STATEMENT OF WORK

MARKET ANALYSIS FOR RESIDENTIAL LAND LEASE STUDY

The purpose of this Statement of Work (SOW) is to provide instruction and minimum appraisal standards to appraisers for the valuation assignment detailed below. This SOW outlines certain criteria that must be followed as required content in an appraisal report prepared for (AVSO).

The Appraiser must read and fully understand the contents of this SOW before continuing the assignment as many aspects of the appraisal report have been detailed throughout. This Statement of Work is to be an attachment to the Appraisal Request and must be included, along with the request in the final appraisal report. Failure to abide by the terms and conditions of Appraisal Request and this Statement of Work may result in an omission of required substance and therefore the return or rejection of the Appraisal Report for non-compliance reasons.

Assignment Elements

OASIS File No.: C57-207-2022-15009 Agency Case No.: C57-207-22-002 Client: U.S. Department of Interior’s, Appraisal and Valuations Services Office

(AVSO)

Intended Users: AVSO and the Bureau of Indian Affairs (BIA) – Rocky Mountain Region

(Northern Cheyenne and Crow Reservations) Intended Use: This assignment is a Market Analysis. A market analysis is an alternative to a site-specific appraisal, which is allowable under 25 CFR 162.322. It is the intended use of this market analysis to provide BIA Agency Superintendents with rental ranges that will assist them in the determination of fair market rent on individual residential tracts of trust and restricted lands within the Northern Cheyenne and Crow reservations in the Rocky Mountain Region.

Definition of Market Rent:

Federal regulations prescribe the definition of market rent for use in negotiating business leases of Indian trust land as:

"FAIR ANNUAL RENTAL". “Fair annual rental” means the amount of rental income that a leased tract of Indian land would most probably command in an open and competitive market. [25 CFR §162.101].

Definition of Market Value

“Market Value Definition”: "The most probable price, as of a specified date, in cash, or terms equivalent to cash, or in other precisely revealed terms, for which the specified property rights should sell after reasonable exposure in a competitive market under all conditions requisite to a fair sale, with the buyer and seller each acting prudently, knowledgeably, and for self-interest, and assuming that neither is under undue duress." The Appraisal of Real Estate, 14th Edition (Chicago: Appraisal Institute, 2013)

Property Rights to be Analyzed:

A right of possession for residential purposes for a specified period. The property rights to be appraised include those residential lease rights stipulated in the standard-form Lease provided by the BIA.

Effective Date: Assignment conclusions should be effective as of the date of inspection unless otherwise noted by the client or the Appraisal Request.

Study Area: The study area will be for the Northern Cheyenne and Crow reservations. The study will include all types of vacant residential property types such as 0-1 acre, Request For Quote 140D0422Q0482 007

1–5-acre, 5–10-acre, 10–20-acre and 20–40-acre residential sites. The rents should assume legal and physical access, and with and without wet and dry utilities.

The subject residential sites allowed uses can be for permanent stick-built homes or modular/mobile homes.

Study Exhibits: The BIA will provide generic lease information and a standard-form of the residential Lease anticipated in the future transactions.

Assignment Conditions Appraiser Qualifications:

This assignment prescribes a State Certified General or State Certified Residential Appraiser in good standing in the state in which the study area is located or hold an equivalent certification issued by another state. The engaged appraiser must sign the report.

Applicable Regulation:

A market analysis is not considered an appraisal as a specific property is not identified only classes of property; the market analysis then is not considered an appraisal subject to the Standards in the Uniform Standards of Professional Appraisal Practice (USPAP). However, since the market analysis is to be performed by an appraiser, acting as an appraiser, the appraiser still must comply with the other parts of USPAP, e.g., the Preamble, the Definitions, the Ethics Rule, Competency Rule, and the Jurisdictional Exception Rule.

Confidentiality: Not applicable.

Extraordinary Assumptions:

Not applicable.

Hypothetical Conditions:

Not applicable.

Inspection: Not applicable Personal Property, Fixtures, and Improvements:

Not applicable

Market Rent Analysis:

The extent of the market rent analysis should be sufficient to accurately characterize the market for such properties including those characteristics that impact rental rates. Recent transactions of relevant residential leases should be researched, confirmed, and analyzed, including private treaty, public lands and trust or restricted property leases. Care should be exercised to isolate the impact of lease rights in the data that are not included in the subject’s proposed lease.

Geographical research area for the market study should be focused on the counties that encompass the Northern Cheyenne and Crow Indian reservations, expansion, or contraction of the study should be discussed with the Review Appraiser prior to the commencement of the contract. The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

Appraisal Methodology:

Two techniques to determine market rent for residential lease parcels are thought to be appropriate in this market analysis if sufficient data were to be found.

Request For Quote 140D0422Q0482 008

1) Lease transaction analysis

2) Annual rent determination by application of a market derived rate of return and residential land value Lease Transaction Analysis

1) Search for market lease transactions

b. Identify start date, lease term (in years)

c. Identify property characteristics that would influence the rent of the transactions, e.g., presence of wet and dry utilities, legal and physical access, type of physical access (paved, gravel, dirt, etc.)

d. Identify lease price trends if any

e. Stratify by parcel size (common grouping) (0.1 - 0.5 acres,

0.51 – 1.0 acres, 1.1 – 2.5 acres, 2.6 – 5 acres, 5.1 to 10.0 acres, 10.1 to 20 acres, 20+ acres)

f. Identify No. of tracts in groupings

g. Identify annual rental and report in absolute terms and in rent per acre, for each grouping report the range from low to high and perform a simple statistical analysis in terms of the mean, median, mode and standard deviation of the groupings

Residential Land Value/ROR Analysis

1) Land Sale Transaction

a. Search for market sale transactions of residential land parcels for the past five years

b. Identify sale data and sale price/price per acre

c. Identify property characteristics that influenced the sale e.g., presence of wet & dry utilities, legal and physical access, type of physical access, (paved, gravel, dirt, etc.)

d. Identify price trends, if any.

e. Stratify by parcel size (common grouping) (0.1 - 0.5 acres,

0.51 – 1.0 acres, 1.1 – 2.5 acres, 2.6 – 5 acres, 5.1 to 10.0 acres, 10.1 to 20 acres, 20+ acres)

f. Identify No. of tracts in groupings

g. Identify sales price of parcels and report in absolute terms and in price per acre, for each grouping report the range from low to high and perform a simple statistical analysis in terms of the mean, median, mode and standard deviation of the groupings.

2) Rate of Return Analysis

a. Solve for an appropriate rate of return, the return should be a return and not a return on and of (as in capitalization rate).

3) Apply the rates to the land data for rent indications.

4) Interpret statistical findings and draw conclusions/recommendations

Reconcile the finding of the two approaches and present final conclusions/recommendations.

Report Exhibits: The Appraisal Request, this Statement of Work, and any documents provided with the request must be attached as an addendum to the appraisal report.

Request For Quote 140D0422Q0482 009

Deliveries: The completed report shall be formatted to 8.5” x 11” page size and delivered to

AVSO

Review: The report will be reviewed in its entirety for compliance with USPAP, and this

SOW. Deficiencies will require correction. Appraiser agrees to promptly correct (within 10 business days), all errors, omissions, and deficiencies and agrees to revise, expand upon, or clarify report contents, by providing additional data or analysis as required by the reviewer, including, if requested, the appraiser’s work file.
