52.212-2 Evaluation-Commercial Products and Commercial Services (Nov 2021)
a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award of this Contract will be made on a Best Value/Trade Off basis. The following factors shall be used to evaluate offers: Technical, Past Performance, and Price.
Technical and past performance, when combined, are more important than cost or price.

STATEMENT OF WORK (SOW)

Agency Case ID: 00160865
AVIS Number: F220083
SECTION 1 – Subject Identification & General Information
Identification Case Name EHW (33C) Conservation Easement
Location 6300 Arbuckle Creek Road Avon Park, Highlands County, Florida
Acreage Easement Area: 405.86 acres +- Total Owned 566.12 acres +-
Property Type Easement Area: Non-Federal Vacant Land
Case Type Partial Acquisition – Conservation Easement
Client U. S. Department of the Interior, Appraisal and Valuation Services Office
(AVSO)
Intended Users The intended users of the report(s) are the client (AVSO) and the U. S. Fish and Wildlife Service (FWS) on behalf of the United States of America
(USA).
Intended Use The appraisal report will be used by FWS in conjunction with negotiating the partial acquisition of certain rights as identified in a proposed perpetual FWS conservation easement on the identified property. It is not intended for any other use.
As the interest to be acquired constitutes a partial acquisition (conservation easement interest), a before and after valuation must be completed in which the appraiser develops opinions of both the market value of the larger parcel before the acquisition of the proposed conservation easement, and the market value of the remainder interest after the proposed conservation easement acquisition.
The “difference” between the before and after values is also reported in a partial acquisition. The conservation easement itself is not specifically appraised. Appraisers should note that this methodology constitutes two separate valuations within the same assignment. (Uniform Appraisal Standards for Federal Land Acquisition (UASLFA) Sections 1.2.7.3.4, 1.7, & 4.6.5)
RFQ number - 140D0422Q0553 008
Please refer to items #4 and #5 of the Special Appraisal Instructions on page 7 of this SOW for additional valuation instructions.
Property Description The subject property is located approximately 5.5 miles northeast of Sebring, FL and 0.5 miles west-northwest of the intersection of Arbuckle Creek Rd. and Raffert Ranch Rd. in unincorporated Highlands County, FL. The parcel is entirely bounded by privately owned lands and is designated as portions of tax parcel numbers C353329A0000300000 (160.9 acres), C023429A0000300000 (162.27 acres), C013429A0000100000 (121.64 acres), and C123429A0000200000 (120.35 acres) by the Highlands County, FL property appraiser. This is a long narrow parcel that is accessed by an easement from Arbuckle Creek Road to the property. There is a 50’ long access easement from Arbuckle Creek Road that benefits the property.
The proposed conservation easement area is also identified by FWS as Tract 33C. The easement acquisition area consists of a previous cattle ranch that is currently used for conservation and recreation.
In the “after” condition, the subject property will be encumbered by a perpetual FWS conservation easement. The 405.86-acre proposed conservation easement area is to be managed as part of the Everglades Headwaters National Wildlife Refuge. (See the attached Sample Conservation Easement for a description of the proposed conservation easement.)
It is anticipated that additional and expanded descriptive information on the subject’s attributes will be uncovered during a physical inspection and due diligence research by the Appraiser. Maps identifying the property to be encumbered are included in the attachments. The Appraiser must immediately notify the AVSO Review Appraiser of any significant discrepancies in the property description provided above. This may result in amended instructions.
Property Access Physical and legal access to the proposed easement area is via a 50’ long access easement from Arbuckle Creek Road to the southern boundary of the property. The easement is recorded in Book 1463, Page 504 in the Highlands County recorder’s office. One of the vesting deeds (Book 1463, Page 508) also directly mentions the easement.
Legal Description The legal description to be used for the footprint of the estimated 405.86-acre conservation easement area is identified in attachment FWS Land Description. The subject is a portion of the lands identified within the title commitment and the most recent transfer in Trustee’s Deed Book 2844, Page 0195 dated August 12, 2021. A copy of the above referenced documents will be provided to the contracted appraiser upon award.
Property Interest to be Acquired
