The Department of the Interior (DOI)/Interior Business Center (IBC), Acquisition Services Directorate (AQD) on behalf of the Appraisal & Valuation Services Office (AVSO) is issuing a request for quotation for appraisal report on:

TECHNICAL QUALIFICATION FOR REQUIREMENT
FACTOR A: TECHNICAL QUALIFICATIONS
1. State Certification: The appraiser must hold a current Certified General Appraiser license from the State of Montana, as demonstrated by providing a copy of their current state licensing certificate. In lieu of a physical copy, the certificate/license number can be provided and will be verified.
2. Technical Acceptability:
a. Experience for Assignment: Both geographical competency and technical competency will be considered. The appraiser shall provide a standard Appraiser’s Statement of Qualifications and a signed proposal letter that describes and attests to the following:
i. Identify years of experience appraising rural property in the state of Montana to
UASFLA standards.
ii. Identify types of rural property appraised in Choteau County, Montana; and/or surrounding/nearby counties. The appraiser must demonstrate geographic competence in the subject market.
iii. The appraiser must have completed the education or taken the necessary steps to conduct an appraisal in full compliance with the Uniform Appraisal Standards for Federal Land Acquisitions, 6th Edition.
b. Qualifications of Associate Appraisers: Sub-contracting of this assignment is not permissible. Any associates expected to contribute to the appraisal must be identified in the proposal and a statement of qualifications and a copy of their license or permit must be provided. The associate appraiser(s) must hold a current Certified General Appraiser license from the State of Montana as demonstrated by providing a copy of their state licensing certificate. In lieu of a physical copy, the certificate/license number can be provided and will be verified.
c. The proposal should consider the target date of delivery. The target date for the submission of the appraisal report is 160 days from the date of contract award. If the appraiser determines that this date is not feasible, then an alternative delivery date may be provided in the proposal.

1. Past Performance
a. Submit a list of at least two of the most recent UASFLA-compliant appraisal reports completed. Include property type, size of property, date of value, location, and the client contact information for reference purposes. If none completed, please state such.
Factor C - Price Quote
The appraisal fee should be commensurate with the location and complexity of the assignment.
The appraiser must provide a firm-fixed price quote with any and all discounts applied for all the work to complete the assignment described in the Statement of Work.

EVALUATION OF QUOTATIONS
FAR 52.212-2 Evaluation-Commercial Products and Commercial Services (Nov 2021)
a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award of this Purchase Order will be made on a Best Value/Trade Off basis.
• The following factors shall be used to evaluate offers:
A. Technical, B. Past Performance - Delivery/Inspection Date and C. Price.
Technical, and Past Performance - Delivery/Inspection Date when combined, are more important than cost or price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

SECTION 2: SUBJECT OF THE APPRAISAL
Property Description: The Appraisal and Valuation Services Office (AVSO) is needing appraisal services relating to a proposed acquisition of approximately 622.35 acres in Choteau County, Montana, partially within the Upper Missouri River Breaks National Monument and the Missouri Wild & Scenic River boundary. It is roughly rectangular in shape and has a large, flat plateau that runs into a cliff that falls onto the banks of the Missouri River. Legal Description of Proposed Acquisition:1

Property Rights Appraised: Fee simple estate subject to outstanding rights and/or reservations of record.

Minerals: Minerals are to be included.
Improvements: There is a small shed on the property, as well as a grass airstrip, that are to be included.

(2) with the owner of the property (if possible); (3) by comparing it with aerial or other maps available in city, county, or other governmental offices; and (4) by comparing it with public records in the recorder’s, auditor’s, assessor’s, tax collectors, or other appropriate city or county offices. If the appraiser discovers a significant error or inconsistency, the appraiser should consult the client for clarification before proceeding with the appraisal.

