STATEMENT OF WORK
National Oceanic and Atmospheric Administration (NOAA) NOAA FISHERIES - Southeast Fisheries Science Center
Population & Ecosystems Monitoring Division Gulf & Caribbean Reef Fish Branch
Gulf Fishery Independent Survey of Habitat and Ecosystem Resources (G-FISHER) Program Charter Vessel
I. Background
The Population and Ecosystems Monitoring Division (PEMD) is one of six divisions within the National Marine Fisheries Service’s (NMFS) Southeast Fisheries Science Center (SEFSC). PEMD supports the SEFSC’s mission and, more broadly, the NMFS mission.
PEMD performs large-scale fishery-independent surveys and applied research. Our scientific products and expertise support fisheries stock assessments, ecosystem-based fisheries management, and protected species management in the Gulf of America (formerly U.S. Gulf of Mexico), U.S. southeastern Atlantic (hereafter South Atlantic), U.S. Caribbean (hereafter Caribbean), and the Atlantic high seas.
Fishery-independent surveys use consistent, standardized sampling methods to assess changes in species-specific abundance, other population metrics (e.g., age and size structure), and environmental and ecosystem metrics over space and time. To carry out our surveys, we use trawls, plankton nets, longlines, scuba, video cameras, fish traps, and environmental sampling equipment. Our surveys are performed from large research vessels during extended offshore cruises, and from small boats carrying out near-shore surveys. Resulting scientific products support assessments for more than 40 stocks, including demersal, coastal pelagic, and highly migratory species, and the generation of management advice to three regional fishery management councils, two interstate marine fisheries commissions, and the International Commission for the Conservation of Atlantic Tunas (ICCAT). Our applied research focuses on fish and invertebrate population, community, and ecosystem dynamics (e.g., assessing the importance of habitat, climate, environmental, and anthropogenic drivers), using traditional approaches and advanced technologies (e.g., genetics, remote sensing, and artificial intelligence).
The Gulf - Fishery Independent Survey of Habitat and Ecosystem Resources (G-FISHER) program conducts optics-based sampling to collect abundance data focused on managed reef fish of the Gulf, and primarily focuses on the snapper-grouper complex. The survey deploys baited remote underwater video (BRUV) arrays at ~1000 randomly selected reef locations annually. Hydrological data are collected at each site to evaluate water quality, and additional information on sea-state and weather are also tracked. Secondary objectives include bathymetric mapping and quantification of habitat types sampled (i.e. video, multibeam and side-scan). Since 2019 water samples have been collected at a subsample of sites and processed for environmental DNA analysis to help evaluate abundance data and to also provide a more comprehensive evaluation of reef assemblages that are not accounted for by optics data. To date G-FISHER data have been used to provide estimates of relative abundance for 19 distinct reef species at 55 assessments since its first use to assess red snapper (Lutjanus campechanus) in 2005.
II. Overview https://www.fisheries.noaa.gov/about/southeast-fisheries-science-center https://www.fisheries.noaa.gov/topic/population-assessments/fish-stocks https://www.fisheries.noaa.gov/national/ecosystems/ecosystem-based-fisheries-management
A stereo-video survey of hard bottom habitat and associated fishes in the northeast Gulf of America is being conducted with a primary objective to generate indices of relative abundance of federally-managed reef fishes for stock assessments and to inform fishery managers. Additional primary objectives are to collect: 1) benthic water samples for environmental DNA (eDNA); 2) environmental data associated with deployments of video arrays; and 3) map and characterize reef fish habitat in the northern Gulf using side scan sonar to help guide and improve survey statistical design and determine species-habitat relationships within fishery-independent reef fish surveys.
III. Scope of Work
The contractor shall furnish the necessary personnel, material, equipment, services and facilities (except as otherwise specified) to provide charter operations for between 16 and 26 sea days (+2 mobilization/de-mobilization) in the area between longitudes 97.30° and 83.00° and from latitude 30.40° to 24.40° (Section V11: Figure 1) to a maximum depth of 200 m. At sea duration for a survey legs would be no more than 14 days-at-sea, and a leg would include two days for mobilization/de-mobilization. 2. One Government employee shall be designated Field Party Chief/Chief Scientist. That person shall be responsible for implementation of the Cruise Plan, compliance with the charter terms, and the conduct and performance of Government personnel aboard the vessel.
