Contract Administration Data

1) Description of Agreement:

A blanket purchase agreement (BPA) is a simplified method of filling anticipated repetitive needs for supplies or services by establishing "charge accounts" with qualified sources of supply.

The objective of this agreement is for a five-year BPA for the rehabilitation, repair, and/or replacement work on up to five (5) groundwater wells located at the Southwestern Native Aquatic Resources & Recovery Center (SNARRC) when requested by the contracting officer or the authorized representative of the contracting officer for the period 07/03/2026 through 07/02/2031.

5-Year BPA for Well Repair and Maintenance

The vendor will be selected based upon proven capabilities. This BPA may only be used at the SNARRC with the U.S. Fish & Wildlife Service (USFWS). The following order procedures shall be used in accordance with FAR Part 12.201-1(e)(3) Blanket purchase agreement. (FAR Overhaul

- Part 12 | Acquisition.GOV).

2) Extent of Obligation:

The Government is obligated only to the extent of authorized purchases actually made under the BPA. The Federal Government is exempt from applicable taxes as determined by the state.

3) Purchase Limits:

Prior to the initiation of a BPA Call, the SNARRC is required to verify the remaining purchasing capacity of the agreement.

Authorized purchase card users shall ensure that credit card purchases do not exceed the applicable micro-purchase threshold. As of the current guidance, the micro-purchase threshold is $2,500.00 for services. Micro-purchase thresholds are subject to change in accordance with authorized revisions to the Federal Acquisition Regulation (FAR), specifically FAR 2.101, and are contingent upon final determinations made by the U.S. Department of Interior and U.S.

Fish and Wildlife Service. Authorized purchase card users are responsible for verifying the most current thresholds prior to initiating any procurement action.

BPA Calls (Below the Micro-Purchase Threshold)

The Government Purchase Card (GPC) may be used to pay for services in amounts less than the micro purchase threshold (MPT) (ref. section 3. Purchase Limits and guidance below).

Authorized purchase card users shall ensure that credit card purchases do not exceed the applicable micro-purchase thresholds supplies.

Prior to purchasing, authorized purchase card users are required to verify the remaining purchasing capacity of this agreement. All purchases are considered “calls” off the applicable BPA. Please refer to the DOI Purchase Card Policy for additional information relating to payment and record keeping.

BPA Calls (Above the Micro-Purchase Threshold)

A Program Purchase Request (PPR) must be submitted in MySupport such that a warranted CO can make the purchase. The PPR must include a brief statement of work for the current need, an independent government estimate (IGE), the required period of performance or completion date, place of performance, technical points of contact, and any other supplemental documentation critical to the requirement. Once submitted and approved, the PPR will be assigned to a requisitioner who will enter the purchase requisition (PR). The PPR/PR is then expedited to a Contract Specialist (CS) for review and processing.

Urgent/Compelling Needs

SNARRC must contact the designated APO Emergency Contact, (ref. APO Emergency Contacts) for urgent requirements (e.g., needs immediate authorization from a Contracting Officer). This approach requires the requesting program/office to immediately send email confirmation to the APO contact that funds are available and to complete a Program Purchase Request in mySupport within 1 business day so the contracting action and obligation (i.e BPA call) can be completed within the 10-day timeframe.

6) Invoicing and Payment Procedures (BPA Calls Exceeding the Micro-Purchase Threshold)

Invoicing procedures for a BPA call over the micro-purchase threshold begin after a BPA call is executed by a warranted CO and services have been completed and accepted by the Government.

(d) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms. However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all offers if such action is in the public interest, accept other than the lowest offer, and waive informalities and minor irregularities in offers received.

(e) Debriefings. If a postaward debriefing is given to requesting Offerors, the Government will disclose the following information, if applicable:

(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed Offeror’s offer.

(2) The overall evaluated cost or price and technical rating of the successful Offeror and the debriefed Offeror and past performance information on the debriefed Offeror.

• Technical capability (ref. page 3)

• Technical experience (ref. page 3)

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(a) Definitions. The clause at Federal Acquisition Regulation (FAR) 52.202-1, Definitions, is incorporated by reference.

(b) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post acceptance rights—

The Contractor shall proceed diligently with performance of this contract, pending final resolution of any dispute arising under the contract.

(f) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence. Examples of occurrences include acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. When an excusable delay occurs, the Contractor shall—

(2) Remedy the delay as quickly as possible; and

(3) Notify the Contracting Officer when the occurrence is over.

The Contractor shall indemnify the Government and its officers, employees, and agents against liability, including costs, for actual or alleged direct or contributory infringement of, or inducement to infringe, any United States or foreign patent, trademark, or copyright, arising out of the performance of this contract, provided the Contractor is reasonably notified of such claims and proceedings.

(A) The date fixed under this contract.

In the event of such termination, the Contractor shall immediately stop all work and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges the Contractor can demonstrate to the satisfaction of the Government using its standard record keeping system, have resulted from the termination. This paragraph does not give the Government any right to audit the Contractor’s records. The Contractor shall not be paid for any work performed or costs incurred which reasonably could have been avoided.

(m) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide the Government, upon request, with adequate assurances of future performance. The Government will send a cure notice to the Contractor, unless the reason for the termination is late delivery. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.
