COMBINED SYNOPSIS/SOLICITATION
Woods Hole Ice and Snow Removal Services
(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice and in accordance with the simplified acquisition procedures authorized in FAR Part 13. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.
(ii) This solicitation is issued as a request for quotation (RFQ). Submit written quotes on RFQ Number 1305M324Q0353.
(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2024-05 (May 2024).
(iv) This solicitation is being issued as a total Small Business Set-Aside. The associated NAICS code is 561790. The small business size standard is $9.0 Million.
(v) This combined solicitation/synopsis is for purchase of the following commercial services:

Statement of Work (SOW)
Grounds Maintenance – Ice and Snow Removal Services
1.0 Background. The National Oceanic and Atmospheric Administration (NOAA), National Marine Fisheries Service (NMFS), Northeast Fisheries Science Center (NEFSC), is located at 166 Water Street, Woods Hole Massachusetts 02543-1026. The Northeast Fisheries Science Center is the research arm of NOAA Fisheries in the region. The Center plans, develops, and manages a multidisciplinary program of basic and applied research.
2.0 General Requirements
2.1 Scope of Work. Non-Personal Service. Contractor shall provide all plant, trained labor, equipment, materials, supervision, transportation, permits, insurance, and quality control necessary to provide ground maintenance – ice and snow removal services for the NMFS/NEFSC Woods Hole Massachusetts properties, herein known as the “Work”.
Contractor shall be fully knowledgeable of all contract requirements and shall make themselves aware of job site conditions that will affect performance under the contract. Contractor shall at all times provide adequate supervision of employees ensuring Work is accomplished in accordance with the terms and conditions of the contract in a manner that will provide the facility with a safe, and satisfactory condition (neat and professional) after storm conditions.
2.1.1 Place of Performance. The NMFS/NEFSC 166 Water Street, Woods Hole Massachusetts 02543-1026.
Areas to be maintained under this performance include the main Laboratory Building #166, the Maintenance/Aquarium Building #16, the Cottage Building #22, and all Parking Lots and Access Roads. Refer to “Site and Performance Location”, Appendix B.
2.1.2 Period of Performance. Performance is for one (1) base year and four (4) option years.

2.1.3 Contractor Hours of Operation. Contractor shall perform with coordination of the Technical Point of
Contact (TPOC) or their designated Alternate prior to each storm event for approval and direction of work/services required as based on the type/length of storm event and the incorporated pricing schedule.
2.1.3.1 Normal hours for the government employees at the location is considered between the hours of 7:00AM – 4:00PM Eastern Standard Time (EST) Monday through Friday, with the exception of recognized United States (U.S) Federal Holidays, or when the Government facility/installation is closed due to local or national emergencies, adverse weather, administrative closings, or similar Government directed facility/installation closings. 2.1.3.1 Technical Point of Contact (TPOC) and/or Alternate TPOC will notify the Contractor of
Government facility/installation closures on an event-by-event basis. Contractor shall maintain an adequate work force for the uninterrupted performance of all tasks defined within this PWS when the Government facility/installation is not closed for the above reasons.

2.1.4 Contractor shall accomplish all Work in accordance with all interstate, federal, state, and local laws and regulations utilizing the latest technology, products, equipment, industry practices, and specifications in order to achieve the quality and performance standards required.
2.1.4.1 Written and verbal communications concerning this contract shall be conducted between the
Contractor and the authorized government team (Contracting Officer, and Technical Point of Contact) only.
2.1.4.2 Contractor shall handle corrective action(s) without dependence upon Government direction.
Contractor shall resolve all discrepancies noted (by the government team) within 24hrs of identification. Contractor shall ensure Contractor’s employees and all associated Subcontractor(s) performing under this contract, are notified of all deficiencies in their area of responsibility to ensure that deficiencies do not reoccur.
2.1.4.3 Contractor shall coordinate all snow and ice removal requirements with TPOC for anticipated storms and unexpected storm conditions as early as possible inclusive of all calendar days.
2.2 Contractor is responsible for understanding the complexity and volume of services required. Overview of the Woods Hole Facility Grounds to be maintained are identified in “Site and Performance Location”, Appendix B of this
SOW.
2.2.1 Contractor shall provide all plant, labor, supervision, oversight, equipment, materials, transportation, permits, insurance, and quality control necessary to provide ice and snow removal for the NMFS/NEFSC Woods Hole Massachusetts properties.
