This Request for Quote (RFQ) is issued in accordance with the Federal Acquisition Regulation (FAR) Part 12, the acquisition of commercial items and Federal Acquisition Regulation (FAR) Part 13 Simplified Acquisition Procedures.

DELIVERY/PERIOD OF PERFORMANCE
The target period of performance is 240 calendar days from the date of the Purchase Order (PO) award.
The initial appraisal target date is 90 calendar days from the date of award. If the target delivery dates are not achievable, then the contractor may provide justification (workload, etc.) and propose an alternative delivery date. See Section 6: Performance/Deliverable Requirements specified in the SOW.

TECHNICAL QUALIFICATION FOR REQUIREMENT
The quotes for this assignment are to be evaluated based on the best value to the United States Government. The quoted price should consider the information and requirements noted within the Statement of Work.
The quote for the appraisal assignment should address the evaluation criteria shown below.
Factor 1: State Certification
a. State Certification - The contractor must hold a current Certified General Appraiser license in the State of Texas or have the ability to obtain a temporary practice permit from the State of Texas. Please acknowledge the certification status in your quote (it will be confirmed on government websites). If the appraiser is licensed in another state and applying for a license in the subject jurisdiction, he/she must provide a reference to the state and certification status.
Factor 2: Technical Acceptability
a. Experience for Assignment – Both geographical competency and technical competency will be considered. The contractor shall provide a standard Appraiser's Statement of Qualifications and a signed offer letter that describes and attests to the following:
i. The appraiser is required to provide verifiable evidence of general and technical appraisal experience within his/her statement of qualifications, a resume, and/or curriculum vitae. Please identify experience appraising similar property as well as recent experience working with the federal government regarding acquisitions, dispositions, and commercial services.
ii. The appraiser’s resume or statement of qualifications should show geographical competency. If the appraiser has experience with these property characteristics, but not in the market local to the subject property, then they must so-state this fact and demonstrate his/her experience in other areas as well as the actions proposed that will allow them to complete the assignment competently.
iii. A designation from a recognized professional appraisal organization will be considered but is not required. If the appraiser is a member of a professional organization, this should be identified in the statement of qualifications or resume with the name of the organization, and the level, type, or category of such membership.
iv. The appraiser must provide a certificate of completion for the UASFLA course.
b. Qualifications of Associate Appraisers: The qualifications of any identified associate who may also be signing the appraisal report must be included with the offer. No other associates may work on the project without prior written authorization from the AVSO Review Appraiser. The appraisal report must detail the specific contribution(s) of all individuals, other than the signer(s) of the appraisal. If the contractor does not list anyone else as providing assistance, it is expected that the quote is submitted as though the individual contractor is doing 100 percent of the research, verifications, property inspections, valuation analyses and appraisal writing. Sub-contracting of this assignment is not permissible.

Factor 3: Past Performance
a. Submit a list of similar USPAP/UASFLA, projects that you have performed in the last five (5) years. Include property type, general location, agency, contact information, etc.
Verifiable UASFLA experience in the past five years is required.
b. Provide comparable sale write up sheets for two property types that demonstrate typical reporting levels for you work. Recall that these appraisals are required to conform to
UASFLA.
c. If you have not previously contracted with AVSO within the past 5 years, please provide one reference (name, position, origination, contact information) who can verify your experience.
Factor 4: Delivery The submission of the appraisal report is due within the contracted timeframe. Target is 90 days from contract award date, but alternative dates will be considered. Note that preference may be applied the quotes that meet or exceed the requested delivery date.
Factor 5: Price Quote
a. The appraiser must provide a firm-fixed price quote with any and all discounts applied for all the work to complete the assignment described in the Statement of Work (SOW).
b. Price quotes will be evaluated for completeness and reasonableness.

