1.1 GENERAL.

a. Description. Provide labor, oversight, materials, and equipment to remove & replace the entryway ramps for buildings located at 1342, 1344 and 1346 Spruce Street in Towaoc, Colorado.

Work shall be provided in accordance with all Terms, Conditions, General, Specific and Technical Provision, Exhibits, Attachments, Maps, Drawings, etc. contained herein or incorporated by Reference. This includes all mandatory provisions of the Federal Acquisition Regulation (FAR), whether referenced or not, current at time of award.

b. Background. The current platforms exhibit significant rust, deterioration, and structural deficiencies, creating unsafe conditions for occupants and visitors. Additionally, the platforms do not meet current Americans with Disabilities Act (ADA) accessibility standards. This project will provide new, durable, and ADA-compliant platforms that meet all applicable building codes and safety regulations.

c. Notice of Set Aside. In accordance with Department of the Interior Acquisiton Regulation 1480, this procurement is set aside for Indian Small Business Economic Enterprises (ISBEEs).

d. Contractor Responsibility. Contractor¿s work and responsibility shall include, but are not limited to, supply of equipment/materials, all planning, programming, administration, management, supervision, and inspection required to assure all equipment/materials are acquired and services are conducted in accordance with the contract and all applicable laws, regulations, or directives. The Contractor shall insure all work meets or exceeds specifications. The prime Contractor shall be responsible for ensuring all subcontractors comply with the provisions of this contract. All materials shall be installed in accordance with the manufacturer¿s recommendations and/or applicable building standards unless specifically stated otherwise in the specifications.

e. Performance Required. Special consideration of the Contractor is directed to the fact that the required accuracy, thoroughness, safety, and progress of this work are essential to the intended purpose. The contractor must be cognizant of the difficulties involved and of the contingencies which may arise, and must make certain that their personnel, equipment, transportation facilities and supply of materials are always adequate to ensure complete compliance with all provisions of these specifications. The work shall be done under professional supervision by competent employees. All contract services shall be in accordance with the submitted documents, and any additions, revisions or deletions must be approved by the Contracting Officer or his/her authorized representative.

f. Completion of Work. Completion of work shall include acceptable performance of all aspects of this contract.

g. Conditions:

1. The Bureau of Indian Affairs reserves the right to cancel all, or part of the work described in this Request for Quote if costs exceed anticipated funding. Department of Labor Wage Rates apply to this work and are attached at the end of this document. The Contractor is required to provide certified payroll documents for all work performed under this request.

2. Pre-Work Conference. The contractor will be required to attend a pre-work conference at least one week prior to beginning work, during which time the Contractor shall supply the Technical POC with an Safety Program Submittal.

3. Hours and Days of Work.

Work may be conducted between the hours of 8:00 a.m. and 4:00 p.m. MST, Monday through Friday. No work shall be performed outside of these times, or on federal Holidays, unless approved by the Technical POC in advance.

When one of the above designated holidays falls on a Sunday, the following Monday is observed as a legal holiday. When a legal holiday falls on a Saturday, the preceding Friday is observed as a holiday. Work shall be scheduled around the above listed Federal holidays except as specified herein or as approved by the POC.

4. Payment Procedure/Additional Work. At no time should the contractor do additional work without prior authorization of the Contracting Officer, and no work shall be performed that will cause the Contractor to exceed the contract price. Work performed without a binding contract document authorizing such work shall result in the Contractor not being paid for that work performed. During the course of the contract, any additional work determined to be needed may be requested by the Project Manager to the Contracting Officer for a Contract Modification.

5. Contract Start and Completion Dates. Work should commence within 14 calendar days of receipt of notice to proceed and may proceed at any mutually agreeable time within that time frame. Work will be completed within 30 days

(30) days of the issuance of the notice to proceed. The notice to proceed will be issued upon receipt and approval of all required performance and payments bonds. All services will be completed as scheduled, unless weather or circumstances beyond the control of either party occur requiring a delay in the work. The Government reserves the right to delay or stop work as needed to accommodate higher priorities, time allowed for completion will be adjusted accordingly.

6. Wage Rates: Department of Labor wage rates apply to this work and are included. The contractor is required to provide payroll documents for all work performed under this contract.