3.0 Contractor shall be responsible for Quality Control. The Government is responsible for Quality Assurance. The Government will evaluate the Contractor’s performance under this contract in accordance with the requirements contained in this statement of work.
4.0 Security Requirements. Security Clearances are not required. The Government reserves the right to deny access to Government facilities/property at any time, for any reason. The Government will not be held liable for any delays or breach of contract caused by refusal to allow entry.
4.1 Contractor employees and associated subcontractors performing under this contract MUST be U.S. citizens or
MUST have established and maintain legal residence in the U.S., and be authorized by the US Government to work in the United States (i.e. Green card, worker authorization, etc.). All Contractor employees and all associated subcontractors performing under this contract MUST have at least one form of US Government issued photo identification (driver’s license, US passport, US work visa, etc.) for entry to the Government facility/property.
4.1.1 Contractor shall provide a list of all personnel performing under this contract to the CO and TPOC no later than five (5) days of contract award prior to the commencement of work. Contractor shall maintain this list throughout the life of the contract to keep it current and up to date reflecting all terminations and additions of personnel performing under this contract.
4.1.2 National Agency Check with Inquires (NACI). Not required. This is a low risk non IT service contract of 180 days or more which require a NACI for Contractor employees, or associated subcontractor(s) when access to a DOC owned, leased, or controlled facility is required for performance. This service does not require access of Contractor employees or associated subcontractor(s) into DOC owned, leased, or control facilities. Due to the TPOC establishing preset schedule where government employees will be present on site during the actual performance of Work, it has been determined that NACI for personnel performing under this contract will not be required.
4.1.3 Contractor employees and associated subcontractor personnel, vehicles, and property under their control are subject to search upon entering or exiting the installation, or at any point while on the installation. Any vehicles or personnel found in possession of prohibited items will be removed, and/or barred, from the installation and released to the appropriate civil authorities.
4.1.4 Government reserves the right to exclude or remove from the site any Contractor employee of the
Contractor or associated subcontractor whom the Government deems incompetent, careless, insubordinate, or otherwise objectionable, or whose continued employment on the contract is deemed by the Government to be contrary to the public interest.
5.0 Special Qualifications and Permits. Contractor shall ensure all required skill sets, licenses, and permits are obtained and maintained for performance under this contract.
6.0 Safety, Security, Fire Protection, Environmental Controls, Conservation of Utilities, and Compliance with Laws and Regulations.
6.1 Contractor shall record and report promptly (as soon as possible but no later than, one hour of incident) to the CO and TPOC, all available facts relating to each instance of damage to Government property or injury to either Contractor or Government personnel.
6.1.1 In the event of an accident/mishap, Contractor shall take reasonable and prudent action to establish control of the accident/mishap scene, prevent further damage to persons or property, and preserve evidence until released by the authorized Government representative (i.e. TPOC, CO).
6.1.2 If the Government elects to conduct an investigation of the accident/mishap, the Contractor shall cooperate fully and assist government personnel in the conduct of investigation until the investigation is completed.
6.1.3 While on Government property, Contractor shall not use a cell phone while operating a vehicle or other motorized equipment unless the operator is utilizing a hands-free device as such is prohibited by Federal regulations.
Motor vehicle regulations are strictly enforced and excessive violations may result in the loss of driving privileges on the Government facility.
6.2 Security. There are no specific security requirements for performance under this contract.
7.0 Government Roles.
7.1 The Contracting Officer (CO) is the only individual with the authority to authorize changes within this contract that will have an effect on the scope, and monetary values (increase or decrease) of contract.
7.2 The Technical Point of Contact (TPOC) is the individual designated and authorized in writing by the CO at contract award to perform specific technical or administrative functions on the contract. The key role of the TPOC is to observe, document, and communicate Contractor performance to both the CO and Contractor. All coordination and correspondence should be forwarded through the TPOC to the CO. TPOC and alternate TPOC (if applicable) will be responsible for the inspection and acceptance of performance and any deliverables under the contract. The TPOC does NOT have authority to change the terms and conditions of the contract.
