APPRAISAL STATEMENT OF WORK

SECTION 1: CASE PROPERTIES

AVIS Project Number: F220023 Agency Case Number: 00160738 Client Agency: U.S. Fish & Wildlife Management Case Name: KLF Tract (10) Non-Federal Klamath Basin Sucker Rearing Facility Realty Action: Acquisition.

Applicable Authority: Section 205, Federal Land Policy and Management Act of 1976 (43 U.S. Code

§ 1715) Requested Service: Appraisal Funding Source: Endangered Species Code: FXFR131108KBRA0

SECTION 2: SUBJECT OF THE APPRAISAL

Proposed Acquisition: 25.52 acres of land encumbered by a 30-year lease which grants the lessee exclusive use of the surface estate, improvements, and existing water right, during the term. The property is located approximately 15 miles south/southeasterly of downtown Klamath Falls in Klamath County, Oregon.

The terms of the lease, which commenced August 27, 2021, included payment in one lump sum at the inception of the lease; therefore, the lease is strictly an encumbrance, rather than an annuity.

The current improvements include a fish hatchery with a geothermal well with water rights.

Request for Quote 140D0422Q0663 007

Legal Description of Proposed Acquisition:2

2 The appraiser should verify the legal description (1) on the ground during a physical inspection of the property; (2) with the owner of the property (if possible); (3) by comparing it with aerial or other maps available in city, county, or other governmental offices; and (4) by comparing it with public records in the recorder’s, auditor’s, assessor’s, tax collector’s, or other appropriate city or county offices. If the appraiser discovers a significant error or inconsistency, the appraiser should consult the client for clarification before proceeding with the appraisal. (UASLFA 1.2.6.2)

Property Rights Appraised: Fee simple subject to encumbrances and reservations of record. See attached

Preliminary Title Commitment File No. 286340AM dated October 26, 2021 for exceptions.

The rights appraised include the reversionary rights to the surface and geothermal water right in 2051, as well as any sub-surface rights not identified in the above-referenced title commitment.

Principal among the sub-surface encumbrances is a geothermal lease dated December 29, 2017 and amended August 26, 2021, which provides the lessee the right to conduct exploration and development of geothermal resources. The lessee has had the option to explore and develop geothermal resources, since its inception in 2017, and no such progress has taken place.

Furthermore, a minerals report will be provided to the appraiser, the conclusion of which is, “as of the date of this report, there is no evidence to support the existence of geothermal mineral resources with development potential on the subject property.”

Although the appraiser must evaluate the financial feasibility of such exploration and development, it is likely that the expert opinions provided, Request for Quote 140D0422Q0663 010 coupled with the history of the subject, will render a valuation of the subsurface geothermal leasehold estate moot.

Current Use: Sucker fish rearing facility with excess land.

SECTION 3: APPRAISAL PROBLEM IDENTIFICATION

Client: Appraisal and Valuation Services Office (AVSO)

Intended Users: Appraisal and Valuation Services Office (AVSO) U.S. Fish and Wildlife Service .

Intended Use: To assist the client agency in its determination of the amount to be paid as just compensation for the property rights acquired or conveyed.3

Type of Value: Market Value subject to encumbrances, reservations, and exceptions of record

Definition of Value: Market value is the amount in cash, or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of value, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property.

UASFLA 1.2.4 at p 10.

Effective Date: The latter of:

a) The date of the last property inspection, or

b) the date upon which the appraiser has concluded his market research and analysis.

SECTION 4: ASSIGNMENT CONDITIONS

Applicable Standards: USPAP 2020-2021 UASFLA 6th Edition

Extraordinary Assumptions: The property owner will retain access through the site by right-of-way or permit issued after the acquisition.

Hypothetical Conditions: None.

Jurisdictional Exceptions: A jurisdictional exception to USPAP Standards Rule 1-2(c) is required for appraisals for federal acquisitions—i.e., appraisals applying the federal definition of market value—to ensure the opinion of value can be used as a reliable measure of just compensation under the Fifth Amendment to the U.S.

Constitution. Therefore, the appraiser must include the following statement:

• the appraisal was developed and the appraisal report prepared in conformance with the Appraisal Standards Board’s Uniform Standards of Professional Appraisal Practice and complies with USPAP’s Jurisdictional Exception Rule when invoked by Section

1.2.7.2 of the Uniform Appraisal Standards for Federal Land Acquisitions.

Pre-Work Meeting: Yes. A pre-work meeting, scheduled by the Review Appraiser at a mutually acceptable time and place, must precede the appraiser’s scope of work determination. The Contracting Officer is the only individual authorized to

Request for Quote 140D0422Q0663 011 enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

Property Inspection: In compliance with the applicable standards.

The appraiser will schedule the property inspection, providing the Review Appraiser and the agency not less than a two-week notice.

Contacting Landowners: Under the Uniform Act, the owner or the owner’s designated representative must be given an opportunity to accompany the acquiring agency’s appraiser during the appraiser’s inspection of the property (UASFLA 1.2.6.4).

Larger Parcel: The appraiser must make a larger parcel determination in every appraisal developed under these Standards (UASFLA 1.4.6 at page 24).

The proposed acquisition is part of 82.17 acres under contiguous ownership, comprised of the following:

•Parcels 1A and 1B – mostly vacant land with a small single family residence on Parcel 1A. The subsurface area of this section is leased to KHG for geothermal water exploration. Limited surface rights are also granted along with this lease. The lease grants the exclusive right to drill for, extract, produce, remove, utilize, sell, and dispose of all forms of thermal energy and other associated geothermal resources. The lease excludes any existing water rights or use of the existing geothermal well. However, it does permit access across the proposed acquisition area (Parcel 2).

•Center (Parcel 2) Proposed Acquisition – Existing fish hatchery along with vacant excess land for expansion, a geothermal water well, and geothermal water rights. This parcel is encumbered by a 30 year pre-paid lease to USFWS for exclusive use of the surface estate, the fish hatchery improvements, and the geothermal water rights. The lease expires in August 2051.

3. The appraisal report must substantially conform to the sequence and content described in Section 2 of the Uniform Appraisal Standards for Federal Land Acquisitions 6th Edition.

4. The appraisal report will be reviewed for compliance with the Uniform Standards of Professional Appraisal Practice, the Uniform Appraisal Standards for Federal Land Acquisitions 6th Edition, and the terms of this Statement of Work. The appraiser must provide explanation, clarification, and/or modification, for any inadequacies identified by the review appraiser, before AVSO will accept an appraisal report.

5. While the public is not an intended user of the appraisal report, the Freedom of Information Act (FOIA) and Agency policy may result in the release of all or part of the appraisal report to others.

6. If the appraiser encounters any intractable questions of fact, law, or appraisal methodology requiring resolution, the appraiser must contact the Review Appraiser for direction. The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work

SECTION 5: PERFORMANCE/DELIVERABLE REQUIREMENTS