RFQ number - 140D0422Q0553 009
The property interest to be acquired is the rights being encumbered by the proposed perpetual conservation easement encompassing a total of 405.86 acres.
The property interest to be appraised in the before-condition is fee simple, subject to license agreement, ordinance, and easement of record.
In the after-condition the property interest to be appraised is fee simple, subject to license agreement, ordinance, and easement of record as well as the terms and conditions of the proposed perpetual FWS conservation easement.
Reservations/Outstanding Rights A title commitment with referenced documents will be provided to the contracted Appraiser upon award. The following are identified in title commitment as encumbering the land proposed for the conservation easement.
10. Access easement dated July 20, 1999, and recorded with the Clerk of Courts, Highlands Co., Fl in ORB 1463 Page 0504 on July 23, 1999.
11. Ordinance #01-02-6 establishing the West Sebring Special Benefit Fire District recorded with the Clerk of Courts, Highlands Co., Fl in ORB 1750 Page 002 on April 07, 2004.
12. License Agreement for fence line recorded with the Clerk of Courts, Highlands, Co., FL in ORB 206 Page 0026 on April 26, 2007.
Please note that according to the Division of Mineral Evaluations, the subject property proposed for conservation easement is outside of any known hydrocarbon or mineral producing area.
National datasets such as USGS's Mineral Resources Data System, local aerial imagery (Google Earth, Digital Globe), Florida Dept. of Environmental Protection and IHS Enerdeq were reviewed for relevant mineral information. There are no recognized mineral development or mineral valuation issues.
In the “after” condition the subject will additionally be encumbered by a perpetual conservation easement and is to be appraised as such. A sample of the proposed conservation easement document identifying the restrictions and permitted uses, similar to what is proposed for the subject, is included in the attachments. Please note that Exhibit B is not site specific to the subject easement area and for sample purposes only. The conservation easement is to run with the land as a perpetual easement. Please refer to the attached sample for a full list of permitted uses and restrictions.
No other easements or encumbrances have been identified by FWS for the proposed conservation easement area. Any additional recorded or unrecorded documents, conditions, agreements, easements and/or encumbrances discovered must be identified and discussed in the appraisal report in relation to their impact on value. The appraiser must immediately notify the AVSO Review Appraiser of any indication of rights contrary to these described. This may result in amended instructions.
RFQ number - 140D0422Q0553 010
Larger Parcel As this request is for a proposed federal acquisition, the Appraiser must identify the larger parcel, or larger parcels (should multiple larger parcels be determined), which satisfies the tests of unity of title, unity of highest and best use (integrated use), and contiguity as it relates to the highest and best use. UASFLA requires that the Appraiser’s analysis that led to the larger parcel determination and the determination itself be reported. This is considered an integral part of the highest and best use analysis. (UASFLA 1.2.7.3.1, 1.4.3-1.4.7, 2.3.3.1, & 4.3)
As reported by FWS, the area of the proposed conservation easement is approximately 405.86 acres. The total acres within the county under the same ownership, both contiguous and proximate to the subject of the report, is estimated at 566.12 acres per county appraiser records. A map depicting the total contiguous ownership, as well as portion of the property under same ownership not to be included in the CE are attached to this solicitation. No other contiguous or proximate lands under similar ownership has been identified by FWS in their request for appraisal services.
However, it is ultimately the appraiser’s responsibility to identify any and all lands having unity of ownership in conjunction with unity of highest and best use for the purposes of determining the larger parcel(s) for appraisal purposes. It is requested that the Appraiser please notify the AVSO Review Appraiser in advance, after property inspection, concerning the Appraiser’s preliminary larger parcel determination.
Ownership Information will be provided to the contracted Appraiser upon award.
Tenancies None.
Subject Property Exhibits The following subject property exhibits will be provided as attachments to the solicitation:
1. EHW(33C) Vicinity Map
2. EHW(33C) Sample Conservation Easement
The following additional exhibits will be provided to the contracted Appraiser upon award:
1. EHW(33C) Conservation Maps

