SECTION 1 – Subject Identification & General Information

Identification Case Name Great Thicket NWR Tract (25,a)

Location York County, ME Acreage Lots 19 and 20: 54.78 ± acres (whole ownership) Part of Lot 20 aka GTK (25): 34.22 ± acres and

GTK (25a) 9.86 ± acres for a total of 44.08 ± acres (proposed acquisition)

Property Type Non-Federal Vacant Land Case Type Acquisition

Appraiser’s Client U.S. Department of Interior, Appraisal and Valuation Services Office (AVSO)

Intended Users The intended users of the appraisal report are the Client and U.S. Fish and

Wildlife Service (FWS) on behalf of the United States of America

Intended Use The appraisal report will be used by the FWS in conjunction with negotiating the proposed acquisition of the identified property via a land purchase. It is not intended for any other use.

Property Description The whole property ownership is 54.78 ± acres, referred to as South Berwick Tax

Parcel Map 6 Lots 19 and 20. Lot 19 is improved with the property owner’s home and not proposed for acquisition. Lot 20 is comprised of two non-contiguous parcels being divided by Clarks Lane. Per FWS, Lot 20 is zoned R3 (Residential Transitional). A land survey has been completed and two lots in Lot 20 totaling approximately 4 acres (± 2 acres per lot) are also being retained by the owner and therefore not included in the proposed acquisition. The two lots are identified as 20-2 and 20-3 on the embedded map on the next page of the SOW. A copy of the noted survey and map will be provided to the contracted appraiser.

The whole property is located in southern Maine in York County. South Berwick is located approximately 3 driving miles to the north. The town of Eliot is located approximately 3.5 miles to the south. Dover, New Hampshire is located approximately 5 miles to the west.

The following pertains to the acquisition tracts which are referred to by FWS as 25 and 25a. Both tracts have access from Oldfields Road and Clarks Lane. Both tracts have mixed cover type including grasslands and woods. FWS estimates there are approximately 20 acres of wetlands on the property and no merchantable timber. The wetlands are associated with tributaries of Quamphegan Brook. Tract 25 also contains a portion of a small pond.

The property is partially enclosed by historic stone walls and barbed wire fence.

Grazing is currently occurring on tract 25a via a verbal agreement with a neighbor.

Recent and historical use of the property has been for agriculture and recreational use.

The subject property has been owned by the current owners for more than 10 years. A copy of the vesting deed, Warranty Deed 027106 BK 1276 PG 342 will be provided to the contracted Appraiser upon Award.

The property has not been appraised by FWS or AVSO in the past 5 years. The property is not currently listed for sale.

AERIAL MAP

Minerals Per AVSO Division of Minerals Evaluation (DME), the proposed acquisition is located near but not directly associated with a mineral producing area. There are a couple of construction aggregate operations within 2 miles of the subject property, but no data suggests that the subject would indicate/have mineral development potential. The assigned DME Geologist concluded there are no recognized mineral valuation issues associated with this property.

Legal Description The legal descriptions and acreages for GTK (25,a) are derived from a recently completed August 2023 survey. Tract I of the below legal description refers to GTK (25a) and Tract II refers to GTK (25) depicted in the aerial photo presented in the SOW.

Legal Description begins on Page 4.

Acreage Whole Property: 54.78 ± acres Subject Property: 44.08 ± acres

Property Interest A current title report has not been provided by the FWS. See the Extraordinary Assumption section on page 9 regarding Property Rights Appraised.

The property rights to be appraised are the Fee Simple Estate subject to the rights of others in and to the appurtenant right insured herein to draw water from pond for irrigation purposes, rights of the public and others to use or pass over Clark’s lane, rights and easements granted in Book 12761, Page 338 and conditions relative to the use thereof (a 20’ wide access easement along the property boundary of Tract GTK (25a), typical utility easements, riparian rights of others in any body of water abutting or crossing the premises, including without limitation pond as shown on plan recorded in Plan Book 292, Plan 23, reserving Goodwin Family Burial Lot, with right of way thereto and therefrom. Any information developed by the Appraiser, or observations that are found to be contrary to the described property rights must be immediately brought to the attention of the Review Appraiser as a request for possible amended instructions. NOTE: Minerals are reported to be intact and the mineral estate is to be included in the rights valued.

