The contract will be administered by the Interior Business Center, AQD in Herndon, Virginia.

The requirement is for an appraisal report on WLK (484) LFT, Wallkill River National Wildlife Refuge, Sussex County, New Jersey—a 6.61-acre vacant, wooded parcel proposed for federal acquisition by the U.S. Fish and Wildlife Service. The appraiser must hold a valid Certified General Appraiser license for New Jersey, demonstrate experience appraising vacant rural agricultural/residential tracts and federal acquisitions under UASFLA guidelines, and provide at least two references each of UASFLA-compliant and similar rural property appraisals. Appraisals must comply with USPAP (2024 edition) Standards 1 & 2, UASFLA (6th Edition, 2016), and 49 CFR Part 24. The evaluation will be based on technical qualifications (Factor A), past performance (Factor B), and price (Factor C), with technical qualifications and past performance weighted more heavily than cost. All offerors must maintain an active Unique Entity Identifier (UEI) and be registered in SAM.gov. Payment will be processed through the Treasury Department's Invoice Processing Platform (IPP), and invoices are due 60 days after final report acceptance.

(6) The Contractor shall pay, unconditionally to each worker, all wages due free and clear without subsequent rebate or kickback. The Contractor may make deductions that reduce a worker’s wages below the E.O. minimum wage rate only if done in accordance with 29 CFR 23.230, Deductions.

(7) The Contractor shall not discharge any part of its minimum wage obligation under this clause by furnishing fringe benefits or, with respect to workers whose wages are governed by the Service Contract Labor Standards statute, the cash equivalent thereof.

(8) Nothing in this clause shall excuse the Contractor from compliance with any applicable Federal or State prevailing wage law or any applicable law or municipal ordinance or any applicable contract establishing a minimum wage higher than the E.O. 14026 minimum wage. However, wage increases under such other laws or municipal ordinances are not subject to price adjustment under this subpart.

(9) The Contractor shall pay the E.O. minimum wage rate whenever it is higher than any applicable collective bargaining agreement(s) wage rate.

(10) The Contractor shall follow the policies and procedures in 29 CFR 23.240(b) and 23.280 for treatment of workers engaged in an occupation in which they customarily and regularly receive more than $30 a month in tips.

(c)

(1) This clause applies to workers as defined in paragraph (a). As provided in that definition–

(i) Workers are covered regardless of the contractual relationship alleged to exist between the contractor or subcontractor and the worker;

(ii) Workers with disabilities whose wages are calculated pursuant to special certificates issued under 29 U.S.C. 214(c) are covered; and

(iii) Workers who are registered in a bona fide apprenticeship program or training program registered with the Department of Labor’s Employment and Training Administration, Office of Apprenticeship, or with a State Apprenticeship Agency recognized by the Office of Apprenticeship, are covered.

(2) This clause does not apply to–

(i) Contracts or subcontracts to which the States of Texas, Louisiana, or Mississippi, including their agencies, are a party;

(ii) Fair Labor Standards Act (FLSA)-covered individuals performing in connection with contracts covered by the E.O., i.e. those individuals who perform duties necessary to the performance of the contract, but who are not directly engaged in performing the specific work called for by the contract, and who spend less than 20 percent of their hours worked in a particular workweek performing in connection with such contracts;

(iii) Individuals exempted from the minimum wage requirements of the FLSA under 29 U.S.C. 213(a) and 214(a) and (b), unless otherwise covered by the Service Contract Labor Standards statute, or the Wage Rate Requirements (Construction) statute. These individuals include but are not limited to-

(A) Learners, apprentices, or messengers whose wages are calculated pursuant to special certificates issued under 29 U.S.C. 214(a) ;

(B) Students whose wages are calculated pursuant to special certificates issued under 29 U.S.C. 214(b) ;

and

(C) Those employed in a bona fide executive, administrative, or professional capacity (29 U.S.C.

213(a)(1) and 29 CFR part 541).

(d) Notice. The Contractor shall notify all workers performing work on, or in connection with, this contract of the applicable E.O. minimum wage rate under this clause. With respect to workers covered by the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute, the Contractor may meet this requirement by posting, in a prominent and accessible place at the worksite, the applicable wage determination under those statutes. With respect to workers whose wages are governed by the FLSA, the Contractor shall post notice, utilizing the poster provided by the Administrator, which can be obtained at www.dol.gov/agencies/whd/government-contracts, in a prominent and accessible place at the worksite. Contractors that customarily post notices to workers electronically may post the notice electronically provided the electronic posting is displayed prominently on any Web site that is maintained by the contractor, whether external or internal, and customarily used for notices to workers about terms and conditions of employment.

(e) Payroll Records.

