Vegetation Removal BPA Setup

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a separate written solicitation will not be issued.

The U.S. Fish and Wildlife Service, JAO, Big Island National Wildlife Refuge Complex, located at: 60 Nowelo St., Suite 100, Hilo, Hawai’i 96720, has a requirement to set up a 5-year Blanket Purchase Agreement with multiple contractors on the Big Island of Hawaii for vegetation removal, fence clearing-including alterations and repairs, per the included Statement of Work listed below. Site visits are a requirement to grasp the scope of the services that are required.

This Request for Quotation (RFQ) is conducted under the procedures of FAR Parts 12 and 13, incorporating provisions and clauses in effect through Federal Acquisition Circular 2005-101. The NAICS code is 561730- Landscaping Services and the small business size is $8M.

Instructions All responsible small business sources may submit a quote, which shall be considered by the agency. Award will be made as a firm-fixed-price contract. The basis of award is the lowest price determined fair and reasonable Award will be made to a responsible source pursuant to FAR subpart 9.1.

Big Island National Wildlife Refuge Complex Hakalau Unit & Kona Forest Unit

Statement of Work

Vegetation clearing, tree removal, and fence repair services for Big Island NWRC (Hakalau and Kona Forest Unit)

1. GENERAL:

The US Fish and Wildlife Service, Big Island NWR Complex, located on the Big Island of Hawai`i is interested in obtaining vegetation clearing, debris removal, and fence maintenance services from a local company over a period of 5 years. The contracted company would be responsible for conducting these services and assuring performance and effective completion of all work items listed as bid items in this statement of work.

The Refuge Complex consists of two units, the Hakalau Forest NWR on the eastern flank of Mauna kea and the Kona Forest Unit located on the western flank of Mauna loa on the island of Hawaiʻi (Figure 1). Hakalau Forest NWR is located approximately 45 road miles (30 miles paved, 15 miles unpaved) in a westerly direction from Hilo, Hawaiʻi and spans portions of the north and south Hilo districts. Driving time is between 1 ½ and 2 hrs. from Hilo.

The Kona Forest Unit is located approximately 23 miles south of the city of Kailua-Kona (Figure 1), in the South Kona District of Hawai‘i County. Communities in the vicinity are Captain Cook, Kealakekua, Kainaliu and Honaunau. The area is rural, with sparse habitation uphill of the main highway (Hwy. 11). Land use in the area is predominantly ranching, but also includes residences, small farms and ecotourism. Access to both units requires an off-road vehicle with good clearance due to steep and rugged terrain.

Description of Terrain, Vegetation and Access:

The Hakalau Forest unit (HFU) is approximately 33,000 acres in size of which, approximately 14,000 acres is protected by conservation fencing. The fenced area within HFU is further subdivided into 10 fenced management units (Figure 2). For all units, the terrain is rolling with gentle to steep slopes and is bisected with numerous gulches, stream beds and channels. The substrate is mostly deep soil with a few rocky outcroppings. Rainfall is high (about 90 inches in upper elevations with more in the lower elevations) so muddy and marshy areas are common. Vegetation at the upper elevations of all of the units is mainly open grazing land dominated by exotic grasses interspersed with native trees such as koa and ʻōhiʻa and a sparse understory. The mid and lower elevations of transition into closed canopy native forests dominated by koa and ʻōhiʻa trees and a dense understory of native bushes, ferns and exotic grasses (Photo 1). Fallen trees are numerous. Upper fenced units are accessible by off road vehicle and utv. Lower fenced units are accessible by UTV and/or foot only

The Kona Forest Unit (KFU) is approximately 15,000 acres in size of which, 5,300 acres (2,145 ha) has been enclosed in 16 miles of fencing and subdivided into three management units (Figure 3). The KFU contains a variety of native rainforest and dryland natural communities that varies in soil type, moisture regime, and degree of past disturbance.