EVALUATION OF QUOTATIONS
FAR 52.212-2 Evaluation-Commercial Products and Commercial Services (Nov 2021)
a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award of this Purchase Order will be made on a Best Value/Trade Off basis.
The following factors shall be used to evaluate offers:
1. State Certification
2. Technical Acceptability
3. Past Performance
4. Delivery/Inspection Date
5. Price Quote
State Certification, Technical Acceptability, Past Performance, and Delivery/Inspection Date when combined, are more important than the Price Quote.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Further past performance determinations in federal contracting shall be made through a review of relevant information listed within the System of Award Management (SAM) and the Contractor Performance Assessment Reporting System (CPARS).

SECTION 2: SUBJECT OF THE APPRAISAL
Property Description: The proposed acquisition totals 3,534.8 acres and has been identified by U.S. Fish and Wildlife Services as Tracts (11,a,b). The tracts are located approximately
12.3 miles south of Anahuac, TX, in Chambers County, TX. A portion of the aggregate property is located inside the acquisition boundary of the Moody National Wildlife Refuge.
The proposed acquisition appears to include approximately (20) Chambers County, Texas tax parcels which are identified as 18307, 18294, 18322, 18304, 18179, 6962, 8125, 19179, 18477, 18474, 18151, 18313, 18316, 7578, 19181, 8126, 18161, 18309, 18317, and 8122. A tax parcel map has been included as Exhibit A with this statement of work.
According to the Alliant National Title Report, Commitment No. 202245913-04, Effective on November 1, 2024 and issued on November 8, 2024, the subject is identified as Tracts 1, 2, 3, 4, 6, 7, 8, and 9. The information below reflects the Tracts identified in the title commitment along with the tract sizes and the corresponding USFWS identified tract numbers. A map has been included as Exhibit B with this statement of work delineating USFWS Tracts (11,a,b). The area highlighted in pink is owed by other private ownership and not a part of the proposed acquisition.

U.S. Fish and Wildlife Service has provided ALTA Title Commitment #202245913-04 (issued November 8th, 2024) by Alliant National Title Insurance Company. The appraisal is to consider the exceptions noted in the title commitment documents and PLSR.
Any recorded or unrecorded documents, conditions, agreements, easements and/or encumbrances discovered must be identified and discussed in the appraisal report in relation to their impact on value.
Access: The property reportedly has legal and physical access. The appraiser must verify the subject’s access as part of the appraisal process.
Tract (11) is bounded on the west by Trinity Bay and on the east by FM 562.
Tracts (11a,b) are bounded on the west by FM 562.
Water Rights: Owned water rights, if any, are to be included in the appraisal.
Minerals: Owned mineral rights, if any, are to be included in the appraisal.

Definition of Market Value: The Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA) defines market value as follows:
Market value is the amount in cash, or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of value, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property.

Effective Date: The effective date must be no later than 30 calendar days prior to the submission of the completed appraisal report, unless the AVSO review appraiser approves in advance other conditions in writing.

- Uniform Standards of Professional Appraisal Practice (USPAP), 2020- 2021 edition.
The appraisal must conform to the following laws, regulations, and policies:
- Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (PL 91-646) as amended. Federal Regulations 49 CFR, Part
Extraordinary Assumptions: None. If the appraiser determines that extraordinary assumptions are necessary, the appraiser must contact the AVSO review appraiser for prior written approval.
Hypothetical Conditions:
None. If the appraiser determines that hypothetical conditions are necessary, the appraiser must contact the AVSO review appraiser for prior written approval.
Jurisdictional Exceptions: The appraiser has been instructed to produce a UASFLA compliant appraisal.
Section 1.2.4 of UASFLA states that “appraisers should not link opinions of value under these Standards to a specific opinion of exposure time.” USPAP requires the appraiser to develop and report a reasonable exposure time if it is a component of the definition of market value, which contravenes the UASFLA. Therefore, the appraiser should invoke USPAP’s Jurisdictional Exception Rule.