(1) The Contractor shall make and maintain records, for three years after completion of the work, containing the following information for each worker:

(i) Name, address, and social security number;

(ii) The worker’s occupation(s) or classification(s);

(iii) The rate or rates of wages paid;

(iv) The number of daily and weekly hours worked by each worker;

(v) Any deductions made; and

(vi) Total wages paid.

(2) The Contractor shall make records pursuant to paragraph (e)(1) of this clause available for inspection and transcription by authorized representatives of the Administrator. The Contractor shall also make such records available upon request of the Contracting Officer.

(3) The Contractor shall make a copy of the contract available, as applicable, for inspection or transcription by authorized representatives of the Administrator.

(4) Failure to comply with this paragraph (e) shall be a violation of 29 CFR 23.260 and this contract.

Upon direction of the Administrator or upon the Contracting Officer's own action, payment shall be withheld until such time as the noncompliance is corrected.

(5) Nothing in this clause limits or otherwise modifies the Contractor’s payroll and recordkeeping obligations, if any, under the Service Contract Labor Standards statute, the Wage Rate Requirements (Construction) statute, the Fair Labor Standards Act, or any other applicable law.

(f) Access. The Contractor shall permit authorized representatives of the Administrator to conduct investigations, including interviewing workers at the worksite during normal working hours.

(g) Withholding. The Contracting Officer, upon his or her own action or upon written request of the Administrator, will withhold funds or cause funds to be withheld, from the Contractor under this or any other Federal contract with the same Contractor, sufficient to pay workers the full amount of wages required by this clause.

(h) Disputes. Department of Labor has set forth in 29 CFR 23.510, Disputes concerning contractor compliance, the procedures for resolving disputes concerning a contractor’s compliance with Department of Labor regulations at 29 CFR part 23. Such disputes shall be resolved in accordance with those procedures and not the Disputes clause of this contract. These disputes include disputes between the Contractor (or any of its subcontractors) and the contracting agency, the Department of Labor, or the workers or their representatives.

(i) Antiretaliation. The Contractor shall not discharge or in any other manner discriminate against any worker because such worker has filed any complaint or instituted or caused to be instituted any proceeding under or related to compliance with the E.O. or this clause, or has testified or is about to testify in any such proceeding.

(j) Subcontractor compliance. The Contractor is responsible for subcontractor compliance with the requirements of this clause and may be held liable for unpaid wages due subcontractor workers.

(k) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (k) in all subcontracts, regardless of dollar value, that are subject to the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute, and are to be performed in whole or in part in the United States.

Location Wallkill River NWR, Sussex County, New Jersey

Acreage 6.61± acres (Proposed Acquisition)

87.41± acres (Total land area owned and expected to be considered in Larger Parcel determination)

Property Type Non-Federal Vacant Land

Case Type Acquisition

Appraiser’s Client U.S. Department of the Interior, Appraisal and Valuation Services Office

(AVSO).

Intended Users The intended users of the appraisal report are the Client and U.S. Fish and Wildlife

Service (FWS) on behalf of the United States of America.

Intended Use The appraisal report will be used by the FWS in conjunction with negotiating the proposed acquisition of the identified property via purchase from the current owner. It is not intended for any other use.

Property Description

The proposed acquisition consists of one parcel located in Wantage Township, Sussex County, New Jersey within the Wallkill River NWR. It is identified as

Sussex County Tax Parcel ID 1924-2-25-Q0055 (Tract 484). The parcel contains

6.61 acres and does not have recorded legal access. It is only accessible by foot/bike via Timberdoodle Trail, when open and publicly accessible. The property is 100% wooded.

The current and historic use of the property is open space and recreation.

It is anticipated that additional and expanded descriptive information on the subject property attributes will be uncovered during a physical inspection and due diligence research by the Appraiser. All site characteristics are to be independently researched and verified by the appraiser. The Appraiser must immediately notify the AVSO review appraiser of any significant discrepancies in the property description provided. This may result in amended instructions.

PROPOSED ACQUISITION

The area outlined in red is the proposed acquisition area.

The area outlined in blue has the same ownership and must be considered in the

Larger Parcel determination.

Property Access The subject property does not have recorded legal access but does have physical access. Foot/bike access to the parcel is via Timberdoodle Trail

(https://www.fws.gov/refuge/wallkill-river/map?trail=timberdoodle-trail) when open and publicly accessible. Wallkill River NWR controls access to the trail and will close it (gated) for seasonal weather and occasional maintenance. The current landowner owns parcel 1924-2-22.01-Q0055 on the North side of the rail trail. This property has legal access via Judge Beach Road. Larger ownership is not technically contiguous as it is divided by the trail which is owned in fee by the https://www.fws.gov/refuge/wallkill-river/map?trail=timberdoodle-trail

AVSO Statement of Work Page 3 of 14

U.S. The subject property is otherwise surrounded by the refuge on all sides. There is no ROW for access to this property through the abutting lots.

