About this file
This document appears to be a Solicitation for a Land Exchange between the Department of the Interior's Interior Business Center and the APPA organization. The Solicitation Number is 140D0424Q1007 and it is for the exchange of Federal Tract 364-17A and Non-Federal Tract 358-27. The required products or services are not explicitly stated, as this seems to be a template or placeholder document without details on the specific land exchange requirements. No information is provided on response dates, award dates, pricing terms, set asides, or incumbents. This document appears to be a high-level placeholder for the land exchange opportunity, rather than containing the full details of the requirement.

Document Title
APPA Land Exchange Non-Federal Tract 358-27 and
This federal exchange falls under the requirements of UASFLA Section 1.12: Special Considerations in Appraisals for Federal Land Exchanges. Please reference this section, particularly as it relates to the larger parcel.
The boundaries of the properties to be exchanged are defined by the exchange agreement and the appraiser should opine within the boundaries of the properties to be exchanged as it pertains to the larger parcel analysis. In addition, property outside the exchange boundaries, if relevant, should also be recognized and discussed in the larger parcel analysis including its relevancy or lack of relevancy to the larger parcel.
Per UASFLA Section 1.12, page 52, it is important for the appraiser to recognize that the same method of valuation must be utilized for both the federal and nonfederal lands.
The appraiser must conduct all research necessary for a well-supported larger parcel conclusion presented in the appraisal report and include the data and analysis that satisfies the tests of unity of title, unity of highest and best use (integrated use), and contiguity as it relates to the highest and best use. (UASFLA 1.2.7.3.1, 1.4.3-1.4.7, 2.3.3.1, & 4.3.) It is the contract appraiser’s responsibility to perform a larger parcel analysis and report their findings and conclusions, as required by UASFLA.
Highest and Best Use
The appraiser shall determine the highest and best use of the subject property as vacant and as improved on the effective date of value. All methodology utilized in development and reporting of the highest and best use will, to the extent practical, be based on market derived data. The appraiser must consider all applicable local, state, and federal ordinances, regulations, land use restrictions, and local practices when concluding the highest and best use of the subject property. Adequate support for the highest and best use conclusion must be included in the appraisal report. Each test of highest and best use (legally permissible, physically possible, financially feasible, and maximally productive) must be discussed and appropriately supported.
The AVSO reviewer requires an interim submission in writing of the appraiser’s highest and best use conclusion once the highest and best use analysis is completed. The highest and best use conclusion must be an economic use that is not speculative or conjectural.
Property Interest
Fee simple estate subject to the exceptions indicated in the title report and reservations, if any, by the property owner. See Outstanding Rights section below.
The appraiser must immediately notify the AVSO review appraiser of any indications of rights contrary to these described. This may result in amended instructions. The appraiser must investigate for and promptly report additional or inaccurate encumbrances on the property to the AVSO reviewer.
Document Title
APPA Land Exchange Non-Federal Tract 358-27 and
Outstanding Rights
Although subject property information is provided to the appraiser in this statement of work, the appraiser must perform his/her own independent research and investigation to ensure typical and appropriate due diligence for an appraisal assignment. The appraiser must research and address discovered public/government or private use restrictions, or encumbrances on, or transfers of, any of the property rights and promptly report additional or inaccurate encumbrances on the property to the AVSO reviewer. These could include property access, minerals, timber, water, or any other use rights.
As required by UASFLA, Sections 1.3.1.5, 1.3.1.6, and 4.4.2.4.1 the contract appraiser is to research and analyze the following: the last known document transferring title or affecting the appraised property’s use, the ten-year history of transfers for the property, and at least a three-year history of any leases.
A title report is provided as an exhibit. The subject tract is encumbered with recorded utility easements, and easements, rights of way, and/or permits to the USA for the use of the Appalachian Trail. The property is also subject to an Agricultural Resolution with The Township of Middle Paxton, along with subdivision conditions. Any recorded or unrecorded documents, conditions, agreements, easements and/or encumbrances discovered must be identified and discussed in the appraisal report in relation to their impact on value. The appraisal report must note if the exception influences the value of the subject property.
Reservations

Personal Property None
Property Access
The property has non-vehicular access over adjacent public land’s trails.