7.2.1 All contracting actions and/or correspondence should be forwarded through the TPOC. The TPOC will address all technical matters, providing technical direction and discussion as necessary with respect to the specifications, or PWS, The TPOC is responsible for monitoring the progress and quality of the Contractor’s performance. The TPOC does not have authority to take any action, either directly or indirectly, that would change the pricing, quantity, quality, place of performance, Work, delivery schedule, or any other term and condition of the contract. When, in the opinion of the Contractor, the TPOC requests efforts outside the existing scope of the contract, the Contractor shall promptly notify the CO in writing. Contractor under such direction shall take no action until the CO has resolved the issue or has otherwise issued a modification to the contract.
7.2.2 In the absence of the TPOC (due to reasons such as leave, illness, and official travel), all responsibilities and functions assigned to the TPOC shall be the responsibility of the Alternate TPCO, and then the CO if both primary and alternate TPCO is unavailable.
8.0 Government Responsibilities:
8.1 Government shall inspect the Work performed under this contract. Any corrective action required as a result of the inspection will be accomplished prior to final monthly billing.
8.1 Contractor may be notified of deficiencies in performance in writing by the TPOC/CO. Oral deficiency notifications will be confirmed in writing by the TPOC/CO. Contractor shall take prompt corrective action upon notice of deficiency. Prompt is defined as within 24 hours of notification.
8.1 Government personnel other than COs and the authorized TPOC, may, with CO coordination, observe
Contractor operations. However, these personnel may not interfere with Contractor performance or make any changes to the contract.
8.1 Government Furnished Property, Materials, Equipment and Services (GFP/M/E/S). None. Government dumpsters shall not be used by the Contractor.
8.1 Government is not responsible for damage to Contractor’s equipment due to trash, debris or uneven terrain.
10.0 Contractor Responsibilities.
10.1 Contractor Furnished Property, Materials, Equipment and Services (GFP/M/E/S). Contractor shall provide all plant, trained labor, equipment, materials, supervision, transportation, permits, insurance, and quality control necessary to achieve the quality performance standards of the Work in this contract. Government dumpsters shall not be used by the contractor.
10.1.1 Contractor shall immediately notify the TPOC/CO if discrepancies are discovered between the existing property conditions and those noted on the SOW or Appendix’.
10.1.2 Contractor shall conduct operations in such a manner as to minimize any inconvenience in the use of the facilities to the occupants and visitors. Contractor shall instruct their employees daily to be mindful of the full time requirement to maintain a safe environment for the facility’s occupants including staff, visitors, customers and the occurrence of the general public on or near the site.
10.2 Specific Tasks.
10.2.1 Coordination and Approval Prior to Work. Prior to each work period resulting from a storm (anticipated or unexpected) the Contractor shall coordinate/communicate requirements with the TPOC. This coordination provides the approval to perform specific services (based on accepted and incorporated price schedule) required for each work period as type and length of storms vary in degree/severity and take place under varied facility operating hours (duty days/hours and non-duty days/hours).
10.2.2 Contractor shall monitor weather and surface area conditions as reported by local Cape and Island news channels, local radio stations, National Weather Service broadcasts, NOAA Weather Radio, or NOAA Web site at the following web address http://www.weather.gov at all times during the performance period of this contract.
10.2.3 Contractor shall initiate snow removal operations based on snow accumulations and coordination/communication with TPOC prior to snow event. Contractor shall ensure that snow removal operations will http://www.erh.noaa.gov/ifps/MapClick.php?CityName=Narragansett&state=RI&site=BOX be completed by 7:00 AM (EST) during regular business days (Monday through Friday). If snow and/or ice buildup occurs during weekends, holidays or on snow closure days, the Contractor shall ensure that parking lots and walkways are cleared by 7:00 AM (EST) of the next business day. If snowfall or icing should continue to accumulate during weekends, the Contractor shall make sure that there is emergency vehicle access to the facility and main entrances are cleared for access to the building and complete snow/ice removal operations shall resume as soon as storm ends during the weekend but shall be completed no later than 7:00 AM (EST) of the next business day.
10.2.4 Contractor shall remove snow and ice at all entrances, walkways and emergency exits of all buildings, including but not limited to: Bldg. 166 (Main Lab), Bldg. 16 (Maintenance/Aquarium), and Bldg. 22 (Cottage).
10.2.5 Contractor shall perform snow removal and ice alleviation services on all parking lots, sidewalks, stairways, ramps, and seal pool viewing area. Snow removal and ice alleviation shall be performed on the full length and width of the parking lots, walkways, ramps and stairways.
