This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a separate written solicitation will not be issued.
The U.S. Fish and Wildlife Service, JAO, Sheldon-Hart Mountain National Wildlife Refuge Complex, located at 20995 Rabbit Hill Road Lakeview, OR 97630, has a requirement for spring box prescriptions per the included Performance Work Statement listed below. All minimum specifications must be met for consideration.
This Request for Quotation (RFQ) is conducted under the procedures of FAR Parts 12 and 13, incorporating provisions and clauses in effect through Federal Acquisition Circular 2005-101.
The NAICS code is 541620 Environmental consulting services and the small business size is $16.5M.
Instructions All responsible small business sources may submit a quote, which shall be considered by the agency. Award will be made as a firm-fixed-price contract. The basis of award is the lowest price determined fair and reasonable Award will be made to a responsible source pursuant to FAR subpart 9.1.

PERFORMANCE WORK STATEMENT (PWS)
Development of Spring Box Reclamation Prescriptions on Sheldon NWR
1. General:
1.1. The U.S. Fish & Wildlife Service, Sheldon-Hart Mountain National Wildlife Refuge Complex (PO Box 111, Lakeview, OR 97630; hereafter Complex) has a requirement for the development of prescriptions for the stabilization and restoration of degraded meadow systems and the reclamation of developed spring system.
1.2. Historic water development was conducted to support grazing operations. The installation of structures for water development led to the degradation of natural springs and meadows and with the cessation of grazing operations the Refuge is working to restore the natural function of these systems.
2. Place of Performance and Period of Performance:
2.1. Work is to be performed in Service-designated areas within Sheldon National Wildlife Refuge. Sheldon National Wildlife Refuge is located in Northeastern Nevada and encompasses approximately 550,000 acres. Work sites are located across the Refuge and may require access via 4-wheel drive vehicles, ATV and/or hiking.
2.2. Weather conditions can be highly variable, including storms (rain and snow), extreme temps, severe wind events, etc.
2.3. Prescriptions will be developed for 5 developed spring or meadow sites.
Prescriptions will include the reclamation of the immediate water development and associated degradation within the immediate area of any structures. (Example photos of degradation below)
2.4. Structure types include but are not limited to spring boxes with piping to troughs, dug outs, and dirt tanks
2.5. Associated local degradation includes but is not limited to features such as erosion from heavy livestock use, head cuts, incision channels, and scour holes
2.6. Normal duty hours Monday thru Friday 8:00 AM – 4:00 PM. In the event of emergencies, contractor shall provide contact information.
2.7. Non-duty hours include week nights, weekends, and Government holidays (New Year’s Day, Martin Luther King JR’s Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran’s Day, Thanksgiving Day, Christmas Day).
3. Scope:
3.1. Contractor shall have experience conducting spring restoration projects in the Great
Basin or high desert environments.
3.2. Contractor shall work with the designated Service personnel to identify and select candidate sites from a list of previously identified water developments.
3.3. Contractor is responsible for all associated travel cost to and from the Refuge and shall plan at least one site visit to each of the water developments selected.
3.4. Contractor shall develop a site-specific reclamation prescription for each location to an end state that is mutually agreed upon with the designated Service personnel.
3.5. Contractor shall provide all labor, facilities, equipment, tools, materials, supervision, and other items to perform all work in accordance with the performance work statement. All operations performed by the contractor shall be in accordance with all pertinent Federal, State, and local laws and regulations.
3.6. Contractor shall utilize existing open roads to access areas. Contractor shall utilize existing staging areas in the field.
3.7. Should the contractor work without Service personnel present the contractor shall coordinate with designated Service personnel as to the location/s and expected return time for field crews.
3.8. Except as specified by Service personnel, contractor shall be responsible for disposal of any and all waste products generated while fulfilling this contract, on a daily basis.
All packing materials shall be recycled at local area recycling stations when possible (located in Lakeview, OR). All other waste shall be disposed of by the contractor at an approved, offsite location.
4. Deliverables and/or Deliverable Schedule:
4.1. Contractor shall provide a written reclamation plan for each site. The plan shall include:
4.1.1. Description and appropriate maps of the site, water development structures, and any associated erosional or other features leading to the degradation of the spring or meadow system.
4.1.2. Recommendation for methodologies to restore the site to natural function or agreed upon end state.
4.1.3. Detailed description of recommended methodologies to be utilized for the reclamation/restoration of the site to include appropriate diagrams.
4.1.4. A work plan for each site that describes the implementation process of the reclamation/restoration methodologies.
4.2. Contractor shall work with designated Service personnel to ensure completeness and clarity or reclamation prescriptions for each selected site and edit prescriptions accordingly
4.3. Initial draft of reclamation prescriptions shall be delivered no later than October, 31 2023. Designated Service personnel shall have 30 days to review documents and provide comments. Final delivery of reclamation prescriptions will be no later than December, 30 2023.
5. Data Management Plan (DMP):
The Project Lead or technical cognizant has used discretion as to whether or not a DMP is relevant or not relevant and has determined it to be ____ relevant or _X_ not relevant.
6. Government-Furnished Property (GFP) / Government-Furnished Information (GFI):
6.1. Government housing may be available depending on availability. Camping is available on a first come first serve basis at the Virgin Valley campground (located approximately 1 mile from the Refuge headquarters.
7. Evaluation and Acceptance:
7.1. The contractor will be evaluated as detailed herein. Inspection and acceptance will be determined by the Technical POC and/or Service personnel. Refer to Paragraph (a) of FAR 52.212-4 (Contract Terms and Conditions – Commercial Items) for additional information on inspection and acceptance.
