PERFORMANCE WORK STATEMENT (PWS)

Cape Fear River Lock and Dam #2 Fish Barrier Alternatives Analysis

Part 1

General Information

1. GENERAL: This is a non-personnel services contract to provide coordination and stakeholder engagement associated with fish passage alternatives at Lock and Dam #2 on the Cape Fear River in Bladen County, North Carolina.

1.1 Description of Services/Introduction: Cape Fear River Lock and Dam #2 is owned and operated by the U.S.

Army Corps of Engineers. The dam currently blocks the upstream migration of Atlantic sturgeon, striped bass, and American shad from reaching important spawning habitat upstream of the dam. Planning and design work with respect to the hydraulic / hydrologic / structural requirements for fish passage as well as an assessment of the full range of options for modifying or removing Lock and Dam 2 to improve the passage of sturgeon, striped bass and American shad so they can swim freely past the dam in an upstream direction without delay. The conceptual designs and analysis should be presented in a meeting with interested parties which include U.S Fish and Wildlife Service, National Marine Fisheries Service, NC Wildlife Resources Commission, NC Division of Marine Fisheries, US Army Corps of Engineers, Cape Fear River Watch, The Nature Conservancy, American Rivers and Bladen County in either an in-person or virtual format. The presentation power point and referenced reports should be made available to meeting participants at or shortly after the meeting.

1.2 1.2 Background: The fish target species include federally listed species (Atlantic sturgeon) and very important commercially and recreational fish (striped bass and American shad). The Cape Fear River is one of the major rivers in NC. The interest and scrutiny of this work will be at a very high level. This is a job for the very experienced (experience in dam alteration as well as dealing with state and federal agencies and the public on sensitive topics involving water supply and federally listed species). Considerable time will be at the field location and in discussion with stakeholders based on satisfying stakeholder interests.

1.3 Objectives: Overall objectives are data gathering to support fish passage alternatives analysis, development of fish passage alternatives (technical details and costs), and reporting (written and via presentation) to stakeholders.

This is a bid for planning and design work as well as an assessment of the full range of options for modifying or removing Cape Fear River Lock and Dam #2.

1.4 Scope:

Engagement and Project Advancement

1. The first phase of the work will include research and data collection. This phase will include research on existing assessments, flow, habitat, and other available environmental data. Field visits of Cape Fear Lock and Dam # 2 will be conducted to gather surveying and depth measurements in the impoundment and assess sediment deposits

2. All collected data will be analyzed and compiled to support the concept planning phase. Calculations will include flow and water level estimates that will be needed to support existing drinking water intakes (to plan for the continuing use of these intakes as part of fish passage design to satisfy all stakeholders). There may also be a need to consider boat navigation requirements depending on stakeholder interest.

3. The conceptual design phase will include compilation of the data collected into development of concept drawings to communicate possible fish passage scenarios for stakeholder consideration. The plans will include options for full removal, partial removal, and bypass or fish ladder type approaches. These plans will include stream restoration measures, sediment management ideas, and suggestions for water intake improvements. Several concepts will be developed to facilitate discussion of various options and configurations.

4. Finally, cost estimates will be prepared for each design option. The cost estimates will be suitable to add to the discussion and plan for future implementation. Findings will be presented to stakeholder group in either an in person meeting or a virtual meeting (whichever allows for the greatest stakeholder attendance).

Deliverables

1. Printed and electronic version of report that includes all data, calculations, concept plans, and cost estimates. Narrative plans, calculations, and drawings to demonstrate restoration design(s) which address the fish passage, upstream water use, sediment management, and post project appearance of one or more alternatives. The plans will include options for full removal, partial removal, and bypass or fish ladder type approaches.

2. Presentation (virtual or in person) delivered to the stakeholder team which includes US Fish and Wildlife Service, National Marine Fisheries Service, US Army Corps of Engineers, NC Wildlife Resources Commission, NC Division of Marine Fisheries, Cape Fear River Watch, The Nature Conservancy, American Rivers and Bladen County.

3. Report and presentation in a format that can be delivered to stakeholder group (attached pdf file for the report and as a power point presentation for the presentation).

All work should be of a degree of completeness that it supports anticipated next steps

Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

52.237-2 Protection of Government Buildings, Equipment, and Vegetation. (APR 1984)

The Contractor shall use reasonable care to avoid damaging existing buildings, equipment, and vegetation on the Government installation. If the Contractor's failure to use reasonable care causes damage to any of this property, the Contractor shall replace or repair the damage at no expense to the Government as the Contracting Officer directs. If the Contractor fails or refuses to make such repair or replacement, the Contractor shall be liable for the cost, which may be deducted from the contract price.

Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
