SOW STATEMENT OF WORK

Seawater Intake System Replacement Hollings Marine Laboratory 331 Fort Johnson Road Charleston, SC 29412

SUBJECT

The Hollings Marine Laboratory (HML), 331 Fort Johnson Rd., Charleston, SC 29412, has the requirement to replace the intake piping associated with the seawater pumping system located at the Fort Johnson Campus.

OBJECTIVE

The HML has a requirement to replace four submerged seawater intakes located in Charleston Harbor.

The seawater system at HML is integral to marine research at the Fort Johnson Campus and life support for thousands of aquatic organisms. The current intake system constructed of PVC piping was installed in 2001 and has been subjected to several hurricanes. The system is functional but unacceptable and needs to be replaced with an updated system incorporating High-Density Polyethylene (HDPE) piping.

New anchoring and support structures will also be necessary.

QUALIFICATIONS

At the time of proposal submittal, the contractor must have all applicable licenses as required under the laws of South Carolina, the federal government, and local ordinances for work performance under this agreement.

Work must be completed observing all federal, state, and local laws and regulations. In order to comply with the Debt Collection Improvement Act of 1966, all contractors must be registered in the System for Award Management (SAM) to be considered for an award of a federal contract. For information regarding registration in SAM, visit the website at http://www.sam.gov. Vendors shall note on the quote if they accept credit cards as a payment method. The vendor needs to include their DUN and Bradstreet numbers in their bid proposal.

SCOPE OF WORK

The contractor shall furnish the necessary supervision, labor, material, fusing equipment, boat and diving equipment, services, and facilities (except as otherwise specified) to remove the existing PVC http://www.sam.gov/ intake piping and replace it with HDPE piping and additional supporting structures. Four intakes, each approximately 100 feet long, comprise the intake system. The seawater is vital to the survival of thousands of marine organisms, and its flow cannot be interrupted. Therefore, removing the existing piping must be phased so as not to eliminate seawater flow completely. The contractor must coordinate with the Technical Point of Contact (TPOC) to develop a schedule of intake pipe removal. Additional requirements are as follows:

1. Remove and dispose of all PVC piping, fittings, and debris.

2. New piping and fittings will be 6-inch DR-11 HDPE with a minimum of 2% carbon black.

3. All flange backing rings and bolt packages will be 316 stainless steel.

4. The HDPE pipes will be elevated; therefore, new concrete support structures will be spaced according to the maximum span length rating of the DR-11 HDPE pipe. The pipe will be secured to each anchor to minimize movement due to wave action. All securing hardware will be 316 stainless steel.

5. A new submerged 3000-lb. (minimum) concrete anchoring structure will be deployed to support the terminal end of the intake pipes and strainers. A 4000-lb. lift is available to aid in deploying the anchoring structure. Stainless steel elbows will be installed at the terminal end to orient the strainers vertically. All securing hardware will be 316 stainless steel.

6. Pressure tests all new piping to ensure no leaks and verify integrity.

(h) Certification Regarding Responsibility Matters (Executive Order 12689). (Applies only if the contract value is expected to exceed the simplified acquisition threshold.) The offeror certifies, to the best of its knowledge and belief, that the offeror and/or any of its principals-

(1) ___ Are, ___ are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(2) ___ Have, ___ have not, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: Commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a Federal, state or local government contract or subcontract; violation of Federal or state antitrust statutes relating to the submission of offers; or Commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property,

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples. (A) The taxpayer has received a statutory notice of deficiency, under I.R.C. § 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. § 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. § 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C.

362 (the Bankruptcy Code).
