STATEMENT OF WORK
National Oceanic and Atmospheric Administration (NOAA) Statement of Work (SOW) for Vessel Charter in Support of Biological Surveys in St. Croix, U.S. Virgin Islands
1.0 GENERAL
1.1 BACKGROUND
The National Oceanic and Atmospheric Administration’s (NOAA) Southeast Fisheries Science Center (SEFSC) conducts research on federally managed marine fisheries, protected species, and the habitats that support them. The Habitat Ecology Branch (HEB) within the SEFSC has a funded MSA Program research project that requires completion of randomized island-wide dive surveys of queen conch populations in multiple locations around the island of St. Croix, USVI.
In order to successfully complete this project, as many sites as possible need to be visually surveyed to provide a robust sample size which will generate an extensive data set of queen conch morphometrics. We plan to survey conch populations at numerous sites around St. Croix during an upcoming field expedition from July 6 – July 21, 2024. To facilitate efficient completion of surveys NOAA Fisheries requires two experienced captains with two appropriate vessels consisting of ample deck and storage space for dive/snorkel and scientific equipment.
1.2 SCOPE
SEFSC divers and scientists will conduct queen conch population surveys from July 6 – July 21, 2024. To facilitate efficient completion of surveys the SEFSC requires two small vessels appropriate for carrying four divers each, a top-side support person, up to 10 SCUBA tanks per vessel, survey equipment, and dive equipment (i.e., fins, masks, and BCDs). Each vessel must have a licensed captain knowledgeable in navigation of the local area. This will enable NOAA SEFSC Principal Investigators and field personnel to focus on locating survey locations and conducting queen conch population surveys as efficiently as possible.
1.3 OBJECTIVE
To conduct scientific diver-based survey operations of the queen conch population located in the nearshore waters of St. Croix, USVI, including Lang Bank. These surveys will employ radial surveys and include visual characterization of benthic habitats and collection of in-situ measurements of queen conch located in the study area. This requirement is to provide two small vessels appropriate for intensive diving operations that will support NOAA SEFSC dive teams and queen conch surveys in and around St. Croix, USVI.
2.0 SPECIFIC REQUIREMENTS/TASKS
The primary task that must be completed is to provide and captain two vessels carrying a total of eight divers and scientific crew to specified locations in St. Croix, USVI, from July 6 – July 21, 2024.
A. VESSEL REQUIREMENTS
1. Each vessel must have a minimum overall length (LOA) of 32 feet and beam measuring between 10-12 feet.
2. Each vessel must have, in proper working order, all required United States Coast Guard (USCG) approved safety, navigation, and communication devices and equipment. Safety gear must meet USCG and OSHA standards. It is desired that safety gear is also SOLAS compliant.
3. Each vessel must be capable of carrying up to six NOAA divers and crew including dive equipment (e.g., BCDs, masks, fins) and survey equipment (e.g., dive flags, dive reels, calipers).
4. Each vessel must be outfitted with adequate deck space and tank racks for storing and securing up to 10 SCUBA tanks on a daily basis.
5. Each vessel and captain must meet NOAA small boat safety standards as outlined in the NOAA Small Boat Standards and Procedures Manual Edition 4.2 (attached to this solicitation).
6. Each vessel must be equipped with a minimum of one anchor and sufficient ground tackle to safely and securely anchor the vessel. Consistent with mission objectives, the vessels must employ anchoring methods in accordance with local regulations to minimize damage to sensitive habitats during any anchoring operations.
7. Each vessel must be able to maintain underway status for the entire duration of the charter. Each vessel must be able to maintain all deck and other necessary services while underway or while on-station (at anchor or otherwise).
8. Each vessel must have a minimum of one VHF radio mounted near the helm. VHF radio contact must be maintained between the vessels. During dive operations, the Captains and scientific crew must monitor and respond to VHF radio communications, check-ins, and emergency call-ins with Government personnel away from the vessel.
9. Each vessel must be equipped with a functioning depth sounder to facilitate navigation and dive operations requiring information about the depth of water beneath the vessels.
10. Each vessel must be equipped with a functioning GPS and chart plotter with updated electronic charts installed mounted at the helm.
11. Each vessel must have the capability to receive up-to-date weather information. The Captains must review and discuss weather reports on a daily basis with the Project Lead.
12. Each vessel must be capable of transiting long distances on a daily basis as requested by the Project Lead.
13. Each vessel must have a full bimini top covering the entire deck area for protection from the elements while on the water.
14. Each vessel must have full swim platforms and ladders with rear deck space to allow divers to don gear, enter the water, and exit the water safely and efficiently.
15. The Captains must conduct a pre-charter shipboard and safety briefing for all crew and Government personnel. At a minimum, the orientation must review the purpose, location, and emergency operation of vessel EPIRBS, VHF and single sideband radios, life jackets, and fire-fighting equipment. In addition, emergency procedures for man overboard and abandon ship must be reviewed including the responsibilities of each scientific crew member in case of the occurrence of these events. Any additional safety information that is specific to the vessels must also be covered at this time.
