(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.

(d) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract. The small business size standard corresponding to this NAICS code(s) can be found at https://www.sba.gov/document/support--table-size-standards.

The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause, or with its offer for an order (see paragraph (c) of this clause), that the data have been validated or updated, and provide the date of the validation or update.
(g) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (f) or (h) of this clause.
(h) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:

FAR 52.212-2 Evaluation—Commercial Products and Commercial Services (Nov 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
An award will be made on the basis of a Best Value Determination. The Government will make an award contingent upon receiving a quote which meets or exceeds the Government’s requirements from a vendor at a fair and reasonable price.
The final award decision will be made by the Contracting Officer (CO) who will consider the vendor’s technical capabilities, personnel, past performance, and price. Technical capabilities are of more important than past performance and price. Price will become more important as quotes become increasingly close in technical quality. The Government may be willing to pay a premium price for a comparably higher-quality solution. At the same time, the Government would not make an award to a vendor with an unreasonable price. When Offerors solutions become more equal in terms of technical approach, price will become a determining factor.
*Technical acceptability will be based on the offeror providing a comprehensive solution addressing all elements of the Statement of Work. Failure to do so will render the offeror’s quote as Technically Unacceptable and it will not be considered for award.
Negative past performance will automatically disqualify any potential offeror as “Technically Unacceptable” as well. Past Performance will be evaluated by reviewing each offeror CPARS and FAPIIS reports.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Quotes which merely offer to develop packets in accordance with the requirements of the SOW will not be eligible for award.
The Technical Capability quote shall not contain price information; however, resource information such as data concerning supplies, materials, equipment, etc. must be contained in the technical quote so that the vendor’s understanding of the detail and complexity of the requirement may be evaluated.

The Government's objective is to obtain the highest technical quality considered necessary to achieve the project objectives, with a realistic and reasonable price. The Government reserves the right to not make an award, if necessary.
This is a RFQ only and in no way obligates the Government to award a Contract or to reimburse vendors(s) for any costs incurred in preparing their quote.
Quote Package Evaluation The Vendor’s submission will be evaluated according to the factors shown below. The Government will make an award based on a solution that provides the best value when compared with the requirement in the SOW.
Factors listed below are in descending order of importance.
Document Title Pathways to Wellness for OJS RRI
Unrealistically low and/or unreasonably proposed prices may be grounds for eliminating a quote from competition either on the basis that the vendor does not understand the requirement, or the vendor has made an unreasonable/unrealistic quote.
The Government intends to award a maximum of one (1) Contract as a result of this RFQ 140A1623Q0008. Quotes received for less than the stated number of items listed in the schedule may be considered ineligible for award. The Government intends to evaluate quotes and award a Contract without communication with vendors. Therefore, the vendor’s initial quote should contain the best terms from a price and technical standpoint.
The Government reserves the right to communicate with vendors if the Contracting Officer later determines such effort to be necessary.
The following factors shall be used to evaluate quotes (evaluation Criteria in descending order of importance). Factor I, Personnel Qualifications and Experience, Factor II, Understanding of the Requirement & Technical Approach, Factor III, Past Performance, and Factor IV, Price.
Factor I – Personnel Qualifications and Experience
The personnel quoted shall have knowledge and experience in the subject areas addressed in the SOW. The vendor shall submit resumes of the quoted personnel as part of their quote submission. Specifically, the quoted Project Manager and Team member (s) should have the following qualifications and Recidivism Reduction work experience:
o Project Manager must have or possess a B.S degree from an accredited University + a minimum of 10 Years’ experience; and or a master’s degree + 5 years’ experience.