D. Operating Procedures
1. The vessel shall perform roughly 24 hour manning (Captain and crew for camera and sidescan deployments and retrieval during the day, Captain and crew during night). Shift length and hours shall be determined by the Field Party Chief (FPC) in consultation with the Captain. The decision shall be based on the type of activity expected as well as on prevailing weather conditions, the Cruise Plan, and general safety of operations. The vessel shall be used to transit to stations if needed during longer runs, and shall not be anchored at night, which requires an on-the-clock Captain beyond daylight operations and potential crew.
Daylight operations (~6am - 6pm)
i. The camera station sampling shift shall last about 12 hours, beginning 1 hour after sunrise, and ending as late as 1 hour after sunset, depending on daylight, tides, and weather. The Field Party Chief has the final authority except in matters relating to safety of the vessel and all personnel on board. The workday for the vessel crew may occasionally exceed that of the scientific field party, since they shall normally be required to run to the next survey area after completion of the sampling day, so that sampling can commence early in the morning. Scientific personnel shall download, charge, maintain, and prepare all video equipment after the field day, for the next field day.
ii. Each sampling station during the camera station shift shall consist of several deployments and retrievals. An average of 15-20 sampling stations shall be completed each day and largely depends on proximity of sampling locations (i.e.
vessel transit time). The range of total completed stations shall be around 450 - 600, dependent on weather conditions and spacing of stations. Coordinates for the stations shall be provided by the Field Party Chief to the Captain prior to the start of the shift. An overview of the area to be covered for camera deployments can be found in section VII, Figure 1. The deployment of a stationary camera array shall occur with the assistance of the vessels Crew, while the Captain maintains station. The camera array soaks on the seafloor for a total of 30 minutes. After the 30 minute soak time is achieved, the Captain shall return to the stationary camera array buoy, and the Crew shall assist with the retrieval of the line. In some instances when sites are close in space two arrays may be deployed simultaneously to increase efficiency. The array shall be brought back on board, and the Scientific Crew shall turn-off and charge necessary video equipment.
iii. Select stations shall require benthic water samples to be taken in tandem with the deployment of the camera array (1-5 per day, typically). The scientific crew shall process the water sample immediately following its retrieval on the back deck of the boat, in a designated clean space.
iv. Opportunistic sidescanning may be completed during daytime operations, a decision to be made by the FPC taking into account progress of camera deployments . Sampling shall consist of several deployments and retrievals of the sidescan sonar systems. Coordinates for the grids shall be provided by the Field Party Chief to the Captain prior to the start of the shift. An overview of the area to be covered can be found in section VII, Figure 1. Each sidescan grid consists of three, 4.1 nm by 0.1 nm transect lines (~4 km2 grid), which takes roughly 2-3 hours to scan in totality. Once a grid is completed, the sidescan sonar system shall be brought back on board by the Scientific Team and Crew members, and the vessel shall transit to the next selected sidescan grid.
2. The Field Party Chief and Captain shall meet a minimum of twice a shift to discuss survey operations and resolve any problems that occur. A meeting should occur at the start of the day before sampling operations begin to discuss the planned activities for the day and at the end of the day to review the work completed that day, any problems which occurred, and plans for the next day’s operations.
3. The Field Party Chief and Captain shall work together to resolve all problems which occur regarding the charter. In the event the Field Party Chief and Captain are unable to resolve any problem which could threaten the safety of the field party, the Field Party Chief shall direct the vessel to return to port where an acceptable solution shall be arranged between the Government and the Contractor or the charter may be terminated. The vessel shall be off charter if required to return to port and shall remain off charter until the problem has been resolved and the vessel has returned to the sampling area.