7. Safeguarding Property: The Contractor shall, at all times prior to delivery, take care to protect and preserve all materials, supplies, and equipment of every description (including material and property which may be Government owned) and all work performed. All reasonable requests of the Technical POC or his/her authorized representative to enclose or specially protect such property shall be complied with. If so determined by the Technical POC that material, equipment, supplies, and work performed are not adequately protected by the Contractor, such property may be protected by the Government and the cost thereof may be charged to the Contractor or deducted from any payment due to them.

8. The Contractor will notify the Technical POC or his/her authorized representative, upon commencement of work activities, and difficulties, interruption, or suspension of work, and when the required work has been completed. The Contractor shall update the Technical POC, or their authorized representative, no less than once weekly on status of work being done.

9. The scope of work only contains approximate measurements for reference. It is required that each interested contractor visit the job site prior to submitting a quote. The Contractor is responsible for quantities, materials, critical dimensions and work conditions used to calculate a proposal.

1.2 CONTRACTOR SUBMITTALS.

a. Pre-Construction Safety Meeting: Meet with representatives of the Contracting Officer to discuss and develop a mutual understanding relative to administration of the overall safety program.

b. As-built drawings of the completed ramps.

1.3 ACCIDENT REPORTING. The Contractor shall maintain accurate accident records and report accidents as prescribed by the Technical POC. Accidents shall be reported within 24 hours of occurrence, and all serious accidents (those resulting in death or injury requiring medical attention or lost time) shall be reported immediately.

1.4 DAMAGE REPORTS. In all instances where Government property, equipment, natural features, landscape, or trees are damaged by contract employees, an immediate notification shall be made to the Technical POC. A full report of the incident and extent of such damage shall be submitted to the Technical POC within two working days of occurrence, excluding weekends and holidays.

1.5 CONTRACT EMPLOYEES. All contract employees shall conduct themselves in a proper and courteous manner at all times. Contract employees shall comply with all provisions of Title 36, Chapter III, Part 327, CFR and obey all posted signs and regulations in the performance of the work under this contract. Being under the influence of or consuming alcoholic beverages or controlled substances by the Contractor or employees while on duty is prohibited.

2.1 SPECIAL REQUIREMENTS:

a. Security.

At the Pre-construction Conference (and prior to beginning work on the contract), the Contractor shall provide a list of all on-site personnel, including sub-contractors (including second and third-tier subcontractors) and suppliers, to the Contracting Officer (note: after award, an SF1413 is required to be completed and returned to the Contracting Officer for each subcontract entered into). The contractor shall update this list when changes occur. Contractor personnel not listed may be denied access to a facility. Contractor personnel will be restricted to designated working areas and any personnel violating this policy may lose access to the facility. Contractor personnel shall have photo identification at all times while working on BIA facilities. Contractors shall provide the COR with 24 hours of advance notice of every delivery to the site (e.g., concrete, lumber, etc...) and provide the company name, delivery person, and phone number of the firm(s) making deliveries. Otherwise, access to a facility may be denied.

b. Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract. The IPP website address is: https://www.ipp.gov.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice: Refer to FAR 52.232-5 Payments under FP Construction Contracts, FAR 52.232-16 Progress Payments, and FAR 52-232-27 Prompt Payment for Construction Contracts. The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of St. Louis (FRBSTL) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email IPPCustomerSupport@fiscal.treasury.gov or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer when submitting their quote.

c. SAM Registration: The successful offeror will be required to be registered with (SAM) System for Award Management, (https://www.sam.gov/) to do business with the government. (NOTE: Pay careful attention when typing in the SAM website address on your browser). Offerors must complete their registration in SAM in order to be eligible to quote for this contract.

d. Failure to provide all information requested on the quote sheet or failure to complete SAM registration may be https://www.sam.gov/ grounds for considering the quote unresponsive.

e. Applicable Publications. Performance of all services will assure complete safety to public visitors, Government employees, contractor employees, and all other persons in the area.

f. Guarantee: The contractor shall offer a guarantee that the work is complete in accordance with all specifications and in compliance with all national, state, and local laws.

3.1 GENERAL SPECIFICATIONS:

General. Provide labor, materials, and equipment to remove & replace entryway ramps for three buildings in Towaoc, CO.

Work shall be provided in accordance with all Terms, Conditions, General, Specific and Technical Provision, Exhibits, Attachments, Maps, Drawings, etc. contained herein or incorporated by Reference. This includes all mandatory provisions of the Federal Acquisition Regulation (FAR), whether referenced or not, current at time of award.

