Section 1 - Supplies or services and prices/costs

1.1 REQUIRED WORK

The Contractor shall provide services as stated in the Statement of Work (SOW).

1.2 OFFEROR’S SCHEDULE

CARPET INSTALLATION SERVICES IN ACCORDANCE WITH THE SOW

FIRM FIXED PRICE (FFP) FOR THE JOB

PRICING SHALL INCLUDE ALL LABOR, TOOLS, SUPPLIES, MATERIALS,

INSURANCE, TRAVEL AND TAXES TO DELIVER AS STATED IN THE SOW.

Section 2 - Description/specifications/statement of work

2.1 TYPE OF CONTRACT

This is a firm-fixed price, single award contract. Services shall be in accordance with the SOW.

The North American Classification Industry System (NAICS) for this requirement is 238330, Flooring Contractors, and the small business size standard is $16.5M. No additional sums will be payable on account of any escalation in the cost of materials, equipment or labor, or because of mailto:JACQUELINE.WOLFE@bia.gov

Document Title BIA OJS Carpet Installation the Contractor’s failure to properly estimate or accurately predict these prices or difficulty of achieving the results required by this contract.

2.2 STATEMENT OF WORK

A. SCOPE

The Department of Interior (DOI), Bureau of Indian Affairs (BIA), Office of Justice Services (OJS) requires carpet installation services.

The Contractor shall provide all supervision, tools, materials and labor to perform the following:

• Furnish and install approximately 1,260 square feet of Milliken Midnight Sparkle carpet tile – style: Shetland, color: 238 Blueberry Tweed

• Furnish and install Milliken Formwork carpet planks border -- color: Denim 123

• Furnish and install Johnsonite transitions, as required – color: Black

Carpet will be laid over existing tile. The Government will be responsible for removing the wax on the ceramic tile at least three (3) days before installation of carpeting. Contractor is responsible for coordinating installation date with the Government at least seven (7) days in advance.

Additional carpet tiles and adhesive shall be provided to the Government for any necessary replacements to accommodate for spills, stains and normal day-to-day wear and tear.

The Contractor shall complete all necessary pre-installation requirements:

Surface Preparation: Prep the floor for any possible interferences, door jams, etc.

Layout: Vendor must identify any potential complications that may interfere with the final product.

Adhesive: Vendor must ensure they are using the correct adhesive for a high traffic area and is available for OJS to apply to replacement tiles if spills, stains and normal day-to-day wear and tear may occur.

Tile Usage: Vendor must utilize an efficient layout is necessary to gain the most out of every square tile per square foot.

Tile Setting: Tiles must set for a minimum of 24 hours before being walked on to allow proper drying. Excessive adhesive must be removed and no remaining adhesive must be seen after drying process. Tiles must be set to have an even surface at final inspection.

B. LOCATION

Services shall be performed at the OJS 3rd floor corridor/hallway located at 1849 C St. NW, Main Interior Building (MIB), Washington, DC 20240.

C. PERIOD OF PERFORMANCE

Installation must be completed over a weekend (preferred) or after close of business hours.

Installation shall take no more than (3) three days. Contractor shall order materials within one

(1) business day after written notification of award from the Government Contracting Officer and send delivery details to the Contracting Officer’s Representative (COR). Lead time for materials is expected to be no more than four (4) weeks. Contractor shall immediately notify COR if delivery is delayed.

D. SECURITY/ACCESS TO GOVERNMENT BUILDING

The COR will coordinate building access with the DOI Facilities and Maintenance office.

Contractor personnel shall sign in each day and be required to wear a visitor’s badge, nametag and company logo at all times. Contractor personnel shall have a valid Government identification prior to being issued a visitor’s badge.

2.3 NON-PERSONAL SERVICES

This contract is a non-personal services contract, under which the contractor is an independent contractor. The Government may evaluate the quality of professional services provided. The Contractor is required to indemnify the Government for any liability producing act or omission by the Contractor, its employees and agents occurring during contract performance. The Contractor shall maintain medical liability insurance, which is not less than the amount normally prevailing within the local community for the specialty concerned.

Section 3 – Inspection and Acceptance

3.1 INSPECTION AND ACCEPTANCE

Services to be inspected and accepted by the authorized Government Contracting Officer’s Representative (COR).

Section 4 – Deliveries or Performance

4.1 Delivery and Period of Performance

Complete installation shall be finalized within six (6) weeks after award of the contract. This timeframe includes lead time for delivery of materials.

5.1. INVOICE AND PAYMENT

Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (April 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice

- A copy of the contractor’s invoice shall be included with the IPP invoice. If no invoice is attached, the Invoice will be rejected.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

6.3 DIAR Clauses and Provisions

DIAR 1452.201-70 Authorities and Delegations (Sep 2011)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a POC at time of award. The POC will be responsible for technical monitoring of the contractor's performance and deliveries. The POC will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The POC is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the POC has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the POC's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause.