10.2.6 Contractor shall remove snow and ice around all dumpsters. Snow and ice shall be removed to a minimum of three feet (3’) around all dumpsters to provide safe walking access and also provide unobstructed truck access from street and parking lot to each dumpster.
10.2.7 Contractor shall not place piled snow at any location which blocks or obstructs any means of egress from any building or facility.
10.2.8 Contractor shall clear all drains with-in parking lots of packed snow and/or ice that may prevent normal draining of melting snow, ice, or rain and cause flooding in parking lots.
10.2.9 Contractor shall initiate sanding of all roads, driveways and parking lots as necessary after snow removal operations are complete. Contractor shall also use the approved chemicals on all walkways, ramps, stairways and building entrances once snow removal has been completed. Surfaced areas shall have a friction coefficient equal to or greater than the surface if just wet.
10.2.10 Contractor shall use the following approved chemicals for ice and snow alleviation on paved parking lots, walkways, ramps and stairways at a rate provided by the manufacturer.
Paved surfaces:
Sodium Chloride/Sand mixture
Walkways, ramps and stairs: Salt is not to be used on any concrete surfaces Calcium Chloride Potassium Chloride Magnesium Chloride
10.3 Based on coordination/communication of storm requirements with the TPOC prior to each weather event the following is a baseline for services which may be required in accordance with the incorporated pricing schedule.
10.3.1 Ice and/or snow removal shall commence when buildup is over 1/8”. In instances of an ice storm or freezing rain, plowing will not be required; however, sanding and the application of approved chemicals on steps and walkways may be required.
10.3.2 3” to 6” of snow/ice/slush shall be considered a routine storm and will require complete removal.
Complete Removal Services for this criteria. Complete Removal Services is identified in subparagraphs 10.2 above.
10.3.3 Over 6” of snow/ice/slush shall require the Complete Removal Services and may require additional services. This may require the following: plowing of fire lane (pass only) in order to provide access for emergency vehicles; extra plowing in excess of that of a complete snow removal for 3” to 6”; bucket services to help load truck to remove excess snow from premises; truck and driver to remove accumulated snow off of premises.
10.4 General Conditions:
10.4.1 Contractor shall be fully knowledgeable of all requirements of the contract documents and shall make themselves aware of all job site conditions that will affect their performance.
10.4.2 Contractor shall maintain and adequate workforce trained to safely and satisfactorily perform under this contract.
10.4.3 Contractor shall ensure all employees and subcontractors are fully trained and have a full understanding of the statement of work task requirements; government will not provide instruction or oversight.
10.4.4 Contractor shall ensure all Contractor employees, and all associated subcontractor(s) are experienced in the type of work involved and familiar with the specifications of this contract. Contractor is responsible for damage to any Government equipment, supplies, or facilities caused by Contractor personnel.
10.4.5 Contractor shall comply with all applicable local, state, and federal codes and laws as well as other government published instructions per the contract documents.
10.4.6 Contractor shall perform in accordance with professional industry standards.
10.4.7 Contractor shall be responsible for all contractor security arrangements including subcontractor’s materials, tools, equipment, and personnel.
10.4.8 Contractor shall accomplish all tasks to meet the requirements of the PWS inclusive of its Appendix’.
10.4.9 Contractor Equipment. The Government may inspect Contractor’s equipment at any time.
Contractor’s equipment shall be subject to approval by the TPOC. Contractor shall service or replace at no cost to the Government any equipment found to be defective, unsafe, or unsuitable.
10.4.10 Contractor Liability: Except as otherwise provided by law, the Government will not be responsible for the loss of, or damage to, the Contractor’s equipment, property, or death of or injury to the Contractor’s employees or associated subcontractors performing under this contract, resulting from the Contractor’s negligent performance under this contract. Contractor shall be responsible for all damages to persons or property that occurs as a result of Contractor’s faulty equipment, fault or negligence of Contractor personnel/employees or associated subcontractors performing Work on this contract.
10.4.11 Job Site Protection. Contractor shall protect the property of others as well as his/her own property.
Contractor shall repair or replace any property damaged by the Contractor during performance under this contract.
Contractor shall take precautions to prevent the spread of dust, moisture and debris. Contractor shall keep the area clean and upon completion of the project, the Contractor shall clean up the work area and remove all debris from the job site in a timely and legally acceptable manner so as to not detract from the aesthetics or the functions of the building.