Past and Current Uses: It is reported by the BLM that the past and current use is rural recreational.
There are no known agricultural or commercial uses, except for fee-based recreational access (hunting/river access).
Property Access: Per the BLM: The property does not have insurable access by road or land, however it does have a private airstrip that allows for access by small aircraft.
The property also borders the Missouri River, which affords access by waterway. Adjacent BLM lands have public access by Graceville Road, a county road. A two-track then branches off the county road, traveling through BLM to the subject property. This two-track is declared open to motorized travel by BLM.
Access information is provided by the BLM; however it is the responsibility of the appraiser to investigate access.
SECTION 3: APPRAISAL PROBLEM IDENTIFICATION
Client: U.S. Department of the Interior, AVSO
Intended Users: AVSO and BLM on behalf of the United States of America
Intended Use: To assist the client agency in its determination of the amount to be paid as just compensation for the property rights acquired.2
Type of Value: Market Value subject to reservations and exceptions of record.
Definition of Market Value: The definition of market value to be used in the appraisal as follows:
Market value is the amount in cash, or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of value, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property.3
Effective Date: The effective date (date of value) shall be no more than 30 days prior to the date of the appraisal report. 4

Applicable Standards: Applicable standards include the Uniform Appraisal Standards for Federal Land Acquisitions, 6th Edition (UASFLA); and the Uniform Standards of Professional Appraisal Practice, 2020-2023 Edition (USPAP).
Extraordinary Assumptions: None. If the appraiser determines that extraordinary assumptions are necessary, he/she must contact the AVSO Review Appraiser for prior written approval.
Hypothetical Condition: None. If the appraiser determines that a hypothetical condition is necessary he/she must contact the AVSO Review Appraiser for prior written approval.
Jurisdictional Exceptions: The appraiser has been instructed to produce a UASFLA compliant appraisal.
Section 1.2.4 , p 10, of the UASFLA states that “appraisers should not link opinions of value under these Standards to a specific opinion of exposure time.” USPAP Standards Rule 1-2c(iv) (pg. 17) requires the appraiser to develop and report a reasonable exposure time if it is a component of the definition of market value, which contravenes the UASFLA. Therefore, the appraiser should invoke USPAP’s Jurisdictional Exception Rule to comply with the UASFLA.
Pre-Work Discussion: A phone or video call with the appraiser will be conducted prior to the inspection of the property. The purpose of the phone/video call will be to discuss the Statement of Work. The AVSO Review Appraiser will coordinate the date and time of the meeting with the appraiser. Representatives from the BLM will be invited to attend the meeting/call.
Property Inspection: The appraiser must inspect the subject property and all comparable sales used in the appraisal, unless the AVSO Review Appraiser has approved other conditions in writing. The inspection of the subject property will be coordinated with the BLM realty staff and/or property owner or property owner’s representative. The owner or owner’s representative must be given the opportunity to accompany the appraiser during the inspection. The appraiser must notify, in advance, both the BLM and AVSO Review Appraiser when the subject property inspection will occur.
Larger Parcel: The appraiser must conduct all research necessary to develop a well-supported larger parcel conclusion in accordance with UASFLA 6th Edition.

Controversies / Issues: Sales to the Government and Environmental / Public Interest Organizations
Sales to government entities and environmental / public interest organizations are inherently problematic for federal appraisal purposes because they routinely involve non-market considerations, making them inaccurate indicators of market value and therefore may be improper to consider as comparable sales.
If the appraiser determines, after careful analysis and verification, that a sale to a government entity or environmental / public interest organization was a true open-market transaction, the sale may be appropriate to consider, particularly if there is an insufficient number of private sales available for use in the sales comparison approach to value. However, such a determination requires extraordinary verification due to the non-market considerations inherent in most acquisitions involving the government and public interest organizations.
If sales involving the government and/or environmental / public interest organizations are used, the appraiser must strictly adhere to the extraordinary verification process as per UASFLA. As an assignment condition, the appraisal report must include adequate discussion relating to each of the required elements in the extraordinary verification process, as discussed in UASFLA 1.5.2.4 and summarized in Appendix E of UASFLA.
SECTION 5: APPRAISAL REQUIREMENTS AND INSTRUCTIONS
1. The AVSO Statement of Work (SOW), engagement letter, and other assignment instructions must be included in the addenda to the appraisal report. Reference to these documents should be provided in the body of the report.
2. While the public is not an intended user of the appraisal report, the Freedom of Information Act (FOIA) and Agency policy may result in the release of all or part of the appraisal report to others.
3. The appraiser shall consider the appraisal report(s), assignment results, and all U.S. Department of the Interior internal documents furnished to the appraiser to be confidential. All requests for information concerning the appraisal should be directed to the AVSO Review Appraiser.
4. AVSO will not normally accept custody of confidential information. Should the appraiser find it necessary to rely on confidential information, he/she will contact the AVSO Review Appraiser for instructions.
5. When the appraiser has performed any services regarding the subject property within the prior three years, he/she must disclose this information to the AVSO Review Appraiser prior to engagement.
6. The appraisal report content should rely on the “AVSO Review Checklist” attached as an exhibit to this Statement of Work. The appraiser is encouraged to refer to this checklist prior to submitting the appraisal report for review.
7. AVSO is the appraiser’s client. The appraiser may not communicate assignment results to any party except AVSO, unless authorized to do so in writing by AVSO.

