B.3.1. GENERAL INFORMATION

B.3.1.1. Introduction

USGS requires the use of contractor services. to: acquire privacy-protected conservation practice data from the United States Department of Agriculture Natural Resources Conservation Service (USDA-NRCS) and Farm Service Agency (USDA- FSA); process and aggregate conservation practice data to protect producer privacy; provide the aggregated data to Chesapeake Bay watershed jurisdictions in support of their annual reporting needs; and to provide expert insights to the USGS on use of the privacy-protected data for research.

Because it is the best interests of the U.S. Geological Survey for its personnel to become proficient in the procurement and aggregation of these data, the contractor will over the course of all years of the contract train qualified USGS scientists on methods used by the contractor to process the data.

B.3.1.2. Background

The Department of the Interior, United States Geological Survey, Maryland-Delaware-DC Water Science Center, Baltimore, MD (MDWSC), has worked collaboratively with Devereux Consulting, to help MDWSC analysts and other regional researchers acquire and analyze data on implementation of conservation practices (i.e. activities designed to mitigate the impacts of agriculture and urbanization on the region’s natural resources). Upon receiving those data, the contractor enters them into a proprietary database where they are formatted to meet federal privacy standards. The goal of this research is to understand the potential for implementation

B.3.1.3. Scope

USGS acquires all available BMP data from the USDA as described in the 1619 agreement.

These data are used to facilitate analysis of water quality trends and to help states in the Chesapeake Bay watershed determine implementation. This ongoing project has helped the states show implementation in the agricultural sector as part of progress toward meeting the 2010 Chesapeake Bay Total Maximum Daily Load for Nitrogen, Phosphorus and Sediment (Bay TMDL). The USDA data are annually acquired and delivered to the Chesapeake Bay states and have been so since 2012. Over the previous years that these data have been used by the USGS, the data handling process that affects the final dataset has been fine-tuned but has remained largely unchanged. Through the life of this activity, the data have been analyzed to determine changes over time.

B.3.2. WORK REQUIREMENTS

B.3.2.1. Technical Requirements

The consultant will work with the CBP (Chesapeake Bay Program) Partners and manage the annual progress Best Management Practice (BMP) implementation review. They will work concurrently with data from USDA-NRCS and USDA-FSA as it relates to the annual progress review, and also for analyses of conservation practice implementation impacts. Consultant will use the following skills to perform the data management and analysis that is needed to support this project:

• Ability to manage large datasets

• Familiarity with the CBP Partnership BMP data and database structures

• Familiarity with USDA-NRCS and USDA-FSA data management systems and the responsible staff

• Understanding of the relationships among agricultural conservation practices and water quality

• Knowledge about and experience with State and Federal conservation practices and data tracking in the Chesapeake Bay Watershed states (PA, VA, MD, DE, WV and NY)

• Establishing new and maintaining existing positive relationships with each of the technical contacts in the Chesapeake Bay jurisdictions

• Experience with maintaining privacy of USDA conservation data sets by strictly adhering to federal data privacy requirements

• Ability to meet deadlines with quick turnaround times, commonly only a few days.

• Graduate-level training in environmental science

• Experience facilitating discussion among state, federal and public stakeholders in the CBP's reporting structure, which includes use of the National Environmental Information Exchange Network (NEIEN) and the CBP Watershed Model/CAST.

• Experience and proven ability in negotiating data sharing and data handling agreements with the U.S. Department of Agriculture. This experience will require having contacts in appropriate USDA positions.

• Experience and proven ability to provide U.S. Geological Survey Chesapeake Bay studies with data and support that benefits USGS conservation practice impacts on the environment.

The selected consultant will manage the solicitation of data from USDA-NRCS and USDA- FSA, an activity that has been going on for more than six years. Upon receiving the USDA data, the consultant will create a database and apply computer code to remove duplicates and

140G0120Q0256 Page 8 of 34 format the data to meet federal privacy standards. This work will be done on a very tight timeline; in the past this work has needed to be completed in as little as 5 days. For project success, the consultant must understand and be able to relate the CBP BMP data to the USDA- NRCS and USDA-FSA conservation practice data, and to combine and format data that enables multiple analyses at varying geographic scales. The consultant must have working relationships with and knowledge of CBP, NRCS, and FSA data handling practices such that issues with the data sources can be quickly resolved.