o The vendor shall secure licensure to continue using the GAIN family of screening/assessment instrument(s), including the existing Recidivism Reduction Initiative (RRI) analytic dataset and existing native-specific instrument customizations/adaptations made under the prior service contract and contract modifications.
o Vendor shall provide access to the software to conduct interactive customized GAIN screening and assessment, generate customized summary reporting, track, and export GAIN and arrest data items
Document Title Pathways to Wellness for OJS RRI o Vendor shall provide regular technical Assistance, monitoring, and coaching to guide data management, tracking and follow-up, and implementation of RRI protocols o Vendor shall provide annual site visits to participating RRI sites to establish, evolve, strengthen, and expand the Pathways to Wellness, an OJS Recidivism Reduction Initiative.
o Vendor shall provide to participating tribes training specific to the GAIN administration, report editing and utility, and how the GAIN customized instrument(s) can assist with establishing a data picture of a cascade of services and RRI standardized protocols o Vendor shall provide for seamless data export, analysis and reporting specific to the GAIN family of RRI-native-specific customized instruments and RRI protocols o Vendor shall coordinate with BIA staff the roll out of the Pathways to Wellness Recidivism Reduction Best Practices Forum o Vendor shall provide an evaluation of the implementation of RRI Evidence Based Practice (EBP), including publications, which will include Training in EBP, TA in the Implementation, Fidelity Monitoring, Progress reporting, and Analysis and Evaluation reporting o Vendor shall provide Ad Hoc Analysis and reporting as well as continued development and customization of the GAIN family of instruments, data, and reports specific to the tribes and OJS as requested by the FOD Deputy Associate Director/COR o Vendor shall recommend, and if approved, provide ad hoc additional and/or in-person technical assistance coaching and webinars, conduct in-person workshops, and participate in planning meetings to expand, strengthen, and evolve the Pathways to Wellness RRI to meet the needs of tribes, as requested by the FOD Deputy Associate Director/COR.
Factor II – Understanding of the Requirements and Technical Approach
The vendor must demonstrate a clear understanding of the SOW objectives and scope;
and also present a logical, rational, and complete approach for accomplishing the work outlined in the SOW. The vendor’s presentation illustrates a quote that is reasonable, responsive, and addresses all aspects of the technical requirement. Simple statements of compliance (i.e., “understood”, “will comply”) without a detailed description of how compliance will be achieved will not be considered sufficient evidence that the quoted services can technically meet the requirement of the SOW. The quotes will be evaluated for technical capability by comparing the vendor’s quote to the SOW. The vendor must document in its technical plan on how it intends to provide the Tribal Court Assessment services and the plan clearly stated in the vendor’s quote. Specifically, the vendor shall demonstrate how it would accomplish:

TASK 1. Technical Assistance and Training TASK 2. Feasibility, Pilot, Program Evaluation, and Statistical Projects TASK 3. Technology Projects TASK 4. Event Planning and Logistics
Factor III - Past Performance Vendors shall submit the following information as part of their quote:
1. A list of three (3) completed or active contracts for related or similar services. The Government will evaluate past performance on contracts that are similar in nature to the requirements in this RFQ. Contracts listed shall include those entered into with the Federal Government, Agencies of State and Local Governments, or Commercial Customers.
2. Each Vendor will be evaluated on its performance under existing and prior contracts which are similar in nature to the requirement of this RFQ. The Government is not required to contact all references provided by the Vendor. Also, references other than those identified any the Vendor may be contacted by the Government to obtain additional information that will be used in the evaluation of the Vendor’s past performance.
Information for the evaluation of past performance will be randomly requested from the list of references or other sources as previously stated. Performance information will be used for both responsibility determinations and as an evaluation factor to be scored. Past Performance Information Retrieval System (PPIRS) will also be used as a source of past information to help with the evaluation of past performance.
3. Vendors are further advised that thorough and complete past performance information is required. Explanations/comments regarding problems encountered and corrective actions taken shall be addressed as a part of the quote submitted in response to the RFQ. The Government will take the Vendor’s comments into consideration when conducting its past performance evaluation. Vendors may not be given the opportunity to address problems encountered in the past performance.
Factor IV - Price
Vendors, at a minimum, shall submit a price quote in sufficient detail for the Government to be able to determine that the proposed price is realistic and consistent with the proposed technical approach. The price quote is to be submitted as Firm-Fixed-Price (FFP). In the event the submissions become equal in technical merit, price will become more important and the determining factor for award.
The Government will evaluate each Vendor’s price for fairness and reasonableness. The Government expects adequate price competition to establish fair and reasonable pricing.
The price detail shall include sufficient descriptions to enable the Contracting Officer to determine the reasonableness of the price submitted. Unrealistically high (or low) pricing
Document Title Pathways to Wellness for OJS RRI in the initial or revised proposal may be grounds for eliminating a quote from competition
– either on the basis that the Vendor does not understand the requirement or has submitted an unrealistic quote.
Price quotes shall be 4 Task Line Items (FFP) as:
o Task 1: Technical Assistance and Training o Task 2: Feasibility, Pilot, Program Evaluation, and Statistical Projects o Task 3: Technology Projects o Task 4: Event Planning and Logistics.
Trade-offs An award will be made based on a Best Value Determination.
