RFQ 140D0422Q0659
Location Map
Property Description The proposed acquisition consists of one legal parcel of record containing a two-story cabin located on the east shore of Lake Ozette. The property has no utilities nor road access and can only be reached by a two-mile boat trip from the Swan Bay launch ramp at the southerly end of Swan Bay Road. Potable water is available nearby from a spring (located off the property). Due to its location directly on the waterfront, the residence relies on a chemical toilet for disposal of human waste.
Legal Description
Property Interest Fee Simple subject to reservations, easements, and encumbrances of record, including a scenic easement limiting the height of the structure and removal of trees on the property that was purchased from the current owner by NPS in 1979.
The appraiser must immediately notify the AVSO review appraiser of any indications of rights contrary to these described. This may result in amended instructions.
Outstanding Rights None. If the appraiser detects any other outstanding rights, they must promptly report them to AVSO Review Appraiser.
Reservations The owner is not reserving any other rights.
Property Access The only legal and physical access is by a two-mile boat trip from the Swan Bay launch ramp at the southerly end of Swan Bay Road.
Larger Parcel The property is not adjacent to parcels that are in the same ownership. Regardless, the appraiser must make a determination of what the larger parcel is on their own applying the three larger parcel tests and documenting that in the highest and best section of the appraisal (see UASFLA 1.2.7.3.1, 1.4.3-1.4.7, 2.3.3.1, & 4.3.).
Ownership/Occupant The property owner occasionally uses the property for recreational purposes.
Tenancies None.
Owner Contact Information To be provided with assignment award. The owner has requested to go along with the appraiser on the property inspection, so it will be necessary for the appraiser to coordinate with both the

Provided Subject Property Exhibits The following Subject Property Exhibits will be provided as attachments to the solicitation:

