Section B - CONTINUATION OF SOLICITATION/CONTRACT FORM B-1 Statement of Work
I. GENERAL INFORMATION
A. Introduction: The US Geological Survey (USGS) has a requirement for two (2) fully found and crewed vessel, with support equipment as specified, to use as a base for USGS geophysical surveys at Breton Island, within the Breton National Wildlife Refuge. The field work is required to fulfill required data collection for the National Resource Damage Assessment Deep Horizon Oil Spill Breton Island Restoration Monitoring Project.
B. Background: The US Geological Survey has been conducting repeat bathymetric surveys around Breton Island for a decade. The island is uninhabited and extremely remote. Lodging at the field site is necessary to successfully complete the investigation. Due to the shallow waters surrounding the island, small shallow-draft vessels are required for the bathymetric surveys. These vessels are not equipped to cross the large, unprotected areas of water necessary to return to a safe port on a daily basis. This requires services to be contracted with local vessels to provide dockage and lodging during operations since no USGS vessel meets the requirements of the projects.
C. Definitions: Operational Day Rate and Down Time
1. Operational (at sea) Rate: Operational rate shall be defined as that time during which the contractor's vessel and crew are available and fully capable of at-sea operation. The course, direction, and ship movement is at Government discretion with due consideration for ship safety as determined by the vessel's master. While at sea, weather time shall be defined as that time when the vessel is unavailable or unsuitable for operations due to inclement weather conditions. During weather time, vessel shall be considered operational unless it is required to leave the field site for safety concerns.
2. Down Time / Standby time: This category shall include the following element: Contractor's down time at sea/at port shall be defined as that period of time when the contractor's vessel and/or crew is not available for Government use and shall include contractor's in-port scheduled maintenance, repair of vessel and/or equipment, and waiting on weather, unless the weather was unusually severe, that would not count as down time. Substitution of a vessel by contractor shall be permitted only with the approval of the Government as to the substitute vessel's equivalent capabilities and endurance.
The Government will not pay for contractor down time.
D. Scope (state general purpose, objectives, magnitude).
Monitoring elevation change at Breton Island following island restoration is necessary to evaluate project performance and identify any corrective actions that may be needed. The project is part of the Deepwater Horizon Natural Resource Damage Assessment (NRDA) Monitoring Plan for the Louisiana Outer Coast Restoration Project. Elevation change is determined by comparing elevations over several time periods of both the island and surrounding seafloor. Elevation surveys were conducted in 2014 before island restoration, in 2022 immediately following restoration, and are to be conducted in 2024 to evaluate change in restoration acreage, shoreline position, and response of the submerged areas around the island. Sediment volumes and transport are also assessed from the measurements.
The U.S. Geological Survey, St. Petersburg Coastal and Marine Science Center is responsible for conducting the surveys.
The USGS uses 4 small vessels to conduct the operations: 7.5 m and 5 m vessels with outboard engines, and two personal watercraft. The vessels are equipped with state-of-the-art bathymetric acquisition systems, integrated with global positioning and navigation systems. Bathymetric data is collected over a series of days to create a comprehensive digital elevation model of the bathymetry surrounding Breton Island. The vessels operate on 12-hour schedules to minimize field time, reducing exposure to the elements. The 12-hour schedule is the maximum allowed for field operations. Due to the nature of marine field operations (sea state, weather, transit time, fueling), a 12-hour duration is expected to achieve 8-10 hours of actual data recording per day. The survey is estimated to acquire 340 line-km of data and will take 4-5 days to complete. The field team consists of 2 persons per outboard vessel as required by USGS boating regulations. Due to the exertion and exposure working on the two personal watercraft, a 4-person team rotates 6-hour operations per day. Two additional team members operate the GPS base stations, collect sediment samples, and process data.
