PROJECT DESCRIPTION

The Trinity River Restoration Program (TRRP) has initiated the restoration of anadromous fish in the river which requires higher flow releases from Lewiston Dam. Mitigation commitments of the program require Reclamation to ensure that affected existing structures be relocated or structurally improved before implementing peak releases. A broader overview and additional research on the program is available online at www.trrp.net.

A flowage easement is proposed to fully cover the subject property. The structures on this property will be impacted during peak releases and hence the need to acquire a flowage easement on this property.

PROPERTY DESCRIPTION

The property is located along River Acres Road, east of Cooper’s Bar and northwesterly of Junction City, Trinity County, California. The subject property consists of three separate legal parcels identified as Trinity County Assessor Parcel Numbers (APN) 009-400-061-000, 009-400- 073-000, and 009-400-069-00l, located in Section 35, in Township 34 North, Range 11 West, Mount Diablo Meridian. Each parcel is a little over one acre totaling approximately 3.26 acres and has direct access from its River Acres Road frontage. Surface of the roadway is compact dirt.

Trinity County records indicated a slightly less total area of 3.25 acres. Please see the table at the end of this section for individual Assessor parcel sizes and street addresses and primary characteristics.

As can be seen on the previous aerial exhibit significant amount of the property lies within the riverway and includes a portion of a natural gravel bar within the river. Outside of the river channel, Request for Quote 140D0422Q0520 010 the property gently slopes upward towards the road. Vegetation on the property is reflective of natural riperian habitat consisting of coniferous trees and shrubs.

The riparian topography places a portion of the property within the designated Floodway of the river with the rest within the designated 100-year Flood Zone along the Trinity River. The property incurs flooding at Trinity River flows of approximately 17,000 cubic feet per second (cfs). The structure reportedly begins to flood from river flows of approximately 18,500 cfs. The TRRP anticipates Maximum Fisheries Flows (MFF) of 23,000 cfs would surround and flood the house, but exact depth remains undetermined. Two BOR color enhanced exhibits follow for visual reference.

Request for Quote 140D0422Q0520 011

The property is improved with a single-family residence and associated outbuildings as represented in the photograh of the subject above. The three parcels operate as one property with most structures situated on APN 009-400-061. The current use is a legal and permitted use. Current owners utilize the residence part time and other times it is rented through VRBO and Air B&B for short term stays.

Request for Quote 140D0422Q0520 012

Reclamation investigated Trinity County records, discovering the existing home was built in 1972.

There are no permits available regarding wells or septic system. Installation of improvements on the site may have preceded record keeping that began in 1973. Per the County, it is not unusual for landowners along the river to have wells within or below the river. It is a considered a permitted use and location for a well. The subject’s well and pump is reported to be located in the riverway.

The septic system is located beneath the driveway of the house. The owner does not have construction or installation records. The system was inspected in 2015 when the property was purchased. The County requires septic systems to be 100’ from the normal high-water mark of the river. It will be the responsibility of the appraiser to verify if it satisfies this condition.

There are reported to be two domestic wells on the property. The primary well is located in the river below the gravel bar in the river. The pump is located inside the well itself. Water is pumped below ground to the house where there is a 200-gallon tank. The controls for the system are located inside the house. There is a second well on the property that is used as the backup well. It is located near the driveway to the house and has a small tank and pump located in a small shed. The well within the river generally produces a sufficient supply of water to serve the residential needs of the property. The second/backup well is used only when the primary well is insufficient.

PROPERTY INTEREST

The property interest to be appraised is market value estimates of fee simple interest, subject to any existing encumbrances and reservations of record before (without) a flowage easement and after (with) as encumbered by the proposed flowage easement in perpetuity. Because the landowner currently holds all rights that will remain in the after valuation, it does not require a hypothetical condition. See Outstanding Rights section below for encumbrances or reservations known to exit at the time of writing this statement of work.

The after-condition appraisal should include consideration of possible mitigation opportunities (such as renovation, relocation, or reconstruction of the improvements) for economic feasibility as a cost to cure mitigating influence of the proposed flowage easement. Ownership has provided several cost estimates for renovation/reconstruction to remove/elevate the dwelling from the proposed flowage easement area. It is noteworthy the analysis should investigate influence in both before and after condition appraisals of influence from the Trinity River Restoration Flows and the 100-year flood plain. Cost estimates provided will be included with the award to the selected appraiser.