16. As mandated by NOAA Dive Program regulations, one appropriately sized Emergency Oxygen Kit must be carried on each vessel during dive operations.
17. The contractor must provide USCG-approved life jackets for all personnel aboard.
18. A Category I 406 MHZ EPIRB (Emergency Position Indicating Radio Beacon) must be affixed to the exterior of each vessel in a manner approved by the USCG.
B. CREW REQUIREMENTS
1. The contractor must provide a Captain for each vessel, appropriately licensed by the USCG for the gross tonnage of the vessel, for the duration of the charter. The Captains must be competent in the use of navigation and safety equipment. The Captains must have experience transiting long distances in small vessels, navigating busy waterways, and operating in the near shore environments of Caribbean islands.
2. The Captains must have demonstrated experience deploying and recovering divers safely from the water.
3. Captains must have all required and necessary qualifications, licenses, and certifications appropriate to their position and must provide all necessary qualifications, licenses, and certifications for the crew as well.
C. GOVERNMENT PERSONNEL
1. Government personnel may consist of Government employees and/or employees of corporations, academic institutions, contractors, or other entities.
2. The TPOC is the primary point of contact for contract management issues, including contract performance and invoicing. While on charter one of the Government’s personnel will be the Project Lead. The Project Lead will be on board and responsible for implementation of the Project Instructions, reporting compliance of vessel and crew with the contract terms, all scientific operations, and the conduct and performance of Government personnel aboard the vessel for the duration of the charter. The Project Lead and the Captain must work together to achieve the goals of the project in a safe and cost-effective manner.
Any problems that cannot be resolved by the Chief Scientist and the Captain must be referred to the TPOC, who will consult with and advise the Contracting Officer to determine a resolution.
3. Government personnel will not be involved in responsibilities typical of the vessel’s crew, such as standing watch, line handling, or operating mechanical non-Government equipment.
D. OPERATING PROCEDURES
1. The workday length and hours will be determined by the Project Lead in consultation with the Captains. The decision will be based on the type of operations expected each day (transiting, survey operations, etc.) as well as on the prevailing weather conditions. The length of the work day will generally range from dawn until dusk and will not exceed 12 hours, per NOAA regulations. The Project Lead has the final authority for the scientific operations of the vessel and Government personnel, except in matters relating to safety of the vessel and personnel on board.
2. The Project Lead and Captains must work together to resolve all problems which occur regarding the charter and operations while underway. In the event the Project Lead and Captains are unable to resolve any problem which has the potential to significantly impact the scientific mission or threatens the safety of the Government personnel, the Project Lead, under consultation with the TPOC and Contracting Officer, may direct the vessel to return to port where an acceptable solution will be arranged between the Government and the contractor, or the charter will be terminated. The vessel will be off-charter if required to return to port and will remain off-charter until the problem has been resolved and the vessel has returned to the survey area.
3. All contractor and vessel equipment specified in the Government’s statement of work and that which is not specified but is necessary for the safe and continuous operation of the vessel must be operational at the beginning of the charter and maintained in working order throughout the duration of the charter.
4. During the charter, all small boat activities must be approved by the Project Lead and must only be conducted in support of the scientific mission.
5. Passengers are not permitted to be transported aboard NOAA chartered vessels for any reason without review and approval from the NOAA Contracting Officer in consultation with the TPOC, program official, or designee acting on behalf of the program office chartering the vessel. No individuals will be aboard without NOAA authorization.
Exception to this requirement is permitted for purposes of rescuing and saving life at sea.
F. OPERATING AREA
For this charter the contractor will navigate the vessels in coastal waters surrounding St Croix, U.S. Virgin Islands, including the Buck Island Reef National Monument and Lang Bank. The general operating area is indicated by the white polygons in the image below. I. PERIOD OF PERFORMANCE
Base Period: July 1, 2024 – September 1, 2024; 2 Vessels, 16 days per vessel.
Option Period 1: June 1, 2025 – September 30, 2025; 2 Vessels, 12 days per vessel.
ADDITIONAL REQUIREMENTS:
COAST GUARD INSPECTION
Performance under this contract is dependent on the vessel(s) passing a U.S. Coast Guard safety examination. The Coast Guard inspection shall be performed no earlier than two weeks before the vessels’ scheduled departure and the Coast Guard certification must be obtained by the vessels no less than one week prior to scheduled departure. In the event that the contractor does not obtain the Coast Guard inspection, the Government may terminate the contract, and the contractor may be liable to the Government for excess re-procurement costs. Inspection is required before the commencement of each charter year, unless the Coast Guard has issued a letter of inspection that is valid for the time period of the charter. The contractor will arrange for the inspection, and any costs associated with bringing the vessels to passing standard shall be borne by the contractor. A copy of the Coast Guard certification shall be posted on each vessel.