Breton Island is located adjacent to the Mississippi River delta. The island is approximately 32 km from the nearest port of safety (Venice, Louisiana). A transit from the port of Venice to Breton Island takes about 1.5 to 2 hours, and includes navigating the Mississippi River, a distributary channel of the Mississippi River Delta (Main Pass), and 16 km of open water within Breton Sound. Vessel traffic, river and tidal currents, and submerged obstacles are common hazards encountered during transit. Only day-time travel during favorable weather conditions is possible for the two outboard vessels, and transit is not recommended at all for the personal watercraft. Fuel consumption during transit is also a factor since there are no facilities outside of Venice.
With these conditions, the only way to complete the mission is for the field team to overnight at the island. Breton Island is a wildlife refuge that contains nesting habitat for endangered pelicans. There is no existing shelter on the island, and camping is not permitted. Charter vessels are available to provide dockage for the vessels and shelter for the field team at night. The contracted live aboard charters are commercial vessels, the USGS does not operate any similar base for operations. The vessels have a Coast Guard mandated capacity of 6 clients per vessel, so two charter vessels are necessary for the 11-person field team. The vessels provide provisions, storage of equipment and fuel, and workspace for data processing and logistics.
Objective(s): To monitor the performance and evolution of island restoration at an important nesting site for endangered waterfowl, repeat bathymetric surveys around the island are conducted to measure elevation change. Due to the logistical difficulties of operating in the remote environment, the field work requires shallow draft vessels operating full-day surveys and remaining on site overnight. Lodging and dockage is available through live-aboard charter vessels. Anticipated period of performance is from August 4 to 11, 2024, departing and returning to port. The charter vessels lodge 5 - 6 personnel per vessel, provide meals and lodging, and storage for equipment and fuel. Approximately 200 - 250 gallons of fuel will be necessary to perform operations. The charter vessels will tow the survey vessels from port to the work site and back to port.
II. WORK REQUIREMENTS
A. Technical Requirements.
Work Specifications:
The US Geological Survey (USGS) has a requirement for two (2) fully found and crewed vessels, with support equipment as specified, to use as a base for the USGS research crews, requiring the vessels remain on site 24 hours a day on consecutive days at Breton Island, Louisiana. Vessels shall house 6 people each. USGS field team will be 10 - 11 people.
1. The contractor shall provide the fully found, crewed vessel and support equipment to enable the Government to conduct field surveys at the remote island. Time frame will be 24 hours a day for 8 days. The vessels will depart port on August 04, 2024, and return to port on August 11, 2024.
2. The contractor shall be responsible for all preparations and maintenance of the vessel and vessel equipment necessary to ensure safe and proper working conditions.
3. The contractor shall provide as a minimum crew, a captain experienced in shallow-water navigation within the Breton
Wildlife Refuge, other personnel as deemed necessary by the contractor and will possess all federally required permits.
4. Under this contract the Contractor is required to:
a. Provide a vessel conforming to all requirements described in this PWS.
b. Provide a crew to operate the vessel. All field work will be done by USGS personnel.
c. Provide lodging and meals for all USGS personnel on board. The number of USGS personnel on each vessel will be 5 -
6. Total number of USGS personnel will be eleven (11).
5. Ordering a vessel and crew for a research trip
Departure on August 4. If weather conditions reduce survey days the vessels may return to port on August 11, otherwise expected return date is August 10. The actual trip is anticipated to be 8/4/2024 - 8/11/2024, with flexibility in case trip needs to be rescheduled due to inclement weather.
6. Down/Standby Time
Down/Standby Time is defined at C.2. of the PWS. The Government will not pay for contractor down/standby time.
Down/Standby Time shall not exceed three (2) calendar days. If down time exceeds three (2) calendar days cumulatively the Government reserves the right to terminate this contract for cause.
7. Vessel Substitutions
The Contractor is permitted to use any vessel for research trips that meets or exceeds the specifications listed at II.B. of the PWS. Substitution of a vessel by contractor shall be permitted only if the substitute vessel¿s specifications meet or exceed the vessel specifications in this PWS as determined by the Technical Liaison. Any vessel substitutions that occur shall be at no additional cost to the Government.