2. Photo of Cabin
The following additional Exhibits will be provided to the winning bidder after contract award:

3. Preliminary Title Report with back-up documents
RFQ 140D0422Q0659
SECTION 2 – Appraisal Requirements & Instructions
Appraisal Standards
1. Uniform Standards of Professional Appraisal Practice (USPAP)
2. Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA)
3. Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (PL
91-646) as amended; Federal Regulations 49 CFR, Part 24
Market Value The amount in cash or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of the appraisal, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property. [Uniform Appraisal Standards for Federal Land Acquisitions, 6th edition, 1.2.4.]
Date of Value The date of value is the date of the last property inspection, which must be no later than 30 calendar days prior to the submission of the draft appraisal report, unless the AVSO Review Appraiser approves in advance other conditions in writing.
Extraordinary Assumptions (EA’s) There are likely to be several uncertainties that the appraiser will have to assume one way or another (see Controversies/Issues section below). If the appraiser determines that any extraordinary assumptions not described below are necessary for the completion of the assignment, he/she must contact the AVSO Review Appraiser for prior written approval.
Hypothetical Conditions (HC’s) None. If the appraiser determines that hypothetical conditions are necessary, he/she must contact the AVSO Review Appraiser for prior written approval.
Jurisdictional Exceptions (JE’s) The appraiser should invoke USPAP’s Jurisdictional Exception Rule to comply with the UASFLA prohibition against stating an Exposure Time in the report. For any other JE’s, the appraiser must contact the AVSO Review Appraiser to obtain prior written approval.
Placement in Report The appraiser must clearly identify all Extraordinary Assumptions, Hypothetical Conditions, and Jurisdictional Exceptions wherever the final value conclusion is stated, including the Letter of Transmittal and the Summary of Salient Facts. These must also be communicated with any General Assumptions and Limiting Conditions.
Property Inspection The appraiser must offer the property owner’s representative the opportunity to accompany them on the inspection and to tell the appraiser any information they deem relevant to the valuation of the subject property. [Uniform Relocation Assistance & Real Property Acquisition Policies Act
RFQ 140D0422Q0659
of 1970 (PL 91-646) as amended and the Uniform Appraisal Standards for Federal Land Acquisitions, 6th Ed. (Section 2.3.1.4, page 58).] The appraiser must notify the AVSO Review Appraiser at least two weeks in advance of when the property inspection will occur.
Controversies/Issues As noted, the property owner’s access to the spring (which is on NPS property) does not appear to be a legal right. Nevertheless, the appraiser may assume that the owner can continue to use the spring to obtain drinking water for the existing recreational use of the cabin.
Similarly, there have been questions whether the owner is in violation of the scenic easement agreement for cutting trees and building a taller structure without first obtaining written permission from NPS. Again, the appraiser may assume that no future owner of the property would be liable for any prior violations of the scenic easement.
Another controversy is the location of the boundaries of the subject parcel. For example, some maps show the residence encroaching onto NPS land. Depending on which map one is using it could be on either property. NPS is unlikely to survey the property unless the owner agrees to sell it to them. Therefore, for the purposes of this appraisal, the appraiser may assume there is no encroachment, pending the results of a survey. In addition, it is unclear whether a tree that recently fell into the lake just north of the residence and possibly impairs access to the lake and water source from the residence is on NPS land or not. Even if it is on NPS land, it is unclear if NPS would remove it. For the purposes of this appraisal, it is an as-is condition and the appraiser must consider its effect on the value of the property.
Should the appraiser determine identify any other unforeseen valuation issues during the course of assignment, he/she must immediately notify the AVSO Review Appraiser.
Legal Instructions None.
Special Appraisal Instructions
1. Even though communication is encouraged with the property owner and the client agency, only the assigned AVSO Review Appraiser can modify appraisal instructions (in writing).
2. The appraiser may not communicate assignment results to any party except AVSO until authorized to do so in writing by AVSO.
3. Any communication (verbal or written) with the Client Agency Realty Contact shall include the assigned AVSO Review Appraiser.
4. An allocation between land and building is required to be part of the appraisal. If the cost approach is not used, there must at least be a land value analysis to support this allocation.
5. The appraiser must measure the building and prepare an accurate sketch showing theinterior layout of the residence and exterior dimensions.
RFQ 140D0422Q0659
6. This statement of work (SOW) has been prepared during the COVID-19 pandemic. Market impacts may vary by property type, but potential exists for significant changes to real property values. For this reason, the appraisal must include a thorough market analysis available at the effective date in support of market condition adjustments or no adjustments if warranted. As applicable, this analysis can include interviews with real estate market participants (such as brokers, lenders, buyers, sellers), economic trends in the market sector and location, listing and sales activity or non-activity, commodity pricing, and changes in the financial markets.
General Appraisal Requirements & Instructions
1. The appraiser must hold a valid license as a Certified General Appraiser for the jurisdiction in which the subject property is located. (Valid credentials include those obtained directly from the jurisdiction, those issued under a reciprocity agreement, and/or those characterized as “temporary” under the jurisdiction’s licensing and certification statutes.)
2. The AVSO Statement of Work, other assignment instructions and engagement letter must be included within the Addenda to the appraisal report.
3. UASFLA (Page 56) states that a report prepared in accordance with UASFLA Sections 2.3, 2.4, and 2.5 is consistent with and/or exceed the requirements for an appraisal report under Standard 2 of USPAP.
4. The appraiser must appraise the subject property in its “As Is” condition unless authorized in writing by the AVSO Review Appraiser to do otherwise.
5. Color photographs and maps of comparable properties shall be included in the appraisal report. AVSO will accept aerial photographs for comparable properties, unless the aerial photographs do not accurately represent the property as of the date of inspection, in which case the appraiser must photograph any unusual property features from the ground.
6. The appraisal report will be reviewed for compliance with the terms of this Statement of
Work (including all cited standards). Any findings of inadequacy will require clarification and/or correction.
7. The appraiser shall consider the appraisal report and all DOI internal documents furnished to the appraiser to be confidential. Refer all requests for information concerning the appraisal to the AVSO Review Appraiser.
8. AVSO will not normally accept custody of confidential information. Should appraiser find it necessary to rely on confidential information, he/she will contact the AVSO Review Appraiser for instructions. The Review Appraiser will view the information and provide further instruction to the appraiser regarding handling and storage of the confidential information.
RFQ 140D0422Q0659
9. While the public is not an intended user of the appraisal report, the Freedom of Information Act (FOIA) and Agency policy may result in the release of all or part of the appraisal report to others.
10. If including any proprietary information in the appraisal, appraiser must gain concurrence from AVSO Review Appraiser and deliver the proprietary information in a separate binder.
11. When the appraiser has performed any services regarding the subject property within the three prior years, he/she must disclose this in the bid proposal.
RFQ 140D0422Q0659
