3. Advise on the general integrity, content, and function of cultural resources, and

4. Recommend measures to protect and manage cultural resources during project activities.

The contractor’s method and deliverables will conform to the IDIQ contract, and the details presented below.

C. Background

The US Fish and Wildlife Service (FWS) is proposing to conduct a fuels reduction project within two timbered units of Little Pend Oreille NWR near the town of Colville, Stevens

County, Washington (Figures 1 - 3). Project activities may include thinning small diameter trees, commercial harvest of medium to large diameter trees, piling brush and thinning debris, and prescribed burning in two units totaling 3,600 acres. The FWS used

DAHPs WISAARD Probability Model to select areas with the greatest potential for cultural resources, resulting in the 1,150 acres for survey under this contract.

D. Regulatory Context

The project occurs on Federal lands within Little Pend Oreille NWR and therefore is subject to Section 106 of the National Historic Preservation Act (NHPA).

E. Work Location/Project Area

The project is located in the central area of Little Pend Oreille NWR, Stevens County, Washington. T. 34/35N, R. 41E, Sections 1, 3, 4, 5, 6, 8, 9, 16, 17, 20, 21, 32 and 33, Cliff

Ridge, Washington USGS Quadrangle.

The project is located in a unit dominated by lodgepole pine, grand fir, Douglas fir, ponderosa pine, and western larch with an understory of shrubs in mountainous terrain.

F. Background Research

The contractor will follow the guidelines of the Washington SHPO for cultural resource research, survey, and site recordation on federal land. The FWS will forward to the contractor pertinent site records, reports, maps, and GIS shapefiles (APE and Survey

Areas). The contractor will conduct background research, and a literature and archival search for cultural resource information in and near the project area. The contractor will consider the nature and location of existing cultural resources in nearby analogous environmental settings and assess information on geomorphological processes that may affect the preservation and discoverability of cultural resources in the project area. The contractor will include a summary of the background research in the final report.

Survey Areas will be inventoried for cultural resources by pedestrian transects spaced about 30-40 meters apart (maximum of 40 meters apart). All cultural resources that meet the definition of a site by the Washington SHPO will be recorded. Site boundaries will be determined by the extent of surface artifacts, cultural features, and geomorphic features. The contractor will prepare Washington SHPO approved site records, location maps, sketch maps, photographs of all sites and obtain Smithsonian trinomials for each documented site. Isolated artifacts will also be recorded. The contractor will inspect any previously recorded sites within the APE and prepare new site records to meet current

Washington SHPO standards. No artifacts will be collected. Diagnostic items such as projectile points, other dateable artifacts, and cultural features will be documented on site records and mapped by GPS.

The contractor will report GPS-derived UTM coordinates and boundaries for each cultural site in the APE so that the site can be relocated by work crews, flagged, avoided, and otherwise excised from the APE of the project by the FWS.

52.212-1 Instructions to Offerors—Commercial Products and Commercial Services.

Instructions to Offerors—Commercial Products and Commercial Services (Nov 2021)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern that submits an offer, other than on a construction or service acquisition, but proposes to furnish an end item that it did not itself manufacture, process, or produce is 500 employees if the acquisition—

(1)Is set aside for small business and has a value above the simplified acquisition threshold;

(2)Uses the HUBZone price evaluation preference regardless of dollar value, unless the offeror waives the price evaluation preference; or

(3)Is an 8(a), HUBZone, service-disabled veteran-owned, economically disadvantaged women-owned, or women-owned small business set-aside or sole-source award regardless of dollar value.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show—

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

https://www.gsa.gov/forms-library/solicitationcontractorder-commercial-items

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at Federal Acquisition Regulation (FAR) 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with FAR subpart 4.10), or alternative commercial products or commercial services for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers.

BASIS OF AWARD

This solicitation will result in the award of one (1) Firm-Fixed Price Design for the Design, Manufacture, Haul, Deliver, and Unload contract in accordance with the provisions herein this section. The final award will consider all factors and will be made on a best-value price and other factors. This process permits tradeoffs among cost or price and non-cost factors and allows the Government to accept other than the lowest priced proposal. The Government may consider award to other than the lowest priced offeror or other than the highest technically rated offeror when it is in the best interest of the Government.

Technical (non-cost) evaluation factors, when combined, are significantly more important than price. The Government intends to award, without discussions (but reserves the right to conduct discussions if the Contracting Officer deems them necessary), to the responsible offeror whose proposal complies with the https://www.acquisition.gov/far/part-52#FAR_52_212_3 https://www.acquisition.gov/far/part-52#FAR_52_212_3 https://www.gsa.gov/forms-library/solicitationcontractorder-commercial-items https://www.acquisition.gov/far/part-4#FAR_Subpart_4_10 solicitation requirements and is determined to be the best value to the Government considering all factors.

M.2.0 EVALUATION FACTORS FOR AWARD. There are three (2) non-price/cost evaluation factors with equal weighting.

M.2.1 Evaluation Factor 1, Technical Capability. Submitted narrative will be evaluated based on inclusion of the required topics and content that the Government determines will provide the best value, based on contractor technical capabilities.

M.2.2 Evaluation Factor 2, Past Performance. Past performance will be evaluated based on inclusion of the required information and combination of all past performance information collected by the Government. Contractor’s with more favorable past performance reviews will be viewed as having less risk to the Government.

M.3.0 Evaluation Factor 3, Price Price will be evaluated for fair and reasonableness but not rated.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)

(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and-

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.

The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

This narrative shall discuss your Management Team, major Sub-contractors/Specialists, and previous Teaming Experience, preferably on a project (or projects) of similar scope and magnitude. Documentation submitted may include but will not be limited to: organizational charts, resumes, professional qualifications, and certifications necessary for satisfactory performance of required services for this Design, Manufacture, Haul, Deliver, and Unload Project.

Evaluation Factor 2, Past Performance. (Total 5 Page Limit) Provide the Current Point of Contact (with phone number and email address) for five ongoing and/or past contracts similar in scope and complexity to the work outlined in the Statement of Work. The Contractor is solely responsible for the accuracy of information provided. The Government will not pursue inaccurate data.

Note: The Government may elect to review and consider other sources of information for evaluating past performance. Other sources may include, but are not limited to inquiries of owner representatives, past performance information and contacts retrieved through CPARS, FAPIIS, and FPDS-NG using all CAGE/ Unique Entity Identifiers (i.e. DUNS) of team members (i.e. partnerships, joint ventures, teaming arrangements or parent companies/subsidiaries/affiliates) identified in the offeror’s proposal. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate, and complete past performance information rests with the offeror.

Evaluation Factor 3, Price. The Offeror shall submit the completed attached Offeror Schedule (separate attachment). The prices shall include all necessary supervision, management, labor, transportation, equipment, materials, direct costs, indirect costs, incidental costs, overhead and profit.

Technical and past performance, when combined, are preferred in accordance with FAR 13.106-2, the relative importance of all other evaluation factors, when combined, when compared to price.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