A. Work to be performed. The work to be performed is as follows:

1. Demolition of previous ramps

a. Safely demolish and remove existing platforms, rusted metal components, and any haz.ardous materials.

b. Dispose of all debris in accordance with environmental regulations.

2. Installation of new ramps;

a. Construct new platforms at each building.

b. Include all applicable ADA-compliant features including, but not limited to, ensure designs incorporate ADA requirements for platform height, ramp slope, turning radius, guardrails, and handrail extensions.

c. Ensure proper drainage, anchoring, and structural stability.

d. Select materials with high corrosion resistance (e.g., galvanized steel, aluminum, composite decking, or pressure-treated lumber).

e. Provide as-built drawings and warranty documentation.

f. Conduct a final walkthrough and obtain client approval.

g. Train facility representatives on maintenance and cleaning requirements.

Section E - Inspection and Acceptance E-1 52.246-12 Inspection of Construction. (AUG 1996)

(a) Definition. Work includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.

(b) The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to Government inspection and test at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract.

(c) Government inspections and tests are for the sole benefit of the Government and do not -

(1) Relieve the Contractor of responsibility for providing adequate quality control measures;

(2) Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;

(3) Constitute or imply acceptance; or

(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (i) below.

(d) The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer's written authorization.

(e) The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes reinspection or retest necessary. The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.

(f) The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.

(g) If the Contractor does not promptly replace or correct rejected work, the Government may (1) by contract or otherwise, replace or correct the work and charge the cost to the Contractor or (2) terminate for default the Contractor's right to proceed.

(h) If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction. However, if the work is found to meet contract requirements, the Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.

(i) Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government's rights under any warranty or guarantee.

Section F - Deliveries or Performance F-1 52.211-10 Commencement, Prosecution, and Completion of Work. (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 90 calendar days. The time stated for completion shall include final cleanup of the premises.

F-2 52.242-14 Suspension of Work. (APR 1984)

(a) The Contracting Officer may order the Contractor, in writing, to suspend, delay, or interrupt all or any part of the work of this contract for the period of time that the Contracting Officer determines appropriate for the convenience of the Government.

(b) If the performance of all or any part of the work is, for an unreasonable period of time, suspended, delayed, or interrupted (1) by an act of the Contracting Officer in the administration of this contract, or (2) by the Contracting Officer's failure to act within the time specified in this contract (or within a reasonable time if not specified), an adjustment shall be made for any increase in the cost of performance of this contract (excluding profit) necessarily caused by the unreasonable suspension, delay, or interruption, and the contract modified in writing accordingly. However, no adjustment shall be made under this clause for any suspension, delay, or interruption to the extent that performance would have been so suspended, delayed, or interrupted by any other cause, including the fault or negligence of the Contractor, or for which an equitable adjustment is provided for or excluded under any other term or condition of this contract.

(c) A claim under this clause shall not be allowed (1) for any costs incurred more than 20 days before the Contractor shall have notified the Contracting Officer in writing of the act or failure to act involved (but this requirement shall not apply as to a claim resulting from a suspension order), and (2) unless the claim, in an amount stated, is asserted in writing as soon as practicable after the termination of the suspension, delay, or interruption, but not later than the date of final payment under the contract.

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $183 for each calendar day of delay until the work is completed or accepted.

(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

I-2 52.228-13 Alternative Payment Protections. (JUL 2000)

(a) The Contractor shall submit one of the following payment protections: A payment bond or an irrevocable letter of credit

(ILC).

(b) The amount of the payment protection shall be 100 percent of the contract price.

(c) The submission of the payment protection is required within 10 days of contract award.

(d) The payment protection shall provide protection for the full contract performance period plus a one-year period.

(e) Except for escrow agreements and payment bonds, which provide their own protection procedures, the Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties.

(a) The Contractor shall procure and maintain during the term of this contract and any extension thereof liability insurance in form satisfactory to the Contracting Officer by an insurance company which is acceptable to the Contracting Officer.

The named insured parties under the policy shall be the Contractor and the United States of America. The amounts of the insurance shall be not less than as follows:

(b) Each policy shall have a certificate evidencing the insurance coverage. The certificate shall identify the contract number, the name and address of the Contracting Officer, as well as the insured, the policy number and a brief description of contract services to be performed. The contractor shall furnish the Contracting Officer with a copy of an acceptable insurance certificate prior to beginning the work.
