Section 1 - Supplies or services and prices/costs

1.1 REQUIRED WORK

The Contractor shall provide services as stated in the Statement of Work (SOW).

1.2 OFFEROR’S SCHEDULE

FIRM FIXED PRICE (FFP) FOR THE JOB

PRICING SHALL INCLUDE ALL LABOR, SUPPLIES, MATERIALS, INSURANCE,

TRAVEL AND TAXES TO DELIVER AS STATED IN THE SOW.

Section 2 - Description/specifications/statement of work

2.1 TYPE OF CONTRACT

This is a firm-fixed price, single award contract, with option years. Services shall be in accordance with the Statement of Work. The North American Classification Industry System (NAICS) for this requirement is 621330, Offices of Mental Health Practitioners (except Physicians), and the small business size standard is $8M. No additional sums will be payable on account of any escalation in the cost of materials, equipment or labor, or because of the Contractor’s failure to properly estimate or accurately predict these prices or difficulty of achieving the results required by this contract. Nor will the contract price be adjusted on account of fluctuations in the currency exchange rates.

2.2 STATEMENT OF WORK

BACKGROUND

The Cheyenne-Eagle Butte School is a Bureau of Indian Education (BIE) operated school located in Eagle Butte, South Dakota. As a BIE operated school, Cheyenne- Eagle Butte School is responsible for providing a high-quality general education and Special Education programming. The Cheyenne-Eagle Butte School-Special Education Department is seeking a state (South Dakota) and nationally certified National Association School Psychologist and possess licensure for all services offered. That can provide long term services for the Cheyenne-Eagle Butte School. That will be able to assist with the completion of psycho-educational evaluations, academic evaluations and other reporting needs of the Cheyenne-Eagle Butte School. Primary responsibilities will include the intellectual, behavioral, academic sections of the comprehensive Special Education Evaluation.

SCOPE OF WORK

The Cheyenne-Eagle Butte School Special Education Department is searching for a contractor to assist the school in fulfilling the responsibilities of School Psychologist, achievement administration and transition. In addition to holding both State of South Dakota and National Certification it is imperative that the School Psychologist is well versed in State of South Dakota and Federal Special Education laws, rules, regulation and eligibility requirements. Cheyenne-Eagle Butte School will provide a clean and comfortable workspace the for contractor while on- site for meetings, evaluations, and report writing including property or supplies to be provided by Cheyenne-Eagle Butte School.

SERVICE PROVIDER PERSONNEL

The purpose of this contract is to acquire the services of both a South Dakota and Nationally Certified School Psychologist and a State of South Dakota certified Special Education teacher. It is imperative that the individual possesses both state and national certification and State of South Dakota Special Education certif ication at time of application. Contractor must have experience working in reservation schools. Experience should consist of experiences that provide a minimum of five years experience working with Native American Students in two or more reservation schools in South Dakota. Experience in a school setting could be either as a counselor, school psychologist or teacher, State and National Certification as a school psychologist is mandatory. The individual must be able to provide 14 consecutive days per month of service on site each month and 10 days a month for achievement/transition purposes. The Contractor must provide a mental health counselor and an individual to conduct assessments. This individual will provide crisis counseling services and be able to administer assessments for the special education evaluation process to assist in keeping the C-EB special education evaluations in compliance according to state and federal law. It is imperative the contractor be able to work collaboratively with the Special Education Director/School Supervisor, school staff, students and parents. Upon notification from school required to be available for consultation when not on-site. The provision of special education services are a highly sensitive area and the need of continuity of services is critical.

GOAL

The overarching goal is to conduct comprehensive psychological evaluations as required by the Individuals with Disabilities Education Improvement Act of 2004 by a highly qualified State and National Certified School Psychologist and State of South Dakota certified Teacher. All evaluations will be completed within established State and Federal timelines for the Cheyenne-Eagle Butte School to fulfill all legal requirements and remain in compliance.

OBJECTIVES

• Provide comprehensive Intellectual Evaluations as designated by Special

Education Coordinator/School Supervisor

• Assist with behavioral evaluations of at-risk and Special Education students

• Provide monthly on-site service provision/Minimum of 14 consecutive days required and the mental health/test administrator on site 2 days a week

• Consultation with Teacher Assistance Team/problem solving team as requested by Special Education Coordinator/School Supervisor

• Provide prompt completion and delivery of evaluations (estimate 2 weeks depending on case load)

• Attend all initial eligibility meetings to review the results with parents/guardians

• All comprehensive evaluations will be completed within 25 school days as required by South Dakota State law

• All comprehensive evaluation reports will be completed within 30 calendar days as required by South Dakota State law

• Provide on-site training to school staff and/or parents on topics related to school psychologist area of expertise upon request from Special Education Coordinator/School Supervisor

• Willing to attend and participate in trainings and workshops requested by Special

Education Coordinator/School Supervisor, pending schedule and availability

• Complete all necessary/required achievement initial and reevaluations

• Assist with all requested achievement evaluations, initial/reevaluations

• Provide assistance with high school transition upon request

TASKS

Contractor must consist of an individual who has at a minimum a Specialists Degree in School Psychology from an accredited university. The individual must have both National Certification through NASP along with a current South Dakota Certification as a school Psychologist. Certification and State of South Dakota teacher cert if icat ion must be held before application. The contractor must have a minimum of five years experience working in two or more schools in South Dakota with preference for reservation schools. The Contractor must be on-site a minimum of fourteen consecutive days per month with additional days being optional. Additionally, the contractor must have credentials to administer achievement evaluations and provide assistance with transition services.

