1. This is a solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice and in accordance with the simplified acquisition procedures authorized in FAR Part 13. This announcement constitutes the only solicitation.

2. This solicitation is issued as a request for quotation (RFQ). Submit written quotes on RFQ Number 1305M324Q0261.

3. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2024-05 (May 2024).

4. This solicitation is being issued as Unrestricted. The associated NAICS code is 562211. The small business size standard is $47.0 M.

5. This solicitation is for purchase of the following commercial services:

(Service) CLIN 0001 – Services, non-personal, to provide all labor, equipment and materials (unless otherwise provided herein) necessary for Hazardous Waste Removal Services at Narragansett, RI in accordance with the Statement of Work. (S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract.

There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.

STATEMENT OF WORK

FOR

HAZARDOUS WASTE DISPOSAL

NEFSC, Narragansett, RI

1.0 Background

The National Oceanic and Atmospheric Administration (NOAA), National Marine Fisheries Service (NMFS), Northeast Fisheries Science Center (NEFSC) is the research arm of NOAA Fisheries in the northeastern United States The Center plans, develops, and manages a multidisciplinary program of basic and applied research at four research laboratories in Massachusetts, Rhode Island, New Jersey, and Connecticut. The purpose of this contract is to provide for the lab pack and removal of hazardous and non-hazardous chemical waste from the Narragansett, Rhode Island Laboratory, located at 28 Tarzwell Drive, Narragansett, Rhode Island, 02882.

The Narragansett Laboratory is registered with the State of Rhode Island as a generator of hazardous waste, with EPA ID # RI7131490008. Under current Rhode Island regulations, the facility has been classified as a Conditionally Exempt Small Quantity Generator. However, the facility may infrequently change status, operating on occasion as a Small Quantity Generator. Based on the estimated current volume of waste, the warehouse will fall under the Small Quantity Generator status.

2.0 General Requirement

2.1 Scope of Work. Non-Personal Service. Contractor shall provide all materials, equipment, trained labor, supervision, transportation, permits, licenses, insurance, and quality control necessary to identify, inventory, lab-pack, package, label, mark, and transport off-site to a TSDF facility for ultimate disposition of hazardous and non-hazardous chemical waste, including legacy samples of marine specimens preserved in ethanol, that are located at the Narragansett Laboratory. (See 11.0 Specific Tasks) The contractor must ship all hazardous waste to a RCRA (Resource Conservation and Recovery Act) designated treatment, storage, or disposal facility using a Hazardous Waste Manifest and a licensed hazardous waste transporter. In addition to this requirement, contractors must provide DOT-approved containers for packing the waste and DOT-compliant transportation vehicles with appropriate placarding and licensed hazardous waste transporters.

Legacy Samples of marine plankton are preserved in ethanol in 3,240 quart-size containers. These small containers are securely packaged inside cardboard boxes. In addition to these legacy samples, there are approximately 270 gallons of chemical waste from laboratories that are stored in large 30 and 55-gallon drums, and smaller 1-5-gallon containers. This lab waste consists, primarily though not exclusively, of 95% ethanol and 37% formalin, some of which also contain small amounts of tissue samples and seawater. An inventory is included in Appendix B, and photos of the current site in Appendix C. Waste profiles will be established and submitted before the waste pickup. Where feasible, all wastes shall be removed the same day they are packaged. If same-day removal is not feasible, removal shall occur within a mutually agreed-upon time frame.

2.1.1 Contractor shall be fully trained and knowledgeable of all contract requirements and shall ensure Work is accomplished in accordance with all applicable Federal, State, and local statutory requirements related to the classification and transport of Hazardous Waste, and the terms and conditions of the contract. The Work shall be performed in a manner that will promote and maintain a safe environment. Contractor is responsible for damage to any Government equipment, supplies, or facilities caused by Contractor personnel.

2.1.2 Special Qualifications and Permits. The Contractor shall ensure all required training, certificates, licenses, skill sets, and permits are obtained and maintained for performance under this contract. The contract shall comply with the applicable requirements of the DOT regulations in 49 CFR parts 107, 171 through 180, and 390 through 397, appropriate to the mode of transport. Copies of training certificates, licenses, and permits, shall be provided upon request.

2.1.2.1 Licenses and Permits - The Contractor shall furnish information establishing that the Contractor is appropriately licensed and permitted (Federal, state, foreign, and international) for the transportation of hazardous waste, some of which contains seawater, plankton, and other marine biological tissue samples preserved in either 95% ethanol or 37% formalin

2.1.3. Insurance - The Contractor shall be required to present evidence to show, at a minimum, the amounts of insurance coverage required by EPA regulations 40 CFR 264.147.