Rainfall averages 30” inches per year at the upper elevation (>6,000’) and up to 80” inches/yr at the lower elevation (1,500-2,000’elevation). The lower elevation region of KFU contains a mix of native and nonnative forest where little management is conducted. In the upper two fenced units, native ʻōhiʻa and ʻōhiʻa -koa forest transitions into a mesic to dry mamane-sandalwood forest and ohia woodland at the highest elevations (>5,500 – 7,500’).

The previous century of wild and domestic cattle on the landscape and koa logging has created many skid roads throughout the mid-elevation forests at KFU. The lower portion of the refuge has been disturbed by wild cattle and pigs and has subsequently been invaded by many non-native weeds (Clidemia hirta, Strawberry guava, Christmas berry). Fenced units are accessible by 4WD, UTV and foot trails. Unfenced boundary lines on the refuge are accessible by both unimproved roads or on foot where no roads exist (Figure 3; Photo 2).

2. SCOPE OF WORK

Vegetation clearing and downed tree/debris removal is needed along along existing fencelines, roads, and unfenced boundary lines shown on Figures 2-3. Fence maintenance and repair is needed for management units on both the Hakalau and Kona refuge units (Photos 1-3).

Services Requested:

1. Labor (per linear ft.) to maintain and repair 48”fencing at Hakalau Forest Unit. Refuge will supply all fence repair materials.

Contractor is responsible for removal of damaged fence materials and repair to the same fence specifications (appendix B).

2. Labor (per linear ft) to maintain and repair 75” fencing at Kona Forest and Hakalau Forest Unit.

2) Work is to be delivered upon fully per the terms of the BPA Ordering Guide.

3) All services rendered will be set along 6 service areas, at a Firm-Fixed priced each year.

4. INSPECTION AND ACCEPTANCE

1) The work shall also be done in accordance with all applicable federal, state and local codes including the most current edition of the IBC, National Electrical Code (NEC), NFPA 101 Life Safety Code, ADA/ABA, and any other applicable disciplines of the International Code Council, as well as with accepted general repair to the same fence specifications (appendix B).

3. Labor (per hour) to clear vegetation from fence lines and roads at the Hakalau unit.

4. Labor (per hour) to clear vegetation from fence lines, unfenced boundary corridors, and roads at the Kona unit.

5. Labor (per hour) to remove downed trees and debris along refuge boundary lines, fences and roads at both the Hakalau and Kona Forest Units.

6. Hauling debris for disposal (cost per load or ton) for both Hakalau and Kona Forest Units.

2) The work shall be accepted when all the work is completed as described here within and in accordance with any contract documents. Work will be inspected to assure compliance with the contract documents, but quality control and adherence to all contract requirements is the responsibility of the contractor, as further described in CFR 52.246-12, “Inspection of Construction”.

3) Inspections shall be performed by Refuge staff.

5. GOVERNMENT FURNISHED MATERIALS

1) In addition to the Availability and Use of Utility Services clause Federal Acquisition Regulation (FAR) 52.236-14, the Contractor shall furnish all temporary facilities and utilities needed including: heat, light, power, water, telephone, sanitary facilities, job offices, material handling equipment, temporary construction aids, and storage enclosures. If suitable USFWS water, electric, or other utility is present at the site, it may be used for construction purposes at no cost, only if it does not adversely impact the operations of the station and field station agrees to permit use. The Contractor shall provide and remove any temporary connections required.

Akala Barn and may be available from the field station catchments, as well. Water catchment at the Kona Forest Unit is available with approval from the refuge manager.

6. SPECIAL NOTICES AND INSTRUCTIONS

1) Campsites: Camps may be permitted with the following restrictions:

a. Location: Shall be approved by the Refuge Manager.

b. No cutting of live trees or ferns larger than 4 inches in diameter unless covered in the project description.

c. Food scraps and human waste may be disposed of in shallow (10 inch deep) split latrines. Metal, plastic, and all other non-degradable refuse must be disposed of properly off of the refuge.

d. No permanent structures may be built, such as tree houses, shelters, pit toilets, etc.

e. Abandoned campsites must be restored to pre-existing conditions.

f. Contactor shall remove all food, refuse, tools and materials upon completion of the project.

g. Camps must be kept tidy at all times with all food items stored in appropriate containers to mitigate rodent and pest problems.