Legal Description NOTE: The legal description and acreage for the property to be acquired are provided by the client and are acceptable for Appraisal Purposes Only. The below land description is included within the Deed recorded December 8, 2014, in Book

3350, Page 697 of the Sussex County Registry of Deeds. This description covers the entirety of the current ownership, including Tax Parcel IDs 1924-2-25-Q0055 and 1924-2-22.01-Q0055. The agency intends to acquire only Lot 25 (Tract 484).

If negotiations are successful a survey may be completed for the tract by FWS prior to acquisition. The full legal description must be made a part of the appraisal report. It should be included in the body of the report. Please refer to item #4 of the Special Appraisal Instructions section of this SOW for additional valuation instructions.

Minerals The mineral rights are assumed to be included in the fee simple estate. A cursory review of case file information was conducted by DME. There was not an explicit request for a mineral report and DME has indicated no mineral valuation issues associated with this assignment.

Property Interest to be Acquired

The property rights to be acquired comprise the fee simple interest, subject to reservations of record, if any.

The subject property may or may not be encumbered by the interests identified in the land description above, also found in Book 3350, Page 697 of the Sussex

County Registry of Deeds. However, FWS is relatively confident that the

Tennessee Gas Transmission Company easement located in Book 776, Page 886, and the New Jersey Power & Light Company easement located in Book 591, Page

16 are pertinent to the larger ownership of Lot 22.01 and not pertinent to Lot 25.

There are no other known encumbrances.

The appraiser must immediately notify the AVSO review appraiser, upon due diligence research, of any restrictions found in addition to these described above.

This may result in amended instructions.

Reservations/Outstanding Rights

A title report has not and will not be provided by FWS. (Please refer to the

Extraordinary Assumption regarding title in Section 2.)

Verification with the property owner regarding outstanding rights, reservations and right of ways is advised and notification of AVSO review appraiser is required should any significant outstanding rights or reservations be discovered by the appraiser during the course of the assignment.

AVSO Statement of Work Page 8 of 14

Any recorded/ unrecorded documents, conditions, agreements, easements and/or encumbrances discovered during a due diligence investigation must be identified and discussed in the appraisal report in relation to their impact on value. The

Appraiser must investigate for and promptly report additional or inaccurate encumbrances on the property to the AVSO review appraiser, which may result in amended instructions.

Personal Property None.

Tenancies None known or noted/reported by USFWS. The appraiser should confirm with the landowner whether there are any leases and/or rental agreements.

Improvements There are no known improvements located on the property to be acquired. The adjacent parcel under the same ownership does contain improvements. They consist of a single-unit residence, paddock barn and a dog kennel/breeding business. The appraiser should confirm with the landowner.

Larger Parcel As this request is for a proposed federal acquisition, the appraiser must identify the larger parcel, or larger parcels (should multiple larger parcels be determined), which satisfies the tests of unity of title, unity of highest and best use (integrated use), and contiguity/proximity as it relates to the highest and best use. UASFLA requires that the factual basis and appraiser’s analysis that led to the larger parcel determination and the determination itself be reported. The appraiser must conduct all research necessary for a well-supported Larger Parcel(s) conclusion presented in the appraisal. This is considered an integral part of the highest and best use analysis. (UASFLA 1.2.7.3.1, 1.4.3-1.4.7, 2.3.3.1, & 4.3)

The property to be acquired consists of approximately 6.61 acres in a single tract.

Additionally, research should be conducted with respect to other properties not part of the acquisition area, but potentially part of a larger parcel. For example, Sussex County PIN 1924-2-22.01-Q0055 (Lot 22.01, which is not part of the property being acquired by the Fish & Wildlife Service), lies adjacent to PIN 1924-

2-25-Q0055 (Lot 25, the property to be acquired) and contains 80.8 acres. Lot

22.01 is not contiguous to Lot 25 but is under common ownership.

If Lot 22.01 and Lot 25 are determined to be the parts of the larger parcel, a before and after appraisal methodology would be required with Lot 22.01 being the remainder property, following the acquisition. However, if the appraiser determines that Lot 25 is a separate economic unit with an independent highest and best use, a before and after situation does not exist.

The appraiser should take extraordinary care to consider the complexity of the potential larger parcel issue(s) and the potential for an expanded scope of work if a before and after scenario arises.

Although only Lot 22.01 is presented as an example of a potential controversy/issue for consideration of the larger parcel(s), it is ultimately the appraiser’s responsibility to identify any and all additional lands in proximity to the subject property having unity of ownership in conjunction with unity of highest and best use for the purposes of determining the larger parcel(s).

AVSO Statement of Work Page 9 of 14

It is requested that the appraiser please notify the AVSO review appraiser in advance, after property inspection, concerning the appraiser’s preliminary larger parcel determination.

Timber The subject property is reported to be 100% wooded. The current owner provided documentation with respect to timber, and a…