2.1.4. Treatment, Storage and Disposal Facilities - The contractor must supply EPA ID#s for all treatment, storage and disposal (TSD) facility(s) used. All TSDs must have Part B permits, SPCC and/or Contingency Plans, closure insurance, and no RCRA or CERCLA actions against them.

2.1.5 Certification - Contractor shall submit evidence of certification; names, addresses, EPA ID numbers, and state certification numbers for main offices, subcontractors(s), transporters, and disposal sites associated with this contract.

2.1.6 Equipment and Supplies - The Contractor shall provide all equipment and supplies (adequate in kind and quantity) for performing all work in this Contract. This includes drums, packaging material, labels, etc.

2.1.7 Shipping Containers - The shipping container sizes and types shall be noted. The Contractor shall specify how the containers are packed, and if the containers hold more than one type of waste.

2.1.8. Treatment Method - The Contractor must specify the specific treatment method to be applied to each waste, and the TSD facility(s) that will perform such treatment.

2.1.9. Transportation - The Contractor shall own and/or operate the vehicles utilized during disposal operations. The transportation vehicle must be properly placarded for regulated quantities of DOT hazardous materials. Drivers shall have the DOT Emergency Response Guidebook, proper safety equipment, and all required permits in the vehicle. Drivers shall be DOT certified in accordance with DOT regulations, 49 CFR 172.704 and applicable modal specific training in 49 CFR 174-177. All Contractor employees at the site shall be familiar with the properties of the chemicals. The required emergency telephone number for the manifest will be provided by NOAA Fisheries at the time of disposal.

2.1.10 Documents - The Contractor shall prepare all documents, including waste profiles, land disposal restriction (land ban) certificates, non-hazardous waste shipping papers and uniform hazardous waste manifests, as necessary. At the conclusion of the destruction of wastes, the Contractor shall provide Certificates of Destruction and/or tracking forms.

2.1.11 Site Inspection - The Contractor is urged to inspect the site where services are to be performed to satisfy themselves regarding all general and local conditions that may affect the cost of Contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after Contract award.

2.2 Period of Performance: To be completed within 45 days of award.

2.3 Place of Performance: NOAA Fisheries, 28 Tarzwell Drive, Narragansett, RI 02882

2.4 Hours of Operation: Contractor shall perform Work between the hours of 8:00 AM and 5:00 PM Eastern Standard Time, Monday through Friday, with the exception of recognized United States (U.S) Federal Holidays, or when the Government facility/installation is closed due to local or national emergencies, adverse weather, administrative closings, or similar Government directed facility/installation closings. Facility access will be provided by Darryl San Souci.

3.0 Security Requirements. Security Clearances are not required. The Government reserves the right to deny access to Government facilities/property at any time, for any reason. The Government will not be held liable for any delays or breach of contract caused by refusal to allow entry.

3.1 Contractor employees and associated subcontractors performing under this contract MUST be U.S. citizens or MUST have established and maintain legal residence in the U.S., and be authorized by the US Government to work in the United States (i.e. Green card, worker authorization, etc.). All Contractor employees and all associated subcontractors performing under this contract MUST have at least one form of US Government issued photo identification (driver’s license, US passport, US work visa, etc.) for entry to the Government facility/property.

3.1.2 National Agency Check with Inquiries (NACI). Not required. This is a low risk non

IT service contract of 180 days or more which requires a NACI for Contractor employees, or associated subcontractor(s) when access to a DOC owned, leased, or controlled facility is required for performance. This service does not require access of Contractor employees or associated subcontractor(s) into DOC owned, leased, or control facilities. Due to the TPOC establishing a preset schedule where government employees will be present on site during the actual performance of Work, it has been determined that NACI for personnel performing under this contract will not be required.

3.1.3 Contractor employees and associated subcontractor personnel, vehicles, and property under their control are subject to search upon entering or exiting the installation, or at any point while on the installation. Any vehicles or personnel found in possession of prohibited items will be http://www.opm.gov/fedhol removed, and/or barred, from the installation and released to the appropriate civil authorities.

3.1.4 Government reserves the right to exclude or remove from the site any Contractor employee of the Contractor or associated subcontractor whom the Government deems incompetent, careless, insubordinate, or otherwise objectionable, or whose continued employment on the contract is deemed by the Government to be contrary to the public interest.

4.0 Safety, Security, Fire Protection, Environmental Controls, Conservation of Utilities, and Compliance with Laws and Regulations.