8. The contractor shall be responsible for all preparations and maintenance of the vessel and vessel equipment necessary to ensure safe and proper working conditions for USGS scientists.
B. Vessel specifications:
The following specifications represent the minimum requirement for any prospective vessel:
a. Size: Length of 60 +/- 5 feet, draft of not more than 48 inches. Size represents the minimum requirement to remain in vicinity of field site to accomplish the research. Offers not satisfactorily meeting this requirement will be determined unacceptable.
b. Speed: Vessel shall be self-propelled twin engine diesel and have a transit speed of at least 10 knots.
c. Range: Vessel shall have a minimum range of 200 miles, in the event of extreme weather events such as hurricanes or tropical storms and navigation to a distant and safe location is required.
d. Power Generation: minimum of a 20-kw generator.
e. Towing capability: Vessel shall be capable of towing a 25-foot vessel with appropriate hooks and cable attachments.
f. Rafting Ability: Vessel shall be capable of having up to 3 skiffs (14 to 25 ft) tied up to main vessel with appropriate equipment.
g. The contractor shall be responsible for all preparations and maintenance of the vessel and vessel equipment necessary to ensure safe and proper working conditions, including fueling work vessels everyday
h. Crew: The vessel shall have a captain experienced in navigating the shallow waters of the Breton Wildlife Refuge.
Additional crew is at the contractor¿s discretion, i.e., if required for safe operation of the vessel.
i. Contractor Furnished equipment: The vessel shall have the following contractor furnished equipment:
1. Navigation and communication equipment, including GPS, satellite weather, VHF marine radio.
2. Anchoring abilities permitting vessel to anchor and remain within close proximity to sample site.
3. Freshwater rinse and deck space storage and deployment of equipment.
4. Refrigeration and ice machine.
j. Facilities:
1. Sleeping accommodations to sleep up to 12 USGS personnel (plus captain and crew) in air-conditioned cabin(s).
2. Storage area sufficient to store Rubbermaid bins, dry bags and assorted field supplies.
3. Indoor air-conditioned workspace of at least 100 square foot, including tabletop space to accommodate computer equipment.
4. Open back deck space of at least 100 square foot for work area.
5. The vessels must have a fully operational galley with mess supplies.
6. The vessels shall be equipped with the ability to hold up to 250 gallons of unleaded fuel, so that work vessels may be refueled on site daily.
k. Certifications: The contractor shall obtain and maintain in effect all necessary permits (except research permits), inspections, certifications, and insurance required by Federal Statue or local government, or subdivision thereof, or of any other duly constituted public authority.
C. Safety/Maintenance/Spare Parts Specifications:
a. Other equipment and Facilities: The vessel, equipment and facilities shall be in proper and safe working condition with normal and emergency equipment and services appropriate to the work and work areas. The contractor shall be responsible for maintaining equipment and facilities in a safe, operational condition and for developing adequate safety procedures.
b. Maintenance and Spare Parts: The contractor shall be responsible for all maintenance of the vessel and vessel equipment necessary to ensure proper working conditions. This includes an adequate supply of spare parts for the vessel and equipment to perform necessary maintenance and reduce to a minimum the down time chargeable to the vessel.
III. SUPPORTING INFORMATION
A. Area of Performance will be Breton Island, Breton Wildlife Refuge.
B. The contract period of performance will from 8/4-9/30/24. The actual trip is anticipated to be 8/4-8/11/24, with flexibility in case trip needs to be rescheduled due to inclement weather.

(a) The performance required herein shall be subject to the technical direction of the Technical Liaison (TL) as identified below. As used herein, "technical direction" is defined as direction to the contractor that fills in details, suggests possible lines of approach, or otherwise supplements the scope of the work set forth herein and shall not constitute a new assignment, and does not supersede or modify any article or clause of this contract.
(b) The Technical Liaison is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the
Disputes Clause;
(4) Terminate, for any reason, the contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government. Only a warranted Contracting Officer is authorized to obligate funds on this or any other contract action.
