & number.
3. Contract number, contract line item number and, if applicable, the order number.
4. Description, quantity, unit of measure, unit price and extended price of the items delivered.
5. Shipping number and date of shipment including the bill of lading number and weight of shipment if shipped on
Government bill of lading.
6. Terms of any discount for prompt payment offered.