7.2. Review of reclamation prescriptions shall be reviewed by designated personnel.
Contractor shall be notified of unacceptable reclamation prescriptions. Contractor shall then replant at no additional cost to the Government.

TECHNICAL REQUIREMENTS
PART 1 GENERAL
1.1 SCOPE
A. This document contains supplemental technical requirements to the Statement of Work for construction of U.S. Fish & Wildlife Service infrastructure projects in Regions 1, 7, & 8 (Oregon, Washington, Idaho, California, Nevada, Alaska, Hawaii & other Pacific Islands).
B. Provide all management, supervision, field-engineering, quality-control, labor, equipment, materials and supplies necessary to perform work described in the statement of work.
C. Conduct site visits, and working meetings, conference calls, and other activities as necessary to accomplish the work in a timely and efficient manner.
1.2 DEFINITIONS (for the purposes of this document)
A. Contracting Officer (CO) is defined as a the USFWS person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings on behalf of the United States of America.
B. COR is the Contracting Officer’s Representative who is explicitly designated in writing by the CO.
C. Contractor is the business entity that is contractually-responsible to the USFWS for accomplishment of the project Work.
D. Government means Owner, Contracting Officer, Contracting Officer’s Representative, or U. S. Fish and Wildlife Service.
E. Performance Specifications are specifications that state what the required results will be with measurable or observable criteria for verifying compliance.
F. USFWS or FWS means United States Department of Interior, Fish and Wildlife Service.
1.3 PROJECT LOCATION AND ACCESS
A. Project location(s) is described in the project Statement of Work.
B. Access:
1. The Contractor shall identify suitable access routes to the work site(s) that are agreeable to the USFWS refuge / hatchery project leader and the COR.
2. Identify and comply with any associated use requirements and restrictions.
Verify with Field Station if roads are in “Open” or “Closed” status prior to using.
3. Site access may be difficult in some instances.
C. Any roads, parking lots, trails, and walkways subject to interference by the work shall be kept open in a manner that provides for safe public use.
1.4 TECHNICAL PROCEDURES
A. General: Comply with the requirements contained in this document unless explicitly indicated otherwise in a project-specific Statement of Work.
B. Contractor is responsible for the proper performance of the Work and shall correct, at no additional expense, to the Government any errors or omissions in connection with such performance.
C. Hazardous Materials: Notify COR immediately of any potential hazardous materials discovered on-site.
1.5 SUBMITTALS
A. Obtain transmittal form “FWS R1-67, Rev. 10/93”, and use for transmitting all submittals.
B. Processing Time: Allow the government 14 calendar days for review of submittals.
Time shall commence upon the COR’s receipt of the submittal. Any resubmittal will require another 14 days of review time.
1.6 HOUSING AND TEMPORARY FACILITIES
a. Housing for workers and campsites are not available on site unless explicitly indicated otherwise in the Scope of Work.
PART 2 PROJECT EXECUTION
2.1 GENERAL
A. Project work will be accomplished via the project-specific Work Statement to convey the unique aspects of the project.
B. Federally listed illegal drugs are not permitted on the jobsite or any Federal property, regardless of State laws.
2.2 PAYMENT
A. 5 work-days prior to sending to the Invoice Processing Platform (IPP), submit a draft invoice to COR for review and concurrence.
B. Proposed fees for construction costs are based on quantities and unit rates as a means to document price reasonableness, and as a tool of managing project price.
C. Unless explicitly approved otherwise and prior to incurring cost:
1. Submit a certified invoice (with signature and date) that clearly indicates the contract number, task order number, USFWS field station name, project name, Contractor name/address/contact person and phone number/email, sequential invoice number, inclusive dates for work invoiced, original contract dollar amount, any contract modification dollar amounts issued to date, grand total contract amount, total value earned to date, cumulative previous payments, net dollar amount due this invoice.
3.4 NOXIOUS WEED / SPECIES / PATHOGEN CONTROL
A. Wash any equipment (and transport trucks) at an approved site prior to entering the project area. This is particularly important when transporting material or equipment from relatively distant areas.
3.5 ENVIRONMENTAL PROTECTION
A. General: Comply with all applicable federal, state, and local environmental laws and regulations. This condition applies to, but is not limited to, laws and regulations governing noise levels, air and water quality standards, erosion control, surface runoff, and cultural resources.
B. Cultural Resources: Immediately stop work if paleontological, archaeological or historical remains (including burials or skeletal material) are encountered, until work is permitted to resume by written order from the Contracting Officer. Notify the Inspector, COR, or Contracting Officer immediately. The Contracting Officer will notify the Regional Archaeologist so the provisions of 36 CFR 800.7 (Resources Discovered During Construction) and other relevant laws are followed. Work in other areas may proceed as approved by the Contracting Officer.
C. Hazardous Materials: Perform any hazardous materials work in strict accordance with governing hazardous materials regulations. Workers shall be knowledgeable and well trained in the handling of project-specific hazardous materials.
3.6 MATERIAL & EQUIPMENT TRANSPORTATION, HANDLING, AND STORAGE
A. Government-owned equipment is not available for Contractor’s use to accomplish any Work, and Government buildings and other facilities are not available for storage of Contractor’s materials, equipment, and tools.
B. Transport, handle, and store materials and equipment in accordance with the manufacturer’s written instructions, and in a secure manner.
3.7 FINAL WALK THOUGH
A. The COR will perform final walk through as promptly as practicable.
B. The time required for such walk through and for making any corrections as a result thereof shall be included in the contract performance time.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