CHARTER VESSEL SAFETY
The contractor shall adhere to the safety regulations as set forth in Coast Guard rules effective on September 15, 1991, and as provided for by the Commercial Fishing Industry Vessel Safety Act of 1988 (specifically, 46 CFR Part 28) or subsequent additions or revisions. These regulations require that specified vessels be equipped with a variety of safety features and equipment.
A Coast Guard inspection of the vessel based on an interagency agreement between National Marine Fisheries Service (NMFS) and the Coast Guard or 46 CFR Part 28 will be required prior to performance. In addition to the requirements of 46 CFR Part 28, the Coast Guard inspection will require conformance with standards for lifesaving and firefighting equipment in the Rules for Small Passenger Vessels, which exceed 46 CFR Part 28. Issuance of the notice to proceed by the Government is conditioned upon the successful completion of the mandatory Coast Guard inspection under Part I, Paragraph 17 of this contract. Failure of the Contractor to successfully complete the inspection requirements shall be grounds for termination of this contract.
Conformance with present regulations for commercial fishing vessels requires that the master or an individual in charge of the vessel ensures that safety drills and instruction are conducted at least once a month (46 CFR 28.270). Safety orientations must be given to each individual on board that has not received the instruction and has not participated in the drills before the vessel can continue to operate. The contractor shall conduct such safety orientations prior to sailing on each cruise leg. It is recommended that a full drill be completed early in each cruise leg even if less than a month has elapsed since the last drill due to the frequent wholesale exchange of scientific personnel at cruise breaks. Each vessel must also have all required emergency instructions posted (46 CFR 28.265).
MECHANICAL BREAKDOWNS OR NON-PERFORMANCE
The contractor is responsible for maintaining all contractor provided equipment and vessels in a safe operating condition during the contract performance. If a mechanical breakdown occurs of the vessel(s) or other contractor provided equipment that is greater than 12 hours cumulative within a 24-hour period that begins at 0700 and ends at 0659, the vessel(s) and all contractor provided equipment shall be considered off charter and make-up fishing days may be required.
The charter shall also be considered off charter if the Captain or Crew of the boat is unable to perform the duties as outlined in the Statement of Work in increments of time greater than 12 hours cumulative within a 24-hour period that begins at 0700 and ends at 0659. The contractor shall make every reasonable effort to resolve the problem causing the vessel(s), contractor provided equipment or Captain and Crew to be out of service and bring it back into service as quickly as possible to continue contract performance. Mechanical breakdown periods in excess of four (4) consecutive or four (4) cumulative days may be grounds for termination of the contract. In the event that the breakdown requires the vessel(s) to return to port for repairs, the vessel(s) will not be considered back on charter until the vessel(s) returns to active survey status as determined by the Contracting Officer in consultation with TPOC.
WORKING CONDITIONS FOR GOVERNMENT PERSONNEL
The contractor shall provide safe, efficient working conditions and accommodations to the Government personnel free from violence, threats of violence, harassment (including sexual harassment), intimidation, and other disruptive behavior. The contractor, its agents, subcontractors, and employees, including the Captain and crew of the vessel shall not harass, assault, oppose, impede, intimidate, threaten, interfere with or make unwelcome advances toward any member of the Government field party. Violation under this clause may result in termination of the contract, at the discretion of the Government under the Default Clause, and in consequent liability of the contractor to the Government for any costs incurred, as well as debarment, suspension or similar action from future participation in government contracts.
PRESENCE OF FAMILY MEMBERS
Unless serving as crew, the spouses or children of crew members or owner(s) may not accompany the vessel during the term of the charter without obtaining written approval in advance from the vessel captain. Liability for any family members allowed on board during the charter is the sole responsibility of the contractor.

FAR 52.212-2 Evaluation - Commercial Products and Commercial Services. (NOV 2021)
Offers will be evaluated based on price and the factors set forth in paragraph (a).
The evaluation will consider the Non-Price Technical Solution (Technical Approach and Past Performance) to be significantly more important than price. However, as quotes are determined to be more equal in the non-price evaluation factor, price becomes more important and may become the determining factor for award. If, at any stage of the evaluation, all vendors are determined to have submitted equal, or virtually equal, Non-Price Technical Solutions, price could become the factor in determining which vendor will receive the award.
The Government intends to evaluate the quotes and award a purchase order based on the Offeror’s initial quote; therefore, the Offeror’s initial quote should contain the Offeror’s best terms from a Non- Price Technical Solution and price standpoint.
The Government reserves the right not to award a purchase order depending on the quality of the quote(s) submitted and the availability of funds. Furthermore, the Government may waive informalities and minor irregularities or omissions in quotes received.
The Government may make award to other than the lowest-priced Offeror or the Offeror with the highest technical rating if the Contracting Officer determines that to do so would result in the best value to the Government. The Government will not make an award at a significantly higher overall price to achieve only slightly superior performance capability.
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
Paragraph (a) is hereby completed as follows: Evaluation factors are listed in order of importance and all factors are more important than price.

The Offeror’s overall technical approach will be evaluated…