8. If the appraiser discovers material facts which differ from those provided by AVSO or encounters circumstances which prevent the appraiser from developing an unbiased appraisal, the appraiser must contact the AVSO Review Appraiser for instructions.
9. Should controversies or issues be identified by the appraiser during the assignment, the AVSO Review Appraiser shall be notified immediately.
10. Only the assigned AVSO Review Appraiser can modify appraisal instructions (in writing). Any changes to and/or clarifications of the Statement of Work may only be conveyed by the AVSO Review Appraiser.
11. The contact information for the AVSO Review Appraiser and other appraisal assignment contacts will be provided upon contract award.
SECTION 6: PERFORMANCE & SUBMISSION REQUIREMENTS
Appraisal Report Due: The target date for the initial submission of the appraisal report is 150 days from contract award. If the appraiser determines that a performance period of 150 days is not feasible, then an alternative delivery date may be provided in the proposal. The appraiser is requested to provide a digital copy of the report that will allow the AVSO Review Appraiser to search text, highlight text, and include review comments.
Review Period: The review period will be 20 days from the receipt of the appraisal report. The report will be reviewed for compliance with the terms of this Statement of Work. Any findings of inadequacy will require clarification and/or correction.
Review & Comments Provided: Review comments and/or suggestions, if any, will be provided to the appraiser, and to the extent that revisions are required, the appraiser shall complete the revisions within 10 days. A digital copy (pdf) of the revised report must be submitted directly to the AVSO Review Appraiser.
Final Appraisal Report: Once the report is reviewed and approved by AVSO, the Review Appraiser will notify the BLM and the appraiser in writing that the review process has been completed. The AVSO Review Appraiser will provide the BLM with a digital copy (pdf) of the final appraisal report at that time. The appraiser’s submission of the report to any other party is strictly prohibited, unless written approval is provided by the AVSO Review Appraiser.

52.204–30 Federal Acquisition Supply Chain Security Act Orders—Prohibition (Dec 2023)
(a) Definitions. As used in this clause— Covered article, as defined in 41 U.S.C. 4713(k), means—
(1) Information technology, as defined in 40 U.S.C. 11101, including cloud computing services of all types;
(2) Telecommunications equipment or telecommunications service, as those terms are defined in section 3 of the Communications Act of 1934 (47 U.S.C. 153);
(3) The processing of information on a Federal or non-Federal information system, subject to the requirements of the Controlled Unclassified Information program (see 32 CFR part 2002); or
(4) Hardware, systems, devices, software, or services that include embedded or incidental information technology.
FASCSA order means any of the following orders issued under the Federal Acquisition Supply Chain Security Act (FASCSA) requiring the removal of covered articles from executive agency information systems or the exclusion of one or more named sources or named covered articles from executive agency procurement actions, as described in 41 CFR 201–1.303(d) and (e):
(1) The Secretary of Homeland Security may issue FASCSA orders applicable to civilian agencies, to the extent not covered by paragraph (2) or (3) of this definition. This type of FASCSA order may be referred to as a Department of Homeland Security (DHS) FASCSA order.
(2) The Secretary of Defense may issue FASCSA orders applicable to the Department of Defense (DoD) and national security systems other than sensitive compartmented information systems. This type of FASCSA order may be referred to as a DoD FASCSA order.
(3) The Director of National Intelligence (DNI) may issue FASCSA orders applicable to the intelligence community and sensitive compartmented information systems, to the extent not covered by paragraph (2) of this definition. This type of FASCSA order may be referred to as a DNI FASCSA order.
Intelligence community, as defined by 50 U.S.C. 3003(4), means the following—
(1) The Office of the Director of National Intelligence;
(2) The Central Intelligence Agency;
(3) The National Security Agency;
(4) The Defense Intelligence Agency;
(5) The National Geospatial-Intelligence Agency;
(6) The National Reconnaissance Office;