Pre-Work Meeting: The appraiser will be required to attend a pre-work meeting. A meeting with the appraiser will be conducted prior to the inspection of the property. The purpose of the meeting will be to discuss the Statement of Work. The meeting may occur at the property at the time of the inspection or by teleconference. If by teleconference, the AVSO review appraiser will coordinate the date and time with the appraiser.
Property Inspection The Appraiser must inspect the subject property and all the market properties used in direct comparison, unless the AVSO Review Appraiser has approved other conditions in writing (UASFLA Section 1.2.6.3.). For appraisals with an intended use of acquisition or exchange, the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (PL 91-646) as amended and the Uniform Appraisal Standards for Federal Land Acquisitions (Section 1.2.6.4), require the Appraiser to offer the property owner and/or the owner's representative an opportunity to accompany the Appraiser during the property inspection. The Appraiser must certify in the report that such an offer was extended (UASFLA Section 2.3.1 .4.).
Permission to enter upon and appraise the property has been granted. The landowner would like to be contacted regarding the opportunity to accompany the Appraiser on the inspection. The permission document is included in the exhibits.
You must notify the AVSO Review Appraiser in advance of when the property inspection will occur.
Highest & Best Use / Larger Parcel Analyses:
Upon completion of the Highest and Best Use and Larger Parcel analyses, the contract appraiser must discuss the conclusions with the review appraiser.
Communication between the Review Appraiser and the Appraiser is essential since the appraiser’s larger parcel conclusion may require modification of the appraisal assignment.
Controversies / Issues 1,739.11 acres of the aggregate 3,534.8 acres are encumbered by an existing conservation easement. The appraisal must consider the impact of this encumbrance.

SECTION 5: APPRAISAL REQUIREMENTS AND INSTRUCTIONS
1. If applicable, strict compliance with UASFLA Sections 1.5.2.1, 1.5.2.4, and Appendix E is required.
2. The AVSO Statement of Work, engagement letter, and other assignment instructions must be included in the addenda to the appraisal report. Reference to these documents should be provided in the body of the report.
3. Unsigned and draft reports will not be accepted.
4. The appraisal report should conform to the sequence and content described in Section 2 of the UASFLA.
5. If including any proprietary information in the appraisal, the appraiser must gain concurrence from the AVSO review appraiser and deliver the proprietary information in a separate binder.
6. When the appraiser has performed any services regarding the subject property within the prior three years, the he/she must disclose this to the AVSO review appraiser prior to engagement.
7. AVSO is the appraiser's sole client. The appraiser may not communicate assignment results to any party except AVSO, unless authorized to do so in writing by AVSO.
8. If the appraiser discovers material facts which differ from those provided by AVSO or encounters circumstances which prevent the appraiser from developing an unbiased appraisal, the appraiser must contact the AVSO review appraiser for instructions.
9. Any communication with the bureau realty contact or property owner must include the assigned AVSO review appraiser.
10. Even though communication is encouraged with the property owner and FWS, only the assigned AVSO review appraiser can modify appraisal instructions (in writing).
11. Any communications between AVSO (Client) and the contract appraiser that pertain to the appraisal review (i.e., review questions, comments, concerns, etc.) are confidential. Disclosure of these communications requires the written approval of the Client.
12. The appraiser must consider the appraisal report and review comments and all DOI internal documents furnished to the appraiser to be confidential. Refer all requests for information concerning the appraisal to the AVSO Review Appraiser.
13. This appraisal assignment will be an engagement between the appraiser and AVSO, the appraiser’s client. The appraiser must address any questions regarding appraisal instructions and/or technical requirements for the appraisal to the AVSO review appraiser. Appraisal assignment contacts are provided as an exhibit in Section 7 of this Statement of Work.

SECTION 6: PERFORMANCE / DELIVERABLE REQUIREMENTS
Appraisal Report Due: Submission of the appraisal report is due within the contracted timeframe. Target is 90 days from contract award date, but alternative dates will be considered.
Note that preference may be applied the quotes that meet or exceed the requested delivery date.
Review & Comments Provided: Target date is less than 20 calendar days after receiving initial appraisal report.
Any subsequent revisions are to be completed within 10 days.
Deliverables: Digital report
Invoice Submission: 60 days after Final Appraisal Report acceptance by the Government.
Closeout: 60 days after Final Appraisal Report
Any adjustments to the above Deliverable/Task Schedule must be submitted to the Contracting Officer (CO). The Contracting Officer will approve or reject the request by email.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.
Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services.