The appraiser must immediately notify the AVSO review appraiser of any indications of rights contrary to these described. This may result in amended instructions. The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

OUTSTANDING RIGHTS

A preliminary title report and all reference documents will be provided along with the award to the selected appraiser. Any recorded or unrecorded documents, conditions, agreements, easements and/or encumbrances discovered must be identified and discussed in the appraisal report in relation to their impact on value. The preliminary title report indicates the following noteworthy exceptions summarized encumbrances on title:

8. An easement affecting the portion of said land for the purposes stated herein, and incidental purposes, affects Parcel 1, a strip of land 20 feet in width lying Northerly of and adjacent to the Southerly line of the land described herein.

10. – 12. Easements affecting the portions of Parcels 2 and 3, being strips of land for existing P.G.&E. powerline.

13. – 15. Utilities and ingress easements granted to various entities.

Request for Quote 140D0422Q0520 017

The appraiser must investigate for and promptly report additional or inaccurate encumbrances on the property to AVSO review appraiser. The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

RESERVATIONS

The current property owner is reserving any water rights as they are not being acquired.

Mineral rights are reserved in the patent dated December 24, 1879 to Joseph McGillivray as noted in exception 9 of the preliminary title report.

Personal Property The assignment does not include valuation of any personal property.

Highway 299 in Junction City. After crossing the bridge over Trinity River turn northerly on Red Hill Road continuing approximately 4.25 miles until reaching Wintu Pass Road then turning left continuing until reaching River Acres Road and the subject property.

Legal The subject is reported to have legal access along its River Acres Road frontage.

The Agency appraisal request covers 3.25 +/- acres of the subject’s ownership. Based on a search of public records, the total acreage owned is the same. The appraiser must conduct all research necessary for a well-supported larger parcel(s) conclusion presented in the appraisal. UASFLA 1.2.7.3.1, 1.4.3-1.4.7, 2.3.3.1, & 4.3.

INSTRUCTIONS

Appraisal Standards

• Uniform Standards of Professional Appraisal Practice (USPAP)

• Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA)

Applicable Law, Regulations, and Policy

• CVPIA PL 102-575 Central Valley Project Improvement Act (Link)

Market Value

The amount in cash or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of the appraisal, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property. [Uniform Appraisal Standards for Federal Land Acquisitions, 6th edition, 1.2.4, page 10.]

DATE OF VALUE

The date of value is the date of the last property inspection, which must be no later than 30 calendar days prior to the submission of the completed appraisal report, unless the AVSO review appraiser approves in advance other conditions in writing. The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

EXTRAORDINARY ASSUMPTIONS

No extraordinary assumptions are pre-approved for this assignment. If the appraiser determines that extraordinary assumptions are necessary for the completion of the assignment, the must contact the AVSO review appraiser for prior written approval. If a subsequent use of an extraordinary assumption is approved, the appraisal must note that it may have affected assignment results. The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

HYPOTHETICAL CONDITIONS

No hypothetical conditions are pre-approved for this assignment. If the appraiser determines that hypothetical conditions are necessary, the appraiser must contact the AVSO review appraiser for prior written approval.

JURISDICTIONAL EXCEPTIONS

The definition of value describes exposure time as “reasonable.” UASFLA 4.2.1.2 states, “… appraisers should not link opinions of market value for federal acquisitions to a specific exposure time.” This deviates from exposure time requirements in USPAP 1-2(c) and AO 35; therefore, the appraiser should invoke USPAP’s Jurisdictional Exception Rule to comply with the

UASFLA.

If the appraiser determines that other jurisdictional exceptions are necessary for the completion of the assignment, the appraiser must contact the AVSO review appraiser for prior written approval. The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

PLACEMENT IN REPORT

The appraiser must clearly identify all extraordinary assumptions, hypothetical conditions, and jurisdictional exceptions wherever the final value conclusion is stated, including the Letter of Transmittal and the Summary of Salient Facts. These must also be communicated with any General Assumptions and Limiting Conditions. The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

PROPERTY INSPECTION

The appraiser must inspect the subject property and all the market properties used in direct comparison, unless the AVSO review appraiser has approved other conditions in writing.

For appraisals with an intended use of acquisition or exchange, the appraiser must certify in the report that the appraiser extended an offer to the property owner (or the owner’s representative) to accompany him/her during the property inspection. [Uniform Relocation Assistance & Real Property Acquisition Policies Act of 1970 (PL 91-646) as amended and

Request for Quote 140D0422Q0520 021 the Uniform Appraisal Standards for Federal Land Acquisitions, 6th Ed. (Section 2.3.1.4, pages 58)] Permission to enter upon and appraise the property has been granted. The permission document will be provided to the selected appraiser with the award package.