2) Native and Alien Plants and Animals

a. Plants may not be removed from the Refuge.

b. Contractor may not plant any vegetation.

c. No pets or domestic animals are allowed on the Refuge.

d. To reduce the spread of Rapid ‘Ohi’a Death and other invasive or destructive plants animals, insects and pathogens to the Refuge, the Contractor shall follow written protocols outlining the cleaning of gear, vehicles, equipment, clothing and footwear prior to entering the Refuge.

3) Equipment Staging Area: Located behind the maintenance shop at the Hakalau Unit and at the Kona Forest Unit Base camp. Fuel may be stored in these locations with proper spill containment kits and procedures approved by the Refuge Manager.

7. Equipment, Materials and Labor

1) All equipment, tools, transportation and labor will be provided by the contractor unless otherwise noted in description.

2) Communications equipment is not provided by the Refuge.

3) The Refuge will not be responsible for theft or vandalism of contractor's property.

8. AVAILABILITY & ACCESS

Contractor and Inspection Crew Activities

Pre-Bid On-Site Inspection Bidders are strongly advised to inspect the project prior to submitting a bid.

Topographic and logistical conditions present difficulties which are not typical for fence maintenance projects. Failure to visit thesite will in no way relieve the successful bidder from completion of the work in accordance with conditions and specifications to the satisfaction of the Contracting Officer's Representative (COR)

a. Pre-bid Site Visit: No formal pre-bid site visit has been scheduled. Contact with Big Island NWRC is required prior to a site visit. To schedule a site visit contact Donna Ball, Deputy Refuge Manager.

b. Unless approved by the Project Leader, the work week is Monday thru Friday, from 7:00 a.m. until 5:30 p.m., except federal holidays. Work shall be performed during these hours unless prearranged with the Refuge. The refuge is not open to the public.

c. Contractor shall notify the COR a minimum of seven (7) days prior to arrival on-site and/or needing access to any of the buildings.

OTHER CONSIDERATIONS

a. The Refuge can provide a place to stay overnight while accomplishing requested fence maintenance and vegetation clearing services. The Kona forest unit has a remote camp without amenities. The Hakalau unit has a cabin available and remote camping is available at the discretion of the refuge manager.

b. Vendor must provide tools required. Refuge will supply materials for fence repair.

ACCESS TO SITE:

Access to the work site from existing roads shall be provided by the contractor at his own expense. The Government assumes no responsibility for the condition or maintenance of any road or structure thereon that may be used by the Contractor in performing the work under these specifications or in traveling to and from the site of work. No payment will be made to any contractor by the Government for any work done in improving, repairing, or maintaining any road or structure thereon for use in the performance of the work under these specifications. Roads subject to interference by the work shall be kept open.

The Hakalau Forest Unit is approximately 2 hours from Hilo and the Kona Forest Unit is approximately 3 hours from Hilo. A 4-wheel drive vehicle is required to access both Refuge Units from the state highway. Both Units are located in isolated areas with no public amenities available such as restaurants, repair shops, etc.

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 60 days.

(a) The Government may extend the term of this contract by written notice to the Contractor within 60 days provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 total years including one base year and up to four option years.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Whenever cost effective, the contractor should provide products and/or services that are energy efficient, promote water conservation and are bio-based. The use of nonhazardous and recovered materials is encouraged.

Electronic Invoicing and Payment Requirements – Invoice Processing Platform (IPP)

Payment requests must be submitted electronically through the U.S. Department of the Treasury’s Invoice Processing Platform System (IPP).

“Payment request” means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions – Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

1. Invoice billed according to contract line items and rates.

2. If final payment is billed, the last invoice shall state “FINAL”

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contract (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3 – 5 business days of the contract award date.