Environmental Conditions
There are no known detrimental environmental conditions.
Property Owner
Central Pennsylvania Conservancy, Inc.
The owner contact information will be provided to the appraiser upon award. The appraiser must contact the property owner to arrange the property inspection and to discuss the property in detail.
Document Title
APPA Land Exchange Non-Federal Tract 358-27 and
The appraisal report must include information learned from the owner about the property itself, the owner’s acquisition and use of the property, the subject’s marketing history, and market data provided, if any.
The appraiser must give the property owner, or the owner’s designated representative, an opportunity to accompany the appraiser during the property inspection, and the results of such offer must be stated in the appraisal report certification. [Uniform Relocation Assistance & Real Property Acquisition Policies Act of 1970 {PL 91-646} as amended, and the UASFLA 6th Edition Section 2.3.1.4, page 58.]
Occupancy
The property is vacant land with one structure known as Peters Mountain Shelter. There are no known leases or other contracts.
SECTION 2 – Appraisal Requirements & Instructions
Appraisal Standards
The appraisal must conform to the following appraisal standards:
• Uniform Standards of Professional Appraisal Practice (USPAP – current edition in effect on the date of the report)
• Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA, 2016), 6th edition.
The appraiser must be familiar with UASFLA 4.10 and comply with the portions related to Federal land exchanges.
Applicable Law, Regulation, and Policy
The appraisal must conform to the following laws, regulations, and policies:
• Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (PL 91-
646) as amended
• Federal Regulations 49 CFR, Part 24
Market Value Definition
Market value is the amount in cash, or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of value, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property.
[Interagency Land Acquisition Conference, Uniform Appraisal Standards for Federal Land Acquisitions, 6th edition. (The Appraisal Foundation, 2016), p.10]
Document Title
APPA Land Exchange Non-Federal Tract 358-27 and
Date of Value
The date of value is the date of the last property inspection, which should be within 30 calendar days prior to the submission of the initial appraisal report, unless the AVSO review appraiser approves in advance other conditions in writing.
Extraordinary Assumptions
None. If the appraiser determines extraordinary assumptions are necessary for the completion of the assignment, they must contact the AVSO reviewer for prior written approval.
Hypothetical Conditions
The appraisal must base the conclusion of market value on the following hypothetical condition:
“It is a hypothetical condition that as of the effective date of value, non-federal Tract 358-27, is not encumbered by the Keystone Recreation, Park and Conservation Fund Act deed restriction.”
The hypothetical condition is an assignment condition that requires a legal instruction, and the legal instruction is included as an exhibit. To comply with USPAP, please also state the use of the hypothetical condition might have affected the assignment results. If the appraiser determines other hypothetical conditions are necessary, they must contact the AVSO reviewer for prior written approval.
Jurisdictional Exceptions
The only jurisdictional exception authorized for use is regarding the definition of market value and the development and reporting of a reasonable exposure time linked to the value opinion. Contrary to USPAP, Section 1.2.4 of the Uniform Appraisal Standards of Federal Land Acquisition states an estimate of market value linked to exposure time and marketing time “… is inappropriate for and must not be included in appraisal reports prepared for federal land acquisitions under these Standards.” Because the appraiser is performing the appraisal in compliance with UASFLA, the Jurisdictional Exception Rule is being invoked. Section 4.2 of UASFLA provides the legal authority for invoking the Jurisdictional Exception Rule to void Standard Rules 1-2(c) and 2-2(a) of USPAP.
If the appraiser believes that USPAP’s Jurisdictional Exception Rule needs to be invoked to comply with additional law or regulation, they must contact the AVSO reviewer to obtain prior written approval.
Placement in Report
The appraiser must clearly identify all extraordinary assumptions, hypothetical conditions, jurisdictional exceptions, general assumptions, and limiting conditions in a prominent location within the report.

Property Inspection
The contracted appraiser must inspect the subject property and all comparable listings, sales and/or rentals as applicable, used in the analysis and in direct comparison, unless the AVSO review appraiser has approved other conditions in writing.
The subject property is a large tract of land that will likely require hiking to adequately inspect the subject property.
