5. Price.

THE GOVERNMENT DOES NOT ACCEPT RESPONSIBILITY FOR NON-RECEIPT OF

QUOTES. IT IS THE CONTRACTOR’S RESPONSIBILITY TO REQUEST AND RECEIVE A

CONFIRMATION OF THE QUOTE RECEIPT.

FAR 52.212-2 Evaluation- Commercial Products and Commercial Services (Nov 2021) Offers will be evaluated based on price and the factors set forth in paragraph (a).

https://sam.gov/content/home

The evaluation will consider the Non-Price Technical Solution (Technical Approach and Past Performance) to be significantly more important than price. However, as quotes are determined to be more equal in the non-price evaluation factor, price becomes more important and may become the determining factor for award. If, at any stage of the evaluation, all vendors are determined to have submitted equal, or virtually equal, Non-Price Technical Solutions, price could become the factor in determining which vendor will receive the award.

The Government intends to evaluate the quotes and award a purchase order based on the Offeror’s initial quote; therefore, the Offeror’s initial quote should contain the Offeror’s best terms from a Non-Price Technical Solution and price standpoint.

The Government reserves the right not to award a purchase order depending on the quality of the quote(s) submitted and the availability of funds. Furthermore, the Government may waive informalities and minor irregularities or omissions in quotes received.

The Government may make award to other than the lowest-priced Offeror or the Offeror with the highest technical rating if the Contracting Officer determines that to do so would result in the best value to the Government. The Government will not make an award at a significantly higher overall price to achieve only slightly superior performance capability.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

Paragraph (a) is hereby completed as follows: Evaluation will be based on the following:

1. Technical Approach and Capability.

The Offeror’s overall technical approach will be evaluated to assess the Government's level of confidence in the Offeror’s understanding of, approach to, and ability to successfully perform the requirements as described in the Statement of Work. Provide a detailed description of the company’s experience performing similar services. A detailed technical approach write-up describing how the Offeror will perform this service is required to be submitted with the quote regardless of whether a site visit was made or not. The technical approach write-up must not be a reiteration of the Statement of Work, but how your company plans on performing the tasks listed in the attached Statement of Work. (i.e. performance checklists, anticipated number of employees, anticipated hours at the facility and/or confirmation of supplies being provided, etc.)

2. Past Performance.

Quote shall include at least two references from at least two separate contracts for similar and relevant recent services within the past two years including the name, phone number, full address, and e-mail address of the reference to demonstrate the offeror’s capability to successfully perform the services listed in the Statement of Work.

The offeror is required to fill out blocks 1-4 and send the attached Past Performance Questionnaire to the references provided by the offeror in their submission. The references should complete the Past Performance Questionnaire and then email it directly to (CS/CO email) by the closing date and time of this solicitation. The Government reserves the right to consider past performance report forms received after the due date and time of the solicitation, past performance questionnaires submitted from previous solicitations, and to contact references for verification or additional information.

The Offeror's past performance on related contracts will be evaluated to determine, as appropriate, successful performance of contract requirements, quality and timeliness of delivery of goods and services, cost management, communications between contracting parties, proactive management and customer satisfaction. The Government will use its discretion to determine the sources of past performance information used in the evaluation, and the information may be obtained from references provided by the Offeror, the agency’s knowledge of Offeror performance, other government agencies or commercial entities, or past performance databases, and will be based on responsiveness, quality, and customer services.

Offerors lacking relevant past performance history, or for whom past performance information is either not available or has not been submitted to the Government, will receive a neutral rating for past performance. A good past performance rating provides higher confidence than a neutral or satisfactory rating.

3. Experience.

Offeror’s experience shall demonstrate the capability to respond sufficiently during major weather events regarding scalability (availability of crews and equipment) and responsiveness (ability to meet response times listed within the Statement of Work).

4. Quality Management.

Quote shall include offeror’s quality management plan with respect to the required services and inspections to ensure compliance with the requirements.

5. Price.

The Government will evaluate the price quote for completeness and reasonableness in relation to the RFQ requirements. Quoted prices must be entirely compatible with the Non-Price Technical Solution.