FAR 52.222-55 MINIMUM WAGES FOR CONTRACTOR WORKERS UNDER EXECUTIVE ORDER 14026 (JAN

a. Definitions. As used in this clause— United States means the 50 states, the District of Columbia, Puerto Rico, the Northern Mariana Islands, American Samoa, Guam, the U.S. Virgin Islands, Johnston Island, Wake Island, and the outer Continental Shelf as defined in the Outer Continental Shelf Lands Act (43 U.S.C. 1331, et seq.).
Worker – (1)
i. Means any person engaged in performing work on, or in connection with, a contract covered by Executive Order 14026, and–
A. Whose wages under such contract are governed by the Fair Labor Standards Act (29 U.S.C. chapter 8), the Service Contract Labor Standards statute (41 U.S.C. chapter 67), or the Wage Rate Requirements (Construction) statute (40 U.S.C. chapter 31, subchapter IV);
B. Other than individuals employed in a bona fide executive, administrative, or professional capacity, as those terms are defined in 29 CFR part 541; and
C. Regardless of the contractual relationship alleged to exist between the individual and the employer.
ii. Includes workers performing on, or in connection with, the contract whose wages are calculated pursuant to special certificates issued under 29 U.S.C. 214(c).
iii. Also includes any person working on, or in connection with, the contract and individually registered in a bona fide apprenticeship or training program registered with the Department of Labor’s Employment and Training Administration, Office of Apprenticeship, or with a State Apprenticeship Agency recognized by the Office of Apprenticeship. (2)
i. A worker performs on a contract if the worker directly performs the specific services called for by the contract; and
ii. A worker performs in connection with a contract if the worker 's work activities are necessary to the performance of a contract but are not the specific services called for by the contract.
b. Executive Order Minimum wage rate.
1. The Contractor shall pay to workers, while performing in the United States, and performing on, or in connection with, this contract, a minimum hourly wage rate of $15.00 per hour beginning January 30, 2022.
2. The Contractor shall adjust the minimum wage paid, if necessary, beginning January 1, 2023, and annually thereafter, to meet the applicable annual E.O. minimum wage. The Administrator of the Department of Labor’s Wage and Hour Division (the Administrator) will publish annual determinations in the Federal Register no later than 90 days before the effective date of the new E.O.
minimum wage rate. The Administrator will also publish the applicable E.O. minimum wage on https://www.sam.gov (or any successor website), and a general notice on all wage determinations issued under the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute, that will provide information on the E.O. minimum wage and how to obtain annual updates. The applicable published E.O. minimum wage is incorporated by reference into this contract. (3)
i. The Contractor may request a price adjustment only after the effective date of the new annual E.O. minimum wage determination. Prices will be adjusted only for increased labor costs
(including subcontractor labor costs) as a result of an increase in the annual E.O. minimum wage, and for associated labor costs (including those for subcontractors). Associated labor costs shall include increases or decreases that result from changes in social security and unemployment taxes and workers’ compensation insurance, but will not otherwise include any amount for general and administrative costs, overhead, or profit.
ii. Subcontractors may be entitled to adjustments due to the new minimum wage, pursuant to paragraph (b)(2). Contractors shall consider any subcontractor requests for such price adjustment.
iii. The Contracting Officer will not adjust the contract price under this clause for any costs other than those identified in paragraph (b)(3)(i) of this clause, and will not provide duplicate price adjustments with any price adjustment under clauses implementing the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute.
4. The Contractor warrants that the prices in this contract do not include allowance for any contingency to cover increased costs for which adjustment is provided under this clause.
5. A pay period under this clause may not be longer than semi-monthly, but may be shorter to comply with any applicable law or other requirement under this contract establishing a shorter pay period. Workers shall be paid no later than one pay period following the end of the regular pay period in which such wages were earned or accrued.

6. The Contractor shall pay, unconditionally to each worker, all wages due free and clear without subsequent rebate or kickback. The Contractor may make deductions that reduce a worker ’s wages below the E.O. minimum wage rate only if done in accordance with 29 CFR 23.230, Deductions.
7. The Contractor shall not discharge any part of its minimum wage obligation under this clause by furnishing fringe benefits or, with respect to workers whose wages are governed by the
Service Contract Labor Standards statute, the cash equivalent thereof.