4.1 Safety Requirements. Contractor shall produce proper OSHA and other industry certificates/licenses upon request of the CO. Contractor shall be responsible for the safety of its own employees. Contractor shall take all necessary precautions to meet proper safety standards, including all Federal, State, and regulations, ordinances, and codes. (Appendix A, Useful Websites).

4.1.1 Contractor shall record and report promptly to the CO and TPOC all available facts relating to each instance of damage to Government property or injury to either Contractor or Government personnel.

4.1.2 If the Government elects to conduct an investigation of the accident/mishap, the Contractor shall cooperate fully and assist government personnel in the conduct of investigation until the investigation is completed.

4.1.3 While on Government property, Contractor shall not use a cell phone while operating a vehicle or other motorized equipment unless the operator is utilizing a hands-free device as such is prohibited by Federal regulations. Motor vehicle regulations are strictly enforced and excessive violations may result in the loss of driving privileges on the Government facility.

4.1.4 While on Government property, smoking will only be allowed in designated areas.

4.2 Security. There are no specific security requirements for performance under this contract.

4.3 Fire Protection Requirements. The emergency telephone number for Narragansett, RI 911.

Contractor shall comply with government evacuation procedures.

5.0 Government Roles

5.1 The Contracting Officer (CO) is the only individual with the authority to authorize changes within this contract that will have an effect on the scope, and monetary values (increase or decrease) of the contract.

5.2 The Technical Point of Contact (TPOC) is the individual designated by the CO at contract award to perform administrative functions on the contract. The key role of the TPOC is to monitor the performance of the contract. The TPOC will observe, document, and communicate Contractor performance to the CO. TPOC and alternate TPOC (if applicable) will be responsible for the inspection and acceptance of performance and any deliverables under the contract. The TPOC does NOT have authority to change the terms and conditions of the contract. TPOC information is identified as: Darryl San Souci, darryl.sansouci@noaa.gov

5.2.1 The TPOC does NOT have authority to change the terms and conditions of the contract. When, in the opinion of the Contractor, the TPOC requests efforts outside the existing scope of the contract, the Contractor shall promptly notify the CO in writing. Contractor under such direction shall take no action until the CO has resolved the issue or has otherwise issued a modification to the contract.

5.2.2 In the absence of the TPOC (due to reasons such as leave, illness, and official travel), all responsibilities and functions assigned to the TPOC shall be the responsibility of the CO until an alternate TPOC is assigned.

5.2.3 Technical Point of Contact (TPOC) will notify the Contractor of Government facility/installation closures on an event-by-event basis. Contractor shall maintain an adequate workforce for the uninterrupted performance of all tasks defined within this SOW when the Government facility/installation is not closed for the above reasons.

6.0 Government Responsibilities

6.1 The Government is responsible for quality assurance of Work.

6.2 The Government will inspect the Work performed under this contract. Contractor may be notified of deficiencies in performance in writing by the CO. Oral deficiency notifications will be confirmed in writing by the CO. Contractor shall take prompt corrective action upon notice of deficiency. Prompt is defined as within 24 hours of notification. Any corrective action required as a result of the inspection will be accomplished prior to final monthly billing. Government will document instances of deficiencies.

6.3 Contractor may be notified of deficiencies in performance in writing by the TPOC/CO. Oral deficiency notifications will be confirmed in writing by the TPOC/CO. Contractor shall take prompt corrective action upon notice of deficiency. Prompt is defined as within 24 hours of notification.

6.4 Government personnel other than COs and the authorized TPOC, may, with CO coordination, observe Contractor operations. However, these personnel may not interfere with Contractor performance or make any changes to the contract.

6.5 Government Furnished Property, Materials, Equipment and Services (GFP/M/E/S). NONE.

6.6 The Government is not responsible for damage to Contractor’s equipment due to trash, debris or uneven terrain.

7.0. Contractor Responsibilities

7.1 Contractor Furnished Property, Materials, Equipment and Services (GFP/M/E/S). Contractor shall provide all trained labor, equipment, materials, supervision, transportation, permits, insurance, and quality control necessary to achieve the quality performance standards of the Work in this contract. Government dumpsters shall not be used by the contractor.

7.1.1 The Contractor shall comply with all laws, ordinances, codes, rules, and regulations bearing on the conduct of the work, including, but not limited to, those of Federal, State, international, and local agencies having jurisdiction. This shall include but not be limited to minimum wages, labor, EPA, DOT, State, and equal employment opportunity laws.

