Proposals are due by August 13, 2024 and will be evaluated on price reasonableness, contractor qualifications/experience, project milestone plan, and set-aside compliance.

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation;

quotes are being requested and a written solicitation will not be issued. 8. INVOICE INSTRUCTIONS

Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (February 2021) Payment requests shall be submitted electronically through the U.S. Department of the Treasury's Internet Payment Platform System (IPP). The IPP website address is: https://www.ipp.gov

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts.

At a minimum a proper invoice shall include:

- Name and address of the Contractor;

- Invoice date and number;

- BIE Contract number:

- Description, quantity, unit of measure, unit price and extended price of the items delivered.

- Shipping number and date of shipment, including the bill of lading number and weight of shipment if shipped on Government bill of lading.

- Terms of any discount for prompt payment offered;

- Name and address of official to whom payment is to be sent;

- Name, title, e-mail and phone number of person to notify in event of defective invoice; and

- Taxpayer Identification Number.

Additional Invoice Requirements:

a. The Contractor shall attach an itemized invoice to each IPP payment request.

b. Improper invoices may result in an invoice rejection. The Contractor shall promptly correct invoices upon notice.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. If the company SAM registration Point of Contact information is not current or correct, the designated company representative may not receive the email notice. Contractor assistance with enrollment or technical support can be obtained by contacting the IPP Production Helpdesk via email IPPCustomerSupport@fiscal.treasury.gov or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(a) The Contractor shall procure and maintain during the term of this contract and any extension thereof liability insurance in form satisfactory to the Contracting Officer by an insurance company which is acceptable to the Contracting Officer. The named insured parties under the policy shall be the Contractor and the United States of America. The amounts of the insurance shall be not less than as follows:

(b) Each policy shall have a certificate evidencing the insurance coverage. The certificate shall identify the contract number, the name and address of the Contracting Officer, as well as the insured, the policy number, and a brief description of contract services to be performed. STATEMENT OF WORK

FOOTBALL STADIUM TRACK AND GOAL POST

1. PROJECT

Pine Ridge School (PRS) is a federally operated school under Department of the Interior, Bureau of Indian Education. PRS is located within the boundaries of the Pine Ridge Indian Reservation in Pine Ridge, South Dakota, Oglala Lakota County. PRS has identified a need for running track maintenance and goal posts. The track encloses the outdoor football field. The area serves a dual purpose for track & field as well as a football field during practice and competitive events.

2. SCOPE OF WORK

TASKS & REQUIREMENTS:

The Contractor shall furnish all supervision, materials, equipment, and personnel necessary to manage and accomplish the work. The Contractor shall provide sufficient technical support and project management to assure the quality and accuracy of estimates, accommodate several concurrent active projects, and provide staff flexibility. Additionally, the government will rely on the contractor's expertise to recognize and address problematic issues and ensure successful execution.

The Government expects that work executed against this order shall exhibit superior quality, responsiveness, and customer service. The Contractor's work responsibility shall include all planning, administration, coordination, and management necessary to provide all work as specified.

The Contractor shall conduct the work strictly following the contract and all applicable Tribal, Federal, State, and local laws, regulations, codes, or directives as appropriate. The Contractor shall ensure that all work provided meets or exceeds critical reliability rates or tolerances specified or included in applicable documents.

3. TASK DESCRIPTIONS:

Task I: Main 400m 8 Lane Track

1. Surface Evaluation:

o Before maintenance begins, a thorough assessment of the existing track condition is necessary. This evaluation helps determine the level of work required. Inspect for cracks, water damage, and other issues affecting the surface.

2. Base Preparation:

o Address any damage to the underlying structure. If cracks or other issues exist in the asphalt subsurface, they need fixing to ensure a solid foundation for the track surface.

3. Existing Surface Removal:

o The existing track surface (usually worn-out synthetic material or asphalt) might need removal. This involves stripping away the old layers to expose the base.

4. Patch and Repair:

o Patch any deficiencies in the asphalt subsurface. This step ensures that the base is smooth and even before the new surface is installed.

5. New Track Surface Installation:

o If necessary, install a new track surface. For a 400-meter track, this typically involves laying down a synthetic all-weather track surfacing system. The material can vary (e.g., polyurethane, latex, or other synthetic compounds). Line striping and markings for the track lanes, start/finish lines, and field event areas are also part of this phase. Lines, Lanes, and Markings shall be within code for competitive events.

6. Quality Assurance:

o Regular inspections during installation are crucial to ensure the track meets quality standards. Proper curing time and adherence to manufacturer guidelines are essential for longevity and performance.

7. Completion and Testing:

o Once the new surface is in place, conduct tests to meet competition standards. This includes checking for proper bounce, slip resistance, and overall safety. ready for athletes to sprint, hurdle, and jump confidently.

Task II Main 400m Long Jump:

1. Build Materials:

o Aluminum: It’s lightweight, corrosion-resistant, and can withstand various weather conditions.

o Galvanized Steel: Galvanized steel used for goalposts is typically heavy gauge (measuring around 4 to 5 inches thick). The gooseneck, the 90-degree arc that supports the crossbar and uprights, is often the most vital piece and measures about 5 inches thick.

o Padding: Shall meet The National Federation of State High School Associations (NFHS) standards for using padding around the goalposts.

o NFHS Specifications:

o Official high school field goalposts adhere to NFHS specifications. These goalposts are typically semi-permanent single-post slingshot designs. Here are the key specs:

o Crossbar: Width measures 23 feet 4 inches.