(c) The contractor shall immediately notify the Contracting Officer in writing if the Technical Liaison has taken an action (or fails to take action) or issues direction (written or oral) that the contractor considers to exceed the above limitations.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records - Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. C-5 52.247-34 F.o.b. Destination. (JAN 1991)
(a) The term f.o.b. destination, as used in this clause, means -
(1) Free of expense to the Government, on board the carrier's conveyance, at a specified delivery point where the consignee's facility (plant, warehouse, store, lot, or other location to which shipment can be made) is located; and
(2) Supplies shall be delivered to the destination consignee's wharf (if destination is a port city and supplies are for export), warehouse unloading platform, or receiving dock, at the expense of the Contractor. The Government shall not be liable for any delivery, storage, demurrage, accessorial, or other charges involved before the actual delivery (or "constructive placement" as defined in carrier tariffs) or the supplies to the destination, unless such charges are caused by an act or order of the Government acting in its contractual capacity. If rail carrier is used, supplies shall be delivered to the specified unloading platform of the consignee. If motor carrier (including "piggyback") is used, supplies shall be delivered to truck tailgate at the unloading platform of the consignee, except when the supplies delivered meet the requirements of Item 568 of the National Motor Freight Classification for "heavy or bulky freight." When supplies meeting the requirements of the referenced Item 568 are delivered, unloading (including movement to the tailgate) shall be performed by the consignee, with assistance from the truck driver, if requested. If the contractor uses rail carrier or freight forwarder for less than carload shipments, the contractor shall ensure that the carrier will furnish tailgate delivery, when required, if transfer to truck is required to complete delivery to consignee.
(b) The Contractor shall -
(1)(i) Pack and mark the shipment to comply with contract specifications; or
(ii) In the absence of specifications, prepare the shipment in conformance with carrier requirements;
(2) Prepare and distribute commercial bills of lading;
(3) Deliver the shipment in good order and condition to the point of delivery specified in the contract;
(4) Be responsible for any loss of and/or damage to the goods occurring before receipt of the shipment by the consignee at the delivery point specified in the contract;
(5) Furnish a delivery schedule and designate the mode of delivering carrier; and
(6) Pay and bear all charges to the specified point of delivery.

To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:
- Contractor generated invoice.
The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the
Federal Reserve Bank of St. Louis (FRBSTL) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email IPPCustomerSupport@fiscal.treasury.gov or phone (866) 973-3131.
If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

Section E - SOLICITATION PROVISIONS E-1 52.204-7 System for Award Management. (OCT 2018)
(a) Definitions. As used in this provision-
Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.
Registered in the System for Award Management (SAM) means that-
(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14) into SAM;
(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in SAM;
(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and
(4) The Government has marked the record "Active".
Unique entity identifier means a number or other identifier used to identify a specific commercial, nonprofit, or Government entity. See www.sam.gov for the designated entity for establishing unique entity identifiers.
(b)(1) An Offeror is required to be registered in SAM when submitting an offer or quotation, and shall continue to be registered until time of award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.
(2) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation "Unique Entity Identifier" followed by the unique entity identifier that identifies the Offeror's name and address exactly as stated in the offer. The Offeror also shall enter its EFT indicator, if applicable. The unique entity identifier will be used by the Contracting Officer to verify that the Offeror is registered in SAM.
(c) If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for establishment of the unique entity identifier directly to obtain one. The Offeror should be prepared to provide the following information:
(1) Company legal business name.
(2) Tradestyle, doing business, or other name by which your entity is commonly recognized.
(3) Company physical street address, city, state, and Zip Code.
(4) Company mailing address, city, state and Zip Code (if separate from physical).
(5) Company telephone number.
(6) Date the company was started.
(7) Number of employees at your location.
(8) Chief executive officer/key manager.
(9) Line of business (industry).
(10) Company headquarters name and address (reporting relationship within your entity).
(d) Processing time should be taken into consideration when registering. Offerors who are not registered in SAM should consider applying for registration immediately upon receipt of this solicitation. See https://www.sam.gov for information on registration.