The Government intends to award a trade-off, single firm fixed-price purchase order on an all or none basis with payment terms of Net 30.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

5.0 SCOPE OF WORK

The contractor shall provide complete snow and ice removal services for the NOAA offices listed above in accordance with this Statement of Work (SOW).

Before an Event:

The COR or COR designee will coordinate with the contractor 24-48 hours prior to an event and establish a time for services to begin. Occasionally, this lead time may not be possible or conditions may change.

In such circumstances, the contractor shall arrive within 2 hours of the time they are requested. For events that may be minor or on the threshold, NWS may decline having any areas treated.

During an Event:

For significant events, snow and ice removal services will be considered “automatic” after the initial coordination with the COR or COR designee. The Contractor shall "automatically" commence plowing and snow removal operations when there is accumulation of two (2) inches of snow, or any amount of ice.

During an event, the contractor shall ensure that the necessary equipment and manpower are at the site and continue with the performance of the snow removal. The goal of the plowing/removal is to show bare pavement. There shall never be greater than 2" of accumulated snow/sleet/ice at any time in the “Primary” areas (later defined).

Pre-treatment and Frozen/Freezing Precipitation:

If pre-treatment is requested, the contractor shall pretreat the primary roadway, parking lots, and sidewalks. During and after an icing/freezing rain event the contractor shall treat the primary roadway, parking lots, and sidewalks. The contractor shall coordinate with the COR to verify the areas in Exhibit B (red areas only).

Drifting Snow:

Occasionally drifting snow will occur after an event in localized areas of the facility. Upon request, the contractor shall arrive at the facility to clear and treat those areas covered by 2 inches of snow or more.

General Instructions:

Salt all drive lanes, fire lanes, parking areas and sidewalks on the Property shown in Exhibit B attached hereto upon start of snow or ice accumulation, apply rock salt to drive lanes, fire lanes and parking lots, apply calcium chloride to concrete sidewalks to plow drive lanes, fire lanes and parking lots, and plow or shovel sidewalks and paved courtyards once two (2) inches of snow accumulate. Treatment of ice, sleet and freezing rain accumulation shall start at the onset of precipitation when the temperature is at or below 32 degrees Fahrenheit. Snow/Ice removal shall be pursuant to the Snow Removal Guidelines attached as Exhibit A.

An application of salt/sand/chemical(s) shall be applied to the cleared areas to reduce hazardous conditions. The contractor shall use due diligence when spreading salt/sand to prevent excessive disbursements on pavement. The contractor shall be responsible for cleanup of any excessive disbursement of salt/sand.

When icy conditions exist (sleet/freezing rain), the contractor shall apply salt/sand to the parking, sidewalks, and driving areas in sufficient amounts to ensure safe walking and driving areas and to reduce safety hazards due to freezing rain and sleet.

Pre-treatment to surfaces shall be applied before a major snow or ice event. Note: Do not pre-treat/post treat Green Areas (secondary areas) as noted in Exhibit B.

6.0 SOURCE OF SNOW ACCUMULATION

Accurate weather information and forecasts are vital to the snow and ice control operations under the contract. The work plan shall indicate the weather sources the contractor will utilize for monitoring, however, the U.S National Weather Service at http://www.erh.noaa.gov/lwx/ shall be used to determine the snowfall in inches and for payment purposes.

7.0 PERFORMANCE CRITERIA

Contractor shall perform all services professionally and in a satisfactory manner, using good quality materials, equipment and workmanship and sufficient trained personnel (including supervisors when appropriate) to complete the services in a safe and timely manner which does not unduly interfere with the operation of the Property, the businesses therein and their suppliers. The Contractor shall obtain and maintain, at its expense and at all times during the term of this Agreement, all necessary licenses, permits, training or other authorizations which may be necessary to perform the services. The intent of this requirement is to remove all snow and ice from driveways, parking areas, and handicapped accessibility areas. The contractor may have to perform snow removal more than once during a snowfall period to keep up with the accumulation of snowfall, however, the basis for payment will be the total snowfall in inches per storm and not the amount of effort expended by the contractor. The contractor shall decide how to use its resources to meet the specified outcome.