2. Installation Methods:

4. CONTRACTOR DUTIES AND RESPONSIBILITIES

A. Maintenance 400m track and long jump runways. Install two new aluminum or Galvanized Steel Football goalposts.

B. The 400m track, long jump, and football goalpost shall meet all high school track and field South Dakota High School Activities Association (SDHSAA) codes.

C. The contractor assures all underground utilities are properly marked and located.

D. Contractor shall avoid damage to existing structures, vegetation, and private and government-owned property.

E. The Contractor shall be responsible for providing temporary electrical power and a portable/chemical toilet for their workers. The Contractor will not use any part of the school buildings or facilities for storage or administrative purposes.

5. SPECIAL REQUIREMENTS

General: Alcohol, drugs, or tobacco products are Prohibited on the school campus at any time.

Prescription drugs prescribed for Contractor/Subcontractor’s employees are acceptable.

1. Mobilization: The successful Contractor shall provide all labor, materials, equipment, supervision, transportation, and all other services to complete the project. The Contractor shall be responsible for mobilization, cost of materials, equipment, office trailer, storage bins, and other materials that require transporting to the project site.

2. Security Background Clearance: A background check approval is required for the Contractor’s Site Superintendent before any work is started on this project. All Contractor employees must wear name badges or a bright fluorescent vest with the company name/logo printed on the safety vest while on the project site (during regular work hours). The Jobsite Superintendent shall report to the school’s front office each day to indicate the number of workers on-site and provide a daily work schedule of work activities.

6. SITE PREPARATION – DEBRIS DISPOSAL

The Contractor shall:

The Contractor shall remove all debris generated by activities daily. The Contractor bears responsibility for all associated or related costs for removing and disposing of all debris from the United States Government's properties.

Plan for the mobilization cost of materials, equipment, an office trailer, storage bins, and other items that must be transported to the project site before starting up.

Plan for equipment storage and security throughout the project. The school is not liable for lost, stolen, or damaged items.

The Contractor shall transport debris outside the school's boundaries to an EPA-approved landfill. The Government is not responsible financially or otherwise for the success or failure of arrangements for the disposal of debris between the Contractor and other parties.

7. WARRANTY

The Contractor should address each of the following:

Applicable warranty and guarantees, including any conditions and response time for repair and replacement of any components during the warranty period of 1 (one)year from completion.

8. OBTAIN ALL MATERIALS AND PERMITS

The Contractor shall procure all permits required for the work, as applicable.

The Contractor and subcontractors shall be held responsible for the safety of their employees and any unsafe acts or conditions that may cause injury or damage to any persons or property within and around the worksite area under this contract.

***Workers in this classification may be entitled to a higher minimum wage under Executive Order 14026 ($17.20 per hour) or 13658 ($12.90 per hour). Please see the Note at the top of the wage determination for more information.

Please also note that the minimum wage requirements of Executive Order 14026 and 13658 are not currently being enforced as to contracts or contract-like instruments entered into with the federal government in connection with seasonal recreational services or seasonal recreational equipment rental for the general public on federal lands. The minimum wage requirements of Executive Order 14026 also are not currently being enforced as to any contract or subcontract to which the states of Texas, Louisiana, or Mississippi, including their agencies, are a party.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors, applies to all contracts subject to the Service Contract Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year. Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is the victim of, domestic violence, sexual assault, or stalking. ALL OCCUPATIONS LISTED ABOVE RECEIVE THE FOLLOWING BENEFITS:

HEALTH & WELFARE: $5.36 per hour, up to 40 hours per week, or $214.40 per week or $929.07 per month

HEALTH & WELFARE EO 13706: $4.93 per hour, up to 40 hours per week, or $197.20 per week, or $854.53 per month*

*This rate is to be used only when compensating employees for performance on an SCA-covered contract also covered by EO 13706, Establishing Paid Sick Leave for Federal

Contractors. A contractor may not receive credit toward its SCA obligations for any paid sick leave provided pursuant to EO 13706.

VACATION: 2 weeks paid vacation after 1 year of service with a contractor or successor, 3 weeks after 10 years, and 4 weeks after 15 years.

Length of service includes the whole span of continuous service with the present contractor or successor, wherever employed, and with the predecessor contractors in the performance of similar work at the same Federal facility. (See

HOLIDAYS: A minimum of eleven paid holidays per year: New Year's Day, Martin Luther King Jr.'s Birthday, Washington's Birthday, Memorial Day, Juneteenth National Independence Day, Independence Day, Labor Day, Columbus Day, Veterans' Day, Thanksgiving Day, and Christmas Day. (A contractor may substitute for any of the named holidays another day off with pay in accordance with a plan communicated to the employees involved.) (See 29 CFR 4.174)

THE OCCUPATIONS WHICH HAVE NUMBERED FOOTNOTES IN PARENTHESES

RECEIVE THE FOLLOWING:

1) COMPUTER EMPLOYEES: This wage determination does not apply to any individual employed in a bona fide executive, administrative, or professional capacity, as defined in 29 C.F.R. Part 541. (See 41 C.F.R. 6701(3)). Because most Computer Systems Analysts and Computer Programmers who are paid at least $27.63 per hour (or at least $684 per week if paid on a salary or fee basis) likely qualify as exempt computer professionals under 29 U.S.C. 213(a)(1) and 29 U.S.C.

213(a)(17), this wage determination may not include wage rates for all occupations within those job families. In such instances, a conformance will be necessary if there are nonexempt employees in these job families working on the contract.