4. The Captain and crew shall exercise due caution and follow safety procedures as directed by the Field Party Chief to help prevent damage or loss of Government gear and equipment. Specific safety procedures may be presented in writing to the Captain by the Field Party Chief. Repair or replacement costs may be deducted from charter payments if loss or damage to Government equipment is the result of negligent disregard of such instructions and procedures.
6. An average of 15-20 sampling stations shall be completed each day and sometimes consist of multiple gear types deployed at a single location. Coordinates for the stations shall be provided by the Field Party Chief to the Captain the night before. The deployment of a stationary camera array shall occur first, with the assistance of the vessels Crew, while the Captain maintains station. The camera array soaks on the seafloor for a total of 30 minutes.
Once 30 minutes have passed, the Captain shall return to the stationary camera array buoy, and the Crew shall assist with the retrieval of the line. The array shall be brought back on board, and the Scientific Crew shall turn-off and charge necessary video equipment. The boat Crew shall assist with the lines.
6. Select stations shall require benthic water samples to be taken in tandem with the camera array. The eDNA sampler is confined to the camera array, and shall be set up by scientific staff prior to deployment. Once the camera array is back onboard, the scientific staff shall collect and process the water samples in the designated clean space.
7. The Contractor shall provide for all operating expenses of this charter. All potential costs to be incurred should be included in unit prices in the schedule.
E. Safety
1) The vessel Captain is responsible for all matters relating to safety of personnel, the vessel, and equipment operation. The Captain shall adhere at all times to Navigational Rules and Rules of the Road whether it be while towing, running, drifting, or at anchor. RFO 52.229-11 Tax on Certain Foreign Procurements-Notice and Representation. (JUN 2020)
(a) Definitions. As used in this provision-
Foreign person means any person other than a United States person.
Specified Federal procurement payment means any payment made pursuant to a contract with a foreign contracting party that is for goods, manufactured or produced, or services provided in a foreign country that is not a party to an international procurement agreement with the United States. For purposes of the prior sentence, a foreign country does not include an outlying area of the United States.
United States person as defined in 26 U.S.C. 7701(a)(30) means
(1) A citizen or resident of the United States;
(2) A domestic partnership;
(3) A domestic corporation;
(4) Any estate (other than a foreign estate, within the meaning of 26 U.S.C. 701(a)(31));
and
(5) Any trust if-
(i) A court within the United States is able to exercise primary supervision over the administration of the trust; and
(ii) One or more United States persons have the authority to control all substantial decisions of the trust.
(b) Unless exempted, there is a 2 percent tax of the amount of a specified Federal procurement payment on any foreign person receiving such payment. See 26 U.S.C. 5000C and its implementing regulations at 26 CFR 1.5000C-1 through 1.5000C-7.
(c) Exemptions from withholding under this provision are described at 26 CFR 1.5000C-1(d)(5) through (7). The Offeror may claim an exemption from the withholding by using the Department of the Treasury Internal Revenue Service (IRS) Form W-14, Certificate of Foreign Contracting Party Receiving Federal Procurement Payments, available at www.irs.gov/w14. Any exemption claimed and self-certified on the IRS Form W-14 is subject to audit by the IRS. Any disputes regarding the imposition and collection of the 26 U.S.C. 5000C tax are adjudicated by the IRS as the 26 U.S.C. 5000C tax is a tax matter, not a contract issue. The IRS Form W-14 is provided to the acquiring agency rather than to the IRS.
(d) For purposes of withholding under 26 U.S.C. 5000C, the Offeror represents that
(1) It [ ]is [ ]is not a foreign person; and
(2) If the Offeror indicates "is" in paragraph (d)(1) of this provision, then the Offeror represents that-I am claiming on the IRS Form W-14 [ ] a full exemption, or [ ] partial or no exemption [Offeror must select one] from the excise tax.