8. Nothing in this clause shall excuse the Contractor from compliance with any applicable
Federal or State prevailing wage law or any applicable law or municipal ordinance or any applicable contract establishing a minimum wage higher than the E.O. 14026 minimum wage. However, wage increases under such other laws or municipal ordinances are not subject to price adjustment under this subpart.
9. The Contractor shall pay the E.O. minimum wage rate whenever it is higher than any applicable collective bargaining agreement(s) wage rate.
10. The Contractor shall follow the policies and procedures in 29 CFR 23.240(b) and 23.280 for treatment of workers engaged in an occupation in which they customarily and regularly receive more than $30 a month in tips.
c.
1. This clause applies to workers as defined in paragraph (a). As provided in that definition –
i. Workers are covered regardless of the contractual relationship alleged to exist between the contractor or subcontractor and the worker;
ii. Workers with disabilities whose wages are calculated pursuant to special certificates issued under 29 U.S.C. 214(c) are covered; and
iii. Workers who are registered in a bona fide apprenticeship program or training program registered with the Department of Labor’s Employment and Training Administration, Office of Apprenticeship, or with a State Apprenticeship Agency recognized by the Office of Apprenticeship, are covered.
2. This clause does not apply to–
i. Contracts or subcontracts to which the States of Texas, Louisiana, or Mississippi, including their agencies, are a party;
ii. Fair Labor Standards Act (FLSA)-covered individuals performing in connection with contracts covered by the E.O., i.e. those individuals who perform duties necessary to the performance of the contract, but who are not directly engaged in performing the specific work called for by the contract, and who spend less than 20 percent of their hours worked in a particular workweek performing in connection with such contracts;
iii. Individuals exempted from the minimum wage requirements of the FLSA under 29 U.S.C. 213(a) and 214(a) and (b), unless otherwise covered by the Service Contract Labor Standards statute, or the Wage Rate Requirements (Construction) statute. These individuals include but are not limited to-
A. Learners, apprentices, or messengers whose wages are calculated pursuant to special certificates issued under 29 U.S.C. 214(a) ;
B. Students whose wages are calculated pursuant to special certificates issued under 29 U.S.C. 214(b) ; and
C. Those employed in a bona fide executive , administrative, or professional capacity (29 U.S.C. 213(a)(1) and 29 CFR part 541).
d. Notice. The Contractor shall notify all workers performing work on, or in connection with, this contract of the applicable E.O. minimum wage rate under this clause. With respect to workers covered by the Service Contract Labor Standards statute or the Wage Rate Requirements (Construction) statute, the Contractor may meet this requirement by posting, in a prominent and accessible place at the worksite, the applicable wage determination under those statutes. With respect to workers whose wages are governed by the FLSA, the Contractor shall post notice, utilizing the poster provided by the Administrator, which can be obtained at www.dol.gov/agencies/whd/government-contracts, in a prominent and accessible place at the worksite. Contractors that customarily post notices to workers electronically may post the notice electronically provided the electronic posting is displayed prominently on any Web site that is maintained by the contractor, whether external or internal, and customarily used for notices to workers about terms and conditions of employment.
e. Payroll Records.
1. The Contractor shall make and maintain records, for three years after completion of the work, containing the following information for each worker:
i. Name, address, and social security number;
ii. The worker ’s occupation(s) or classification(s);
iii. The rate or rates of wages paid;
iv. The number of daily and weekly hours worked by each worker;
v. Any deductions made; and
vi. Total wages paid.
2. The Contractor shall make records pursuant to paragraph (e)(1) of this clause available for inspection and transcription by authorized representatives of the Administrator.
The Contractor shall also make such records available upon request of the Contracting Officer.
3. The Contractor shall make a copy of the contract available, as applicable, for inspection or transcription by authorized representatives of the Administrator.
4. Failure to comply with this paragraph (e) shall be a violation of 29 CFR 23.260 and this contract. Upon direction of the Administrator or upon the Contracting Officer 's own action, payment shall be withheld until such time as the noncompliance is corrected.
5. Nothing in this clause limits or otherwise modifies the Contractor ’s payroll and recordkeeping obligations, if any, under the Service Contract Labor Standards statute, the Wage Rate Requirements (Construction) statute, the Fair Labor Standards Act, or any other applicable law.
f. Access. The Contractor shall permit authorized representatives of the Administrator to conduct investigations, including interviewing workers at the worksite during normal working hours.