7.1.2 The Contractor is responsible for compliance with terms and conditions as stated in this requirement and will notify the TPOC before any changes that would affect the Contract. NOAA Fisheries is responsible for providing access to the facility(s), and a NOAA Fisheries representative will be available to address any questions during the Contract performance. NOAA Fisheries will not be held responsible for, indemnify, defend or otherwise abrogate any claim or cause of action by or against the Contractor or any subcontractor for their failure to comply with any applicable law or regulation.

7.1.3 Contractor shall immediately notify the CO if discrepancies are discovered between the existing property conditions and those noted on the SOW.

7.1.4. Contractor shall immediately notify the CO if the Contractor determines that it will not be able to meet the deliverable schedule, so that the two organizations can work together to revise the schedule.

7.1.5 Within five (5) work days of the contract starting date, the Contractor shall submit to the CO for approval, schedules to accomplish required services. If changes need to be made to reduce conflicts with Government operations, special events, or other occurrences, the Contractor shall meet with the CO and revise the schedule as necessary. The CO can request changes to the work schedule so spacing of services is distributed to meet the needs of the Government. Contractor shall not deviate from this schedule without prior approval from the CO.

7.1.6 Within ten (10) days of the contract start date, the Contractor shall submit all Safety Data Sheets (SDS) for any materials used under this contract containing "dangerous" or "warning" labels to the CO.

7.1.7 If services cannot be completed as scheduled due to inclement weather, Contractor shall perform any and all scheduled services the following work day with no degradation to existing scheduled services.

7.1.8 Contractor shall conduct operations in such a manner as to minimize any inconvenience in the use of the facilities to the occupants and visitors. Contractor shall instruct their employees daily to be mindful of the full time requirement to maintain a safe environment for the facility’s occupants including staff, visitors, customers and the occurrence of the general public on or near the site.

7.1.9 Contractor shall provide all vehicles, containers, etc., that are necessary to safely remove and dispose of debris.

7.1.10 Contractor shall be responsible for quality control of Work performed.

7.1.11 Contractor shall be fully knowledgeable of all requirements of the contract documents and shall make themselves aware of all job site conditions that will affect their performance.

7.1.12 Contractor shall maintain an adequate workforce trained to safely and satisfactorily perform under this contract.

7.1.13 Contractor shall ensure all employees and subcontractors are fully trained and have a full understanding of the statement of work task requirements; the Government will not provide instruction or oversight.

7.1.14 Contractor shall ensure all Contractor employees, and all associated subcontractor(s) are experienced in the type of work involved and familiar with the specifications of this contract.

Contractor is responsible for damage to any Government equipment, supplies, or facilities caused by Contractor personnel. Government will not provide instruction or oversight.

7.1.15 Contractor shall comply with all applicable Federal, State, and local acts, regulations, rules, codes, ordinances, and statutes, as well as other government published instructions per the contract documents.

7.1.16 Contractor shall perform in accordance with professional industry standards.

7.1.17 Contractor shall be responsible for all contractor security arrangements including subcontractor’s materials, tools, equipment, and personnel.

7.1.18 Contractor shall accomplish all tasks to meet the requirements of the SOW.

7.1.19 Written and verbal communications concerning this contract shall be conducted between the Contractor and the authorized government team (Technical Point of Contact, Contracting Specialist, and Contracting Officer) only.

7.1.20 Contractor shall handle corrective action(s) without dependence upon Government direction. Contractor shall resolve all discrepancies noted (by the government team) within 24hrs of identification. Contractor shall ensure Contractor’s employees and all associated Subcontractor(s) performing under this contract, are notified of all deficiencies in their area of responsibility to ensure that deficiencies do not reoccur.

7.1.21 Contractor shall be available on site within 2 hours of notification as required by the government for issues that cannot be resolved by telephone to the Government's satisfaction.

Contractor is responsible for understanding the site condition, complexity, volume and quality of services required.

7.1.22 Contractor Equipment. The Government may inspect Contractor’s equipment at any time. Contractor’s equipment shall be subject to approval by the TPOC. Contractor shall service or replace at no cost to the Government any equipment found to be defective, unsafe, or unsuitable.

7.1.23 Contractor shall comply with all applicable criteria of the Department of

Transportation (DOT) and Environmental Protection Agency (EPA) when completing the requirements of this contract.

7.1.24 Contactor shall clean and secure the work area upon completion and remove any trash resulting from work. Government dumpsters shall not be used.

8.0 Contractor Liability - Except as otherwise provided by law, the Government will not be responsible for the loss of, or damage to, the Contractor’s equipment, property, or death of or injury to the Contractor’s employees or associated subcontractors performing under this contract, resulting from the Contractor’s negligent performance under this contract. Contractor shall be responsible for all damages to persons or property that occurs as a result of Contractor’s faulty equipment, fault or negligence of Contractor personnel/employees or associated subcontractors performing Work on this contract.