(8) The intelligence elements of the Army, the Navy, the Air Force, the Marine Corps, the Coast Guard, the Federal Bureau of Investigation, the Drug Enforcement Administration, and the Department of Energy;
(9) The Bureau of Intelligence and Research of the Department of State;
(10) The Office of Intelligence and Analysis of the Department of the Treasury;
(11) The Office of Intelligence and Analysis of the Department of Homeland Security; or
(12) Such other elements of any department or agency as may be designated by the President, or designated jointly by the Director of National Intelligence and the head of the department or agency concerned, as an element of the intelligence community.
National security system, as defined in 44 U.S.C. 3552, means any information system (including any telecommunications system) used or operated by an agency or by a contractor of an agency, or other organization on behalf of an agency—
(1) The function, operation, or use of which involves intelligence activities; involves cryptologic activities related to national security; involves command and control of military forces; involves equipment that is an integral part of a weapon or weapons system; or is critical to the direct fulfillment of military or intelligence missions, but does not include a system that is to be used for routine administrative and business applications (including payroll, finance, logistics, and personnel management applications); or
(2) Is protected at all times by procedures established for information that have been specifically authorized under criteria established by an Executive order or an Act of Congress to be kept classified in the interest of national defense or foreign policy.
Reasonable inquiry means an inquiry designed to uncover any information in the entity's possession about the identity of any covered articles, or any products or services produced or provided by a source. This applies when the covered article or the source is subject to an applicable FASCSA order. A reasonable inquiry excludes the need to include an internal or third-party audit.
Sensitive compartmented information means classified information concerning or derived from intelligence sources, methods, or analytical processes, which is required to be handled within formal access control systems established by the Director of National Intelligence.
Sensitive compartmented information system means a national security system authorized to process or store sensitive compartmented information.
Source means a non-Federal supplier, or potential supplier, of products or services, at any tier.
(b) Prohibition. (1) Unless an applicable waiver has been issued by the issuing official, Contractors shall not provide or use as part of the performance of the contract any covered article, or any products or services produced or provided by a source, if the covered article or the source is prohibited by an applicable FASCSA orders as follows:
(i) For solicitations and contracts awarded by a Department of Defense contracting office, DoD FASCSA orders apply.
(ii) For all other solicitations and contracts DHS FASCSA orders apply.
(2) The Contractor shall search for the phrase “FASCSA order” in the System for Award Management (SAM) at https://www.sam.gov to locate applicable FASCSA orders identified in paragraph (b)(1).
(3) The Government may identify in the solicitation additional FASCSA orders that are not in SAM, which are effective and apply to the solicitation and resultant contract.
(4) A FASCSA order issued after the date of solicitation applies to this contract only if added by an amendment to the solicitation or modification to the contract (see FAR 4.2304(c)). However, see paragraph (c) of this clause.
(5)(i) If the contractor wishes to ask for a waiver of the requirements of a new FASCSA order being applied through modification, then the Contractor shall disclose the following:
(A) Name of the product or service provided to the Government;
(B) Name of the covered article or source subject to a FASCSA order;
(C) If applicable, name of the vendor, including the Commercial and Government Entity code and unique entity identifier (if known), that supplied or supplies the covered article or the product or service to the Offeror;