Outstanding Rights, Reservations and Right of Ways

A current title report has not been provided by the FWS. The land survey shows eight exceptions. Those exceptions include the rights of others in and to the appurtenant right to draw water from pond for irrigation purposes, an easement for rights of the public and others to use or pass over the discontinued portion of Clark’s lane (for purposes of fire, safety and recreational use) rights and easements granted in Book 12761, Page 338 and conditions relative to the use thereof a 40’ wide access and utility easement along the western most property boundary of Tract GTK (25a), typical utility easements, riparian rights of others in any body of water abutting or crossing the premises, including without limitation pond as shown on plan recorded in Plan Book 292, Plan 23, and Quamphegan Brook.

with right of way thereto and therefrom. See Extraordinary Assumptions on page 7 regarding Property Rights Appraised. There are no other outstanding rights noted in the appraisal request package.

Verification regarding any, recorded or unrecorded documents, conditions, agreements, easements, reservations, and/or encumbrances, with the Property Owner is advised and notification of the Review Appraiser is required should any significant outstanding rights or reservations be discovered by the Appraiser during the course of the assignment. Any significant outstanding rights or reservations discovered by the Appraiser must be discussed in the appraisal report in relation to their impact on value.

Personal Property A temporary stock tank and livestock panels are located on tract 25a for cattle and will be removed prior to closing.

Property Access Both acquisition tracts have frontage on Clarks Lane and Old Fields Road.

Larger Parcel The agency request indicates that the total ownership acres are 54.78 acres of land and the acres to be appraised is 44.08 ± acres of land. Per FWS the landowners will retain their 6.7-acre homesite (Lot 19) and two 2-acre tracts from Lot 20.

It is ultimately the Appraiser’s responsibility to identify any and all additional lands that may have an impact on the Larger Parcel analysis.

The Appraiser must conduct all research necessary for a well-supported Larger Parcel(s) conclusion presented in the appraisal. As the Appraiser, you must identify a larger parcel (or potentially multiple larger parcels) which satisfies the tests of unity of title/ownership, unity of highest and best use/integrated use, and contiguity/proximity as it relates to highest and best use in accordance UASFLA, Sections 1.2.7.3.1., 1.4.3 – 1.4.7., 4.3.3 –

4.3.4.5. and 4.6.1.1. This is considered an integral part of the highest and best use analysis. Section 2.3.3.1.2 of UASFLA requires that the Appraiser must describe the factual basis and analysis that led to the larger parcel determination and the determination itself be reported. The Appraiser should also keep in mind that in situations where there are multiple larger parcels present, the appraisal assignment is to estimate the market value of the property in its entirety. This may require estimating the value of each larger parcel, but simply adding those values together to estimate the value of the whole would violate the Unit Rule.

The appraiser should be aware that there is the potential for the subject property to consist of multiple larger parcels. It is requested that the Appraiser please notify the AVSO Review Appraiser, after property inspection, to discuss the Appraiser’s preliminary larger parcel determination(s) and support. If multiple larger parcels are concluded, each larger parcel identified will require a separate valuation analysis. It will be the engaged Appraiser’s decision as to the presentation within a single report or multiple reports.

Ownership/Occupant Information will be provided to the contracted Appraiser upon Award.

Tenancies A verbal grazing agreement with a neighbor is in place until 12/31/2024, for cattle grazing on the smaller acquisition tract 25a. The Appraiser should confirm with landowner whether there are any other leases and/or rental agreements on the property.

Contact Information All necessary contact information will be provided to the Appraiser upon contract award.

Provided Subject Property Exhibits The following additional Exhibits will be provided only to the Appraiser awarded the contract:

1. Tract F230115 – Vesting Deed

2. Tract F230115 – Survey (August 2023)

3. Tract F230115 – Supplemental Appraisal Map

4. Tract F230115 – Property Card Map 6 Lot 20

5. Tract F230115 – Tax Map 6

6. Tract F230115 – Permission to Inspect and Appraise

7. Tract F230115 – Conservation Easement Agreement (referenced in survey but not part of current ownership -encumbers Lot 20-001)

SECTION 2 – Appraisal Requirements & Instructions

Appraisal Standards

1. Uniform Standards of Professional Appraisal Practice Standards 1 & 2 (USPAP-2020/2021 edition)

2. Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA 6th edition, 2016)

3. Uniform Relocation Assistance and Real Property Acquisition Act of 1970 (PL91 – 646) as amended; Federal Regulations 49 CFR, Part 24

Market Value

Market value is the amount in cash, or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of value, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property. [Interagency Land Acquisition Conference, Uniform Appraisal Standards for Federal Land Acquisitions, 6th edition (Interagency Land Acquisition Conference, 2016), p.10.]

Date of Value

The date of value is the date of the last property inspection, which should be within 30 calendar days of the submission of the initial appraisal report, unless the AVSO Review Appraiser approves in advance other conditions in writing.

Extraordinary Assumption (EA)

EA – Property Rights Appraised: A current title commitment was not provided for this assignment.