At no time shall malfunctioning equipment impede or delay plowing or cleaning operation. It is the contractor’s responsibility to have all equipment working or malfunctioning equipment removed or operational immediately upon failure.

8.0 PRIORITY LIST

The contractor shall meet with the Contracting Officer's Representative (COR) identified in the contract award, or the COR designee to establish the priorities for starting snow and ice removal services at the start of each season. Regular meetings may also be necessary during the snow season to review the contractor's performance or make necessary adjustments in the priorities for snow and ice removal services. The priority of snow removal can and may be dictated by the COR or designee.

9.0 EQUIPMENT OPERATION & RESPONSIBILITY

The contractor shall be responsible for the safe, careful and efficient operation of equipment and all equipment shall be maintained in good operating condition. The breakdown of equipment shall not relieve the contractor of the responsibility of providing snow removal services. All equipment and personnel operating under the terms of this contract shall be in full conformance with Federal and State regulations.

The government is not providing any equipment or materials.

http://www.erh.noaa.gov/lwx/

10.0 INSPECTION AND ACCEPTANCE

If any of the services do not conform to the contract requirements, the Government may require the contractor to perform the services again in conformity with the contract requirements, at no increase in contract price. If the defects in services are not corrected by performance, the Government may (1) require the contractor to take necessary action to ensure that future performance conforms to contract requirements and (2) reduce the contract price to reflect the reduced value of the services performed.

If the contractor fails to expeditiously take the necessary action to ensure that further performance will be in conformity with contract requirements, the Government may terminate the contract.

11.0 SUPERVISOR

One supervisor shall be provided by the contractor to accomplish snow removal in accordance with best practices of the industry and shall provide proper supervision of all jobs. Directions of snow removal shall be coordinated with the WFO or designee as needed; however, detailed instructions for carrying out such directions shall be the responsibility of the Contractor's supervisor. In all respects, the contractor shall be responsible for the work being performed.

The supervisor shall be required to provide and wear a working cell phone and respond to calls from the government representative within ten minutes during the performance of duty. Numbers shall be furnished to the appropriate field office prior to any work being performed under this contract. The supervisor shall have the ability to speak, read and write in English.

12.0 CONTACT LIST

The contractor shall submit the names, telephone numbers and cell phone numbers to be used as a 24-hour, seven day a week contact point. Likewise, the contractor may contact the COR or designee to plan the snow removal.

When snow begins to fall with heavy and rapid accumulations shortly before or during business hours, the Contractor will begin plowing the snow from the parking lot using the fastest method possible. In some cases, this means windrowing snow at islands or even light posts and it is understood that the snow will be removed from such places upon request. Stacking snow onto islands may also be necessary, depending upon snowfall accumulation and time limitations.

10. Contractor shall not create drifts in front of dumpster enclosures, fire lanes, or entrances, on sidewalks or blocking walkways and agrees to remove Contractor-created drifts at no additional cost to the Government. If Contractor does not remove the drifts in front of the fire lanes and dumpster enclosures, Contractor agrees to pay any expenses incurred by the Government for removal of said drifts.

11. Contractor shall be responsible for damage to the Property caused by snow removal operations including, but not limited to, buildings, curbs, parking blocks, islands, sidewalks, light poles, signs, landscaping, vehicles, paving or striping of the Property or equipment used in connection therewith.

12. The Contractor agrees to contact the COR if for some reason the entire Property cannot be completely plowed within four (4) hours after snow or ice has stopped falling.

13. Contractor agrees to complete the Snow Control Sheet attached for each plow and salting. To receive payment, this sheet must be attached to the invoice.

14. Contractor agrees to provide the COR's property manager with all current after hour's telephone numbers.

15. The contractor will coordinate with COR on the areas in green of Exhibit B. These areas may not need to be cleaned/treated/plowed until after an event is over.