(D) Brand;
(E) Model number (original equipment manufacturer number, manufacturer part number, or wholesaler number);
(F) Item description;
(G) Reason why the applicable covered article or the product or service is being provided or used;
(ii) Executive agency review of disclosures. The contracting officer will review disclosures provided in paragraph (b)(5)(i) to determine if any waiver is warranted. A contracting officer may choose not to pursue a waiver for covered articles or sources otherwise covered by a FASCSA order and to instead pursue other appropriate action.
(c) Notice and reporting requirement. (1) During contract performance, the Contractor shall review SAM.gov at least once every three months, or as advised by the Contracting Officer, to check for covered articles subject to FASCSA order(s), or for products or services produced by a source subject to FASCSA order(s) not currently identified under paragraph (b) of this clause.
(2) If the Contractor identifies a new FASCSA order(s) that could impact their supply chain, then the Contractor shall conduct a reasonable inquiry to identify whether a covered article or product or service produced or provided by a source subject to the FASCSA order(s) was provided to the Government or used during contract performance.
(3)(i) The Contractor shall submit a report to the contracting office as identified in paragraph (c)(3)(ii) of this clause, if the Contractor identifies, including through any notification by a subcontractor at any tier, that a covered article or product or service produced or provided by a source was provided to the Government or used during contract performance and is subject to a FASCSA order(s) identified in paragraph (b) of this clause, or a new FASCSA order identified in paragraph (c)(2) of this clause. For indefinite delivery contracts, the Contractor shall report to both the contracting office for the indefinite delivery contract and the contracting office for any affected order.
(ii) If a report is required to be submitted to a contracting office under (c)(3)(i) of this clause, the Contractor shall submit the report as follows:
(A) If a Department of Defense contracting office, the Contractor shall report to the website at https://dibnet.dod.mil.
(B) For all other contracting offices, the Contractor shall report to the Contracting Officer.
(4) The Contractor shall report the following information for each covered article or each product or service produced or provided by a source, where the covered article or source is subject to a FASCSA order, pursuant to paragraph (c)(3)(i) of this clause:
(i) Within 3 business days from the date of such identification or notification:
(A) Contract number;
(B) Order number(s), if applicable;
(C) Name of the product or service provided to the Government or used during performance of the contract;
(D) Name of the covered article or source subject to a FASCSA order;
(E) If applicable, name of the vendor, including the Commercial and Government Entity code and unique entity identifier (if known), that supplied the covered article or the product or service to the Contractor;
(F) Brand;
(G) Model number (original equipment manufacturer number, manufacturer part number, or wholesaler number);
(H) Item description; and
(I) Any readily available information about mitigation actions undertaken or recommended.
(ii) Within 10 business days of submitting the information in paragraph (c)(4)(i) of this clause:
(A) Any further available information about mitigation actions undertaken or recommended.
(B) In addition, the Contractor shall describe the efforts it undertook to prevent submission or use of the covered article or the product or service produced or provided by a source subject to an applicable FASCSA order, and any additional efforts that will be incorporated to prevent future submission or use of https://dibnet.dod.mil/

(d) Removal. For Federal Supply Schedules, Governmentwide acquisition contracts, multi-agency contracts or any other procurement instrument intended for use by multiple agencies, upon notification from the Contracting Officer, during the performance of the contract, the Contractor shall promptly make any necessary changes or modifications to remove any product or service produced or provided by a source that is subject to an applicable FASCSA order.
(e) Subcontracts. (1) The Contractor shall insert the substance of this clause, including this paragraph (e) and excluding paragraph (c)(1) of this clause, in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial products and commercial services.
(2) The Government may identify in the solicitation additional FASCSA orders that are not in SAM, which are effective and apply to the contract and any subcontracts and other contractual instruments under the contract. The Contractor or higher-tier subcontractor shall notify their subcontractors, and suppliers under other contractual instruments, that the FASCSA orders in the solicitation that are not in SAM apply to the contract and all subcontracts.
