1.0 GENERAL

1.1 BACKGROUND

The National Oceanic and Atmospheric Administration’s (NOAA) Southeast Fisheries Science Center (SEFSC) conducts research on federally managed marine fisheries, protected species, and the habitats that support them. The Habitat Ecology Branch (HEB) within the SEFSC is coordinating with the U.S.

Army Corps of Engineers (USACE) to conduct queen conch population surveys around and offshore from Port Everglades in Fort Lauderdale, FL, to compile abundance and distribution data for a biological assessment required under the Endangered Species Act. In order to successfully complete this task, the entire nearshore area surrounding the Port must be surveyed for the presence, spatial location, and abundance of individual conch.

1.2 SCOPE

SEFSC divers and scientists will conduct queen conch population surveys from April 14-17, 2024. To facilitate efficient completion of surveys the SEFSC requires a liveaboard research vessel (primary vessel) measuring at least 80 feet in length, is outfitted with three small boats with outboard motors, and capable of housing up to 12 divers and crew for four full days at sea. The primary research vessel must also be capable of daily launching and retrieving of three small boats capable of carrying four SCUBA divers plus SCUBA tanks, fins, masks, BCDs, and survey equipment. The primary research vessel must have an inspected and certified air compressor onboard to refill SCUBA tanks each day.

1.3 OBJECTIVE

To conduct scientific diver-based survey operations of the queen conch population located in the nearshore waters of Fort Lauderdale, FL. The contractor, its agents, subcontractors, and employees, including the Captain and crew of the vessel must not harass, assault, oppose, impede, intimidate, threaten, interfere with or make unwelcome advances toward any member of Government personnel. Violation under this clause may result in termination of the contract, at the discretion of the Government under the Default Clause, and consequent liability of the contractor to the Government for any costs incurred, as well as debarment, suspension or similar action from future participation in Government contracts. Violation of the contractor’s obligations under this clause may result in criminal and/or civil prosecution of the person(s) involved by either the Government or affected Government personnel, as provided by applicable law, as well as adverse performance evaluation under the terms and conditions of this contract.

5. During the charter period, the possession or use of intoxicating substances and/or illegal drugs, by any person, is not permitted and may be grounds for termination of this contract by the Government.

D. GOVERNMENT PERSONNEL

1. Government personnel may consist of Government employees and/or employees of corporations, academic institutions, contractors, or other entities.

2. The TPOC is the primary point of contact for contract management issues, including contract performance and invoicing. While on charter one of the Government’s personnel will be the Project Lead. The Project Lead will be on board and responsible for implementation of the Project Instructions, reporting compliance of vessel and crew with the contract terms, all scientific operations, and the conduct and performance of Government personnel aboard the vessel for the duration of the charter.
