1. INSTALLATION GUIDELINES

A) All antennas, transmission lines, equipment, mounting devices, and cables to be installed at the site must be approved by the government or its structural consultant. The government will not permit any installations that exceed the structural capacity of the tower.

B) A pre-construction meeting must be held at the site prior to the commencing of work. This may be accomplished by telephone if the government deems. If the NWR site is in an operational status, notification to the lead forecaster at the Weather Service Forecast Office (WFO) must be accomplished prior to the transmitter being shut down.

C) All transmission and control cables are to be securely fastened to the tower. Transmission lines are to be installed according to the manufacturer’s guidelines and supported with the use of cable “butterfly” clamps designed for that particular model cable. Wrap-lock straps may be used only on short runs of small flexible cable (“jumpers”) and not used on the majority of the coaxial cable. The securing of lines using nylon ties or electrical tape is strictly prohibited.

D) All metallic materials installed on the tower including brackets, bolts, nuts, and washers must be either stainless steel or hot-dipped galvanized.

E) No drilling, punching, or welding to any part of the tower will be permitted. No removal or alteration of the tower structure is allowed.

F) All work performed on the tower will be performed by a government or lessor approved contractor. A copy of the contractor’s proof of insurance must be on file with government and/or lessor before work at the site will be allowed. The contractor shall perform all work while in compliance with Federal, State and Local regulations.

G) If during the course of installation, government personnel deem the installation inadequate, the user or his contractor will make changes in the installation to meet government’s requirements. After the antenna and cabling has been installed, the antenna and cabling will be swept by an NWS employee for verification. This must be approved before any work is to be done on the removal portion of this SOW.

The Regional NWR Focal Point or their designated individual has the final say over any disputes.

H) The contractor agrees to cooperate with the government and lessor to ensure a safe working environment at the site. This includes any RF radiation exposure guidelines that are applicable.

52.212-2 Evaluation- Commercial (LPTA)

Offers will be evaluated based on price and the factors set forth in paragraph (a).

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Paragraph (a) is hereby completed as follows: Evaluation will be based on the following;

1. Technical Acceptability/Capability.

Quote shall include at least two references from at least two separate contracts for similar and relevant recent services within the past two years including the name, phone number, full address, and e-mail address of the reference to demonstrate the offeror’s capability to successfully perform the services listed in the Statement of Work.

The offeror's past performance on related contracts will be evaluated to determine, as appropriate, successful performance of contract requirements, quality and timeliness of delivery of goods and services, cost management, communications between contracting parties, proactive management and customer satisfaction. The Government will use its discretion to determine the sources of past performance information used in the evaluation, and the information may be obtained from references provided by the Offeror, the agency’s knowledge of Offeror performance, other government agencies or commercial entities, or past performance databases, and will be based on responsiveness, quality, and customer services.

A good past performance rating provides higher confidence than a neutral or satisfactory rating.

2. Price.

The Government intends to award a low priced, technically acceptable, single firm fixed-price purchase order on an all or none basis with payment terms of Net 30.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(1) ¿ Are, ¿ are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples. (A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