9.0 Contractor Insurance Requirements. Contractor shall at its sole expense insure its activities in connection with the Work under this contract and shall obtain, keep in force, and maintain insurance in accordance with FAR clause 52.228-5, Insurance—Work on a Government Installation.

Contractor shall provide a copy of the Insurance Certificate to the CO upon request.

10.0 Job Site Protection. Contractor shall protect the property of others as well as his/her own property.

Contractor shall repair or replace any property damaged by the Contractor during performance under this contract. Contractor shall take precautions to prevent the spread of dust, moisture and debris. Contractor shall keep the area clean and upon completion of the project, the Contractor shall clean up the work area and remove all debris from the job site in a timely and legally acceptable manner so as to not detract from the aesthetics or the functions of the building.

11.0 Specific Tasks. Contractor and subcontractors working under this contract shall be fully knowledgeable and skilled in the disciplines required to successfully fulfill this requirement.

Contractor shall at all times ensure Work is accomplished in accordance with the terms and conditions of the contract in a safe and professional manner. Contractor shall perform all tasks in accordance with applicable criteria of the Department of Transportation (DOT) and Environmental Protection Agency (EPA)..

Contractor shall perform the following tasks for CLIN 0001:

1. Contractor shall provide all supervision and labor to properly identify, classify, label, segregate and lab-pack both RCRA and non-RCRA hazardous waste into DOT-approved containers.

2. Contractor shall provide the DOT approved containers needed for packing, transport and disposal of hazardous and non-hazardous waste containers at an EPA (or Authorized State)-licensed/ permitted Treatment, Storage, or Disposal Facility (TSDF).

3. Contractor shall prepare and maintain RCRA required documentation including manifests, packing slips and shipping papers.

12.0 Deliverables

12.1 The following documents shall be submitted to the TPOC prior to disposal activity:

1. Arrangement of lab-packs

2. Proof of ownership of transportation

12.2 The following documents shall be submitted to the TPOC after disposal activity:

1. Tracking and certificate(s) of disposal/destruction

2. All documents are required to complete invoicing

13.0 IT Security. Not applicable. Requirements of 48 CFR 1352.239-73 do not apply and a Security Accreditation Package is not required.

14.0 Section 508. Not applicable. Section 508 of the Rehabilitation Act of 1973 (29 U.S.C. 794d) as amended by P.L. 105-220 under Title IV (Rehabilitation Act Amendments of 1998) is not required.

15.0 Invoicing. Invoicing Instructions for Standard Form 1449 - Use of the Invoice Processing Platform (IPP) Electronic Invoicing System is mandatory - locate this platform at: HTTPS://WWW.IPP.GOV

1. Contractor will provide “proper” invoices in arrears of tasks performed (and expensed) with the last invoice being submitted within 30 days of contract completion. Invoices shall be submitted (via electronic copy) no later than by the 10th day of the billing month.

2. Payments will be based on receipt of a proper invoice and satisfactory contract performance and guidelines in FAR 32.9, Prompt Payment.

3. To constitute a proper invoice, the Contractor’s invoice shall be prepared in accordance with, and contain the elements specified in FAR 52.212-4(g), “Invoices”.

4. The Government will return invoices that do not comply with FAR 52.212-4(g), “Invoices” within 7 days after the date the invoice was received along with a statement as to the reasons why it is not a proper invoice.

5. The Contractor will send invoices in accordance with the terms and conditions of this contract to the https://www.ipp.gov/ https://www.acquisition.gov/far/part-52#FAR_52_212_4 mandatory electronic invoicing system: HTTPS://WWW.IPP.GOV :

Improper invoices will be returned and payment will not be made until receipt of a proper invoice.

Payments resulting from approved and accepted invoices will be made via Electronic Funds Transfer (EFT) in accordance with the businesses System for Awards Management (SAM) registration information.

FRIEGHT/SHIPPING COSTS: If freight costs exceed $100.00, a copy of the waybill must accompany the invoice to support the freight charges.

INVOICING PLATFORM INSTRUCTIONS: The Contractor must use the IPP website (https://www.ipp.gov ) to register, access, and use IPP for submitting payment requests. If not already enrolled, the Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email within three to five business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email:

If the Contractor is unable to comply with the requirement to use IPP for submitting payment requests, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

Contractor shall prepare and submit a “proper” invoice to the TPOC for approval [with a copy to the contracting officer for information]. b) Name (where applicable), title, phone number, and mailing address of person to notify in the event of a defective invoice.