(e) If the Offeror represents it is a foreign person in paragraph (d)(1) of this provision, then-
(1) The clause at FAR 52.229-12, Tax on Certain Foreign Procurements, will be included in any resulting contract; and
(2) The Offeror shall submit with its offer the IRS Form W-14. If the IRS Form W-14 is not submitted with the offer, exemptions will not be applied to any resulting contract and the Government will withhold a full 2 percent of each payment.
(f) If the Offeror selects "is" in paragraph (d)(1) and "partial or no exemption" in paragraph (d)(2) of this provision, the Offeror will be subject to withholding in accordance with the clause at FAR 52.229-12, Tax on Certain Foreign Procurements, in any resulting contract.
(g) A taxpayer may, for a fee, seek advice from the IRS as to the proper tax treatment of a transaction. This is called a private letter ruling. Also, the IRS may publish a revenue ruling, which is an official interpretation by the IRS of the Internal Revenue Code, related statutes, tax treaties, and regulations. A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts. For questions relating to the interpretation of the IRS regulations go to https://www.irs.gov/help/tax-law-questions.

CHARTER VESSEL SAFETY
The contractor shall adhere to the safety regulations as set forth in Coast Guard rules effective on September 15, 1991, and as provided for by the Commercial Fishing Industry Vessel Safety Act of 1988 (specifically, 46 CFR Part 28) or subsequent additions or revisions. These regulations require that specified vessels be equipped with a variety of safety features and equipment.
A Coast Guard inspection of the vessel based on an interagency agreement between National Marine Fisheries Service (NMFS) and the Coast Guard or 46 CFR Part 28 will be required prior to performance. In addition to the requirements of 46 CFR Part 28, the Coast Guard inspection will require conformance with standards for lifesaving and firefighting equipment in the Rules for Small Passenger Vessels, which exceed the requirements of 46 CFR Part 28. Issuance of the notice to proceed by the Government is conditioned upon the successful completion of the mandatory Coast Guard inspection contained in this contract. Failure of the Contractor to successfully complete the inspection requirements shall be grounds for termination of this contract. Conformance with present regulations for commercial fishing vessels requires that the master or an individual in charge of the vessel ensures that safety drills and instruction are conducted at least once a month (46 CFR 28.270). Following personnel changes, safety orientations must be given to each individual on board that has not received the instruction or has not participated in the drills, prior to continuation of vessel operations. The contractor shall conduct such safety orientations prior to sailing on each cruise leg. Due to the frequent wholesale exchange of scientific personnel at cruise breaks, it is recommended that a full drill be completed early in each cruise leg even if less than a month has elapsed since the last drill. Each vessel must also have all required emergency instructions posted (46 CFR 28.265).
(End of Solicitation and Contract Language)
COAST GUARD INSPECTION
Performance under this contract is dependent on the vessel passing a U.S. Coast Guard safety examination. The Coast Guard inspection shall be performed no earlier than two weeks before the vessels’ scheduled departure and the Coast Guard certification must be obtained by the vessel, no less than one week prior to scheduled departure. In the event that the contractor does not obtain the Coast Guard inspection, the Government may terminate the contract, and the contractor may be liable to the Government for excess re-procurement costs. Inspection is required before the commencement of each charter year, unless the Coast Guard has issued a letter of inspection that is valid for the time period of the charter. The contractor will arrange for the inspection, and any costs associated with bringing the vessel to passing standard shall be borne by the contractor. A copy of the Coast Guard certification shall be posted on the vessel.

CONTROL OF PLASTIC DISCHARGES
Contractor shall comply with the Marine Plastic Pollution Research and Control Act of 1987, which establishes Federal requirements for controlling plastic discharges from ships.
(End of Solicitation and Contract Language)
HARMLESS FROM LIABILITY
The contractor shall hold and save the Government, its officers, agents, and employees harmless from liability of any nature or kind, including costs and expenses to which they may be subject or on account of any or all suits or damages of any character whatsoever resulting from injuries or damages sustained by any person or persons or property by virtue of performance of this contract, arising or resulting in whole or in part from the fault, negligence, wrongful act or wrongful omission of the contractor, or any subcontractor, their employees, and agents.