3. EHW(33C) Easement Deed
4. EHW(33C) Land Description

SECTION 2 – Appraisal Requirements & Instructions
Appraisal Standards
• Uniform Standards of Professional Appraisal Practice (USPAP- 2020/2021 edition) Standards 1 & 2
• Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA - 6th Edition, 2016)
• Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (PL 91-646) as amended; 49 CFR, Part 24
Market Value Market Value is the amount in cash or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of value, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property. (Uniform Appraisal Standards for Federal Land Acquisitions, 1.2.4 of 6th Edition) This definition of value must be placed in the Scope of Work section of the report in accordance with
UASFLA 2.3.1.8.
Date of Value The date of value is to be the date of the last property inspection, which should be within 30 days of the initial report date.
Extraordinary Assumptions (EA’s) None. If the Appraiser determines that any other extraordinary assumption is necessary for credible assignment results, he/she must contact the AVSO Review Appraiser for prior written approval.
Hypothetical Conditions (HC’s) None. If the Appraiser determines that a hypothetical condition is necessary for credible assignment results, he/she must contact the AVSO Review Appraiser for prior written approval.
Jurisdictional Exceptions (JE’s) Opinions of market value for federal acquisition purposes shall not be linked to a specific opinion of exposure time [UASFLA, 6th Ed., Section 1.2.4, 1.2.7.2 and 4.2.1.2 (legal basis)], unlike other appraisal assignments subject to USPAP [Standard Rule 1-2(c) and 2-2(a)(vi)]. This exclusion of exposure time requires the use of a Jurisdictional Exception (JE) to USPAP. (Refer to page 15 of USPAP for proper reporting.)
If the Appraiser believes that USPAP’s Jurisdictional Exception Rule is needed to comply with any other additional law or UASFLA regulation, he/she must contact the AVSO Review Appraiser to obtain prior written approval.
RFQ number - 140D0422Q0553 012
Please also note that in accordance with UASFLA, Section 1.2.4, estimates of marketing time are not appropriate and must not be included in appraisal reports prepared to UASFLA standards.
Placement in Report The Appraiser must clearly identify and discuss the implications of any authorized Extraordinary Assumptions and Hypothetical Conditions (including a statement that their use might have affected the assignment results) within the Scope of Work section of the appraisal report along with the Jurisdictional Exception (assignment condition) per UASFLA Section 2.3.1.8. Please also identify any authorized EAs and HC’s wherever the final value conclusion is stated.
Property Inspection The Appraiser must physically inspect the subject property. The owner has given permission to enter the property to conduct an inspection and desires to be in attendance. The document granting permission to appraise will be provided to the contracted Appraiser upon award. Please contact the owner directly, after award, to arrange a date and time for inspection. You must notify the AVSO Review Appraiser, in advance, when the property inspection will occur.
For appraisals with an intended use of acquisition, the Appraiser must certify in the report that he/she extended an offer to the property owner (or the owner’s representative) to accompany him/her during the property inspection. [Uniform Relocation Assistance & Real Property Acquisition Policies Act of 1970 (PL 91-646) as amended and the Uniform Appraisal Standards for Federal Land Acquisitions, 6th Ed. (Section 2.3.1.4)]
Pre-Work Meeting/Conference Call The contracted Appraiser will be required to participate in a pre-work meeting by telephone with the assigned AVSO Review Appraiser. The AVSO Review Appraiser will coordinate the date and time of the pre-work meeting directly with the Appraiser once a contract is awarded.
Controversies/Issues Should the Appraiser identify controversies or issues during the course of assignment, immediately notify the assigned AVSO Review Appraiser.
Legal Instructions None given.
RFQ number - 140D0422Q0553 013
Special Appraisal Instructions
1. Even though communication is encouraged with the property owner and the client agency, only the AQD Contracting Officer, in conjunction with the Review Appraiser’s concurrence, can modify appraisal instructions (in writing).
2. The Appraiser may not communicate assignment results to any party except AVSO unless authorized to do so in writing by AVSO.
3. Any communication (verbal or written) with the client agency realty contact shall include the assigned AVSO Review Appraiser.
4. The area of the easement acquisition is estimated to contain 405.86 acres, with the actual acreage to be eased dependent upon completion of a formal survey. Consequently, it is requested that in addition to stating the final value conclusions for the larger parcel(s) and remainder parcel(s) within the appraisal report, that the applicable unit values (e.g., $XX/acre) be stated along with the range of acreage within which that unit value would be valid (e.g., Before Condition - $XX/acre is valid for a range of XX-XX acres). This range would consider no material changes to the physical characteristics of the larger parcel(s) and assumed to apply to the “difference” reported. This is an assignment condition that is to be reported in the scope of work section of the appraisal report.
5. This statement of work (SOW) has been prepared during the COVID-19 pandemic.
Market impacts may vary by property type, geographic location, etc., but the potential exists for significant changes to real property values. For this reason, the appraisal must include a thorough market analysis, based upon the data available as of the effective date of value, in support of any market condition adjustments or for no adjustments. As applicable, this analysis can include interviews with real estate market participants (such as brokers, lenders, buyers, sellers), economic trends in the market sector and location, listing and sales activity or non-activity, commodity pricing, and changes in the financial markets.
The market research, analysis and rendered value opinion for this appraisal assignment is to be based upon the data available as of the effective date of value. This is considered an integral part of the highest and best use analysis. (UASFLA 1.2.7.3.1, 1.4.3-1.4.7, 2.3.3.1, & 4.3)
As reported by FWS, the area of the proposed conservation easement is approximately 216.95 acres. The total acres within the county under the same ownership, both contiguous and proximate to the subject of the report, is estimated at 221.95 acres per county appraiser records.

If the Appraiser determines that an extraordinary assumption is necessary for credible assignment results, he/she must contact the AVSO Review Appraiser for prior written approval.
RFQ number - 140D0422Q0553 021
If the Appraiser believes that USPAP’s Jurisdictional Exception Rule is needed to comply with any other additional law or UASFLA regulation, he/she must contact the AVSO Review Appraiser to obtain prior written approval.
The owner has given permission to enter the property to conduct an inspection. The document granting permission to appraise will be provided to the contracted Appraiser upon award. Please contact the owner’s representative directly, after award, to arrange a date and time for inspection.
