52.212-3.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain
Telecommunications and Video Surveillance
Services or Equipment.
(b) Prohibition. (1) Section 889(a)(1)(A) of the
John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after
August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to-
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain
National Defense Authorization Act for Fiscal
Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.
This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to-

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that-

(b)(1) of this provision.
(ii) For covered services-
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the
Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph
(b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the
Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

Officer directs. If the Contractor fails or refuses to make such repair or replacement, the
Contractor shall be liable for the cost, which may be deducted from the contract price.
52.212-2 Evaluation - Commercial Items. (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the
Government, price and other factors considered.
The following factors shall be used to evaluate offers: best value to include technical experience, past performance, and price.
Technical and past performance, when combined, are significantly more important when compared to price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer's specified expiration time, the
Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Assessment of Universal Accessibility at the John Heinz National Wildlife Refuge at Tinicum
Part 1
General Information
1. GENERAL: This is a non-personnel services contract to provide Assessment of Universal Accessibility at the John Heinz National Wildlife Refuge at Tinicum.
1.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, 0facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform Assessment of Universal Accessibility at the John Heinz National Wildlife Refuge at Tinicum as defined in this Performance Work Statement except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract.
1.2 Background: The John Heinz National Wildlife Refuge at Tinicum is implementing best practices to provide accessible facilities and programs for their visitors with disabilities. Section 504 of the Rehabilitation Act (1973), as amended, rules against discrimination on individuals with disabilities in any programs and activities conducted by a federal agency. The Architectural Barriers Act of 1968, as amended, contains requirement for sites, facilities and buildings to be accessible. Based on legal mandates, that includes media accessibility, visitors with disabilities are entitles to the same park experience as everyone else. The John Heinz National Wildlife Refuge at Tinicum is committed to providing facilities, programs, services and media access to all.
The Cusano Environmental Education Center (Visitor Center) parking lot and approximately 3 miles of trails should be assessed for accessibility by diverse audiences, training regarding accessibility and programming so that modifications can be made, should be assessed for egress and exits, access to restroom facilities, and access to exhibits. Trails and parking lots should be assessed for surfaces, grade, and slope. An evaluation and suggested improvements with ideas on reviewing current programming to generate changes that would create programs that welcome people from communities with some of the challenges noted above and will provide the John Heinz National Wildlife Refuge at Tinicum staff with a report on current conditions and provide suggestions on improvements to be made.
This accessibility assessment will assist with further upgrades to the infrastructure of the Refuge and enhance universal accessibility and current programming, expanding outreach to diverse audiences. The universal accessibility assessment and programming should include all or some of the following: Persons with Physical Disabilities, Persons with Visual Impairments, Persons who are Hard of Hearing, and members of the Autistic Community.
1.3 Objectives: This Assessment of Universal Accessibility is to create a project charter for the John Heinz National Wildlife Refuge at Tinicum representatives through cooperative efforts to refine goals, processes, tasks, products, and approaches that are include accompanying timelines for completing the accessibility assessment.
Assessment for egress and exits, access to restroom facilities, and access to exhibits.
Trails and parking lots should be assessed for surfaces, grade, and slope.
Evaluate and suggest improvements with ideas on reviewing current programming so modifications can be made.
Generate changes that would create programs that welcome people from communities with some of the challenges noted as to include all or some of the following: Persons with Physical Disabilities, Persons with Visual Impairments, Persons who are Hard of Hearing, and members of the Autistic Community.
Will provide the John Heinz National Wildlife Refuge at Tinicum staff with a report on current conditions and provide suggestions on improvements to be made.
1.4 Scope: The Cusano Environmental Education Center (Visitor Center) parking lot and approximately 3 miles of trails should be assessed for accessibility by diverse audiences, training regarding accessibility and programming so that modifications can be made, should be assessed for egress and exits, access to restroom facilities, and access to exhibits. Trails and parking lots should be assessed for surfaces, grade, and slope. An evaluation and suggested improvements with ideas on reviewing current programming to generate changes that would create programs that welcome people from communities with some of the challenges noted above and will provide the John Heinz National Wildlife Refuge at Tinicum staff with a report on current conditions and provide suggestions on improvements to be made.
Services include:
On-site evaluation of identified areas: Three members of the Contractor will facilitate a two-day evaluation of facilities, visitor center, signs, and public trails with John Heinz National Wildlife Refuge at Tinicum staff.
Summary Report: Accessibility barriers identified in the previous step will be compiled by staff from CONTRACTOR, outlining the primary barriers and recommended short-, mid-, and longer-term solutions Training: The Contractor, with input from John Heinz National Wildlife Refuge at Tinicum, will develop and deliver a one-day basic training program for John Heinz National Wildlife Refuge at Tinicum, focusing on outdoor recreation accessibility, the “types” of amenities at John Heinz National Wildlife Refuge at Tinicum, and implementation of accessibility best practices, instead of all barriers and laws.
Virtual project completion: Upon conclusion of the on-site evaluation and training, two virtual meetings (60-minute meetings) are anticipated to ensure that the John Heinz National Wildlife Refuge at Tinicum and CONTRACTOR staff collaborate around findings and recommendations.
The contractor shall accomplish by providing a final report that will be a summary briefing report that John Heinz National Wildlife Refuge at Tinicum will be responsible for distributing. John Heinz National Wildlife Refuge at Tinicum is encouraged to utilize the document to address accessibility needs internally and/or collaboratively with local disability stakeholders, advocates, and community members. This awareness and grassroots involvement are essential to affect meaningful change and produce quality, accessible experiences for visitors with disabilities. All documents will be compliant with Section 508 of the Rehabilitation Act, as amended.
1.5 Period of Performance: The Period of Performance reads as follows:
The period of performance shall be for one (1) Base Year of 12 months.
1.6 General Information
1.6.1 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract.
1.6.2 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
1.6.3 Recognized Holidays: Contractor is not required to perform services on holidays.

1.6.4 Hours of Operation: The contractor is responsible for conducting business, between the hours of 7:30 am to 4:00 pm Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings.
For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons.