The AVSO Client, Fish and Wildlife Service (FWS), has requested that I assume there is clear title to the property being appraised and that there are no additional encumbrances or restrictions (including mineral or other reservations) that could materially affect value. Use of this statement is consistent with FWS policy. A change in the estate appraised, when final title is obtained, could require an amendment of the appraisal or re-appraisal of the property so that the estate appraised matches the estate to be transferred.

The Appraiser may not assume or invoke any EA’s without documented prior written approval. If the Appraiser determines that any additional EA’s are necessary for the completion of the assignment, he/she must contact the Review Appraiser for prior written approval (UASFLA, Section 1.2.7.1.).

Hypothetical Conditions (HC’s)

No HC’s have been identified which are necessary for the completion of this assignment. The Appraiser may not assume or invoke any HC’s without documented prior written approval. If the Appraiser determines that hypothetical conditions are necessary, he/she must contact the AVSO Review Appraiser for prior written approval (UASFLA, Section 1.2.7.1.).

Jurisdictional Exceptions (JE’s)

The only JE that is authorized for use is in regard to the definition of market value and the development and reporting of a reasonable exposure time linked to the value opinion. Contrary to

USPAP, Section 1.2.4. (and 1.2.7.2.) of the Uniform Appraisal Standards for Federal Land Acquisition states that opinions of market value linked to a specific exposure time and marketing time “… are not appropriate for just compensation purposes, and must not be included in appraisal reports prepared under these Standards.” Because the Appraiser is performing the appraisal in compliance with UASFLA, the Jurisdictional Exception Rule is being invoked. Sections 1.2.4 and

1.2.7.2 of UASFLA provides the legal authority for invoking the Jurisdictional Exception Rule to void Standard Rules 1-2(c) and 2-2(a) (v) of USPAP.

If the Appraiser believes that USPAP’s Jurisdictional Exception Rule needs to be invoked to comply with any additional law or UASFLA regulation, he/she must contact the AVSO Review Appraiser to obtain prior written approval.

Placement in Report

The Appraiser must clearly identify and discuss the implications of any authorized Extraordinary Assumptions and Hypothetical Conditions (including a statement that their use might have affected the assignment results) within the General Assumptions and Limiting Conditions and Scope of Work sections of the appraisal report along with the Jurisdictional Exception (assignment condition) per UASFLA Sections 2.3.1.7 & 2.3.1.8. Please also identify any authorized EAs and HCs wherever the final value conclusion is stated, including the Letter of Transmittal and the Summary of the Salient Facts.

Property Inspection

The Appraiser must physically inspect the subject property and all of the market properties used in direct comparison, unless the AVSO Review Appraiser has approved other conditions in writing (UASFLA Section 1.2.6.3.).

For appraisals with an intended use of acquisition or exchange, the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (PL 91-646) as amended and the Uniform Appraisal Standards for Federal Land Acquisitions (Section 1.2.6.4), require the Appraiser to offer the property owner and/or the owner’s representative an opportunity to accompany the Appraiser during the property inspection. The Appraiser must certify in the report that such an offer was extended (UASFLA Section 2.3.1.4.).

Permission to enter upon and appraise the property has been granted. The landowner’s contact information and the document granting permission to appraise will only be provided to the contracted Appraiser. Please contact the owner directly, after engagement, to arrange a date and time for inspection. You must notify the AVSO Review Appraiser in advance of when the property inspection will occur.

Pre-Work Meeting

The contracted Appraiser will be required to participate in a pre-work meeting (via phone) with the assigned AVSO Review Appraiser. The AVSO Review Appraiser will coordinate the date and time of the pre-work meeting directly with the Appraiser once the contract is awarded.

Controversies/Issues

No controversies/issues have been identified. Should the Appraiser identify controversies or issues during the course of assignment, he/she must immediately notify the AVSO Review Appraiser.

Legal Instructions None

Special Appraisal Instructions

1. Even though communication is encouraged with the Property Owner and the client agency, only the AQD Contracting Officer, in conjunction with the assigned AVSO Review Appraiser’s concurrence, can modify appraisal instructions (in writing).

2. The Appraiser may not communicate assignment results to any party except AVSO unless authorized to do so in writing by AVSO.

3. Any communication (verbal or written) with the Client Agency Realty Contact shall include the assigned AVSO Review Appraiser.