The appraiser must give the property owner, or the owner’s designated representative, an opportunity to accompany the appraiser during the property inspection, and the results of such offer must be stated in the appraisal report certification. [Uniform Relocation Assistance & Real Property Acquisition Policies Act of 1970 (PL 91-646) as amended and the Uniform Appraisal Standards for Federal Land Acquisitions, 6th Ed. (Section 2.3.1.4, pages 58)]. The appraiser must notify the AVSO review appraiser once an inspection date is scheduled.
Pre-Appraisal Meeting
The appraiser is required to attend a pre-work call with the assigned AVSO review appraiser. The AVSO reviewer will coordinate the date and time of the pre-work call once the contract is awarded. If any significant items of concern are observed during the property inspection, from aerial photographs, or from other materials researched during the appraisal process that were not discussed in the pre-appraisal meeting, the appraiser must contact the AVSO reviewer before continuing with the appraisal assignment.
Controversies/Issues
1. This appraisal request is one of two appraisals required to assist in the proposed exchange of two properties. This statement of work is for the appraisal of APPA Tract 358-27, the nonfederal parcel.
A second statement of work applies to the appraisal for APPA Tract 364-17A, the federal parcel.
Both appraisals will be completed by the same appraiser.
2. According to the exchange agreement and the title commitment, the subject is currently encumbered with a deed restriction by the Pennsylvania Department of Conservation and Natural Resources, also referenced as the Keystone Recreation, Park and Conservation Fund Act deed restriction. However, the property must be appraised under the hypothetical condition that the DCNR restrictions, which are discussed in the documents included as exhibits, do not encumber or restrict the property in this assignment based on the legal instruction issued.
3. The subject is also encumbered by a NPS protective easement, as the Appalachian Trail runs through the southern portion of the property in an east/west direction. The appraisal must consider the impact, if any, of the protective easement on the market value, and address it in the appraisal report.

Should the appraiser identify any controversies or issues during the course of the assignment that were not previously discussed with the AVSO reviewer, the appraiser must immediately notify the AVSO reviewer before proceeding with the assignment.
Legal Instructions
This property is part of a land exchange between the Central Pennsylvania Conservancy, Inc.
(APPA 358-27) and The United States of America (APPA 364-17A).
A legal instruction was issued to use a hypothetical condition that the subject property is not encumbered by the DCNR Keystone Act Deed Restriction. Reference to the legal instruction and use of the hypothetical condition must be prominently stated in the report.
General Appraisal Requirements & Instructions
1. The appraiser must hold a valid license as a Certified General Appraiser for the jurisdiction in which the subject property is located and insert a copy of the license within the appraisal report.
(Valid credentials include those obtained directly from the jurisdiction, those issued under a reciprocity agreement, and/or those characterized as “temporary” under the jurisdiction’s licensing and certification statutes.)
2. The AVSO statement of work, other assignment instructions and engagement letter must be included within the Addenda to the appraisal report.
3. This statement of work is intended to identify the subject and the potential appraisal problems the appraiser is expected to solve. This is the best information gathered at the time that the statement of work is written, and appraisal proposals are requested, but it is not intended to be relied upon by the appraiser as the final appraisal report information. While the appraiser must analyze the information provided (title policy, exhibits, statement of work, etc.), the final appraisal must reflect an appraiser’s typical and appropriate due diligence including the subject and market data research, interviews, and verifications. This information may differ from the information listed in this statement of work. Differences from the statement of work information should be discussed promptly with the reviewer during the appraisal process prior to submission of the appraisal report.
{UASFLA 1.3, page 18}.
4. All appraisals complying with UASFLA must conform to the sequence and content outlined in UASFLA, Appendix B).
5. UASFLA (Page 56) states that a report prepared in accordance with UASFLA Sections 2.3, 2.4, and
2.5 is consistent with or exceeds the requirements for an appraisal report under Standard 2 of
USPAP.
6. The appraisal report content should rely on the “UASFLA Checklist” provided by AVSO.
7. The appraiser must appraise the subject property in its “as is” condition as of the effective date of value, unless authorized in writing by the AVSO reviewer to do otherwise.