DELIVERY

To provide 14 days per month of on-site school psychological services per month and 10 days on-site for achievement/transition purposes and a mental health/assessment

PLACE OF PERFORMANCE

Contractor’s work is to take place on the Cheyenne – Eagle Butte School campus, contractor’s office or other location as determined and approved by the Special Education Coordinator/School Supervisor

SECURITY REQUIREMENTS

Contractors and staff are required to check in with Special Education Director/Administration prior to entering the school campus.

2.3 FEDERAL TRAVEL REGULATIONS

*NOTE: This clause is applicable to pre-approved travel outside the scope of services in the SOW. Travel costs to/from the school for services as stated in the SOW are included in the Firm Fixed Price as stated in Section 1.2.

Travel cost incurred for transportation, lodging, meals, and incidental expenses (as defined in the regulation cited in FAR 31.205-46) shall be considered to be reasonable and allowable only to the extent that they do not exceed on a daily basis the maximum per diem rates in effect at the time of travel as set forth in the Federal Travel Regulation.

The consultant will be reimbursed for travel to provide support at a Government site or other site as may be specified and approved by the COTR under this effort. All travel shall be approved, by the COTR, prior to commencement of travel. Consultant shall provide supporting documentation and a detailed breakdown of incurred travel costs with each invoice.

2.4 BACKGROUND INVESTIGATION

Document Title

In accordance with 25 U.S.C. 3201 (P.L. 101-630), Indian Child Protection and Family Violence Prevention Act; 42 U.S.C. 13041, Crime Control Act of 1990; 441 Departmental Manual, Personnel Security and Suitability Requirements all positions with duties and responsibilities involving regular contact with or control over Indian children are subject to a background investigation and determination of suitability for employment. Accordingly, all such positions require a favorable screening (applicant and suitability) determination made by the Bureau of Indian Affairs (BIA) Office of Indian Education Programs (OIEP), Personnel Security and Suitability Program; and a favorable background investigation determination conducted by the Office of Personnel Management (OPM).

A favorable screening (applicant and suitability) determination must be made by the Bureau of Indian Affairs (BIA) Office of the Indian Education Programs (OIEP), Personnel Security and Suitability Program prior to contract award or made within 60 days of incorporation of this clause into a current/existing contract. Pending completion of a background investigation by OPM, the Contractor who has been granted a favorable screening (applicant and suitability) determination must be within the sight and under the supervision of a Government employee who has had a completed background investigation (42 U.S.C 13041 (3)) during contract performance until a final background investigation determination has been made.

Prior employment with the Federal Government, including BIA, OIEP or the Bureau of Indian Affairs, does not assure that the appropriate screening or investigation was conducted nor does it alleviate or guarantee a favorable screening (applicant and suitability) determination or background investigation. Prior to an award or during the 60 day period discussed in paragraph two, it is solely the company, individual or contractor's responsibility to contact the BIA, OIEP Personnel Security and Suitability Program at 505-563-5287/5288/5289/5294 in order to obtain a complete security package, which includes but is not limited to appropriate investigative forms and/or inquire about their previous investigation; and, obtain a screening (applicant and suitability) determination, and subsequent final background investigation.

If an unfavorable screening (applicant and suitability) determination is made, a purchase order shall not be awarded to the individual who received an unfavorable screening or to the company who has proposed to employ the individual to perform the work. The individual and or the company who proposed to employ this individual may be determined to be non-responsible if an unfavorable screening (applicant and suitability) determinations is made, which will make them ineligible for purchase order award.

If an unfavorable final background investigation determination is made, the purchase order may be terminated and the employee in question shall not be authorized to provide service to the BIA, OIEP, if the services involve contact with or regular control over Indian children.

2.5 NON-PERSONAL SERVICES

This contract is a non-personal services contract, under which the contractor is an independent contractor. The Government may evaluate the quality of professional

The Contractor is required to indemnify the Government for any liability producing act or omission by the Contractor, its employees and agents occurring during contract performance. The Contractor shall maintain medical liability insurance, which is not less than the amount normally prevailing within the local community for the specialty concerned.

Section 3 – Inspection and Acceptance

3.1 INSPECTION AND ACCEPTANCE

Services to be inspected and accepted by the authorized Government Contracting Officer’s Representative (COR).

Delivery shall be within 30 days of award. Maintenance shall be for a period of 1 year after award. Warranty shall be for a period of 3 years after award.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice

- A copy of the contractor’s invoice shall be included with the IPP invoice. If no invoice is attached, the Invoice will be rejected.

The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.

Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form.

This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
