C.1.1 The contractor shall provide electric utility services to the government facilities at:

C.2 CONTRACTOR’S EQUIPMENT
The Contractor, at its expense shall furnish and install at all facilities required to supply electric utility service and measure such services at the delivery points specified. The equipment remains provider for Wingate Elementary and Wingate High the property of the Contractor. The Contractor shall at all times during the life of this contract, operate and maintain such equipment at its expense, and shall assume all taxes and other charges in connection therewith. Said equipment shall be removed and the Government premises restored as near as practicable to their original condition, ordinary wear excepted, by the Contractor, at its expense, within a reasonable time after discontinuance of services under this contract.
The Government shall assume any damage to the equipment (meters, etc.) by the Government.
C.3 SECURITY REQUIREMENTS
The contractor must follow the security process at the BIE facility. The COR will provide the necessary facility pass requirements, security clearance requirements, etc. The contractor is required to check in and out at the main office daily when entering and leaving the facility. BIE reserves the right to inspect all boxes, packages etc. coming into and exiting from any BIE facility.
C.4 ACCESS TO PREMISES
The Contractor shall have access to the premises served at all reasonable times during the continuance of this contract and at its termination for the purpose of reading, meters, making installations, repairs, and removals of the Contractor’s equipment, and for any other proper purposes hereunder; provided, however, that proper Governmental authority may limit or restrict such right of access in any manner considered by such authority to be necessary to advisable.

F.2. HOURS OF OPERATIONS
(a) Normal Hours of Operation
The Contractor must perform the services required under this contract during the following hours:
7:00am to 4:00pm. The Contractor is responsible for notifying the COR if he/she will be late, or is ill and unable to work for other reasons. A schedule will be established, any deviations to the schedule must be approved in advance by the COR. If it is required of the BIA to supply an attendant to stay after the normal hours of operation, the Contractor must cover the additional cost of the BIE attendant.

SECTION G – CONTRACT ADMINISTRATION DATA
G.1. CONTRACTING OFFICER
a. The Contracting Officer (CO) is the only individual who can legally commit or obligate the Government to the expenditure of public funds.
b. The CO is the only person authorized to make and changes or approve any changes in any of the requirements of the contract, and notwithstanding any provision contained elsewhere in this contract, the said authority remains solely with the CO. In the event the contractor makes any changes at the direction of any person other than the CO, the changes will be considered to have been made without authority and no adjustments will be made in the contract price to cover any increase in costs incurred as a result thereof.
c. The CO whose name is shown below will affect all contract administration. Communications pertaining to contract administration matters will be addressed to the CO. No changes in, or deviation from, the scope of work shall be effect without a supplemental (modification) executed by the CO authorizing such changes.
d. The CO may change without notice. The change will be administered by Contract Specialist:

G.2. CONTRACTING OFFICER’S REPRESENTATIVE (COR)
The Contracting Officer will designate a representative in dealing with the Contractor at the site, to administer the technical aspects of the contract and to assure compliance. The representative has no authority to issue change orders or otherwise authorize changes, which would affect the contract price, specifications, conditions or period of performance. Designation of a COR will be issued when the contract is awarded.

G.4. INVOICE SUBMISSION

Invoice Contents:
Invoices will be paid upon approval and acceptance by the Government COR. Invoices must include, as a minimum, the following information:

4. Price of deliverable
5. Quantity of deliverable
6. Date deliverable was provided to the Government for inspection
7. Serial number/part number if applicable

Within sixty calendar days of product acceptance and/or completion of services:
a. The contractor shall submit a final invoice, designated as such by a clear statement of “FINAL INVOICE” on the face of the invoice document.
b. The contractor shall provide a certificate of completion which certifies all goods and service have been provided as required by this task order.
c. The contractor shall provide a release of claims against the government for any further payment under this task order.

The sixty calendar day submission timeframe shall not be extended without written authorization from the contracting officer. In the event items a, b, or c above are not submitted within the authorized timeframe, the contracting officer will make final cost determinations in order to make final payment and close out the contract unilaterally.
To constitute a proper invoice, the invoice must conform to the requirements identified in FAR 32.905(b), “Payment Documentation and Process” and FAR 52.232-25, “Prompt Payment (JAN 2017)”.
SECTION H – SPECIAL CONTRACT REQUIREMENTS
H.1. Payment for Unauthorized Work
No payments will be made for any unauthorized supplies and/or services, or for any unauthorized changes to the work specified herein. This includes any services performed by the Contractor of their own volition or at the request of an individual other than a duly appointed Contracting Officer. Only a duly appointed Contracting Officer is authorized to change the specifications, terms, and conditions under this effort.
H.2. Release of News Information
No news release (including photographs and films, public announcements, denial or confirmation of same) on any part of the subject matter of this effort or any phase of any program hereunder shall be made without the prior written approval of the Contracting Officer.
H.3. Notice Regarding Late Delivery/Delayed Performance
The contractor will immediately notify the Contracting Officer in writing in the event the contractor encounters difficulty in performance by giving pertinent details, including the date by which it expects to complete performance or make delivery. However, the notification will be informal only in character and will not be construed as a waiver by the Government of any contractual delivery schedule or date, or any rights or remedies provided by law or under this effort.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