8. Color photographs and maps of comparable properties shall be included in the appraisal report.
AVSO will accept aerial photographs for comparable properties unless the aerial photographs do not accurately represent the property as of the date of inspection. The appraiser must photograph any unusual property features from the ground.
9. The appraisal report is required to include adjustment grids/tables demonstrating either quantitative or qualitative adjustments for the sales comparison analyses. If both types of adjustments are used, the quantitative adjustments must be applied before the qualitative adjustments are applied. The preferred method of adjusting comparable sales is through supported quantitative adjustments (percentage, $/sf, etc.).
Qualitative adjustments (similar, inferior, or superior) should be used when the market variables cannot be quantified. When the appraiser must resort to qualitative analyses, support for that method requires a more extensive discussion of the appraiser’s reasoning why a comparable is similar, inferior, or superior to the subject property. UASFLA notes in 1.5.2.3 page 28, “When appraisers must resort to qualitative adjustments, more extensive discussion of the appraiser’s reasoning is generally required. This methodology may also require the presentation of a greater number of comparable sales.”
All adjustments must be supported by clear, appropriate, and credible analysis based on documented market research. Mere references to undisclosed “trends” or reliance on the appraiser’s “opinion” or “judgment” without market support is unacceptable. Market support may include discussions with sellers/buyers, lessors/lessees, potential investors, brokers, etc.
10. The appraisal report will be reviewed for compliance with the terms of this Statement of Work (including all cited standards). Any findings of inadequacy will require clarification and/or correction.
11. The appraiser shall consider the appraisal report and all DOI internal documents furnished to the appraiser to be confidential. Refer all requests for information concerning the appraisal to the AVSO reviewer.
12. AVSO will not normally accept custody of confidential or proprietary information. Should the appraiser find it necessary to rely on confidential or proprietary information, then the appraiser must contact the AVSO reviewer for instructions prior to delivering the initial appraisal report.
13. While the public is not an intended user of the appraisal report, the Freedom of Information Act (FOIA) and bureau policy may result in the release of all or part of the appraisal report to others.
14. When the appraiser has performed any services regarding the subject property within the three prior years, they must disclose the extent of the service in the bid proposal and on the signed certification page of the appraisal report.
Special Appraisal Instructions
Document Title
APPA Land Exchange Non-Federal Tract 358-27 and
1. The appraiser should review the SOW and all provided attachments in detail to ensure they have a good understanding of the appraisal problem, including analysis of any easements and encumbrances running along or through the subject property that may impact value.
2. The determination of the larger parcel is interrelated with the highest and best use. This analysis must include comments and factual support for all four tests of a highest and best use analysis. The analysis must consider possible property uses, possible parcel division, the competitive market supply and demand, along with consideration of the most probable use(s), probable user(s), and the timing of the use if a change in use is anticipated.
3. Review comments provided in writing to the appraiser will require a response in writing from the appraiser. Any requested revisions/additions to the appraisal must be highlighted in a contrasting color in the subsequent electronic report submitted to the reviewer prior to the final, signed electronic copy of the appraisal.
4. Documentation of all comparable sales and other comparable market data utilized in the appraisal must follow UASFLA’s verification, analysis, and reporting requirements (pages 26 and 122). All comparable market data must be verified by the appraiser with the buyer, seller, broker, or other person having knowledge of the price, terms, and conditions of sale. The appraiser should not use sales to or from government agencies in the appraisal unless the sales are used to supplement other open market, competitive property sales. Sale verification requirements, particularly for those sales to governmental entities or non-governmental organizations (NGOs) for which extraordinary verification requirements apply, are outlined in UASFLA 6th Edition pages 28, 219, Section 4, and Appendix E.
5. Even though communication is encouraged with the National Park Service (NPS), only the assigned
AVSO reviewer can modify appraisal instructions (in writing).
6. The appraiser may not communicate assignment results to any party, except the AVSO reviewer, until authorized to do so in writing by AVSO.
7. Any communication (verbal or written) with the NPS realty contact shall include the assigned
AVSO reviewer.

However, property outside the exchange boundaries, if relevant, should be recognized and discussed in the larger parcel analysis including its relevancy or lack of relevancy to the larger parcel.
