52.212-2 Evaluation - Commercial Items. (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: best value.

Price Proposal The Government intends to issue a fixed-price contract as a result of this RFQ. Interested parties shall submit one (1) copy of a price proposal that includes the vendor DUNS number and itemizes, at a minimum, the cost per hour for each labor category needed to perform services, chemical costs, equipment costs, fuel costs, and incidental expenses. Offerors are advised to provide their best and final pricing, including any proposed discounts, upon initial submission. Email offers will be accepted and are preferred over fax or USPS mail.

Technical Proposal The offeror shall provide one (1) copy of the technical proposal. The technical proposal should be prepared simply and economically providing straight forward, concise delineation of capabilities. The information provided shall be factual and complete. Proposals that merely offer to provide supplies as described in the SOW will not receive further consideration for award. The proposal shall also include references.

Technical Experience The Contractor will be selected based on a competitive bid and the contractor’s comprehension of the requirements, the contractor’s ability to complete the assessments, and the experience of the contractor with contracts of similar complexity, as demonstrated in the contractor’s proposal. Contractors are requested to provide a technical approach and costs for treating invasive plants at these 3 units, as follows:

1. The treatment methods (i.e. foliar spray, girdling, cut stump, basal spray, etc.), timing and treatment frequency (if more than 1 treatment needed). *Note: For Pines Trail, we request cutting at or near ground level and treating of cut surface with herbicide to prevent sprouting.

2. Estimated treatment success (i.e. 80% control one year after treatment)

3. Identify any follow-up treatment needed to ensure restoration of native shrub, and provide separate cost estimates for each year.

4. Identify the equipment that will be used to treat/access the site and move around within the treatment area

5. Identify the chemicals (including surfactants) to be used and formulations

6. Identify the time frame(s) for treatment, assuming the contract will be awarded no later than February 1, 2021.

7. Identify methods of mechanical treatment (mowing, cutting, etc.) if proposed

8. Identify a method to document all areas have been treated and how success will be determined

9. Provide cost estimates for each treatment unit and treatment cycle separately, and include any savings from treating multiple sites.

10. Document certifications, insurance, licenses, etc that are required by the State of Massachusetts to perform such services.

11. Exhibit and document past experience related specifically to contracts providing similar invasive species control services.

12. Provide references from other similar projects that they have performed.

The factors listed above will be evaluated equally and considered significantly more important than price during the evaluation phase. Award will be made on a firm-fixed price basis. Due to time constraints, the government anticipates awarding this order based on initial proposals. Contractors are strongly encouraged to propose their 'best and final' pricing with the initial proposal.

Technical and past performance, when combined, are significantly more important when compared to price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-5 Contract Terms and Conditions Required To Implement Statutes or Executive Orders - Commercial Items. (OCT 2020)

(a) The Contractor shall comply with the following Federal Acquisition Regulation (FAR) clauses, which are incorporated in this contract by reference, to implement provisions of law or Executive orders applicable to acquisitions of commercial items:

(1) 52.203-19, Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements (JAN 2017) (section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. (b) The Contractor shall comply with the FAR clauses in this paragraph (b) that the Contracting Officer has indicated as being incorporated in this contract by reference to implement provisions of law or Executive orders applicable to acquisitions of commercial items: (Contracting Officer check as appropriate.)