4. The completed land survey indicates the total acquisition is 44.08 acres. The total acquisition is comprised of two non-contiguous parcels GTK (25) being 34.22 ± acres and GTK (25a) being

9.86 ± acres. It is requested that in addition to stating the final conclusions(s) of the larger parcel(s) within the appraisal report, the unit value(s) (e.g., $XX/acre) for the larger parcel(s) be stated along with the range of acreage within which that unit value(s) would be valid (e.g., $XX/acre is valid for a range of XX-XX acres). This is an assignment condition and to be reported as such within the appraisal report:

NOTE TO INTENDED USER: This range in acreage is only applicable to the footprint of the appraised larger parcel(s) as a result of the completed survey and considers no material changes to the physical characteristics of the larger parcel(s). This range in value is only intended to be a tool to assist the acquiring agency in re-calculating the value of an appraised larger parcel using the acreage of the completed survey. The range in acreage within which the concluded unit value(s) would be valid is not intended for use by acquiring agency to add additional lands/tracts to the proposed acquisition or to allow the retention/removal of lands/tracts from the proposed acquisition after the appraisal has been completed. Addition or removal of the tract(s) from the appraised larger parcel could change the physical characteristics of the property and require amendment of the appraisal or reappraisal.

General Appraisal Requirements & Instructions

1. The appraisal is to be documented in an “Appraisal” reporting format (USPAP Standard 2-2 (a)).

UASFLA page 56, Section 2.2 states that a report prepared in accordance with UASFLA reporting formats set forth under sections 2.3, 2.4 and 2.5 (Appendix B, C, and D) are consistent with and/or exceed the requirements for an appraisal report under Standard 2 of USPAP. All appraisals complying with UASFLA should reasonably conform to the report formatting outlined in UASFLA, (Sections 2.3., 2.4., 2.5., and Appendix A, B, C and D, depending on applicability).

2. The Appraiser must hold a valid license as a Certified General Appraiser for the jurisdiction in which the subject property is located as demonstrated by provision of a copy of the state certificate. (Valid credentials include those obtained directly from the jurisdiction, those issued under a reciprocity agreement, and/or those characterized as “temporary” under the jurisdiction’s licensing and certification statutes.)

3. Documentation of the comparable sales and other market data utilized in the appraisal must comply with reporting requirements of UASFLA Sections 2.3.1.6., 2.3.3.2.1., 2.3.3.4., and the Uniform Relocation Assistance & Real Property Acquisition Policies Act 1970. For instance, the latter requires “A description of the comparable sales, including a description of all relevant physical, legal and economic factors such as parties to the transaction, source and method of financing, and verification by a party involved in the transaction.” Color photographs and maps of comparable properties shall be included in the appraisal report. AVSO will accept aerial photographs for comparable properties, if the aerial photographs accurately represent the comparable property as of the date of sale. The Appraiser must photograph any unusual property features from the ground.

4. If sales to governmental entities, including sales to non-profit entities with the intention of transferring the sale property to a governmental entity, are included in the appraisal report, they are subject to extraordinary verification and treatment. They must be documented in accordance with the guidelines found in UASFLA Sections 1.5.2.4 and 4.4.2.4 and Appendix E. Each of the items of Section 1.5.2.4/Appendix E must be specifically addressed when communicating the confirmation of any government sales.

5. The AVSO Statement of Work, any other written assignment instructions and pages 1 & 2 of the Contract Award document must be included within the Addenda to the appraisal report, along with the Appraiser’s license, to include temporary license, if applicable, and qualifications. The appraisal report will be reviewed for compliance with the terms of this Statement of Work (including all cited standards). Any findings of inadequacy will require clarification and/or correction.

6. The Appraiser must appraise the subject property in its “As Is” condition unless otherwise instructed herein or authorized in writing by the AVSO Review Appraiser to do otherwise.

7. The Appraiser shall consider the appraisal report and all DOI internal documents furnished to the Appraiser to be confidential. Refer all requests for information concerning the appraisal to the AVSO Review Appraiser.

8. AVSO will not normally accept custody of confidential information. Should Appraiser find it necessary to rely on confidential information, he/she will contact the AVSO Review Appraiser for instructions. The AVSO Review Appraiser will view the information and provide further instruction to the Appraiser regarding handling and storage of the confidential information.

9. While the public is not an intended user of the appraisal report, the Freedom of Information Act (FOIA) and Agency policy may result in the release of all or part of the appraisal report to others.

10. If including any proprietary information in the appraisal, Appraiser must gain concurrence from

AVSO Review Appraiser and deliver the proprietary information in a separate binder.

11. The Appraiser must indicate whether he/she has (or has not) performed any services, as an Appraiser or in any other capacity, regarding the subject property within the three-year period immediately preceding submitting the bid for the assignment. If a service has been provided regarding the subject property, the service provided must be specified and appropriately disclosed following the direction of the USPAP Ethics Rule, Conduct Section. This disclosure must be made within the bid proposal and also noted on the signed certification page of the completed report.

SECTION 3 – Performance & Submission Requirements
