SECTION B – CONTINUATION
This is a competitive request for proposal (RFP) pursuant to Federal Acquisition Regulation (FAR) part 12, Commercial Items and FAR part 15, Contracting by Negotiation competed on beta.sam.gov.
Set-aside Full and Open Competition
North American Industry Classification System (NAICS) 611710, Educational Support Services, Size Standard $16.5 million
Product Service Code (PSC) U009, Education / Training - General
Place of Performance TBD (see PWS for additional details)
1. CONTRACT TYPE
The Department of the Interior (DOI), Bureau of Indian Education (BIE) is competing this RFP for the purpose of entering into a Firm Fixed Price (FFP) type contract with a base period and one option period.
The Government’s goal is to establish a performance based FFP contract for this opportunity. See section
E of this document for additional details.
This requirement is a performance based acquisition (PBA), utilizing a Performance Work Statement
(PWS) (see attachment 1) for commercial services.
2. PERFORMANCE INFORMATION
The anticipated Period of Performance (POP) dates are as follows:
Base Period - July 1, 2021 – April 30, 2022
Option Year 1 - May 1, 2022 –April 30, 2023
FAR 52.217-8 - May 1, 2023 – October 31, 2023*
*The POP and estimated price for FAR 52.217-8 are for evaluation purposes only. The clause may be invoked at any time by the Contracting Officer (CO) during the life of the contract.
One (1) option period of up to 12 months, to extend performance, will be included in this contract. When deciding whether to exercise the option, the administrative CO will consider the quality of the Contractor’s performance under this contract, as well as requirements specified at FAR 17.207-Exercise of Options.
The evaluation of the option periods does not obligate the Government to exercise any of them.
3. PRICING SUMMARY
Additional performance information is contained within the PWS.
The government is incorporating a pricing schedule (see attachment 2) into this RFP that all offerors must complete and turn in with their offer.
Project Title
4. PRICING TERMS
In addition to any pricing terms identified, the following terms apply:
1. The FFP CLINs established shall be inclusive of all applicable costs of performance under contract to include labor, materials, travel, fees, taxes (federal, state, local, tribal), profit, etc.;
2. If applicable, the New Mexico Gross Receipts Tax (NMGRT) must be estimated and incorporated into the offeror’s proposed allowable pricing (see attachment 7). NMGRT is not, nor will it be, an allowable itemized expense under this contract. Additionally, the vendor will not be reimbursed for any tax changes in rates in the future, as it is the contractor’s responsibility to project tax fluctuations and propose rates accordingly. NMGRT is being categorized as a tax under FAR 52.212-4(k);
3. Attachment 2 has outlined the loan and scholarship distribution amounts for each year. These are provided as best estimates for evaluation purposes. Both the base year and option year 1 amounts may fluctuate depending on the available funds for these programs. It is anticipated that the base year distribution amount will not fluctuate more than +/-5%. Contractors shall quote administrative service fees based upon these estimates;
4. Should option year one (1) distribution amounts change considerably, either positive or negative, renegotiating the administrative fees may take place by mutual agreement of the parties.
5. INVOICING
1. All invoices shall be submitted via www.IPP.Gov, unless otherwise agreed upon. See section C.3. of this document for additional details;
2. The contractor may invoice for administrative services in accordance with the approved invoicing schedule in the contract (see FAR 52.212-1 addenda for further instruction);
3. The contractor may invoice for scholarship and loan distribution funds after the government has approved the distribution list each semester or as required throughout performance. The contractor may not invoice for the entirety of the scholarship balance at the onset of performance.