B.3.2.2. Criteria for acceptance

• Crosswalk table meets the needs of the CBP and jurisdictions for understanding how NRCS practice names map to CBP practice names.

• Summary report contains information on the given year’s acquisition timeline and data sources, whether there were any changes in the data handling process that affected that year’s final dataset, any known quality control issues with the acquired data that could affect data interpretation, and the timeline and contents of data delivered to the six jurisdictions listed in the deliverable.

• Excel spreadsheets:

o Spreadsheets are consistently formatted so that the same categories of information are provided for each of the six relevant jurisdictions.

o Each Excel spreadsheet contains a “ReadMe” tab with brief descriptions of: the data included, the data source(s) including contact names and databases; the data aggregation process and how it affects reporting; the geographic coverage of included practices (i.e for all counties within the watershed and jurisdiction boundary); the timeframe of included practices; and information on overlap or reporting among datasets that could affect interpretation.

o Data are presented in spreadsheets in a logical and organized fashion.

B.3.2.3. Deliverables

• A separate Excel spreadsheet for each of the 6 Chesapeake Bay Watershed jurisdictions containing USDA conservation practices (Delaware, Maryland, New York, Pennsylvania, Virginia, West Virginia). Each spreadsheet should include the time series of processed NRCS and FSA conservation practice data for that state from 2007 to most recent year, along with a “ReadMe” tab documenting and explaining the contents of the spreadsheet.

• An updated crosswalk table of how each NRCS practice is reported to the CBP’s database of conservation practice names and associated land uses, with comments or suggestions for improvements as appropriate.

• A report summarizing that year’s data handling process and documenting any changes or improvements in the most recent USDA conservation practice datasets over previous years.

• Additional preparation of datasets and expert input on analysis to assess conservation impacts, as requested and as resources allow (ongoing, to end of option period).

• Expert support for USGS BMP data collection, organization, and analysis efforts.

B.3.3. TIMELINE FOR ANNUAL SUPPORT

B.3.3.1. Coordinate with CBP Partners to prepare updated crosswalk of how each NRCS practice is reported to the Chesapeake Bay Program’s database of conservation practice names and associated land uses and identify suggested improvements for progress. Completed by the end of November in the year of data acquisition.

B.3.3.2. Obtain best possible most recent conservation datasets in their native format from USDA- NRCS and USDA-FSA. Completed by the end of October in the year of data acquisition.

B.3.3.3. Process USDA conservation data as needed and deliver aggregated data to each jurisdiction for the jurisdiction’s submission to the annual NEIEN progress report; deliver unaggregated data to 1619 states as needed. Completed by: the end of November in the year of data acquisition.

B.3.3.4. Coordinate with jurisdictions and conservation district staff and resolve possible reporting errors in USDA dataset. Completed by the beginning of January after the data acquisition.

B.3.3.5. Supervise labeling and aggregation of USDA conservation data at county, HUC8, HUC12, Non-Tidal Network basins, and NHD+ watershed scale throughout the Chesapeake Bay Watershed to support USGS factors affecting change analysis. Completed by the end of January after the data acquisition.

B.3.5.1. Data Rights, Security/Privacy Issues

All data (original and processed) remain the under the sole ownership of the United States Government, U.S. Department of Agriculture. The data will be processed by the contractor and distributed only to USGS personnel and entities under contract or working under official written agreement with the USGS. All persons receiving the data shall sign and adhere to privacy terms described in the data sharing agreement.

B.3.5.2. Safety, Environment

All work performed under this agreement will be done by the contractor in their premises using their equipment. The USGS therefore has no safety or environmental concerns as all responsibilities for these falls on the contractor.

Contractor visits to Federal facilities shall be coordinated with federal employees. When contractor visits Federal facilities all applicable rules, regulations, and norms of behaviors will be followed.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the http://epa.gov/watersense/

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the

COR.

C.1. DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements - Internet Payment Platform (IPP) (September 2011)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Internet Payment Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice [CO to edit and include the documentation required under this contract]:

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

C.2. GS1131 Unilateral Deobligation of Unexpended Funds (MAY 2013)

The contractor shall submit all invoices under the award no later than 90 calendar days after the period of performance has expired, unless a request for extension has been submitted to the Contracting Officer. After 120 days has passed since the expiration of the performance period, the government reserves the right to issue a unilateral modification deobligating any unexpended funds, and to initiate closeout procedures.
